Vacation Rental Ordinance Reminder

Deadwood Property Owners: As many of you may know, the commercial transient use of residentially zoned properties is prohibited within Deadwood city limits. The nightly rental of a property must be commercially zoned or operate with an approved conditional use permit for a Manager Stay Bed and Breakfast. Vacation rentals, as allowed by the State of South Dakota Department of Health, are PROHIBITED in residentially zoned property within the City of Deadwood and where permitted must be licensed with the State of South Dakota and register with the City of Deadwood as a commercial lodging establishment. The growing trend to vacation rental properties while appealing to not only the owner, but the customer in Deadwood is a liability to you as an owner. Not only is the safety of the customer very important while staying in a lodging establishment, but both the customer and the property owner are subject to fine if found in violation of City of Deadwood Codified Ordinance 17.53. The City of Deadwood asks that if you are actively using your property as a vacation rental to stop and to remove all marketing from all websites. If you have any questions in regards to vacation rentals or the ordinance please feel free to contact me anytime. Thank you.
