PETITION FOR REVIEW AND REQUEST THAT PETITION BE HELD IN ABEYANCE

The New Jersey Division of Rate Counsel, the Office of the People's

Counsel for the District of Columbia, the Maryland Office of People's Counsel,

and the Delaware Division of the Public Advocate ( collectively, "Petitioners"),

hereby each petition this Court, pursuant to Section 313(b) of the Federal Power

Act ("FPA"), 16 U.S.C. § 825/(b), and Fed. R. App. P. 15(a), for review of a final

order, issued by the Federal Energy Regulatory Commission ("FERC" or

"Commission"). The order as to which review is sought was issued in FERC

Docket Nos. EL16-49-000 and EL18-178-000 (consolidated). The order is:

Calpine Corp. v. P JM Interconnection, L.L. C., 169 FERC ,r 61,239 (2019) ("December 19 Order" or "Order").

A copy of the December 19 Order is attached hereto as Exhibit A to this petition.

The jurisdiction and venue of this Court is established by FP A Section 313(b ), 16

U.S.C. § 825l(b).

The Court should be aware that on January 21, 2020, Petitioners timely

requested rehearing of the December 19 Order. On February 18, 2020, the

Commission issued an "Order Granting Rehearing For Further Consideration," or

"tolling order," in which the Commission purports to afford itself additional time

to consider all timely filed requests for rehearing of the December 19 Order. 1

Petitioners understand that under the current precedent of this Circuit, issuance of

the Tolling Order may render the instant Petition premature and subject to

dismissal without prejudice. See Cql. Co. v. FPC, 411 F .2d 720 (D.C. Cir. 1969).

But, guided by this Court's admonition in Eagle-Picher Industries Inc. v. EPA,

759 F.2d 905 (D.C. Cir. 1985), this Petition is being filed out of an abundance of

caution.2

v. FERC, No. 17-1098, is the issue of "whether the Natural Gas Act [''NGA"],

and specifically 15 U.S.C. § 717r(a), authorizes [FERC] to issue tolling orders

that extend the statutory thirty-day period for Commission action. on an

application for rehearing."3 The Court in Allegheny Defense may overrule

California Company and its progeny, and find FERC unable through the issuance

of tolling orders to grant itself extensions of time to act on requests for rehearing

beyond the thirty-day time period set forth in 15 U.S.C. § 717r(a). Should the

Court issue that ruling under 15 U.S.C. § 717r(a), that determination would

almost certainly mean that FERC cannot do so under the counterpart provision of

the FPA, 16 U.S.C. § 825/(a).4 If such a determination were accorded retroactive

application, 5 then the Tolling Order would be a nullity, Petitioners' request for

and the sixty-day time period for Petitioners to seek judicial review of the

December 19 Order would have begun on February 21, 2020. 7

The matters at issue in the December 19 Order are of great import. 8

Petitioners have filed this protective petition for review because of a concern that,

in these circumstances, awaiting further Commission action before seeking

judicial review of the December 19 Order could result in a loss of Petitioners'

rights to do so.
