Below is the Motion Docket of Third Circuit Court for Friday, May 22, 2020. In light of the Order entered by the Tennessee Supreme Court on March 13, 2020 suspending in-person court proceedings, as extended by the TSC Order of March 25, 2020, the Third Circuit Court will entertain certain motions on Friday, April 24, 2020, as designated on the attached Motion Docket, via video conferencing. Please understand that this is the Court’s way of providing an avenue for litigants and attorneys to be heard on motions that the Court designates as priority matters. This in no way obligates either party to move forward on the motion and the Court will continue to liberally grant continuance requests. Please remember, we are here to help and to accommodate as much as reasonably possible. For those motions that do go forward, please note as follows: 1. The Court will conduct hearings on motions designated below by video conference. The docket denotes in blue which motions will be heard by video conference and in red those motions which have been continued by the Court. 2. If your motion is designated to be heard, please contact the Court’s staff to confirm your intentions to go forward on your motion, to provide a telephone number where you may be reached and to be provided details as to the hearing and video conference information. To participate in video conferencing it will require a download of the Jabber Guest App on the device that will be used for the conference call. Upon your call, a staff member will provide specific details. 3. In support of the underlying purpose of the TSC’s suspension of in-person hearings, 3rd Circuit Court will not require counsel and their client be together at the same location, but will allow counsel and their client to participate remotely. We understand that there are unique circumstances to everyone’s current situation and will not go forward with the motion if there is an objection by anyone. Remember that both you and your client need to have a copy of the exhibit and a copy should have been forwarded to opposing counsel. If the exhibit has been timely filed, it will be available to the court on the date of the motion, however a “chamber copy” forwarded to: [email protected] would be appreciated. For affidavits, sworn income and expense statements or other exhibits normally required to be notarized, the Court will allow a declaration as set forth under TRCP 72 to help facilitate the preparation of such sworn exhibits. Third Circuit expects to have the video conferencing capabilities available beginning with the March 31, 2020 uncontested divorce docket and all future hearings. 4. In the event an interpreter is necessary, the use of the State Trial Court interpreter, an interpreter approved by the Administrative Office of the Court or approved by the AOC guidelines is required for motion hearings and it is incumbent on the party requiring the interpreter to secure the same. Below is the Motion Docket of Third Circuit Court for Friday, May 22, 2020. In light of the Order entered by the Tennessee Supreme Court on

5. On Friday, May 22, 2020, the Court will do a first call through the docket beginning at 9:00 a.m. that will be captured on video recording in the

courtroom. The Court will call through the docket and announce motions that have been continued, stricken, agreed upon or marked ready.

6. After concluding the first call of the docket, the Court will commence video conferences. The video conferences will be initiated by the court

staff and be handled in the order designated by the Court. The Court will attempt to hear 1st call matters taking less than 5 minutes first, 2nd call matters

taking less than 10 minutes next and 3rd call matters, which shall be limited to a total of 20 minutes, next. If you anticipate your motion will take longer

than 20 minutes total, please contact the Court by Thursday, May 21, 2020 by 12 o’clock noon for a special setting. All video conferences will take

place in the courtroom, with a video recording to create a record of the hearings. If you suspect the Court may not have the telephone number where

you can be reached to notify you when to check in on the video conference, please make sure to forward your number to the Court by 12:00 noon on

Thursday, May 21, 2020.

7. Attorneys and Pro Se litigants are still encouraged to communicate prior to the motion docket to try to reach an agreement on any pending

motions. The Court will continue to accept announcements for agreed orders, continuances and strikes. Again, the Court is liberally granting

continuance requests.
