Ontario Highway Transport BoardPeriodically, temporary applications are filed with the Board. Details of these applications can be made available at anytime to any interested parties by calling (416) 326-6732.

The following are applications for extra-provincial and public vehicle operating licenses filed under the Motor Vehicle Transport Act, 1987, and the Public Vehicles Act. All information pertaining to the applicant i.e. business plan, supporting evidence, etc. is on file at the Board and is available upon request.

Any interested person who has an economic interest in the outcome of these applications may serve and file an objection within 29 days of this publication. The objector shall:

1. complete a Notice of Objection Form,

2. serve the applicant with the objection,

3. file a copy of the objection and provide proof of service of the objection on the applicant with the Board,

4. pay the appropriate fee.

Serving and filing an objection may be effected by hand delivery, mail, courier or facsimile. Serving means the date received by a party and filing means the date received by the Board.

ONTARIO ENERGY BOARDAmendments to the Standard Supply Service Code

1. Section 1.2.1 of the Standard Supply Service Code is amended by adding “3.2.1A or” to the end of the definition of “electing spot consumer” between the word

“section” and “3.2.2”.

2. Section 1.6 of the Standard Supply Service Code is amended by adding the following immediately after section 1.6.2.

1.6.3 The amendments to sections 1.2.1, 3.2.6, 3.3.2, 3.3.3 and 3.3.4 and the addition of sections 3.2.1A and 3.2.1B come into force on the date on which they are published on the Board’s website after having been made by the Board.

3. Section 3 of the Standard Supply Service Code is amended by adding the following immediately after section 3.2.1:

3.2.1A The commodity price for electricity payable by an electing spot consumer referred to in section 8(1)(a) of Ontario Regulation 95/05 (Classes of Consumers and Determination of Rates) that has a conventional meter shall be the weighted average hourly spot market price, for the period over which the electing spot consumer is being billed, determined in accordance with the Retail Settlement Code, with such adjustment as may be made by the IESO in accordance with the Electricity Act and the regulations.

3.2.1B A distributor shall charge an electing spot consumer in accordance with section 3.2.1A only upon being requested to do so in writing by the electing spot consumer. In such a case, the distributor shall charge the electing spot consumer in accordance with section 3.2.1A for electricity consumed after an actual read of the electing spot consumer’s meter by the distributor.

4. Section 3.2.6 of the Standard Supply Service Code is amended by deleting the “t” between the words “TOU” and “date” in the first sentence of the section.

5. Section 3.3.2(d) of the Standard Supply Service Code is amended by adding the words “subject to section 3.3.4,” immediately before the words “the tier threshold” at the beginning of the section.

6. Section 3.3.3 of the Standard Supply Service Code is deleted and replaced with the following:

3.3.3 For the purposes of section 3.3.2(c), an RPP consumer referred to in section 3.3.4, other than a property defined in the Condominium Act, 1998 that is comprised predominantly of units that are used for non-residential purposes, shall be deemed to fall within the residential class.

7. Section 3.3.4 of the Standard Supply Service Code is amended as follows:

i. by deleting the reference to “the Tenant Protection Act, 1997” and replacing it with a reference to “the Residential Tenancies Act, 2006”; and

ii. by adding the phrase “or 3.3.2(d)” immediately after the phrase “section 3.3.2(c)” in the second last sentence of the section.

4. The following are Class I proposals for instruments:

1. A proposal to classify a pesticide under Ontario Regulation 63/09 (General) made under the Pesticides Act if the pesticide contains a pesticide ingredient that is neither classified under that regulation nor contained in a pesticide classified under that regulation.

2. A proposal to reclassify a pesticide under Ontario Regulation 63/09 made under the Pesticides Act.

3. A proposal to declassify a pesticide under Ontario Regulation 63/09 made under the Pesticides Act unless,

i. declassification would take place at the request of, or with the consent of,

A. the person who registered the pesticide under the Pest Control Products Act (Canada) or the Fertilizers Act (Canada), or

B. in the case of a pesticide registered under the Pest Control Products Act (Canada), the Canadian agent of the person who registered the pesticide, or

ii. the pesticide is no longer registered under the Pest Control Products Act (Canada) or the Fertilizers Act (Canada).

4. A proposal by the Ministry of Natural Resources to enter into an agreement with a body responsible for managing a natural resources management project, if a pesticide prescribed for the purposes of subsection 7.1 (1) of the Pesticides Act may be used for the purposes of the project.

1. Subsection 2 (1) of Ontario Regulation 223/05 is revoked and the following substituted: Supplementary inspections

(1) For every inspector who performs supplementary inspections at a slaughter plant under subsection 57.2 (1) of the meat regulation, the operator of the plant shall pay a fee of, (a) $20 for every hour that the inspector performs supplementary inspections on a day other than a holiday; and (b) $25 for every hour that the inspector performs supplementary inspections on a holiday.

2. The Regulation is amended by adding the following section: Fees for certain supplementary inspections not payable

2.1 (1) This section applies in respect of a slaughter plant for which a director has established an inspection schedule under subsection 57.1 (1) of the meat regulation that provides for inspectors to be performing inspections at the plant for 37.5 hours on five days in a seven-day period. (2) If a director assigns inspectors to perform supplementary inspections under subsection 57.2 (1) of the meat regulation at a plant described in subsection (1) on a day within the seven-day period that is not one of the five days on which inspectors are normally assigned to perform inspection under the inspection schedule, fees that would otherwise be payable under subsection 2 (1) in respect of the first 7.25 hours of supplementary inspections performed on that day are waived unless that day is a holiday.

3. Section 3 of the Regulation is revoked and the following substituted: Supplementary inspections — veterinary inspectors

3. For every veterinary inspector who performs inspections at a plant under subsection 57.2 (3) of the meat regulation, the operator of a plant shall pay a fee of $40 for every hour that the veterinary inspector performs the inspections.

4. Subsection 3.1 (4) of the Regulation is revoked and the following substituted: (4) The fee payable by the operator of a slaughter plant specified in a provisional authorization issued under the meat regulation to slaughter one or more food animals outside of a slaughter plant is $40 for every hour that a veterinary inspector attends at the operator’s plant to conduct a post mortem inspection of the carcasses of the animals.

5. Section 4 of the Regulation is amended by striking out “section 138.4” in the portion before clause (a) and substituting “section 57.3”.

The annual subscription rate is $126.50 + G.S.T. for 52 or 53 weekly issues beginning the first Saturday in January, payable in advance. In-year new subscriptions will be pro-rated for the first year. A new subscriber may order back issues of the Gazette at the single-copy rate as inventory permits.

Refunds for cancelled subscriptions will be pro-rated from 50% or less depending upon date. For subscription information/orders please call (416) 326-5306 during normal business hours.

Individual Gazette copies may be ordered on-line through the website at www.serviceontario.ca/publications or by phone at 1-800-668-9938.
