MANUFACTURER'S REQUEST:New Flyer requests the following amendment to this Section: A pilot bus for a Heavy Duty 40ft clean diesel transit bus shall be built, tested and be 100-percent complete and functional before METRO will issue acceptance and approval to initiate assembly of the remaining buses (production buses) to be delivered under the terms of this Contract. The Contractor shall provide METRO with all manufacturing and assembly diagrams for the pilot bus no less than 10-business days prior to the start of the pilot bus assembly. At METRO’s option, testing can include operation of the pilot buses within METRO’s service area for a period not to exceed two (2) weeks. All METRO testing of the pilot buses shall be completed within two (2) weeks. Once complete and approved by METRO, the pilot bus will return to the Manufacturer’s facility and remain there to serve as a template for production buses. The Contractor shall schedule the pilot bus production and testing so that it does not alter the delivery schedule specified in Section III, Article 2 Bid/Contract Schedule of Items and Prices. The pilot bus will be placed at the head of the production line and used by production staff to ensure production buses are exact copies of the pilot bus. METRO will pay the Contractor for 95% of the bus unit fixed price listed in Section III, Article 2 Bid/Contract Schedule of Items and Prices, Item No. 1 - Heavy Duty 40ft clean diesel transit buses after the pilot bus is accepted and the remaining 5% will be paid once the pilot bus is delivered to METRO and final acceptance is completed. The contractor may request a waiver during the Pre-Production meeting to delete the requirement of a pilot bus and provide a First Article Bus if the same bus model has been in operation at Houston Metro. The contractor must provide sufficient documentation demonstrating that there are no significant differences between models. Production of the remaining units would commence within two (2) weeks after acceptance of the First Article Bus.

In some instances, METRO may require the Contractor or its designated representative to perform warranty covered repairs that are clearly beyond the scope of its capabilities. In these cases, the Contractor will provide the parts and tools required to complete warranty repairs, but when possible, we request that METRO provide shop space to so we can complete the repairs. This allows us to work with METRO in order to return the bus to revenue service as quickly as possible. If shop space is unavailable, Contractor will utilize contractors with their own service facilities in the METRO area to perform the repairs and get the buses back into revenue service as soon as possible. This will be provided in lieu of a New Flyer Service Center.

This abbreviated list is complied using the actual bus build information that is available in the customers bus production Bill of Material (BOM) NFI Parts will also provide the customer with a more inclusive Parts Provisioning List following last-bus delivery. This listing will be compiled using further part assembly breakdown information identified in the customers Parts manual and will assist in stocking additional parts that further support new bus operations and maintenance over the next 2-3 years.
