CALL TO ORDER Dr. Williams called the meeting to order at 9:04 a.m. and she asked for a moment of silence for those who lost their lives on September 11, 2001. The Board introduced themselves to the public. New members Pamela James, RN and Gayle Melvin, Public Member were welcomed to the board. DISPOSITION OF MINUTES Meeting Minutes – July 10, 2019 The Board reviewed the minutes of the July 10, 2019 meeting. Ms. Kaza moved, seconded by Ms. Abdill, to approve the minutes as presented. The motion carried by majority with Ms. Udealer abstaining. ADOPTION OF THE AGENDA Ms. Walters moved, seconded by Ms. Udealer, to adopt the agenda. The motion carried unanimously. ACTIVITIES REPORT Dr. Zickafoose reported the number and types of active licenses as of September 11, 2019.

RN – 20,603; Temporary RN Permits - 0; Temporary GN Permits - 0 LPN - 2967; Temporary GPN Permits - 0 CRNA - 367 NP - 1527 CNM - 52 CNS - 209 Total APRNs - 2155; Temporary APRN Permits - 2 Total Active Licenses – 25,725 with 2 temporary permits

COMMITTEE REPORTS

APRN Committee

Dr. Castaldo reported reported a lack of quorum for the July 1st meeting and informed the Board

that the committee has met twice since the last board meeting. He reported there were seven

out of nine independent practice applications approved with two contingent upon further

clarification. The committee reviewed and approved suggested changes to the APRN rules and

regulations and they are on the Board of Nursing agenda for final review. Dr. Castaldo

mentioned that a set of rules pertaining to APRN education programs is being sent to the

respective APRN national associations for review. Dr. Zickafoose added they were also sent to

the DE nursing programs for input.

PRESIDENT’S REPORT

Dr. Williams reported that she, Dr. Castaldo, and Dr. Zickafoose attended the NCSBN Annual

meeting in August where she and Dr. Castaldo served as delegates. It was a very informative

meeting with many opportunities to network with other board presidents across the United

States. The APRN Compact is not moving forward at this time in order to allow national nursing

associations the opportunity to provide input. Delaware supports compact licensure for APRNs.

EXECUTIVE DIRECTOR’S REPORT

Dr. Zickafoose reported a handout summarizing the NCSBN meeting was provided to each

board member. She added that Phil Dickison spoke to the EDs and provided an update on Next

Generation NCLEX (NGN). Delaware House Bill 220 was enacted which requires health

insurance carriers to provide coverage for prescription medications approved by the FDA for

Medication Assisted Treatment. Delpros online licensure system has been delayed until later

this fall and emails were sent to inform nurses and employers. Meeting dates for 2020 were

also distributed.

NEW BUSINESS BEFORE THE BOARD

Tiffany McGriff, GN (Conviction)

Ms. Bastholm moved, seconded by Ms. Walters to grant Tiffany McGriff, GN a waiver for

licensure by examination. The motion carried unanimously.

Patricia Hemminger, RN (Discipline)

Dr. Castaldo moved, seconded by Ms. Udealer to grant Patricia Hemminger, RN a waiver for

licensure by endorsement. The motion carried unanimously.

Naomi Thomas, RN (Villanova Refresher Course

Ms. Bastholm commented the refresher does not have clinical hours and it does not meet the

boards requirements of 40 hours of theory and 80 hours of clinical. After discussion, Mr. Hare

moved, seconded by Ms. Kaza to continue the application of Ms. Thomas for licensure by

endorsement and to provide her with the options to obtain the required practice hours. The

motion carried unanimously.

Complaints Ratification of Assignments/Assigned Board Contact Mr. Hare moved, seconded by Ms. Abdill, to ratify the following complaint assignment given to the respective Board contact person as noted below. The motion carried unanimously.

Legislative Update

Ms. Singh provided an overview of the administrative process to make changes to the rules. Dr.

Zickafoose provided a brief synopsis of the rationale for the changes to section 8 which were

previously approved by the APRN committee. After review of the proposed rules, Ms. Glenn-

Vernon moved, seconded by Ms. Udealer, to accept the changes and proceed with a hearing.

The motion carried unanimously.

After review of the proposed rule changes to sections 2 and 6, Mr. Hare moved, seconded by

Ms. Kaza to accept the changes and proceed with a hearing. The motion carried unanimously.

Review of Compliance

Corey Makos, RN

Corey Makos complied with the July 11, 2018 Consent Agreement. His probation was lifted on

June 29, 2019 and he now holds an active, single state license.

Cody Krogh, RN

Cody Krogh complied with the May 11, 2016 Consent Agreement. His probation was lifted and

he now holds an active, multistate license.

Practice Issues There were no practice issues. Educational Issues

Villanova University Clinical Placement Notification

Dr. Zickafoose reported all required documents were submitted and they plan to have two

groups of 8 students at Nemours for their undergraduate program and one group of 8 students

for their APRN program.

Licensure Issues

There were no licensure issues.

LICENSEE APPROVAL

Ms. Udealer moved, seconded by Ms. Kaza, to ratify the attached licensee list. The motion

carried unanimously.

OTHER BUSINESS BEFORE THE BOARD

There was no other business before the board.

NEXT MEETING

The Board’s next meeting is scheduled for October 9, 2019, at 9:00 a.m., in Conference Room

A, of the Cannon Bldg., 861 Silver Lake Blvd., Dover, Delaware.

PUBLIC COMMENT

Mr. Rob Collins from Schwartz & Schwartz addressed the board regarding the number of

Consent Agreements that were rejected. A nurse practitioner in the audience commended the

board for the consideration given to each case. Mr. Alderson asked the board to remember

hearing. The following were marked collectively as Board Exhibit 1: a copy of the October 2017

Board Order, the August 6, 2019 petition to lift suspension letter with accompanying letter from

Rachel Shelton and Cameron Villas, and the August 9, 2019 letter notifying Mr. Bader of the

Hearing.

Mr. Alderson provided preliminary information and clarified the timeline as presented by Ms.

Singh. Mr. Bader was sworn in, presented his case, and responded to questions posed by

Board members.

The Board entered into deliberations. At 10:20 a.m. Mr. Hare moved, seconded by Ms. Silverio

to lift Justin Bader’s suspension provided he enroll in a professionals’ health monitoring program

in Florida or the jurisdiction where he intends to practice within 90 days. The motion carried

unanimously.
