Issue 18 - January 2019 Brussels Privacy Hub Newsletter On 30 January 2019, the Brussels Privacy Hub together with the Future of Privacy Forum will host an official CPDP side event named "Digital Data Flows Master Class: De-Identification, Differential Privacy, and Homomorphic Encryption". Participants will gain an understanding of: what it means to identify individuals in datasets; how to reduce risks of re- identification through anonymization and pseudonymization; what is involved in common re-identification attacks; and how data holders are using methods such as differential privacy (a statistical technique), and homomorphic encryption (an advanced computation method), to gain insights about data without identifying individuals. No technical background is needed. On1February2019,theBrusselsPrivacyHubtogetherwithPANELFIT(ParticipatoryApproachestoaNewEthicaland Legal Framework for ICT) will host a panel on"Health data and AI in clinics and research: legalbasis,transparencyandaccountability".Thepanelwilldiscuss thekeychallengesofhealthdataprocessing in clinics and research under the GDPR andbeyond: in particular, how to balance the protection ofpatients/datasubjectswith the interestsofmedical research.Relevant elements to consider are lawfulness, transparencyand accountability. As regards lawfulness, it is necessary toexplorethelimitsofinformedandfreeconsent(inparticularin the case of data monetisation or where secondary datasubjectsareinvolved)andtheopportunitiestoavoidconsentrequests (e.g. because of “public interests”). On27November2018, theBrusselsPrivacyHub andtheFutureofPrivacyForum(FPF) organised the secondsessionoftheDigitalDataFlowsMasterclass:EmergingTechnologiesonLocationData:GPS,Wi-fi,andSpatialAnalytics. The successful event involved opening remarksby Hub Co-Director PaulDeHert (LSTS, VUB) and JulesPolonetsky (CEO, FPF), and presentations on geo-locationdata and de-identification methods bySimonHania (DPO,Uber), on mobile sensors and Wi-Fi analytics, by StaceyGray (Privacy Counsel, FPF) and on location data flows byKaraSelke(VPofPrivacy&DataPartners,StreetLightData)who used case studies to facilitate the discussion. On 27 November 2018, the Brussels Privacy Hubwas organising a full-day workshop on “Big Data andCybersecurityinChinaandtheEU:Identifyingpointsofconvergenceandfuturecooperation”.Theworkshopelaborated upon the notions of BigData andCybersecurity,asperceivedandusedinChinaandintheEU.Theworkshopwas attended by EU and Chinese high-profile expertsspecialistsinthefieldsofcybersecurityanddataprivacylaw.It was organised with the support of the VUB ConfuciusInstitute,underits2018callforresearchactivities.

On 30 November 2018, the Brussels Privacy Hubhosted a lunchtime debate on “The copyright directiveandconcernsforfreeexpression,bigdatainnovationand access to information”. The debate, moderated byJens-Henrik Jeppesen (Centre for Democracy &Technology),featuredcontributionsbyRaeganMacDonald(Mozilla) and Aleksandra Kuczerawy (KU Leuven) andfocusedontheproposalforanewcopyrightdirectivebytheEuropean Commission that is currently undergoing triloguenegotiations. Within this proposal the focus was on threeprovisions that could potentially have long-term effects onfreedomofexpression,bigdataandfreedomof information,namelyArticle3 (textanddataminingexception),Article11 (press publishers’ right) andArticle13 (upload filters).Findasummaryofthedebatehere.

TheVUBresearchchair“DataProtectionOntheGround”(DPOG) promotes the investigation into actual practices ofdata privacy in organisations and the dissemination of bestpractices.Thefocusofitsresearchisondevelopmentsinfoursectors: smart cities, health,media, and banking. The Chairholder is Prof. Jo Pierson, the doctoral researcher is Mrs.Ine van Zeeland and the research is coordinated by theresearch center imec-SMIT (Studies onMedia, Innovation &Technology), in collaboration with the research group LSTS(Law, Science Technology & Society) and Mr. WillemDebeuckelaere (President Data Protection Authority). TheChairwas established in partnershipwithBNPParibas Fortisandlaunchedatanopeningeventon13December2018incollaborationwiththeBrusselsPrivacyHub.

On 17 December 2018, the Brussels Privacy Hubhosted the sixth event in theMeet the Author Serieswith Philipp Hacker (Humboldt University of Berlin/WZBBerlinSocialScienceCenter)discussinghisarticle“TeachingFairness toArtificial Intelligence:ExistingandNovelStrategies against Algorithmic Discrimination underEULaw”. On14January2019,theBrusselsPrivacyHubVisitingScholar, Dr Monique Mann, presented her research whichexplores the developing policies of the ‘Five Eyes’ (FVEY)surveillancepartnershipwithregardstolawenforcementandintelligence agency attempts to access encryptedcommunicationsinaseminartitled"AssAccess’butnot‘a backdoor’?: The Five Eyes’ War On Maths". Theresearch which will also lead to a Working Paper in theBrusselsPrivacyHubWorkingPaperSeriesexamineskey issues including impacts on privacy and informationsecurity, issues of mutual legal assistance and transnationaldata flows, and oversight (or lack thereof) of the newpowers. Prof.ChristoperKunergiveslectureinTokyoIn November 2018, Prof.Christopher Kuner gave two lectures inTokyo,Japan.Thefirstwasakeynotespeechattheconferenceon the EU General Data Protection Regulation (GDPR) hostedbytheJapanesedataprotectionauthority(PPC)on20November;theprogramme is available here (in Japanese). The second was held atKeioUniversityLawSchoolattheinvitationofProf.KatsuhiroShojion22 November, and was entitled “The Internet and the GlobalReachofEULaw”(inJapanese).

Prof. Vagelis Papakonstantinou appointed amember of the Greek GDPR implementationlaw-makingcommitteeBrussels Privacy Hub member Vagelis Papakonstantinou hasbeenappointedamemberofthelaw-makingcommitteedraftingthe GDPR (and the Police and Criminal Justice Data ProtectionDirective) implementation law in Greece. The law-making committee,establishedunder theGreekMinistry of Justice, has been in sessionsince2016buthasnotbeenabletoproduceafinallegislativeactyet,although public consultation has already taken place on a previousdraft.UnderitscurrentmandatethecommitteeneedstoconcludeallrelevantworksuntilendofFebruary2019.
