Concerned over theincreasing number ofhuman lives lost in roadaccidents. the Madras HighCourt on Monday directedthe State government tomake wearing og helmetmandatory for two-wheelerriders from July 1.

It also directedofficials to install CCTV at junctions andalong roads to monitor the implementationof the order.

Passing order on a civil miscellaneousappeal, which challenged an order of MotorAccidents Claim Tribunal, JusticeN.Kirubakaran. directed the HomeSecretary, and the DGP to inform the publicthrough media that wearing of helmet wascompulsory for two-wheeler riders from July1 under section 129 of the Motor VehiclesAct 1988.

Failing to do so would result in theimpounding of the riders documents.including the driving license.

Once impounded documents, thedocuments would be released only onproduction of a new ISI-certificate helmet

with the purchase receipt, thejudge said.

The authorities shouldsuspend the driving license of therider and cancel it after holding anenquiry. The State Governmentshould keep the court informedevery two months about thenumber of cases filed againstviolators.

However, the court asked the policeauthorities, not to misuse this order to causeunnessary hardship to riders and give roomfor an allegation of corrupt practice. The judgealso directed the Surface Transport Ministryto go in to the details of the design of the helmetto provide visibility on the sides as well as inthe front and directed the Ministry to ask allStates to monitor if the order was beingcomplied without fail.

It was really disheartening to note that anumber of lives were lost because two wheelerriders were not wearing helmet.

The pathetic position was inspite ofjudgements given by the Supreme court andvarious High Courts. The judge said 6,419persons lost their lives last year in Tamil Nadualone.
