Auction Sale Rules (All cattle sold by Kivells are sold under the Livestock Auctioneers Association Conditions of Sale)

Maiden heifers stated to be sold for breeding purposes. The vendor warrants a maiden heifer stated in the catalogue or at the time of sale to be sold for breeding purposes to be free from any malformation which would render the animal incapable of breeding. The warranty is a 5 day warranty if the malformation is patent or a 6 month + 5 day warranty if the malformation is latent. If the purchaser proves a breach of warranty the purchaser may return the animal to the vendor. Notice of claim must be supported by a veterinary surgeon’s certificate.

Cows or heifers sold as being in milk and/or in calf. The vendor warrants a dairy cow or heifer in calf and/or in milk:

(a) To be correct in the udder and teats; (b) Not to be infected with clinical mastitis; (c) Not to suck any other animal or herself; and (d) To be quiet to milk.

The warranties in conditions (a) & (b) is an after sale warranty which shall run from the close of the day’s sale or until the animal is removed from the sale premises, whichever is sooner. The warranty in conditions (c) & (d) is a 5+5 day warranty.

Cleansing The vendor warrants that all newly calved cows and heifers have cleansed satisfactorily before the sale. This warranty is a 3 day warranty in which any claim made by the purchaser must be supported by a veterinary surgeon’s certificate. The vendor is obliged to pay for the cost of one wash out.

Cows or heifers sold as served or guaranteed in calf. When an animal stated to have been served less than 10 weeks prior to the sale and is pregnancy diagnosed positive, this is given as guidance only and carries no warranty. If a cow or heifer has been positively diagnosed as 10 weeks or more in calf at the time of sale and thereafter is proved to be not in-calf, and a Veterinary Surgeon’s certificate to that effect is produced there is a 38 + 5 day warranty.

Where a cow or heifer is sold as ‘having run with a bull’ no warranty as to the animal being in calf at the time of sale is given.

Breeding Stock bulls The vendor warrants that any bull 10 months or over sold as a stock bull is capable of and effective at natural service. This warranty is a 16 week warranty.

Please note Milk yields are given as a guide but carry no warranty. The descriptions are supplied by the vendor and whilst they are believed to be correct this catalogue in no way shall guarantee their accuracy. Antibiotics – Please would all vendors inform the Auctioneers if any animal has been treated with any antibiotics. There are serious penalties incurred to milk producers for antibiotic contamination.

Foreword

Kivells are pleased to have been instructed to disperse the herd of Holstein Friesian Dairy

Cattle on behalf of Mr AJH Lawry, Garras Farm, St Allen, Truro. The herd will be removed to

Holsworthy Livestock Market for convenience of sale on Wednesday 12th July 2017,

commencing at 11:30am.

The herd commenced in 1936 and the family have been farming and in milk production at

Garras Farm for 4 generations farming a completely homebred herd. For many years Holstein

Friesian sires have been used for breeding such as ‘ABS Destination, Ballycairn Mascol Mars,

Ballycairn Tiergan Rubicon, Bellemont Lexus, Deangate Tex, Farnear Haddy ET, Huddlestone

Strauss, Majestic Cosmos, Sherdon Irresistable’.

An NMR individual cell count test occurred on Monday 3rd July and these results are shown

in the catalogue. The average cell count for cows in the sale is cc106. Individual yields will be

announced on the sale day.

The sale comprises 73 milking cows, including 36 first calvers, 18 second calvers, 5 third

calvers and 14 fourth + calvers. 10 dry cows due August to November and 27 In Calf Heifers

all due to Limousin Bull from August to September onwards.

A Limousin Bull has run with the In Calf Heifers from November 2016 and the approximate

due dates are noted in the catalogue.

The cows are cubicle housed and herringbone parlour milked. The herd graze grass from the

months April to October and they are fed grass silage in the winter months with cake fed in

parlour.

Cepravin dry cow therapy is used at drying off. The herd was TB tested on 27 June 2017.

PD+ Due Date Warranty: Due to the use of natural service stock bulls in addition to AI bulls all due dates and PD results are the veterinary surgeons best estimate and should be treated as estimates. We recommend that you check PD due dates with your own vet as soon as possible after the sale and certainly within 7 weeks of the sale (the warranty period). All claims for incorrect due dates must be made within 7 weeks of the sale date. Claims outside of the 7 week warranty cannot be considered.
