WAIVER OF LIABILITY AND MEDIA RELEASEATOMIC BOMB CHALLENGE

By signing below: I represent and warrant that I am at least eighteen (18) years of age, a resident of the United States and in good physical and mental health and do not suffer from any mental or physical condition or disability which might render my participation in the Sticky Lips Pit BBQ Restaurant Atomic Bomb Challenge (the “Contest”) hazardous to myself or to others or which would impair my ability to understand this release. I understand that I am encouraged to consult my own health care provider before participating in the Contest, especially if I have food allergies, take any medications and/or am being treated for any illness or condition. Should I decide to not to do so, this decision shall be entirely at my own risk. I understand that, as a direct and/or indirect result of my participation in the Contest, there is a possibility of serious physical injury, physical disability and/or death to myself or others. I hereby agree and acknowledge that I am voluntarily participating in the Contest with full and complete knowledge of the risks and dangers involved. I hereby agree to accept and assume any and all risks of any nature whatsoever including, without limitation, personal and emotional injury, physical disability, and/or death and will release and hold, Sticky Lips Pit BBQ Restaurant, BBQ Pit Boys, Inc., or its officers, directors, agents, employees, stockholders and sponsors (collectively, the “Releasees”) harmless from any and all liabilities, claims, demands, causes of action, damages, costs, expenses and obligation of any nature whatsoever for any such injuries, disabilities or death that I or others may sustain as a result of my participation in the Contest. I, for myself and for my heirs, executors, administrators, assigns and anyone else who might make a claim on my behalf, hereby agree not to make any claim against and/or sue any of the Releasees for any such death, injury or illness, whether caused by the negligence of the Releasees or otherwise.

I irrevocably grant to BBQ Pit Boys, Inc. ("Company") and Company's assigns, licensees and successors the right to use my image and name in all forms and media for all purposes throughout the world and in perpetuity. I waive the right to inspect or approve versions of my image used for publication or the written copy that may used in connection with the images. I release Company and Company's assigns, licensees and successors from any claims that may arise regarding the use of my image including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity or copyright. Company is permitted, although not obligated, to include my name as a credit in connection with the image.
