rigines) to exclude that portion situated between 25 deg. 20 min. and 26 deg. 30 min. of South Latitude and 127 deg. 30 min. and 129 deg. of East Longitude, and of its area being reduced to about 15,010,700 acres accordingly.

IN pursuance of section 19 of the Fisheries Act, 1905-1951, I, the Governor of the State of Western Australia, by and with the advice and consent of the Executive Council, do hereby revoke the Pro­clamation dated 13th March, 1953, defining nets to be used in Shark Bay, and published in the Government Gazette of 27th March, 1953, and do hereby declare as follows:-

(a) That with respect to nets known as or called "whiting nets" for catching all species of whiting, nets having meshes throughout of not less than 2in. shall, when used or intended to be used in the waters

of Shark Bay, together with all its loops, bays, estuaries, inlets, pools and affluents, be lawful nets.

(b) That with respect to nets known as or called "mullet nets" for catching all species of mullet, nets having meshes throughout of not less than 3in., shall, when used or intended to be used in the waters of Shark Bay, together with all its loops, bays, estuaries, inlets, pools and affluents, be lawful nets.

(cl That with respect to nets known as or called "tailor nets" for catcl1ing tailor, nets having meshes in a portion at one end only not exceeding 150 yards in length of not less than 2in. and in the remainder meshes of not less than 3in. shall, when used or intended to be used in the waters of Shark Bay, together with all its loops, bays, estuaries, inlets, pools and affluents, be lawful nets.

(d) That with respect to nets known as or called "bream nets" for catching all species of bream, nets having meshes throughout of not less than 2in. shall, when used or intended to be used in the waters of Shark Bay, together with all its loops, bays, estuaries, inlets, pools and affluents, during the months of August, September and October, be lawful nets.

(e) That with respect to nets known as or called "bream nets" for catching all species of bream, nets having meshes throughout of not less than 3in. shall, when used or intended to be used in the waters of Shark Bay, together with all its loops, bays, estuaries, inlets, pools and affluents, during the months of January, February, March, April, May, June, July, November and December, be lawful nets.

IN pursuance of the provisions of section 10 of the Fisheries Act, 1905-1951, I, the Governor of the State of Western Australia, by and with the advice and consent of the Executive Council, do hereby prohibit all persons from taking any fish whatso­ever by means of fishing nets in those portions of Western Australian waters described in the Schedule hereto for a period of three years as from date of publication of this Proclamation in the Government Gazette.

Schedule. (a) All that portion of the Moore River between

its junction with the sea and Boobabbie Bridge situate approximately eight (8) mires by water from the mouth of the said river.

(b) All that portion of Western Australian waters lying seawards within a radius of one half-mile of the mouth of the Moore River.

F.D. 49/48, Ex. Co. No. 2184. IN pursuance of the provisions of section 14 of the Fauna Protection Act, 1950-1954, I, the Governor of the State of Western Australia, by and with the advice and consent of the Executive Council, do hereby declare as follows:-

(1) That the period from 6 o'clock in the afternoon of 17th December, 1955, to 31st May, 1956, shall be an open season in respect to wild ducks in that part of the State which lies within the boundaries of the road districts specified in the First Schedule hereto, with the exception of those areas defined in the Second Schedule hereto.

(2) That the period from 5 o'clock in the fore­noon of 18th December, 1955, to 31st May, 1956, shall be an open season in respect to wild ducks in that part of the State not included in the areas specified and defined in the First and Second Schedules hereto.

First Schedule. Harvey, Bunbury, Dardanup, Collie, Preston,

Capel, Busselton, Augusta/Margaret River, Nannup, Balingup, Greenbushes, Bridgetown and Man­jimup Road Districts.

Second Schedule.

(al The whole of the area within a radius of 20 miles of the General Post Office, Perth.

(bl All municipalities and townsites in the South-West Land Division.

(cl The whole of the Rockingham Road District. (d) The whole of the waters of Lakes Leschen­

aultia, Yealering and Seppings, and Bambun, Wagin, Nambung, Mungala, Nannerup and Warder­ing Lakes, and all land within 20 chains of their shores.

(e) The whole of the waters of Leschenault, Vasse and Wonnerup Estuaries and all land within 20 chains of their shores.

(f) The whole of the waters of the Vasse, King and Kalgan Rivers, and all land within 20 chains of their banks.

(g) All that portion of the Capel River between the Capel and Stirling Bridges and all land within 20 chains of the river bank.

(h) The whole of the waters of Oyster Harbour and Princess Royal Harbour and all land within a radius of 20 chains of their shores.

(i) The whole of the area of the Yanchep Caves Reserve.

PROCLAMATION

By His Excellency Lieutenant-General Sir Charles Henry Gairdner, Knight Commander of the Most Distinguished Order of Saint Michael and Saint George, Knight Commander of the Royal Vic• torian Order, Companion of the Most Honour­able Order of the Bath, Commander of the Most Excellent Order of the British Empire, Governor in and over the State of Western Australia and its Dependencies in the Commonwealth of Australia.

WHEREAS it is enacted by section 4 of the Water Supply, Sewerage and Drainage Act, 1912-1950, that all lands acquired for or dedicated to the purposes of any of the Acts mentioned in the Schedule to the Act, and all water works, sewerage, drainage and irrigation works constructed or in course of construction under any of those Acts or constructed by the Government and declared by the Governor to be subject to any of those Acts, shall vest in the Minister on behalf of Her Majesty: Now, therefore, I, the Governor, acting· with the advice and consent of the Executive Council under the provisions of section 4 of the Water Supply, Sewerage and Drainage Act, 1912-1950, do hereby declare that the water works at Yuna Townsite more particularly described in the First Schedule hereunder and the water works at Marble Bar Townsite more particularly described in the Second Schedule hereunder be subject to the Country Areas Water Supply Act, 1947-1954.

First Schedule.

Yuna Townsite. Two excavated tanks on reserve 18439 South

and adjoining the Yuna Railway Siding, No. l Tank being roofed and having a capacity of ap­proximately 530,000 gallons, No. 2 Tank being un­roofed and having a capacity of 330,000 gallons. Two 5,000 gallon overhead tanks in the railway siding. All piping necessary for the reticulation system, together with a diesel driven centrifugal pump.

Second Schedule.

Marble Bar Townsite. The well situate close to Sandy Creek and all

waterworks thereon which or some of which are main storage consisting of three 5,000 gallon inter­connected squatter's type tanks, a supplementary storage supply of approximately 5,000 gallons, two vertical spindle "Stalker" pumps, two 6 h.p. "Lister" diesel engines and all piping required for the reticulation system.

WHEREAS it is enacted by section 115 of the Factories and Shops Act, 1920-1954, that the expres­sion "Public Holiday" shall mean certain days therein specified, and any other day declared by proclamation to be a public holiday for the pur­poses of the said Act: Now, therefore I, the said Governor, acting by and with the advice and consent of the Executive Council, do hereby pro­claim and declare that Wednesday, the 28th day of December, 1955, from 8 o'clock in the forenoon to 1 o'clock in the afternoon, shall be a public holiday in the Kellerberrin Specified Locality for the purposes of section 115 of the Factories and Shops Act, 1920-1954, and all shops (except those mentioned in the Fourth Schedule and registered small shops) and warehouses shall be closed.

AT a meeting of the Executive Council held in the Executive Council Chamber at Perth, this 24th day of November, 1955, the following Order in Council was authorised to be issued:-

Land Act, 1933-1954. ORDER IN COUNCIL.

Corres. No. 2955/49. WHEREAS by section 33 of the Land Act, 1933-1954, it is inter alia, made lawful for the Governor by Order in Council to direct that any land reserved pursuant to the provisions of this Act shall be

granted in fee simple to any person (as defined in the said section) subject to the condition that the person shall not lease or mortgage the whole or any part of the land without the consent of the Governor and subject to such other conditions and limitations as the Governor shall deem necessary to ensure that the land is used for the purpose for which the land is reserved as aforesaid; and whereas it is deemed expedient that reserve No. 24339 (Pemberton Lot 209) should be granted in fee simple to the Country Women's Association of Western Australia to be held in trust for the purpose of a Rest Room (Country Women's Asso­ciation): Now, therefore, His Excellency the Gover­nor by and with the advice and consent of the Executive council doth hereby direct that the beforementioned reserve shall be granted in fee simple to the Country Women's Association of Western Australia to be held in trust for the afore­said purpose, subject to the condition that the land shall not be leased or mortgaged in whole or in part without the consent of the Governor.

And whereas His Excellency the Governor did cause to be laid on the Table of each House of Parliament his proposals dated the 13th day of August, 1952, for the revocation in part of the dedication of Crown lands as State Forest; and whereas after such proposals had been laid before Parliament a resolution was passed by both Houses that such proposals should be carried out: Now, therefore, His Excellency the Governor, with the advice and consent of the Executive Council, doth hereby revoke in part the dedication of Crown lands as State Forest No. 4 by excising that portion of such State Forest as is described in the Schedule hereto.

WHEREAS section 74 of the Constitution Act, 1889, provides that the Governor in Council may vest in heads of departments, or other officers or persons within the State, power to make minor appointments; and whereas it is desirable that power of appointment of foreman and other per­sons employed at a daily rate of wage on works under the control of the Department of Public Works, and of Water Supply, Sewerage and Drain­age (exclusive of the Metropolitan Water Supply, Sewerage and Drainage Department) should be vested in James McBurney: Now, therefore, His Excellency the Governor, by and with the advice of the Executive Council, hereby vests in James McBurney and any persons appointed to act temporarily in his place the appointment of fore­man and all other persons employed on such works at a daily rate of wages.

Water Boards Act, 1904-1953. Denham Water Area.

WHEREAS by the Water Boards Act, 1904-1953, and the Water Supply, Sewerage and Drainage Act, 1912, the Governor is empowered by Order in Council to constitute the district of a local authority or two or more local authorities or any part or parts of such district or districts a Water Area, under such name as may be directed; and whereas, under the provisions of the said Acts, the Governor may authorise the Minister for Water Supply, Sewerage and Drainage, to exercise within a Water Area all the functions of a Water Board: Now, therefore His Excellency the Governor, by and with the advice and consent of the Executive Council, doth hereby constitute an area, having the boundaries described in the Schedule hereunder, a Water Area for the purpose of the said Acts, under the name of the Denham Water Area, and doth hereby appoint the Minister for Water Supply, Sewerage and Drainage, to exercise all the functions of a Water Board under the Acts in such area.

Schedule. All that portion of land comprising the whole

of Denham Townsite and North Locations 58 and 59 (but excluding Peron Station Homestead situated within the boundaries of the said North Location 58 comprising an area of approximately one acre) and all as shown outlined in red on Plan P.W.D., W.A. 34871.

This Order in Council shall take effect on the 7th day of December, 1955.

Traffic Act, 1919-1954. Nannup Road Board.

ORDER IN COUNCIL. L.G. 236/53.

HIS Excellency the Governor acting by and with the advice and consent of the Executive Council hereby makes the following Order under section 49 of the Traffic Act, 1919-1954, namely, that the Nannup Road Board is hereby empowered to make by-laws in pursuance of-

(1) clause (a) of paragraph (vii) of subsec­tion (1) of section 47 of the said Act, defining what shall be deemed heavy traffic for the purpose of this Act;

(2) clause (b) of paragraph (vii) of subsec­tion (1) of section 47 of the said Act, pro­hibiting the passage of heavy or obstruc­tive traffic over any specified road, either generally or during certain months of the year;

(3) clause (1) of paragraph (vii) of subsec­tion (1) of section 47 of the said Act pro­hibiting the carriage by a vehicle on any road of a load which (including the weight of the vehicle) exceeds the weight pre­scribed as the maximum load that may be lawfully carried on the road, notwithstand­ing the fact that there may have been issued a license which authorises the carrying by the vehicle of a greater load.

Subject to the condition that no such by-law shall be valid and effectual unless it has prior to notification of its making being published in the Government Gazette, been submitted to and ap­proved by the Governor.

The above location is available for leasing under section 116 of the Land Act, 1933-1954, for the purpose of cropping and grazing for a period of 10 years at a rental of twenty pounds (£20) per annum. The lease will be subject to the following conditions:-

( a) No compensation shall be payable for any improvements effected and in existence at the expiration or earlier determination of the lease.

(b) Existing improvements shall be maintained to the satisfaction of the Minister for Lands.

Cc) Any person being the holder of a Miner's Right may enter on the land for prospect­ing purposes and mark off mining tene­ments and to the right of the Mines De­partment to grant such tenements without compensation for the loss of the use of the land or for any improvements effected thereon by the lessee.

I'l' is hereby notified, for general information, that the areas scheduled hereunder are available for selection under Part V. of the Land Act, 1933-1950, and the regulations appertaining thereto, subject to the provisions of the said Act.

Applications must be lodged at the Department of Lands and Surveys, Perth, not later than the date specified, but may be lodged before such date, if so desired.

NOTICE is hereby given that it is the intention of the Council of the Municipality of Albany to borrow the sum of £2,000 to be expended upon works and undertakings within the Municipal dis­trict, such works and undertakings consisting of water reticulation, etc., at Centennial Oval.

RESOLVED that the Melville Road Board, in pur­suance of section 7 of the Town Planning and Development Act, 1928, amplify and amend the above Town Planning Scheme gazetted on the 20th day of November, 1936, in so far as it applies to business sites, such additions to be in accordance with the schedule as enumerated herewith:-

IT is hereby notified, for general information, that the Honourable Minister for Labour, pursuant to the provisions of the Bread Act, 1903-1949, and with the consent of the Bread Manufacturers' (Perth and Suburbs) Industrial Union of Employers of Western Australia and the West Australian Operative Bakers' Union of Workers has · been pleased to authorise the hours mentioned in the Schedule to this notice for the days therein men­tioned on which bread may be made or baked and delivered, within a radius of 25 miles from the General Post Office, Perth, in substitution of the hours for those days as provided by sections 12 and 13 of the Act.
