Circular Economy Package (CEP)

• General rules adopted in May 2018

• 40 Implementing and Delegated Acts (technical legislation) to be developed by the European Commission and validated by the Member States in the next years (in some cases right of scrutiny by the European Parliament)

• 4 Acts were identified as critical to steel (re-use, reporting, incineration clause and calculation point)

• Draft Decision December 2018: « Composite packaging and other packaging composed of more than 1 material shall be reported per material containedin the packaging with the exception of ancillery elements…such as labels. »

1. reporting obligations for coatings and lacquers

2. no predominant materials principle anymore (repeal of Decision 2005)

• Draft Decision March 2019: draft decision (end of February 2019) implementing decision amending 2005/270/EC on calculation RR and reporting:

1. predominant material principle maintained till 2024 (tbc – final text)

2. per material principle + threshold (5%) from 2025 (confirmed) coating in cans are needed to comply with food contact legislation

ONE OF APEAL’S KEY OBJECTIVES


to proactively manage REACH impact for the tinplate industry

• REACH is a regulation of the European Union, adopted to improve the protection of human health and the environment from the risks that can be posed by chemicals, while enhancing the competitiveness of the EU chemicals industry

• REACH is designed to allow smooth transition to another chemical substance/process when suitable alternative is economically and technically viable

• authorisation is a time-limited process

• under REACH the use of Chromium Trioxide (Chrome VI) will gradually be removed in the EU

OPINION ON EC DRAFT DECISION – CHROME (VI)

• CrO3 use for ETP

• REACH Committee at Feb. meeting issued positive opinion on the EC draft decision

• 4 years Review Period from Date of Adoption

• Review Period until approx. March 2023

• EC must adopt the draft decision

• publication in OJEU expected in coming weeks


A FULLY ALIGNED STEEL INDUSTRY • under this authorisation APEAL

members still produce chrome passivated tinplate (standard product) in full compliance with REACH regulation until March 2023

• all APEAL members are fully aligned and committed to the successful implementation of Chrome Free Passivation Alternative (CFPA) for tinplate


Our joint REACH challenge requires engagement of the full supply chain (tin mills, canmakers, coatings suppliers) and we continuing to work intensively towards successful implementation
