2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] पूव� : बायां ,वाह बंध पूवZ सीमा का िनमा�ण करता है । बायां ,वाह बंध एक तटबंध है जो नजदीक के )े�; म% जल के ,वेश का िनवारण करता ह ै। यह 2.5 �कलोमीटर लंबा ह ैऔर इसका उपयोग सड़क के 7प म% �कया जाता ह ै; पि] चम : दायां सीमांत बंध पि] चमी सीमा का िनमा�ण करता ह ै। इस बंध का भागत: बाड़ Gारा और भागत: एक दीवार Gारा संर)ण �कया जाता ह ै । और ओखला प)ी अभयार1 य िविभ^ न ,कार के बड़ी सं_ या म% जलीय पि)य; के आवास के 7प म% जाना जाता ह ैऔर ,वासी तथा िनवासी पि)य; (लगभग 6,000 पि)य; क� 324 ,जाितयां) को स`दय; के दौरान सूचीबb �कया गया है और इस अ0 यार1 य म% आन ेवाले मह+ वपूण� पि)य; म% कोमcर%dस, हरैो^ स, इeेdस, डाट�र, कूट, ब+ तख% आ�द भी हO ; और अभयार1 य के चार; ओर के )े� तथा उसम% पि)य; क� िविभ^ न ,जाितय; के ,सार का सुधार करना और उनका िवकास करना तथा उसके पया�वरण का संर)ण और प�रर)ण आव] यक ह ै; और ओखला प)ी अभयार1 य क� पूवZ, पि] चमी और दि)णी सीमा से सौ मीटर तक के )े� का और उ+ तरी सीमा से 1.27 �कलोमीटर के )े� को पा�रि� थितक�य और पया�वरण क� दिृ& ट से पा�रि�थितक संवेदी जोन के 7प संरि)त और सुरि)त करना आव] यक हो गया है और पूवZ, पि] चमी और दि)णी सीमा से एक �कलोमीटर )े� के भीतर और ओखला प)ी अभयार1 य क� दि)णी सीमा से 1.27 �कलोमीटर )े� के भीतर वािणि( यक खनन काय�कलाप; का ,ितषेध करना आव] यक हो गया ह ै। अतः, अब, के^Fीय सरकार, पया�वरण (संर)ण) िनयम, 1986 के िनयम 5 के उपिनयम (3) के साथ प�ठत पया�वरण (संर)ण) अिधिनयम, 1986 (1986 का 29) क� धारा 3 क� उपधारा (1), उपधारा (2) के खंड (v) और खंड (xiv) और उपधारा (3) Gारा ,दj शि:य; का ,योग करते kए, उ+ तर ,दशे रा( य म% ओखला प)ी अभयार1 य क� पूवZ, पि] चमी और दि)णी सीमा से सौ मीटर तक के )े� को और रा& 'ीय राजधानी रा( य )े� �द� ली क� उ+ तरी सीमा से 1.27 �कलोमीटर तक के )े� को ओखला प)ी अभयार1 य पा�रि�थितक संवेदी जोन के 7प म% अिधसूिचत करती ह,ै िजसका िववरण िनlानसुार है, अथा�त ्:-- 1111.... पा�रि�थितकपा�रि�थितकपा�रि�थितकपा�रि�थितक सवंदेीसवंदेीसवंदेीसवंदेी जोनजोनजोनजोन काकाकाका िव�तारिव�तारिव�तारिव�तार औरऔरऔरऔर उसक�उसक�उसक�उसक� सीमाएंसीमाएंसीमाएंसीमाएं--(1) ओखला प)ी अभयार1 य क� उ+ तर ,दशे के गौतम बुb नगर िजले और रा& 'ीय राजधानी रा( य )े� के दि)ण पूव� िजले से सौ मीटर से 1.27 तक पा�रि�थितक संवेदी जोन का िव�तार ह ै। (2) पा�रि�थितक संवेदी जोन का )े� पूवZ, पि] चमी और दि)णी सीमा से सौ मीटर तक और ओखला प)ी अभयार1 य क� उjरी सीमा से डीएनडी Vलाई ऑवर तक नदी तल के िव� तार तक 1.27 �कलोमीटर तक उ+ तर ,दशे के गौतम बुb नगर िजले और रा& 'ीय राजधानी रा( य )े� �द� ली के दि)णी पूवZ िजले तक फैला kआ है । (3) ओखला प)ी अभयार1 य के चार; ओर का पा�रि�थितक संवेदी जोन का मानिच� इस अिधसूचना के उपाबधंउपाबधंउपाबधंउपाबधं 1111 के 7प म% संलn ह ै। (4) पा�रि�थितक संवेदी जोन क� बाहरी सीमा के मह+ वपूण� Qबदoू को उपद@शत करने वाले िनदpशांक इस अिधसूचना के साथ उपाबंधउपाबंधउपाबंधउपाबंध 2222 के 7प म% संलn है । (5) पा�रि�थितक संवेदी जोन के भीतर आने वाले दस शहरी )े� या eाम उनके � थायी Qबदoु पर अ)ांश और दशेांतर सिहत इस अिधसूचना के साथ उपाबंध उपाबंध उपाबंध उपाबंध IIIIIIIIIIII के 7प म% उपाबb हO : परंतु उपाबंध 3 पा�रि�थितक संवेदी जोन क� संबंिधत आंचिलक महायोजना म% रा( य सरकार; Gारा पुि& ट �कए जाने के अq यधीन होगा । 2222.... पा�रि�थितकपा�रि�थितकपा�रि�थितकपा�रि�थितक संवदेीसंवदेीसंवदेीसंवदेी जोनजोनजोनजोन केकेकेके िलएिलएिलएिलए आचंिलक महायोजनाआचंिलक महायोजनाआचंिलक महायोजनाआचंिलक महायोजना ---- (1) संबंिधत रा(य सरकार पा�रि�थितक संवेदी जोन के ,भावी ,बंधन के ,योजन के िलए इस अिधसूचना के राजप� म% ,काशन क� तारीख से दो वष� के भीतर � थानीय लोग; और िनB निलिखत संबंिधत रा( य िवभाग; म% परामश� से आंचिलक महायोजना तैयार करेगी तथा जो �क उ+ तर ,दशे / रा& 'ीय राजधानी रा( य )े� �द� ली के स)म अिधकारी Gारा अनुमो�दत होगी, अथा�त् :- (i) वन, पया�वरण और व^ य जीव ,बंधन ; (ii) उ+ तर ,दशे या �द� ली पुिलस ; (iii) शहरी आवास िवकास ; (iv) पय�टन ; (v) eामीण ,बंधन और िवकास ;

(vi) Qसचाई और बाढ़ िनयं�ण ; (vii) लोक िनमा�ण िवभाग या के^ Fीय लोक िनमा�ण िवभाग; (viii) भू-राज� व; और (ix) आपदा ,बंधन । (x) उ+ तर ,दशे ,दषूण िनयं�ण बोड�/�द� ली ,दषूण िनयं�ण बोड� । (2) आंचिलक महायोजना िनlीकृत )े�; के पुनtGार, िवuमान जल िनकाय; के संर)ण, आवाह )े�; के ,बंधन, जल संभर ,बंधन, भू जल ,बंधन, मृदा और नमी संर)ण �थानीय समुदाय क� आव]यकताo और पा�रि�थितक� और पया�वरण के ऐसे अ^य प�र,ेvय; िजनपर qयान दनेे क� आव]यकता है के िलए उपबंध करेगी । (3) आंचिलक महायोजना सभी िवuमान और ,�तािवत शहरी बि�तय;, eामीण बि�तय;, वन; क� �क�म और ,कार, कृिष )े�; और बागवानी )े�;, झील;, अ^य जल िनकाय; और उuमी इकाइय; को िचि^हत करेगी । (4) आंचिलक महायोजना म% ऐसे उपाय अंत@व& ट ह;गे जो के^ Fीय सरकार या रा( य सरकार Gारा पैरा 4 म% िविन`द& ट सारणी के � तभं (2) म% िविन`द& ट काय�कलाप; के िविनयमन के िलए िविन`द& ट �कए जाएं । (5555) इस ,कार तैयार जोनल मा�टर योजना )े�ीय िवकास योजना के साथ साथ समाx त होगी । 3. रा� यरा� यरा� यरा� य सरकार �ारा �कए जान ेवाल ेउपाय सरकार �ारा �कए जान ेवाल ेउपाय सरकार �ारा �कए जान ेवाल ेउपाय सरकार �ारा �कए जान ेवाल ेउपाय- रा( य सरकार इस अिधसूचना के उपबंध; को ,भावी करने के िलए िनB निलिखत उपाय करेगी, अथा�त् :- (1) भू(1) भू(1) भू(1) भू----उपयोगउपयोगउपयोगउपयोग---- पा�रि� थितक� सवंेदी जोन म% वन, उuान )े�, कृिष )े�, उuान और मनोरंजन के ,योजन के िलए िचि^ हत खुले � थान; का उपयोग या उनका संप�रवत�न वािणि( यक या उuोग; से संबंिधत िवकास काय�कलाप; के िलए नह= �कया जाएगा : परंतु पा�रि� थितक� संवेदी जोन के भीतर कृिष भूिम के संप�रवत�न को मानीटरी सिमित क� िसफा�रश; पर और रा( य सरकार के पूवा�नुमोदन से � थानीय नाग�रक; क� आवासीय आव] यकताo को पूरा करने के िलए और yमशः पैरा 4 क� सारणी के � तभं (2) के अधीन िविन`द& ट मद सं_ या 24 और मद सं_ या 27 म% सूचीबb काय�कलाप; के िलए अनु{ात �कया जा सकेगा, अथा�त्:- (i) सुर)ा बल िशिवर; और (ii) वषा� जल संचयन: परंतु पा�रि� थितक� संवेदी जोन के भू-अिभलेख; म% उ+ प^ न होने वाली �कसी �ु�ट का सुधार रा( य सरकार Gारा मानीटरी सिमित के मत को अिभ,ाx त करने के प] चात् ,+ येक दशा म% एक बार �कया जाएगा और उ| त �ु�ट के सुधार से पया�वरण, वन और जलवायु प�रवत�न मं�ालय म% के^ Fीय सरकार को संसूिचत �कया जाएगा : परंतु यह भी �क पूवc| त �ु�ट सुधार म% �कसी भी दशा म% भूिम उपयोग म% प�रवत�न िसवाय इस उप पैरा के अधीन उपबंिधत के अनु{ात नह= �कया जाएगा । (2) पय�टनपय�टनपय�टनपय�टन--------पा�रि�थितक संवेदी जोन के भीतर पय�टन संबंधी �yयाकलाप िनlानुसार ह;गे, अथा�त ्:-- (i) पा�रि�थितक संवेदी जोन के भीतर सभी नए पय�टन �yयाकलाप; या िवuमान पय�टन �yयाकलाप; का िव�तार पा�रि�थितक पय�टन,पा�रि�थितक-िश)ा और पा�रि�थितक िवकास तथा पा�रि�थितक संवेदी जोन क� वहन )मता पर आधा�रत अqययन पर जोर दतेे kए रा}ीय 9ा~ संर)ण ,ािधकरण, पया�वरण और वन मं�ालय और पय�टन मं�ालय, भारत सरकार Gारा जारी के^Fीय माग�दश�क िसbांत; के अनुसार होगा ; (ii) पा�रि�थितक संवेदी जोन म% �कसी भी ,कार के संिनमा�ण क� मजंूरी नह= होगी ; (iii) आंचिलक महायोजना का अनुमोदन �कए जाने तक िवuमान पय�टन �yयाकलाप; के िवकास और ,सार को वा�तिवक �थल िविन`द संवी)ा तथा मानीटरी सिमित क� िसफा�रश के आधार पर संबंिधत िविनयामक ,ािधका�रय; Gारा अनु{ात �कया जाएगा ; (3) नसै गकनसै गकनसै गकनसै गक िवरासतिवरासतिवरासतिवरासत- पा�रि�थितक संवेदी जोन म% मू�यवान नैस@गक िवरासत क� पहचान क� जाएगी और आंचिलक महायोजना म% सिBमिलत �कया जाएगा ; सभी जीन पूल के िलए आरि)त )े�, चान िवरचनाएं, जल ,पात;, झरन;, घाटी माग, उपवन;, गुफाएं,

4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)] �थल;, मण, अरोहण, खड़ी चान; आ�द को प�ररि)त �कया जाएगा ; रा(य सरकार उनके संर)ण और संभारण के िलए इस अिधसूचना के ,काशन क� तारीख से छह मास के भीतर उपयु: योजना बनाएगी और ऐसी योजना आंचिलक महायोजना का भाग ह;गी । (4) "विन"विन"विन"विन #दषूण#दषूण#दषूण#दषूण - पया�वरण िवभाग या रा(य वन िवभाग उ+ तर ,देश /रा& 'ीय राजधानी रा( य )े� �द� ली सरकार, वायु (,दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 (1981 का 14) के उपबंध; के अनुसार, पा�रि�थितक संवेदी जोन म%, qविन ,दषूण के िनयं�ण के िलए माग�दश�क िसbांत और िविनयम क� िवरचना करने वाला ,ािधकरण होगा । (5) वायुवायुवायुवायु #दषूण#दषूण#दषूण#दषूण - पया�वरण िवभाग या रा(य वन िवभाग उ+ तर ,देश/रा& 'ीय राजधानी रा( य )े� �द� ली सरकार, वायु (,दषूण िनवारण और िनयं�ण) अिधिनयम, 1981 के उपबंध; के अनुसार, पा�रि�थितक संवेदी जोन म%, वायु ,दषूण के िनयं�ण के िलए माग�दश�क िसbांत और िविनयम क� िवरचना करने वाला ,ािधकरण होगा । (6) बिह)ाव*बिह)ाव*बिह)ाव*बिह)ाव* काकाकाका िन�सारणिन�सारणिन�सारणिन�सारण ::::-------- पा�रि�थितक संवेदी जोन म% उपचा�रत बिहाव जल का िन�सारण जल (,दषूण िनवारण तथा िनयं�ण) अिधिनयम, 1974 (1974 का 6) के उपबंध; के अनुसार होगा । (7777) ) ) ) ठोसठोसठोसठोस अपिश-अपिश-अपिश-अपिश- ::::-------- (1) (1) (1) (1) ठोस अपिश का िनपटान िनlानुसार �कया जाएगा:- (i) पा�रि�थितक संवेदी जोन म% ठोस अपिश का िनपटान समय-समय पर यथा संशोिधत अिधसूचना सं. का.आ. 908(अ) तारीख 25 िसतंबर, 2000 Gारा के^Fीय सरकार Gारा ,कािशत नगरपािलक ठोस अपिश (,बंध और हथालन) िनयम, 2000 के उपबंध; के अनुसार �कया जाएगा; (ii) �थानीय ,ािधकरण जैव िनlीकरणीय और अजैव िनlीकरणीय संघटक; म% ठोस अपिश; के संपृथकन के िलए योजनाएं तैयार कर%गे ; (iii) जैव िनlीकरणीय सामeी को अिधमानतः खाद बनाकर या कृिम खेती के माqयम से पुनःच�yत �कया जाएगा ; (iv) अकाब�िनक सामeी का िनपटान �कसी पया�वरणीय �वीकृत रीित म% होगा । (8) जैवजैवजैवजैव िच�क/सािच�क/सािच�क/सािच�क/सा अपिश-अपिश-अपिश-अपिश----- पा�रि�थितक� संवेदी जोन म% जैव िच�क+सा अपिश का िनपटान भारत के राजप� म% भारत सरकार के त+ कालीन पया�वरण और वन मं�ालय Gारा ,कािशत अिधसूचना सं. का.आ.630(अ) तारीख 20 जुलाई, 1998 जैव िच�क+सा अपिश (,बंधन और हथालन) िनयम, 1998 के उपबंध; के अनुसार �कया जाएगा । (9) यानीययानीययानीययानीय प�रवहनप�रवहनप�रवहनप�रवहन - प�रवहन क� यानीय गितिविधयां आवास के अनुकूल िविनयिमत ह;गी और इस संबंध म% आंचिलक महायोजना म% िवशेष उपबंध अिधकिथत �कए जाएंगे और ऐसे समय जब तक क� आंचिलक महायोजना के तैयार होने और उ+ तर ,दशे/रा& 'ीय राजधानी रा( य )े� उ+ तर ,दशे सरकार के स)म ,ािधकारी Gारा अनुमो�दत �कय ेजान ेतक, मानीटरी सिमित यानीय गितिविधय; को िवuमान िनयम; और िविनयम; के अनुसार मानीटर करेगी । ((((10101010)))) vkarfjd ,oa czkâ; izdk'k

NOTIFICATION

New Delhi, the 19th August, 2015

S.O. 2262(E).-Whereas, a draft notification, for declaration of Eco-sensitive Zone (ESZ) around Okhla Bird

Sanctuary in the National Capital Territory of Delhi and the State of Uttar Pradesh was published in the Gazette of India,

Extraordinary, Part II, Section 3, Sub-section (ii) vide notification of the Government of India in the Ministry of

Environment, Forest and Climate Change number S.O. 2499 (E), dated the 24th

September, 2014, inviting objections and

suggestions from all persons likely to be affected thereby within a period of sixty days from the date on which copies of

the Gazette containing the said notification were made available to the public;

And whereas, copies of the Gazette containing the said notification were made available to the public on 24th

September, 2014;

And whereas, all objections and suggestions received from all persons and stakeholders in response to the draft

notification have been duly considered by the Central Government;

And whereas, the Central Government considers that the Okhla Bird Sanctuary is located in the National Capital

Region (NCR) at the point where the river Yamuna leaves the territory of the National Capital Territory of Delhi and

enters the State of Uttar Pradesh;

And whereas, the boundaries of Okhla Bird Sanctuary are as follows:-

North: The Okhla Weir and Okhla Weir Bund forms the Northern boundary of the Sanctuary; River Yamuna

and Hindon Cut enter the sanctuary from the section close to Delhi Noida Direct flyover but there is no entry to

the flyover from this side;

South: The Okhla barrage Tie Bund, Amrapali Marg (a road that connects Delhi and Noida) and Shahdara

drains forms the Southern boundary, and most of this boundary is fenced;

East: Left afflux bund forms the Eastern boundary. The left afflux Bund is the dyke that prevents water from

entering the nearby areas, and it is 2.5 kilometers long and is used as a road;

West: The right Marginal Bund forms the western boundary of the sanctuary and this bund is protected partly

by a fence and partly by a wall;

And whereas, the Okhla Bird Sanctuary is known for its aquatic habitat of large number and variety of

migratory and resident birds (about 324 species of about 6000 birds) have been listed during winters and the important

birds that visit the sanctuary includes different species of Cormorants, Herons, Egrets, Darter, Koot, Ducks, etc.;

And whereas, it is necessary to conserve and protect the area around the sanctuary and to propagate

improvement of and develop the different species of birds therein and its environment;

And whereas, it has become necessary to conserve and protect the area up to one hundred meter from the

eastern, western and southern boundary and up to 1.27 kilometers from the northern boundary of the Okhla Bird

Sanctuary as an Eco-sensitive Zone from ecological and environmental point of view and to prohibit any commercial

mining activities within one kilometer area from the eastern, western and southern boundary and within 1.27 kilometers

area from the northern boundary of the Okhla Bird Sanctuary.

Now, therefore, in exercise of the powers conferred by sub-section (1) read with clause (v) and clause (xiv) of

sub-section (2) and sub-section (3) of section 3 of the Environment (Protection) Act, 1986 (29 of 1986), read with sub-

rule (3) of rule 5 of the Environment (Protection) Rules, 1986, the Central Government hereby notifies an area up to one

hundred meter from the eastern, western and southern boundary and an area up to 1.27 kilometers from the northern

boundary of the Okhla Bird Sanctuary in the State of Uttar Pradesh and the National Capital Territory of Delhi, as Okhla

Bird Sanctuary Eco-sensitive Zone (hereinafter called as the Eco-sensitive Zone), details of which are as under, namely:-

1. Extent and boundaries of Eco-sensitive Zone.-(1) The extent of Eco-sensitive Zone ranges from 100 meters to

1.27 kilometers from the boundary of the Okhla Bird Sanctuary in the district of Gautam Budh Nagar of Uttar Pradesh

and South East District of the National Capital Territory of Delhi.

(2) The Eco-sensitive Zone is the area up to one hundred meter from the eastern, western and southern boundary

and up to 1.27 kilometers from the northern boundary of the Okhla Bird Sanctuary up to Delhi Noida Direct fly over

across the river bed, situated in Gautam Budh Nagar district of Uttar Pradesh and South East district of National Capital

Territory of Delhi.

(3) The map of the Eco-sensitive Zone around Okhla Bird Sanctuary is appended to this notification as Annexure-I.

(4) The coordinates showing prominent points of the outer boundary of Eco-sensitive Zone is appended to this

notification as Annexure-II.


(5) The list of ten urban areas or villages falling within the Eco-sensitive Zone along with their longitudes and

latitudes at prominent points is appended to this notification as Annexure-III:

Provided that the Annexure-III shall be subject to confirmation by the State Governments in the respective

Zonal Master Plans of the Eco-Sensitive Zone.

2. Zonal Master Plan for the Eco-sensitive Zone.- (1)The State Governments shall, for the purpose of effective

management of the Eco-sensitive Zone, prepare Zonal Master Plans with respect to their State, within a period of two

years from the date of publication of this notification in the Official Gazette, to be approved by the competent authority

in the State of Uttar Pradesh or, as the case may be, the National Capital Territory of Delhi, in consultation with the local

people and with the following concerned State Departments, namely:-

(i) Forest, Environment and Wildlife Management;

(ii) Uttar Pradesh or Delhi Police;

(iii) Urban Housing Development;

(iv) Tourism;

(v) Rural Management and Development;

(vi) Irrigation and Flood Control;

(vii) Public Works Department or Central Public Works Department;

(viii) Land Revenue;

(ix) Disaster Management; and

(x) Uttar Pradesh Pollution Control Board/ Delhi Pollution Control Committee.

(2) The Zonal Master Plan shall provide for restoration of degraded areas, conservation of existing water bodies, management of catchment areas, watershed management, ground water management, soil and moisture conservation,

needs of local community and such other aspects of ecology and environment that need attention.

(3) The Zonal Master Plan shall demarcate all the existing and proposed urban settlements, village settlements, types and kinds of forest, agriculture areas, horticultural areas, lakes, other water bodies and entrepreneurial units.

(4) The Zonal Master Plan shall contain the measures as may be specified by the Central Government or the State Government, for regulation of activities specified under column (2) of the Table specified in paragraph 4.

(5) The Zonal Master Plan so prepared shall be co-terminus with the regional development plan.

(6) The Zonal Master Plan shall be a reference document for the Monitoring Committee referred to in paragraph 5, for carrying out its functions of monitoring under the provisions of this notification.

3. Measures to be taken by State Government.-The State Governments shall take the following measures for

giving effect to the provisions of this notification, namely:-

(1) Land Use.-Forests, horticulture areas, agricultural areas, parks and open spaces earmarked for recreational

purposes in the Eco-sensitive Zone shall not be used or converted into areas for commercial or industrial related

development activities:

Provided that the conversion of agricultural lands within the Eco-sensitive Zone may be permitted on the

recommendation of the Monitoring Committee, and with the prior approval of the State Government, to meet the

residential needs of the local residents, and for the activities listed at item numbers 24 and 27 specified under column

(2) of the table, respectively, in paragraph 4, namely:-

(i) Security Forces Camp; and (ii) Rainwater harvesting:

Provided further that any error appearing in the land records within the Eco-sensitive Zone shall be corrected by

the State Government, after obtaining the views of Monitoring Committee, only once in each case and the correction of

said error shall be intimated to the Central Government in the Ministry of Environment, Forest and Climate Change:

Provided also that the above correction of error shall not include change of land use in any case except as

provided under this sub-paragraph.

(2) Tourism.- The activity relating to tourism within the Eco-sensitive Zone which shall form part of the Zonal

Master Plan shall be as under, namely:-

(i) all new tourism activities or expansion of existing tourism activities within the Eco-sensitive Zone shall be in


accordance with the guidelines issued by the Central Government in the Ministry of Environment, Forest and Climate

Change and the Ministry of Tourism and by the National Tiger Conservation Authority, with emphasis on eco-tourism,

eco-education and eco-development and based on carrying capacity study of the Eco-sensitive Zone;

(ii) new construction of any kind shall not be allowed within the Eco-sensitive Zone;

(iii) till the Zonal Master Plan is approved, development for tourism and expansion of existing tourism activities

shall be permitted by the concerned regulatory authorities based on the actual site specific scruitinisation and

recommendation of the Monitoring Committee.

(3) Natural heritage.-All sites of valuable natural heritage in the Eco-sensitive Zone such as the gene pool reserve

areas, rock formations, waterfalls, springs, gorges, groves, caves, points, walks, rides, cliffs, etc., shall be identified and

be preserved and proper plan be drawn up for their protection and conservation, within six months from the date of

publication of this notification and such plans shall form part of the Zonal Master Plan.

(4) Noise pollution.- The Environment Department or the State Forest Department of Uttar Pradesh or the National

Capital Territory of Delhi shall issue guidelines and regulations for the control of noise pollution in the Eco-sensitive

Zone in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981(14 of 1981) so as to

declare silence zone or no horn zone within Eco-sensitive Zone.

(5) Air pollution.- The Environment Department or the State Forest Department of Uttar Pradesh or the National

Capital Territory of Delhi shall issue guidelines and regulations for the control of air pollution in the Eco-sensitive Zone

in accordance with the provisions of the Air (Prevention and Control of Pollution) Act, 1981 (14 of 1981).

(6) Discharge of effluents.- The discharge of treated effluent in Eco-sensitive Zone shall be in accordance with the

provisions of the Water (Prevention and Control of Pollution) Act, 1974(6 of 1974).

(7) Solid wastes. - Disposal of solid wastes shall be as under:-

(i) the solid waste disposal in Eco-sensitive Zone shall be carried out as per the provisions of the Municipal Solid

Waste (Management and Handling) Rules, 2000 published by the Government of India in the erstwhile Ministry of

Environment, and Forests vide notification number S.O. 908 (E), dated the 25th

September 2000;

(ii) the local authorities shall draw up plans for the segregation of solid wastes into biodegradable and non-

biodegradable components;

(iii) the biodegradable material shall be recycled preferably through composting or vermiculture;

(iv) the inorganic material shall be disposed of in an environmentally acceptable manner.

(8) Bio-medical waste.-The bio-medical waste disposal in the Eco-sensitive Zone shall be carried out as per the

provisions of the Bio-Medical Waste (Management and Handling) Rules, 1998 published by the Government of India in

the erstwhile Ministry of Environment, and Forests vide notification number S.O. 630(E), dated the 20th

July, 1998.

(9) Vehicular traffic. - The vehicular movement of traffic shall be regulated in a habitat friendly manner and

specific provisions in this regard shall be incorporated in the Zonal Master Plan and till such time as the Zonal Master

Plan is prepared and approved by the competent authority in the State Government Uttar Pradesh or the National Capital

Territory of Delhi, the Monitoring Committee shall monitor compliance of vehicular movement as per the rules and

regulations in force.

(10) Interior and Exterior Lighting-

(i) Minimise use of bright interior lights during migration season;

(ii) promote dimming of exterior building lights during late night hours;

(iii) promote lesser use of glass in building façade to minimise the reflection of light during day and night; and

(iv) bright lights should be restricted and birds friendly diffused light during night should be promoted during

migratory season of the birds (i.e. 15th

October to 15th

March).

4. List of activities prohibited or to be regulated within the Eco-sensitive Zone.-All activities in the Eco-

sensitive Zone shall be governed by the provisions of the Environment (Protection) Act, 1986 (29 of 1986)and be

regulated in the manner specified in the Table below, namely:-

State of Uttar Pradesh and for the National Capital Territory of Delhi to be called the Monitoring Committee, for effective

monitoring of the Eco-sensitive Zone, as under:-

(i) Principal Secretary (Environment and Forest) - Chairman

(ii) Member Secretary, Central Pollution Control Board - Member

(iii) Member Secretary, Uttar Pradesh Pollution - Member

(iv) An expert in the area of ecology and environment - Member

to be nominated by the Government of Uttar Pradesh

for a period of one year

(v) One representative of Non-governmental Organisation - Member

(working in the field of environment including heritage

6. Terms of Reference.-

(1) The Monitoring Committee shall monitor the compliance of the provisions of this notification.

(2) The activities that are covered in the Schedule to the notification of the Government of India in the erstwhile

Ministry of Environment and Forest number S.O. 1533(E), dated the 14th

September, 2006, and are falling in

the Eco-sensitive Zone, except the prohibited activities as specified in paragraph 4 thereof, shall be scrutinised

by the Monitoring Committee based on the actual site-specific conditions and referred to the Central

Government in the Ministry of Environment, Forest and Climate Change for prior environmental clearances

under the provisions of the said notification.

(3) The activities that are not covered in the Schedule to the notification of the Government of India in the

erstwhile Ministry of Environment and Forests number S.O. 1533(E), dated the 14th

September, 2006 but are

falling in the Eco-sensitive Zone, except the prohibited activities as specified in paragraph 4 thereof, shall be

scrutinised by the Monitoring Committee based on the actual site-specific conditions and referred to the

concerned Regulatory Authorities.

(4) The Member Secretary of the Monitoring Committee or the concerned Collector or the concerned park in-

charge shall be competent to file complaints under section 19 of the Environment (Protection) Act, 1986 (29 of

1986) against any person who contravenes the provisions of this notification.

(5) The Monitoring Committee may invite representatives or experts from concerned Departments, representatives

from Industry Associations or concerned stakeholders to assist in its deliberations depending on the

requirements on issue to issue basis.

(6) The Monitoring Committee shall submit the annual action taken report of its activities as on 31st March of

every year by 30th

June of that year to the Central Government in the Ministry of Environment, Forest and

Climate Change as per pro forma given in Annexure-IV.

(7) The Central Government in the Ministry of Environment, Forest and Climate Change may give such directions,

as it deems fit, to the Monitoring Committee for effective discharge of its functions.

7. The provisions of this notification are subject to the orders, if any, passed, or to be passed, by the Hon’ble

Supreme Court of India or the High Court or National Green Tribunal (NGT).
