Dear Mr. Noyes:

Environmental Compliance Services, Inc. (ECS) responded to a request from Andy Shively of VTrans on September 4, 2007 to assist in assessment and remedial actions regarding the release of No. 2 fuel oil at the above referenced location. The release was reported to the Vermont Department of Environmental Conservation (VT DEC) by Andy Shively on September 4, 2007. A Site Locus map of the approximate subject area is provided as Figure 1.

Release Summary

The release occurred during normal operating hours on September 4. According to VTrans employees at the Dummerston Garage, the transfer pump between the day tank inside the building and the main fuel supply tank outside the building malfunctioned and caused the day tank to become overfilled. An unknown quantity of No. 2 fuel oil was released through the vent pipe of the day tank to the ground surface behind the main garage. The vent pipe to the day tank is piped through the wall to the outdoors; therefore, no oil was released inside the building. As soon as the release was discovered, the transfer pump was immediately shut down. Andy Shively of VTrans was notified of this release and subsequently contacted ECS. At the time of the release, an area measuring approximately 2 feet wide by 8 feet long was impacted by the release. Although the exact quantity of spilled fuel oil could not be determined, it was reported by VTrans that only two to five gallons were likely released.

Summary of Remedial Actions

On September 5,2007, ECS and VTrans employees began removing the petroleum impacted soil using a backhoe and hand tools. At that time, VTrans employees had located a PVC stand pipe enclosing a metal sewer pipe within the release area. During excavation activities, soil samples were visually inspected and field screened for the presence of Total Organic Vapors (TOVs) using a Photovac Model 2020 photoionization detector (PID) calibrated to an Isobutylene span gas and referenced to benzene. Confirmatory soil samples collected from the base of the excavation (3.5 feet deep) registered TOV concentrations no greater than 1.7 parts per million (ppm) TOV concentrations of soil samples collected from the lateral extent of the excavated area ranged from 2.2 ppm to 2.9 ppm. surrounding the pipe. TOV concentrations within the sandy backfill surrounding the sewer pipe ranged from non-detectable to 1.7 ppm, thus confirming that the pipe and associated backfill were not acting as a preferential pathway for contaminant migration.

Confirmatow Samling

The final excavation measured approximately 7 feet wide, by 5 feet long and 3.5 feet deep. One composite confirmatory sample (S-1), composited from samples collected at the vertical and horizontal limits of the excavation, was submitted Spectrum Analytical of Agawam, Massachusetts for Total Petroleum Hydrocarbons (TPH) via method 8 100. The soil sample was immediately placed in a cooler on ice and maintained at approximately 4' C until delivery to the laboratory The Spectrum Analytical laboratory report is included as Attachment I.

In summary, TPH was reported in soil sample S-1 at a concentration of 126 milligrams per kilogram (mg/Kg). This concentration is below the VT DEC TPH Guidance Levels for residential locations (200 mgkg) and industrial locations (1,000 mglkg).

Sensitive Recmtors

Based on municipal records and a site inspection conducted by ECS, it appeared that no sensitive receptors such as wetlands, surface water or drinking water wells were located near the vicinity of the release. Furthermore, groundwater was not encountered during soil excavation activities. Therefore, it is not likely that groundwater was impacted by this release.

Management of Remediation Waste

On September 5, 2007, approximately five cubic yards of petroleum impacted soil was excavated from the release area and stockpiled on and covered with polyethylene sheeting. The soil pile remains on-site and is pending disposal.

Conclusions

An unknown quantity of fuel oil was released during the normal operations at the VTrans garage. However, it was reported by VTrans that only two to five gallons of oil were likely released The release occurred as a result of a malfunctioning shut-off switch connected to a transfer pump between the day tank and the main fuel supply tank;

The release was confined to the gravel surface behind the building at the VTrans Dummerston Garage on Route 5 in Dummerston, Vermont;

The final excavation measured approximately 7 feet wide, by 5 feet long and 3.5 feet deep. Approximately 5 tons of petroleum impacted soil were removed as part of remedial actions and transported off site for asphalt batch recycling;

No sensitive receptors were identified to have been impacted during response actions;

Groundwater was not encountered during soil excavation activities. Therefore, it is not likely that groundwater was impacted by this release; and TPH was reported in confirmatory composite soil sample S-1 at a concentration of 126 mgKg which is below the VT DEC TPH Guidance Levels

Recommendations

Based on the above conclusions, ECS recommends no further action in regard to the on-site he1 oil release.
