The tail is wagging the dog!

I can’t even pretend to understand thegoing’s on at the Utah Legislature. Onehears our representatives use the inane OttoVon Bismarck quote, “Laws are likesausages, it is better not to see them beingmade”, or you’ll hear the absurd statementthat “it’s just the way the legislature works”,as if that means anything. The goal seemsto be to leave their constituents in confusion,hoping they will throw their hands in air,letting them go about their businessundisturbed. Well guys, news flash. Wewould all like nothing better than for ourlegislators to go about transacting thepeoples business. Which, is of course whatthey were elected for in the first place. And,most of us would love to be able to trustthem to do that. Let the big unruly mutt doits job.

However, having followed the UtahPawnshop and Secondhand MerchandiseTransaction legislation the past couple ofyears, it’s become obvious that this big mutthas a tail, and it’s waggling many legislatorsback and forth. They appear all too often tobe at the tails beck and call. In this case, themetaphoric tail is lobbyists representing thePawnshop industry. Sources tell me that(Senate bill) SB212, the 2010 amendment tothe underlying pawnshop law, was writtenin its entirety by lobbyist Rob Jolley (whorepresents Utah pawnshops) and his staff.The bill was ultimately carried by SenatorJon Greiner, using what’s called a “boxcar”bill (bills with general titles, like “taxchanges”, but containing no text orlegislation), which are usually introducedin case an issue arises beyond normal filingdeadlines. This is a handy little trick if yourobjective is to avoid scrutiny early in thesession. Greiner, one of the senates “bigdogs” was definitely wagged by the tail.When ask about the bills contents, theSenator responded that he didn’t know yet,having not yet read the bill. SenatorGreiner’s “sausage” seems to be giving offa foul odor.

Perhaps with Utah’s short legislativesession, it may be appropriate for lobbyiststo play a roll in helping inform and educateour legislators about the myriad issues onwhich they must make decisions. There ishowever, a vast difference betweenlegislators seeking information, and totallyabdicating their responsibilities. We have

PROVO CITY SHOPSlobbyists writing our laws, and electedrepresentatives pushing them through, asif they were nothing more than theirlackeys. The tail is definitely wagging thedog. There’s little wonder that citizenshave come to abhor this cozy relationship.

Let’s get one thing clear. Rob Jolley doesnot represent the interests of Utah businessnor its citizens; he is the mouthpiece ofUtah’s pawnshop industry.

The danger here is that once the lobbyisthands his bill off to a legislator, it churnsthrough the legislative process under theguise of the peoples business, without thestigma associated with special interestgroups. With the support of very fewlegislators, the bill can quietly work its waythrough a “friendly” committeeassignment, be sent to the floor with arecommendation for passage, and goneunchallenged, receive a near unanimousvote on the floor. This has been the roadthe Utah Pawnshop and SecondhandMerchandise Transaction amendments havetaken over the past few years.

In recent months, I’ve had the opportunityto talk with a number of legislatorsregarding the pawnshop bill. There havebeen 3 prominent themes. First, most hadnever read the legislation. It’s nearimpossible for legislators to read each of thehundreds of bills filed each session. Second,with no organized opposition to the law,they had cast their votes based oncommittee recommendation. Third, giventhe chance for open discussion of the issue,most shared our conclusion that antiquesshops, secondhand and coin dealers did notwarrant inclusion under this law.

The time has come for every business whichhas been included under these pawnshopregulations, along with those who are stillin the pawn industries sights, to organizeand actively work to put an end to thisnonsense. The 2010, pawnshop lobbywritten amendment to the underlyinglegislation made one clear point. The intentof next year’s amendment is to include everybusiness dealing with secondhandmerchandise under the same regulation aspawnshops. During the last legislativesession, a member of Jolley’s pawn lobbystaff, had the gall to state that next year,antiques shops would lose their exclusion,and be under the law. Excuse me; I wasunder the illusion that our representativesmade those decisions. Clearly the pawnlobby hopes to wag the dog’s tail again nextyear. We all need to get involved to seethat it doesn’t happen.

Walter Larsen Spring Antiques Show features local dealers

As always, the Spring installment of the Walter Larsen Original Salt Lake Antiques Show & Sale chased out the winter blues, and brought a little Razzle Dazzle into the valley. Presented at the South Towne Expo Center, the place was hopping with dealers from through-out the west, hocking their finest wares to an enthusiastic crowd of collectors. Not to be outdone by the traveling medicine show, local dealers turned out with a matching assortment of fine antiques, collectibles and decorative objects. I had a chance to stop by and chat with a few of them, and found spirits high in anticipation of a rewarding weekend.

Objects’ d’Art: Valuable small items thatcannot be classified under other headings.

Ogee: (Cyma Reversa) a molding consistingof a double curve, convex above and concavebelow.

Ogee Bowl: A favored shape for the bowl ofdrinking glasses in the second half of theeighteenth century. The bowl curves outfrom the stem, then in a little and then outagain-like an elongated S.

Okawachi: Japanese porcelain factory nearArita; founded in the mid-seventeenthcentury; made stoneware and porcelain.

Olivewood: A close-grained wood ofgreenish yellow color that was used forparquetry, particularly during the late Stuartperiod.

Omnium: A Whatnot (q.v.).

Opaline: Semi-translucent milk white glasswhich glows when held up to light.

Opaque-twist: Glass Stems (See Latticino.)Came into favor about 1745 and stayed theretill the end of the century.

Ormolu: Bronze, or brass of high puritycontaining an admixture of zinc, cast inornamental forms and gilded; the useparticularly favored by the French forfurniture mounts, clock-cases, vases,candlesticks, chandeliers. (See next entry.)

Or Moulu: gilt made from a fusion of finelyground gold with mercury, which came tomean the gilded metal itself, ‘ormolu’.

Orrery: A mechanism representing themotions of the planets round the sun,invented by George Graham, c. 1700, andnamed after Charles, Earl of Orrery, forwhom a copy of the invention was made.

Ottoman: A backless upholstered sofa inwhat English cabinetmakers of the lateeighteenth and early nineteenth centuriessupposed to be the Turkish manner. Usually

the term is used to describe what is littlemore than an upholstered stool.

Ouchak Rugs: From the great weavingcentre of Ouchak in Asia Minor; valuablespecimens can be found dating back to thesixteenth century. The earliest havemedallion and Turkish scroll designs;‘White’ Ouchaks with white or ivory grounddate from the seventeenth century. Can bevery coarse (sixteen to seventy-two knots)but extremely durable and of carpet size.

Outside Decorators: Independent specialistsin the decoration of porcelain to whom thefactories sent their wares in the ‘biscuit’state for painting, enameling and gilding.Some Outside Decorators purchased theundecorated porcelain; others solicitedwork.

Over-glaze: Decoration applied to potteryand porcelain after glazing.

Overlay Glass: See Cased Glass.

Ovolo: A convex molding of which thesection is a quarter circle. The popular termis ‘quarter-round’. Ovolo moldings withegg-and-dart enrichment was a favoredornament on furniture in the sixteenth andseventeenth centuries.

Owl Jug: Jug in the form of an owl; thedetachable head is a cup. Made inearthenware (and stoneware) from as earlyas the mid-sixteenth century in Germany,and a popular Staffordshire product of theeighteenth century.

Oyster Veneer: Veneer made up of discs(cross-sections) of wood cut from branchesof trees and laid together as parquetry.Finely grained light-colored woods wereused

Soundtrack: Eddie and the Cruisers (John Cafferty and the Beaver Brown Band)

As a rule, I don’t care much for movie soundtracks. More often than not, they tend to be a rehash of old rock & roll, Broadway musicals or other popular material, trading on the creativity of musical artists to evoke familiarity or elicit positive reactions to the film. There are of course exceptions, one of my favorites being the soundtrack from the 1983 embassy pictures film “Eddie and the Cruisers”. I can’t say I loved the movie. Although a bit predictable and hokey, it’s still not a bad way to spend a couple of hours on Sunday afternoon. But I did love the original music. Contrary to Oscar Wilde, I’m not sure this story of a New Jersey bar band isn’t more art imitating life, than vise versa. Providing the original music for the saga of Eddie Wilson was John

Cafferty and the Beaver Brown Band, itself, a 1970’s / 80’s Rhode Island bar band. Although the Cruiser’s story chronicled the evolution of a 1950’s band into 60’s acid rock, the sound track created by Cafferty was more Springsteen-esque, reflecting the popularity of the New Jersey rocker during the early 80’s. John Cafferty wrote and performed 10 original songs for Eddie and the Cruisers, with the soundtrack album from the film reaching the top 10 on Billboard and producing a #7 hit single hit (On the Dark Side). Cafferty’s work on Eddie and the Cruisers would bring his band national attention, leading to the group's 1985 follow-up album Tough All Over. Although a song from that album (Voice of America's Sons), was featured on the soundtrack of the Sylvester Stallone movie Cobra, Eddie and the Cruisers would remain the only true bright spot in an otherwise journeyman career. Over the next few years, the Beaver Brown Band would make several fruitless attempts to cash in on the Eddie and the cruisers connection, but in the end, would fade from sight.
