WEEK 1 1.1. Discharge by Performance Available remedies: Equitable remedies (specific performance/injunction) = unlikely to be decreed where a damages award is sufficient. Damages = "unliquidated" (i.e. "as of right" and not discretionary) Alternate money claim following contractual breach = liquidated sum (action is debt - innocent party has performed consideration and sues breaching party for agreed payable price).
