1. Purpose.This regulation establishes policy and responsibilities for use of DOD construction agents in the design or construction of militaryf acilities, including military f amily housing, in accordance withDOD Directive 4270–5 (app A). Geographic areas are designated tospecific construction agents in appendix A. Functional area of re-sponsibility for DOD construction agents include:

a . . M ilita ry c o n s t r u c t i o n pr o j e c ts ( i n c lu d i n g m i l i t a r y f am i l yhousing) contained in the annual Military Construction Authoriza-tion and Appropriation Acts.

b . D e s i g n a nd co ns t ructi o n a s sis tance f o r U n s p e c if ied Mino rConstruction and Operation and Maintenance (O&M) type repair

and improvement upon request of DOD agencies.c. Design and construction assistance for facilities requirements

upon request of non–DOD agencies (including nonappropriated fundsponsors).

2. Applicability.This regulation applies to—

a . A ll e l e ments o f the Ac t i v e A rm y, A rm y N a t i o n a l Gu a r d(ARNG), the US Army Reserve (USAR).

b. The acquisition of military facilities, including military family

housing, and certain ARNG and USAR facilities within the 50

United States and District of Columbia.

c. The acquisition of military facilities, including military family

housing, outside the United States.

3. Responsibilities.

a. The Chief of Engineers will establish policy and procedures to

provide DOD construction agent service in the 50 United States, the

District of Columbia, and in assigned geographic areas of overseas

locations.

b. . Commanders of major Army commands and heads of USARand ARNG elements will—

(1) Use services of the appropriate DOD construction agent in

accordance with provisions of appendix A.

(2) Submit request for approval of Assistant Secretary of Defense

(Manpower, Reserve Affairs, and Logistics), for use of other than a

designated DOD construction agent, to HQDA (DAEN–MPC–C),

WASH, DC 20314.
