Minutes of 183rd NRC Meeting Held from 30th May to 04th June , 2011

The 183rd Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from 30 May 2011 to 4 June, 2011 at NRC, Jaipur.

In pursuance of the Gazette Notification No.213 dated 25.08.2010, NRC has been terminated under Section 21(2)(a) of NCTE Act, 1993 and the powers and duties on behalf of the Northern Regional Committee are being exercised and performed under Section 21(2)(b) by Shri Hasib Ahmad, former Member Secretary, NCTE.

The following member and convener were present:-

1. The applicant institution was given an additional intake of 100 seats of B.Ed. Course on 8th April 2008 for the session 2008-09. As such, it did not complete 3 academic sessions since then to be eligible to apply for an additional course (M.Ed). Since the institution applied in 2010 when it was not eligible to apply, the application is in violation of clause 8(3) of the NCTE Regulation 2009. The institution in its application did not mention the date of recognition of additional intake and thus concealed important information, due to which its application was

processed to this stage.2. The applicant submitted a

copy of the land document attested and identified by the Executive Magistrate. However, certified copy of the land document, to be issued by the registering land authority himself, as required under clause 7(1)(iv) of the NCTE Regulation has not been submitted. Even the earlier copy with application was ‘Attested and Identified’ by Executive Magistrate, which was not accepted on the same ground and letter of deficiency was issued.

3. The land use certificate submitted by the institution is one issued by an Advocate ‘Attested and identified’ by an Executive Magistrate. The certificate has not been issued by a Civil/revenue authority, duly notarized. As such, the CLU is not in accordance with the provision under clause 7(i) (VI) of the NCTE Regulation 2009.

Hence the committee decided to issue Show Cause Notice to the institution under section 15(3) (b) of the NCTE Act 1993 on the above points and directs the Institute to reply within 21 days.

1. The building plan submitted by the Society is that of the Om Maa Aadi Shakti K.V. Public School, which appears to be a Senior Secondary School. This Society proposes to conduct the D.EL.Ed. Course in the School premises itself, which is not permissible.

2. The total existing built up area of the building that houses the School is 1700 Sq. Mtrs. Thus

required built up area of 1500 Sq. Mtr. is not exclusively available for the D.EL.Ed. Course.

Hence the committee decided to issue Show Cause Notice to the institution under section 14(3) (b) of the NCTE Act 1993 on the above points and directs the Institute to reply within 21 days.

(i) The correction deed duly registered has been considered. The Khasra No. of the land is 90 and not 200. However, the institution had earlier mentioned Khasra No.200 in its application and in its building plan which do not match.

(ii) The Building Completion Certificate submitted by the Society is not in order. It does not mention the specification of the land and the total area constructed.

However, NRC decided to constitute VT, and the above correction and documents may be submitted to the Visiting Team.

Mtrs. is not exclusively available for the proposed Course.

Hence the committee decided to issue Show Cause Notice to the institution under section 14(3) (b) of the NCTE Act 1993 on above points and directs the Institute to reply within 21 days.

1. The Society has applied for recognition of two institutions for D.EL.Ed. Course and both of them are located at Shanti Nagar, Fatehpur. While this institution is named as Nivedita Singh Girls Degree College, the other one has been named as Yuvraj Singh Mahavidalaya. In both the institution only D.EL.Ed. Course is proposed to be started and as per application there are no other courses being conducted in either of the two institutions. NRC feels that opening of two institutions for D.EL.ED. Course in close proximity to each other is nothing but commercialization of Education, which NCTE is mandated to check under section 12(m) of the NCTE Act 1993. (VT Constituted for

other institution).(ii) The institution is a Degree College having BA level Courses, but this information has not been provided and concealed in the application, which is thus incomplete and liable to rejected.

In the building plan the applicant has added an area of 3612 Sq. Mtrs. for D.EL.ED. Course, but then this is not part of the plan comprising of Block A and Block B only, with a total area of 2399.29 Sq.Mtrs. only.

ii. The building plan submitted by the institution for its B.Ed. course is entirely different from the one submitted now for D.EL.ED. Course. Thus it appears that the building plans submitted is fake and for B.Ed. Course the Society got inspection done at some other institution.

iii. Since both the courses are in the same institution namely Ravindra Singh Samiti Mahavidalaya, Sahibapur, Gonda, the map of the entire institution with earmarked space for B.Ed. course and D.EL.ED. Course including common space for both the courses should have been submitted.

Hence, NRC decided to issue Show Cause Notice to the institution under section 15(3) (b) of the NCTE Act 1993 on above points and directs the Institute to reply within 21 days.

B NRC also decided that institution be asked to submit following documents for its existing B.Ed. course, for which a Show Cause Notice under section 17 of NCTE Act 1993 be issued for its existing B.Ed. course.

(i) A copy of the land document where the degree college building along with B.Ed. course is located.

(ii) A building plan of the existing degree college, earmarking space available for B.Ed. course and other course duly countersigned by the Executive Engineer of the Rural Engineering Deptt. Of Govt of U.P. in that area

(iii) List of faculty appointed by the institution during the last

3 years, along with the minutes of the Selection Committee that selected the faculty from time to time and a copy of the approval of the University for the appointments made.

1) The institution did not submit a certified copy of the land document, as obtained from the office of the Registrar Lands. A certified copy was obtained by the institution 25.02.2011, but again instead of sending the original, the institution submitted a photocopy.

2) The institution did not submit notarized copy of the CLU. Instead, it submitted a copy of the Khatauni indicating transfer of land in the name of the institution and its use for educational purposes on 18.03.2008. However, the Khatauni cannot be accepted in lieu of CLU, as the institution is new institution and transfer is claimed only on 18.03.2008.

3) The institution has given a building plan for a total built up area of 4000 Sq. Mtrs out of which 1500 is for the B.Ed. course and 2500 is for the D.EL.ED. course. The institution has not given the stage of construction of the building and actual area available for the D.EL.Ed. Course, as no B.Ed. course is being conducted in the institution. It, therefore, appears that the building plan may be fake, since the institution is not having any B.Ed. course, as per entries in the application form.

1) The institution has not submitted a certified copy of the land document. It appears that the institution obtained a Certified Copy of 25.02.2011, but still submitted its photocopy and not the original certified copy.

2) The institution has submitted a copy of the khatauni in lieu of the CLU. The khatauni clearly mentions that the land in question has been converted as non-agricultural, under section 143 of the land Act, but still the actual order declaring the land as non-agricultural has not been submitted. Since it is not the case of an old transfer but has been done only in March 2009; a notarized copy of the order issued under section 143 should have been submitted.

3) The institution is a degree college. However, no course other than the proposed D.EL.Ed. Course is being conducted in the institution in accordance with the entries’ in the application form.

4) In Case, the proposed course is to be located in the Mahavidyalaya building, a detailed building plan of the college giving area earmarked for its existing courses and that to be occupied by the proposed courses including D.EL.ED. should have been given.

1) The institution did not submit the certified land document issued by the competent registering authority. The document submitted in the reply is again a notarized photocopy of the land document which cannot be accepted in lieu of the Certified Copy.

2) The Society has submitted a copy of the ‘Khatauni’ duly notarized, which indicates that the land under khasara No. 435 and 436 has been declared as non-agricultural. However, a notarized copy of the orders of the SDM declaring the land as non-agriculture under section 143 of the Land Act has not been submitted. Since in this case declaration was made in 2004, a copy of the CLU duly notarized needs to be provided.

3) Building plan submitted by the institution is the copy of approved building plan but the plan duly approved and signed by the Bareily Development Authority has not been submitted. Moreover, the building plan does not indicate the total available area earmarked for existing B.Ed. and for the proposed D.EL.ED. Course, with common area to be used for both the courses. Since the name of the institution i.e. Jyoti College of Management Science and Technology Bareily, clearly shows that the institution may be having courses other than the B.Ed./D.EL.Ed. Course in the building. In case the proposed course is to be located in the college, a detailed building plan of the college giving area occupied

for existing course and that earmarked for proposed courses including D.EL.ED. Course should have been submitted instead of a separate building plan for D.EL.ED. Course.

4) The institution at the time of recognition for B.Ed. course submitted entirely different land documents and building plan, even though both the maps are in the name of Jyoti College of Management School and Technology. This precisely means that the institution has its B.Ed. course at some other place, and is applying for D.EL.ED. Course at another place or else the institution is submitting or submitted fake documents/ Building plan The institution could not clearly establish the availability of the prescribed built up area of 3000 Sq.Mtrs. for both the courses.

5) The institution is a multi faculty college but it did not indicate the existing courses in its application. Thus the application is incomplete and concealed important information to mislead NRC, and is liable to be rejected.


NRC also decided that a notice under section 17 of the NCTE Act may also sepertaly given for th existing B.Ed. course about non-availibilty of proper built up area as per NCTE Norms and availability of proper staff duly approved by the University.

1. The institution did not submit a certified copy of the land document, as obtained from the office of the Register Lands. A certified copy was obtained by the institution 25.02.2011 but again instead of sending the original document, the institution submitted a photocopy.

2. The institution did not submit notarized copy of the CLU. Instead, it submitted a copy of the Khatauni indicating transfer of land in the name of the institution and its use for educational purpose on 18.03.2008. However, the Khatauni cannot be accepted in lieu of CLU.

The Society has not given any details of the courses being conducted in their college. The institution needed to clearly establish that no other courses are being conducted in the building, as per entries in the application for the D.EL.Ed. Course. However, in case other courses are conducted the institution should have given this information and should also have given a detailed lay out plan of the college with clear earmarking of the built up area being used for existing courses and that available for the proposed courses including present D.EL.Ed. Course so as to clearly establish that the institution has the required built up area as per NCTE Norms.

However, since other courses are being conducted the institution concealed an important information and did not provide a detailed lay out plan of the college with clear earmarking of the built up area being used for existing courses and that available for the proposed courses including present D.EL.Ed. Course. Thus the institution failed to clearly establish that the institution has the required built up area as per NCTE Norms. By concealing this information institution misled NRC,made the application incomplete and thus the application is liable to be rejected.

The institution is a very old institution and is not in position of providing any proper land document, the whole history of the institution would be needed and the year of the first entry in the Khatauni along with the copy of old Khatauni if available would need to be provided, so as to clearly establish that the institution has been in existence in that building for a very long time. In any case the institution is required to establish beyond doubt that the land of the Madrasa where D.EL.ED. course is proposed has been in its possession and legally belongs to them.

3. The revised building plan submitted by the institution is again not acceptable as it is a photocopy of the land document on which area of the land and details of the land has been written in hand. This addition should have been countersigned by the Competent Authority which approved the initial building plan.

4. Moreover, the building plan of the Madrasa including the D.Ed. Course, did not clearly indicate the built up area currently being used for its existing Madarsa students and the space segregated and earmarked for the proposed D.El..ED. Course. The building plan should show the clear availability of 1500 Sq. Mtrs of land exclusively for the D.EL.Ed. Course, in addition to the existing space being used for Madrasa Course.

5. The institution did not submit a notarized copy of the CLU. A copy of the Certification by SDM/ ADM has been submitted which indicates that the Madarsa is in existence

on the stated land and the building is being used for the madarsa but no details as to the period since when the Madrasa has been in existence and why proper CLU cannot be issued/submitted has not been given .Moreover even this letter has not been notarized and only a photocopy has been submitted.

Moreover recommendation of the State Govt in this case needs to be obtained, in the context of existing availability of B.Ed. course and need for more B.Ed. Colleges in the State/Area, as the application is being treated as a fresh application on the orders of the of the Hon’ble Court.

Hence, NRC decided that RD, NRC needs to verify the veracity of the letter of GNIDA dt. 28.04.2005 and obtain recommendation of the State Govt of U.P.

The institution in order to establish that they have the required area of 1500 Sq. Mtrs. for the proposed B.Ed. course has now asserted that their entire building comprises of three wings and while two Wings are being used for their existing graduate level courses in Management disciplines and Journalism & Mass Communication, their third wing is entirely vacant and the B.Ed. Course is proposed to be conducted in this wing. They have further claimed that a total area of 3150 Sq. Mtrs is available in this wing, which is proposed to be utilized for B.Ed. Course. The claim suffers from following infirmities.

(i) The institution did not submit any blue print of the existing building so as to indicate the manner in

which wing ‘A’ and ‘B’ is being utilized, so as to establish that C wing is totally vacant. There is no indication to the effect that only A and B wings were shown to the University Inspection team for seeking recognition/affiliation to their existing courses.

(ii) The institution did not submit any blue print of the existing building with the detailed map of the C wing so as to clearly establish that the C wing has been constructed as per NCTE Norms and is suitable for a Bed course . This requirement of approved building plans is a pre conditions for consideration of applications vide clause 7(v) of the NCTE Regulation 2009. The proposed building plan submitted has no demarcation for ‘A’ ‘B’&’C’ Wings. Moreover, the total proposed built up area in the proposed building plans is 33,119 Sq. Mtrs. with floor wise area being 7012.11 Sq. Mtrs. on four floors and 6432 Sq.Mtrs. in the basement. Since the institution has constructed only 9575 (without basement) Sq. Mtrs., the institution should have provided a building plan of the building already constructed with detailed utilization pattern proposed in C wing for their B.Ed. course.

(iii) Clause 8(7)(ii) of NCTE Regulation provides, “The Society sponsoring the institution shall have to ensure that proposed teacher education institution has a well demarcated land area as specified by the norms. The teacher education institution shall not be allowed to have any other institution within its demarcated area or building and shall not have any other course(s) in its building”. The present composite building of the Society, without total segregation of ‘C’ wing is in total violation of this clause.

(iv) The existing courses conducted in the same building are B.B.A, B.B.A(Banking and Finance) BCA and Bachelor in Journalism, and Mass Communication. The applicant society did not provide the details of the enrolment under these courses so as to have a fair degree of assessment of the requirement of space for these courses, in the absence of a detailed space utilization of wing ‘A’ and ‘B’ of the institution. As such, NRC has no way to assess the claim that the ‘C’ wing is totally vacant for B.Ed. course.

(v) The NCTE Regulation 2009 also provides, “There shall be games facilities with a playground where there is scarcity of space as in the metropolitan towns/hilly regions, facilities for yoga, small court and indoor games may be provided”. The present building seems to have no such facility .

In view of the above, NRC came to conclusion that the reply to the show cause notice is not satisfactory and it failed to prima facie convince that the institution have a building suitable for B.Ed. course as per NCTE Norms. As such, recognition to the proposed B.Ed. course is refused under section 14(3)(b) of the NCTE ACT 1993.

1. The explanation of the institution

regarding usage of a block of school for the proposed D.Ed. Course has not been accepted. They denied that they are using the school block shown in the map for the D.El.Ed. Course. It cannot be accepted in view of an explicit observation of the Visiting Team that they were doing so. The reply also claims that the institution has made more construction for the proposed D.EL.Ed. course and this confirms the observation of the Visiting Team that they proposing the course in a Block of their existing school. It is thus clear that the institution tried to get recognition to a B.Ed. Course in its School building and is now in the process of construction of a block for D.EL.Ed. course.

2. The institution has simply denied other observation in the Show Cause Notice regarding size of room and orgainsing of Multipurpose Hall without any proof what over to establish its claim.

3. The institution after issue of the letter of intent under section 7(9) of the NCTE Regulation, did not made the selection properly and by following the due process of selection. Moreover, of faculty documents like advertisement and minutes of selection committee etc. were not found in order. The institution circumvented the process of selection; although it managed to get the approval of SCERT for the selecting made:- Infirmities in the selection/appointments of faculty were considered in detail in minutes of 170th (21-22 Oct 2010), 172nd (12-13 Nov 2010), 177th ( 27-29 Jan 2011) and the emergent meeting held on 20-22 April 2011 of NRC. The institution while responding to the observations of NRC in this regard in its minutes placed on the website of NRC, did not respond to the observations that it did not properly appoint the faculty but only prepared documents to obtain approval for appointment of its faculty.

As such, the institutions reply to the Show Cause Notices dt. 3rd Nov 210 and reply to in the observation of NRC on its emergent meeting of 20-22nd April 2011 has not been found in order. NRC therefore decided to refuse recognition to the institution for a D.EL.ED. under section 14(3)(b) of the NCTE Act 2011.

In case of Principal Dr. Rakesh Kumar, University’ approval has been obtained but Dr. Kumar does not posses 5 Yrs of experience of teaching at M.Ed. level. Hence he is not qualified to be appointed as professor.

2) Similerly Dr. Kavita Mittal appointed as Reader does not posses a minimum of 3 yrs of experience of teaching at M.Ed. level.

1. The institution submitted a building plan, indicating land details and dimension of various rooms. However, the building plan is not approved by any Civil Authority and has been signed by the Manangement.

2. The building completion certification is issued by Gram Pradhan but here again no details of land, built up area has been given. The certificate is dt. 02.07.2009. However, subsequent to issue of this certificate, inspection was carried out and the Visiting Team observation in this regard is very negative terming the certificate as false as the VT found the building being only of two storeye’s with built up area as 1135 Sq. Mtrs, contrary to the building plan having 3 storyes, with proposed area s 1692.34 Sq. Mtrs. Thus both the certificate and building plan do not depict the right picture, as

observed by the VT. The institution did not do anything after the VT to improve the facilities further.

3. The reply of the institution regarding sports faculty, Science Lab, Computers has been found satisfactory.

As such, institution be asked to clarify it position regarding exact built up area of the institution, which it may substantiate by a certification from Civil Authority of the Executive Engineerof the Rural Engineer Services Department of Govt of U.P.
