1 I am taking this opportunity to introduce my country Balawaristan (Pakistan and China occupied Gilgit Baltistan, Chitral and Shenaki Kohistan) and enlighten the readers about these regions of great geographic and strategic significance. BRIEF HISTORY Before 6 BC a well flourishing and prosperous state of Brooshaal existed under the rule of Brooshaaski Speaking people, who lived mostly in Yasen (Yasin), Nagir and Hunza. After the decline of the ancient state of Brooshaal, a new state Bloristan was established by Balti speaking people, which subsequently spread out from Tibet, Ladakh to Chitral. Today this area is under the occupation of China, Afghanistan and Pakistan. A local famous indigenous king Shri Buddat, extended his kingdom from Gilgit to Chitral, Yasen (Yasin), Tangir, Darel, Chilas, Gor, Astor, Hunza, Nagir up to Skardu. Later the foreign invaders hatched conspiracy with some local Darbari Traitors and occupied his kingdom after killing Shri Buddat and then maligning him, naming him a

men-eater, in a bid to control his kingdom forever.The ancient name of this side of Hindu Raaj (Southern Mountain Ranges of Gilgit Valley) was corrupted from the original Sargin to Gilit, which was corrupted in to Gilgit with further passage of time. The remains of pre-history stone circles, ancient stone buildings and Buddhist carvings suggest that Gilgit was once the seat of a Buddhist or Hindu dynasty, while traces of abandoned cultivation on higher altitudes point to the fact that the population in early times was far larger that it is today. After its reins passed through the hands of many rulers, Sulaiman Shah, Tham (Ruler) of Yasen (Yasin), conquered Gilgit in 1823. Shah Sikandar, the Tham (Ruler) of Nagir and Gilgit, was killed by Gohar Aman, ruler of Yasen (Yasin). Then in 1842, the cousins Bodol and Badang, both Generals in the forces of Gohar Aman, from Yasen, along with Sarbaland Khan of Yasen Thooi, defeated Sikh forces led by Mathuradas completely in Biyahrchi, the frontier between Gilgit and Poonyal. Gulab Singh of Jammu and Kashmir replaced Sikh forces with Dogra troops in Gilgit after the treaty of Amritsar in 1846, but their occupation was short-lived and they were soon driven out from Gilgit by Gohar Aman of Yasen.When Hunza was attacked in 1848, both Nathu Shah and Karim Khan were killed, and Gilgit fell to Yasen (Yasin) and Gohar Aman, the Tham (Ruler) of Yasen, repelled Sikh Forces headed by Bop Singh in 1852. Gohar Aman also ruled Gilgit until his death in 1860. The so-called Gilgit Agency was established in 1877 by British government as a bulwark against the advance of Imperial Czar of Russia. It comprised the Gilgit Wazarat, Nagir, Hunza, Punyal Jagir, Yasen (Yasin), Kuh-Ghizer, Ishkoman, and Chilas.In 1935, the British leased Gilgit Agency and the states Nagir, Hunza, Yasen (Yasin) and Ishhqamen (Ishkomen) from the Maharaja of Jammu and Kashmir for 60 years. The leased region was then treated as part of British India, administered by a British Political Agent inGilgit. Before the division of Indian sub-continent and princely states, the British Empire decided to hand over the charge of tiny states such as Yasen (Yasin), Punial (Pooya), Gupis (Goopechh), Ishkoman (Ishhqamen), Gilgit, Nagir, Hunza (Kanjut), Astore and Chilas to the Maharaja of

Kashmir. Before 1860 Mestuch (now became a part of Chitral), Gupechh and Ishhqamen were also integral parts of Yasen. After the murder of British spy Col. George Hayward in 1873 by Yasen ruler Mir Wali, differences broadened between the State of Yasen and the British government. As a revenge for Hayward’s death, the British dissected Mestuch, Koh Ghezer, Gupis and Ishhqamen from Yasen. Shhenaki Kohistan up to Koli were also part of Chilas (Gilgit Agency) while Rundu, Kharmang, Skardu and other semi- independent kingdoms of Ladakh and Astore were placed under the direct control of Maharaja of Jammu & Kashmir.The British Empire was also given a part of Yasen from Barenas to Shandoor and Broghol to Chitral. Meanwhile Chaqansarai in the Wakhan corridor was passed to Afghanistan and a large part of Hunza passed to China as the British tried to keep the Russia and China away from its Indian boundaries.This Area of over 2 million inhabitants spread over 100,000 Sq. Kms, came under Pakistan’s control as a result of local uprising against the then Maharajah (Ruler) of Jammu & Kashmir, used by Pakistan to occupy the territory on the pretext of providing administrative support to the newly born Muslim neighbor state. This happened on 16th November 1947, just 15 days after Gilgit claimed its independence. Later Pakistan maintained its hold by dividing the people on sectarian lines. This is the world’s most beautiful as well as most deprived and neglected part of the region.

GEOGRAPHYGilgit Baltistan borders the Wakhan corridor of Afghanistan, Badakhshan province to the northwest, China’s Xinjiang Uyghur Autonomous Region, the Indian-controlled state of Jammu and Kashmir to the south and southeast, the Pakistan occupied Jammu and Kashmir to the south, and Pakistan’s North-West Frontier (newly Khyber Pokhtonkhowa) Province lies to the west. Gilgit Baltistan is home to approximately 2 million people and 8 of the world’s highest peaks towering above 7000 meters, with the only exception of Mount Everest of Nepal. Amongst the highest mountains are K2 (Mount Godwin-Austen) and Nanga Parbat, the latter being one of the most

treacherous mountains in the world. The region also has some of the world’ shighest mountain ranges, the main ranges being the Karakoram,Himalaya and the Hindu Kush which lies to the west. Three of the world’s longest glaciers outside the polar regions are found in Gilgit Baltistan, the Biafo Glacier, the Baltoro Glacier, and the Batura Glacier. There are, in addition, several high altitude lakes in Gilgit Baltistan.World’s highest polo ground Shandoor and world’s highest altitude plain Diwasei are also situated in this region. CLIMATEThe climate of Gilgit-Baltistan varies from region to region, as surrounding mountain ranges create sharp variations in weather. The eastern part has the moist zone of the western Himalayas, but going toward Karakoram and Hindu Kush the climate dries considerably. There are towns like Gilgit and Chilas that are very hot during the day in summer, yet cold at night, and valleys like Astore, Khaplu, Skardu, Yasin, Ishkomen, Gupis, Darel, Hunza, and Nagar where the temperatures are cold even in summer. The maximum temperature goes up to 40C in summer in Chilas and Gilgit and in winter it drops below minus 30C in Astore, Khaplu, Skardu, Yasin, Ishkomen, Gupis, Hunza, Nagar and Chitral and other parts of Balawaristan. SPORTPolo is the favourite game of the people of Gilgit (Gilit), Skardu (Askardoo), Khapulo, Chilas, Yasin (Yasen), Punyal, Nagir, Astore, Chitral and the surrounding areas. Many tourists visit to enjoy polo in Gilgit Baltistan. LANGUAGESLanguages spoken in Gilgit Baltistan, Chitral and Shenaki Kohistan:The population of this area is a mixture of many ethnic groups like natives Brooshoo,Yashkuns, Balti, Kho, Shhen, Wakhi, Kashmiris, Gurjor, Kashgaris, Pathans and Kohistanis. Shia & Sunni along with Ismailis and Noorbakhshia form the main religious groups. The Shina language (with several dialects) is spoken mainly in Gilgit, Punyal, Astore and throughout Diamer, and in some parts of Goopechh (Gupis) and Ishhqamen (Ishkomen). The Balti dialect, a sub-dialect of Ladakhi and part of Tibetan language group, is spoken by the entire population of Baltistan.

Brooshaaski is an isolated language spoken in Yasen (Yasin), Nagir and Hunza (Kanjoot) and some parts of Gilgit and in some villages of Punyal and Srinagar of Kashmir. Khowar is mainly language of Chhitrar (Chitral) but it’s also spoken in Goopechh (Gupis), Ishhqamen (Ishkomen) and some villages in Yasen (Yasin) of Ghazer district. Minor languages are spoken in the region including Wakhi in upper Ishhqamen (Ishkomen) and upper Hunza. Another interesting language is Domaki, which is spoken by the musicians in the region. Gojri also spoken by a small clan of Goojoor, scattered in different areas of this region, who graze cattle on high-altitude pastures. Some Pakistani settlers also speak Pashto, Punjabi and Hindko (Hazarwal). This region has been linked with Jammu & Kashmir by UNCIP resolutions in spite of its unique culture, Traditions, Languages and History.

NATURAL RESOURCES

The land which lies amid world’s eight highest towering mountains (except Mount Everest), snow-clad peaks , mighty glaciers second to the North Pole and narrow lush green valleys with heights varying from 8000 feet to 28,750 feet above the sea level, covers about 28000 square miles area. God has blessed this paradise of earth, by huge water resources, large variety and best quality of fruits, forests, beautiful lakes, rivers, springs, largest glaciers and numerous minerals. This fulcrum of central Asia is a living paradise on earth, which has abundance of natural resources, of which some are described below. 1.MINERALSThere are mines of Uranium 238, Ruby, Emerald, Topaz, Quartz, Iron, Marble, Sulphur, Alum and Oil; besides, Silver and a huge quantity of highest quality of Gold mines are found in this disputed region. According to a joint report of the Australian Agency for International development (AUAID)and Pakistan Mineral Development Corporation (PMDC) in 1995, there are 1480 gold mines in this area, out of which 123 are many times pure than the world famous mines of South Africa. The quality of South African gold mines is 20 to 31 parts per million (ppm)while 123 gold

mines of Balawaristan have 112 to238 ppm. Only a seventy of those mines in Balawaristan were estimated of worth 500 trillion dollars. The net worth of remaining 1410 gold mines is still to be estimated. If only the wealth of these 70 gold mines is distributed among the 2 million people of Balawaristan the share of each person would be 1.25 billion rupees per year for years. If the mines are used for 100 years, the share per head would only decrease to 1.25 million rupees per annum.Ambassadors and investors arrived in Skardu for a two-day Conference on Friday from 14-16 May 2010, would explore the untapped potential of the highly natural resources-rich region, mainly for tourism, hydro power, minerals and foods. The diplomats were from different countries like Russia, Italy, Bulgaria, Hungary, Romania, Korea, Bahrain, Iran, Turkey, Brunei, Tunisia, Jordan, Kenya, Nepal, Afghanistan, Bangladesh, Philippines and Malaysia. LOCAL ResentmentCancelling massive leases given by General Musharaf regime to China, Pakistan and other countries, was the demand of Pakistan Gems Stones and Minerals Association and the Chairman of Legal Committee for Minerals and Development, Mr. Sifat Shah. Gilgit Chambers of Commerce President Mr.Javed Hussain and Import and Export President Mr. Mohammad Ali Qaid cleared that the local traders have nothing to do with the Ambassadors Conference in Skardu, because they have not been taken into confidence. The episode was the aim of the so-called Chief Minister Mehdi Shah who is not an indigenous man and who is playing the game of Pakistani conspirators, the Chamber of Commerce Lahore. This is the design of Pakistani colonial power to snatch the natural resources by giving some personal benefits to Mehdi Shah and his company by neglecting the whole population of Gilgit Baltistan. The honourable Ambassadors of Russia and others should realize that, being members of UNSC and UN they should honour UNCIP resolutions regarding this disputed part of Jammu & Kashmir, where Pakistan has no legal stand according to the UN resolutions. We do support investment from foreign countries, but this should not be dealt with Pakistanis and their puppets, unless the reign is in the hands of local indigenous people. NOTE :- Greedy Pakistani occupants had planned to exploit these precious gold mines with the help of AUAID and its corrupt PMDC.

According to the agreement of Pakistan with Australia, 74% share would be in favour of AUAID , 23% for PMDC and the remaining 3% for the Pakistani Administration (Occupants) i.e Ministry of Kashmir and Northern Areas Affairs (KANA) and the Pakistani administration based in the Gilgit Baltistan(Balawaristan).As far as the share to the people of Balawaristan, who are the actual owners of these mines, nothing is promised.China, by taking leases of precious mines including copper, Gold and Uranium etc, by constructing Air Strips on the Road, Railways and Dams, is creating serious problems to the environment, demography, geography and political dispensation. 2.WATER RESOURCESThough rainfall is less in Balawaristan, but in winter all peaks are covered with heavy snowfall. Water flows in summer due to melting of mighty glaciers. Other water sources are the natural beautiful lakes, flowing into rivers and giving birth to famous Indus River, which irrigates Pakistan.These mighty glaciers and lakes which are tributaries of river Indus destroy thousands of acres of Balawaristan yearly but Pakistan gives 6.5 Billion rupees to its NWFP (New name Khyber Pukhtoonkhowa) province as royalty on the pretext of Tarbela dam, but nothing is paid to the resource owners i.e. the people of Balawaristan.Instead of withdrawing its troops and civilians Pakistan is planning to build 7 Mega Dams on this disputed land by violating UNCIP resolutions.Bhasha Diamar Mega Dam’s reservoir, located in Diamar (disputed Territory), would submerge 110 kilometers of the Karakoram Highway and around 80,000 people would be displaced initially. After further extension of this dam, about 300,000 local indigenous people will be displaced and about 200 KM area up to Gilgit town will be submerged. This will destroy the oldest trace of Buddha civilization besides other ancient civilizations. Pakistan also has a plan to build Mega dam in Skardu by submerging 200,000 aborigines population of this disputed area for its own benefits. With a depth of 650 feet, Skardu Dam (disputed Territory), will submerge not only Skardu city along with its historical and secret religious places and forts but also minerals and ancient houses of the whole Baltistan including Kharmang, Shigar, Khapolu, and many places of Rundo will be vanished from the land forever.

Pakistan is also building a 3rd Dam in Bonji (disputed Territory), on river Indus without consulting of the people, who have no representation anywhere in the world. Great loss to our environment, wild life, minerals both semi and precious stones worth billions is expected. An indigenous population displacement of 80,000 in Diamar Bhasha Dam, 300,000 in Skardu dam and about 30,000 in Bunji dam will occur. Bhasha-Diamer dam is planned without ensuring that the royalty from the dam would accrue to the people of Gilgit Baltistan. In fact, the reservoir spread over an area of 7.3 million acre feet in Diamer in Northern Areas of Jammu & Kashmir State and it would inundate about 32 villages. However, the power house is situated some kilometers away in NWFP and it is supposed to generate 4,500 megawatts of electricity. Given Pakistan’s step-motherly treatment towards the people of this disputed territory, the royalty from the dam would accrue to NWFP and not to Gilgit Baltistan, because the power generating unit will be build in Bhasha in NWFP with the intention to continue the usual deprivation of the people of this disputed land. In February 2010 Pakistani occupation forces killed 3 peaceful protestors and injured dozens others when they demonstrated against the forceful eviction of their land to construct Diamar Bhasha Dam for the interest of Pakistani Punjab and to make strong presence of its forces and personnel of ISI, so to keep its control firmly along with the presence of Chinese Military might. A large lake has been created by Pakistani occupying regime intentionally with criminal negligence, when in January 2010 huge landslide blocked Hunza river in the village of Attaabad. Due to formation of this new lake more than 2 dozen villages were completely destroyed and more than 20 people lost their lives. important aspect of our cultural heritage, we should heed the advice of Prof Harald Hauptman, an expert from Heidelberg University on petroglyphs or rock art. He has called for the establishment of a museum devoted to the preservation of the tens of thousands of rock carvings and inscriptions in Gilgit-Baltistan. According to him, more than half these carvings will be submerged by the construction of the Diamer-Bhasha hydropower dam on the upper Indus River valley. True, dams are essential to resolving our energy needs. But the historical significance of these rock carvings must also be kept in mind. There are some 150 places in the world where such primordial arts exist in concentrations of more than 10,000 carvings. Those discovered in Gilgit-Baltistan comprising some 50,000 rock carvings and 5,000-6,000 inscriptions of a dozen scripts dating back to the late Stone Age are among the world’s largest epigraphical records.

Ideally, rock art in Gilgit-Baltistan should be preserved and made accessible within its original landscape, like it has been done elsewhere, although this would hinder development in the area. Unfortunately, many of the rock engravings have already been damaged or defaced because of vandalism and ignorance. The best way to save this piece of heritage would be to document the carvings and inscriptions and preserve this documentation in a museum in Gilgit. In fact, for the past two decades, Prof Hauptman has been involved in a joint effort by Pakistan and Germany to systematically document the invaluable rock art sites by getting them photographed and recorded. This documentation is being supplemented by making replicas of some of the carvings. What better way for the government to demonstrate its commitment to the preservation of an important artistic feature than to announce plans to establish such a museum?

The area has no authority of its own, being disputed area of Jammu and Kashmir, the occupants (Pakistan) snatch 4.5 Billion from tourists visiting Balawaristan and nothing is paid to the local people. The area has 8 highest peaks of the world, thus foreign mountaineers pay 7 to 8 million Rupees to Pakistan per team. 4. FOREST There are thick forests in the Dardistan Province of Balawaristan, which covers almost 11000 hectares of the land. Government of Pakistan usurps 1.5 billion Rupees from these forests, besides misappropriations by the corrupt Pakistani lent officials. While the local people, who are the actual owners, are paid a meager amount as royalty.

5. KARAKORAM HIGHWAY (KKH)The 851 kilometer long KKH was constructed without paying a single penny to the local people on one side, and illegally gifting 2500 sq. mile area of Shamshaal of Hunza to China by Pakistan for construction of this

High Way, on the other side. Pakistan earns billions of dollars from this highway, besides ease of passage for military equipment including WMD (weapon of mass destruction, like nuclear bomb and missiles) from china comes via KKH. Again, no royalty or tax is paid to local people. About 3 billion rupees in shape of custom is being earned by Pakistan from the Sost Custom check Post in Hunza per annum. Despite Pakistan having no right to collect taxes from this disputed land. 6. WILD LIFEOne can find a large number of precious wild animals, birds which are very rare in other parts of the world. Markhors(Ibex) Markopolo sheeps, snow tigers, leopards, oxens, snow bears, eagles, vultures, kites, red leg partridges, tohrchons (marmot) , choughs, pygmies and many hunting and other birds in this paradise of earth. The estimated income from wild life is 1 billion rupees. Pakistan’s greedy military and civil officers deputized in Balawari-stan are hunting these rare animals and birds by gunship helicopters and smuggle some hunting birds to Pakistan for Arab Sheikhs to earn dollars.Rare Brown Bear, Snow Leopard and Ibex (Markhor) are hunted by

Pakistani forces by gunship Helicopter7. FISHIn this land of paradise one can find clean and mineral water everywhere in large quantity. Hence the fish breeding is much higher than any other part of the world. There are rare trout fish available in this area. The income from this source is estimated 10 million dollars, but Pakistani Military and civil officers use detonators to blast the whole area where the fish are available, as a result this area is being depleted of its precious gifts from Nature. 8. INDIRECT TAXAs you know that the area of Balawaristan is a disputed territory and Pakistan has no right to collect any kind of tax from this land, but the clever Pakistani collect 2.7 billion rupees per annum, from indirect tax from the goods imported to this region from Pakistan markets, besides the direct taxes imposed on this disputed and unconstitutional land.

9. AIR ROUTEDifferent countries like China are using the Air route of Balawaristan but the tax is snatched by Pakistan instead of Balawaristan. I would like to refer to & repeat the Universal Declaration of Human Rights of United Nations and some references from the Official documents of the United Nations High Commissioner for Human Rights Geneva Volume 1 (First Part) 2002. The aim of reproducing the UN Declaration is to know whether these are beneficial for human beings of this part of the world or are useless documents that have never been implemented by some member countries like Pakistan. UN never bothered to know about the plight and miseries of human beings, who are covered in its papers. This is the irony that neither UN itself bothers to implement its own resolutions nor it has any mechanism for check and balance. The Universal Declaration of Human Rights only benefits the rulers of UN Members countries not the human beings. This is the only reason behind to reproduce the Universal Declaration of Human Rights again here in this paper for those who believe in justice and equal rights for all. The area of my topic is Balawaristan (Pakistan and China occupied Gilgit Baltistan, Chitral and Shenaki Kohistan). This is a disputed territory linked with Jammu & Kashmir according to UNCIP resolutions of 13 August 1948 and 5th January 1949.The Universal Declaration of Human Rights adopted and proclaimed by General Assembly resolution 217 A (III) of 10 December 1948. Whereas recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world. Whereas disregard and contempt for human rights have resulted in barbarous acts which have outraged the conscience of mankind, and the advent of a world in which human beings shall enjoy FREEDOM of SPEECH, and belief and freedom from fear and want has been proclaimed as the highest aspiration of the common people. Human rights abuses are widespread and common in Gilgit Baltistan for many decades but unfortunately absence of local media; independent judiciary, misrepresentation and distortion of facts have helped Islamabad to hide its illicit practices normally carried out in the disguise of political authority in this Colony under Pakistani occupation. Large population

faces severe human rights abuses that encompass political, religious, gender, ethnic and economic. Area faces serious and widespread discrimination in economic, political, social, ethnical and religious spheres. Human Rights Organizations are not allowed into this part of the world. Human Right Commission of Pakistan has only prepared a report last year, but that was also only partially true, due to interference by Pakistan authorities. World famous Human Rights organizations do not give any attention towards this most neglected area. This is the only part of the world, where Human Rights are 100 percent violated, because the local indigenous people have no right to appeal in any court against Human Rights Violations in the absence of High Court and Supreme Court.More than 200 political leaders and workers are facing sedition charges (of Pakistani section 124A) and facing weekly trials in the Kangaroo Courts in Pakistani occupied Gakoch, Gilgit and Skardu. Our fault is that we chose to speak against Pakistani injustices in public as the right to freedom of speech is enshrined to them by Universal Declaration of Human Rights. One cannot imagine the kind of economical, physical and mental torture these innocent people are facing at the hands of the Pakistani colonial courts since 14 August 1997. They are being given continuous punishment without giving them fair and impartial access to justice, because this is an undeclared colony of Pakistan, where justice is beyond the imagination without Justice System and any recognized representation. Though sedition laws can only be imposed against the Pakistani citizens if they revolt against their own legal government. This region does not come under the constitution of Pakistan and the people are not Pakistani citizens according to the UNCIP resolutions and not even according to Pakistani constitution and courts. Thus sedition charges cannot be imposed on the people of this disputed region. Hence all punishments/court verdicts should stand null and void against an indigenous person of that region, but the agony is,

who will decide this-The UN? The Universal Declaration of Human RightsArticle 1All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood. The human beings born in Gilgit Baltistan are not considered as equal to the Pakistani nationals in jobs, economics, military, judiciary and all spheres of lives. Gilgiti and Balti are considered to be subordinate in all the military and civil departments and in political representation, because this is under occupation of Pakistan as the last colony of the 21st century. Article 2Everyone is entitled to all the rights and freedoms set forth in this declaration, without distinction of any kind, such as race, colour, sex, language, religion, political or other opinion, national or social origin, property, birth or other status. The race, languages, culture, politics, nationality, opinion and property rights are totally violated by Pakistani occupying regime. Pakistani nationals who are mostly fundamentalists have been settled here to change the unique culture, language, history and demography, which is totally in violation of this charter as well as UNCIP resolutions.

Article 3Everyone has the right to life, liberty and security of person.The life, liberty and security of 2 million indigenous people of this region are at high risk, because of Pakistani Forces, its Intelligence Agencies and terrorists continue to be a threat. Article 5No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.People of this disputed region are kidnapped, tortured, killed, insulted, forcibly exiled and threatened by

Pakistani controlled Police and subordinate Judiciary on the direction of Pakistani masters and ISI, without giving them the right of justice in any high court or supreme court. Article 6Everyone has the right to recognition everywhere as a person before the law.Pakistani nationals and personnel of occupying forces are considered superior to the local indigenous people. Local police cannot ask a Pakistani national, if he commits a murder of a local, because Pakistan Army and its ISI always protect Pakistani nationals, who are considered above the colonial law. This is the land where people are not protected by any constitution and law, because it’s an occupied territory and because of the continued apathetic negligence shown by UN. Article 8Everyone has the right to an effective remedy by the competent national tribunals for acts violating the fundamental rights granted him by the constitution or by law.This region does not come under Pakistani constitution, and Indian constitu-tion is out of its range. That is why this is a lawless land and whatever Pakistani masters utter, becomes the law, which does not grant any fundamental rights to this region. Article 9No one shall be subjected to arbitrary arrest, detention or exile.Arbitrary arrest, torture, detention and exile is the daily routine of the occupying regime of Pakistan, because of absence of higher and independent Judiciary and representation in any Parliament. Establishment of Human Rights organizations and independent media is out of question. Hundreds and hundreds local people are put behind bars for their religious and political differences and many political leaders including Mr. Wajahat Hassan, Ex member of NA Council and Col. Nadir Hassan were arrested and forcibly sent to Pakistan from their home at Gilgit on 1st Nov. 2009, when they tried to hold public gatherings during the election campaign.

Again on 27th April 2010 Mirza Wajahat Hassan, Presidnet Gilgit Balti stan Thinkers Forum (GBTF) and Chairman of APNA, Arif Shahid, Genral Secretary APNA, Prof. Mohammad Abdul Rezaq Khan Khalique, Ex President of JK NAP and Spokesman of APNA, Sardar Saghir Chairman JKLF, Mr. Sabir Kashmiri, Jammu & Kashmiri Liberation Front (JKLF) auf Kashmiri Group, Col. (Retd) Nadir Hassan, Mehmood Baig, Ex resident Bar Council Jammu & Kashmir Muzafarabad and Mr. Mohhad Farooq Advocate, Chairman Karakorum National Moment (KNM) were arrested and forcibly sent to exile to Rawalpindi Pakistan by the orders of Pakistan Army. Indigenous people are given death sentence in the absence of High Court and Supreme Court. ISI had been given orders by the then so-called democratic government of Pakistan in 1999 to eliminate me, when I revealed ISI’s intrigue of invading Gilgit Baltistan and then Jammu and Kashmir by using its Afghan Talibaan, in my letter to UNSC permanent members. Gen. Musharraf and other Pakistani generals, political and religious leaders should be booked as war criminals for the genocide carried out by them in this region. More than 3000 youth have been killed, 1000 have become disabled and wounded, while 40 were still missing, and several civilian buildings had been destroyed as a consequence of Pakistan sponsored terrorist activities. Thousands of indigenous people have been killed since 1971 by Pakistani sponsored sectarian violence, but rather than punishment, the culprits are awarded and promoted for their crimes by Pakistani occupying regime. A Pakistan Army Col. was promoted when he killed an indigenous youth in the Degree College Gilgit in 1996. Many Pakistani FC soldiers were promoted to higher ranks when they were found guilty in the murder cases in Gilgit. Article 12No one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, or to attacks upon his honour and reputation. Everyone has the right to the protection of the law against such interference or attacks.ISI interferes in everybody’s private matters and correspondence. Private letters from Post Offices to Emails and telephones are monitored by Pakistani intelligence agencies as well as by Chinese in this disputed region. The local indigenous people who raise any

objection against Pakistani occupying regime, are detained, kidnapped, tortured and all available media is used to tarnish their reputation by terming them as agent, traitors or enemy etc. Their relatives are also threatened and disgraced. The houses of three GBDA (Gilgit Baltistan Democratic Alliance) leaders including Mr. Ehsan Ali advocate, ex president of Gilgit Baltistan Bar Council, Mr. Sultan Madad and Advocate Wazir Shafi were broken into in broad daylight by ISI agents in Gilgit and they also got barred from participating in UNHRC session in Geneva in March 2010. Article 13Everyone has the right to residence within the borders of each state.Many areas in Astore and Baltistan have been declared out of bounds by Pakistan Army for the local indigenous people, for the free operation of the terrorist training camps by ISI and other illegal activities like accumulationof WMDs and their hideouts. Local indigenous people’s movements are monitored by Pakistani intelligence agencies and they give no right to freedom of movement for the nationalist parties, particularly BNF. Article 151. Everyone has the right to a nationality.2. No one shall be arbitrary neither deprived of his nationality nor denied the right to change his nationality.Being a citizen of a disputed region, the people of Gilgit Baltistan do not have any legal nationality. Though we have ID cards and Pakistani passports, but these are useful for tracking purpose but not for any legal and constitutional matter. Constitutionally this is part of India, but India does not grant nationality rights, because of its occupation by Pakistan and Pakistan does not give nationality right, because it does not come under the ambit of the constitution of Pakistan. The reason of this ambiguity is the UNCIP resolutions. Article 19Everyone has the right to freedom of opinion and expression, this right

includes freedom to hold opinion without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers. The people of Gilgit Baltistan even cannot dream of the freedom of expression in general and nationalist parties in particular. The fundamentalist religious groups, pro-Pakistani parties and terrorist groups have been given the freedom of expression and movement. It has already been mentioned that more than 200 people are facing sedition charges when they tried to express their views in the public peacefully. Many people had been sent behind bars when they only tried to express themselves. Many have been tortured, kidnapped and thousands were killed by declaring them as Sooni or Shia. Article 201. Everyone has the right to freedom of peaceful assembly and association.2. No one may be compelled to belong to an association.Only Pro-Pakistani and religious parties have the right for assembly. Even in the last so-called elections, hundreds of GBDA (Gilgit Baltistan democratic Alliance) workers and leaders were detained, tortured, threatened and some of them exiled, when they announced public gathering during election campaign before the so-called local Assembly elections on 31st October 2009. People are compelled by threatening and economically exploited, so that they join Pakistani parties and groups for sustaining their livelihood.

Article 211. Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.2. Everyone has the right to equal access to public service in his country. 3. The will of the people shall be the basis of the authority of government, this shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free

voting procedures. Article 23 1. Everyone has the right to work, to free choice of employment, to just and favourable conditions of work and to protection against unemployment.2. Everyone, without any discrimination, has the right to equal pay for equal work. The people of Gilgit Baltistan don’t have any kind of their government and no question of representation because of its colonized status in the hands of Pakistan. The so-called elections held on 12 November 2009 were not held by an impartial body, because it was aimed for Pakistanis by Pakistanis. Here the will of the people has no value but the will of Pakistani forces and its ISI is the superior one. Everyone in Gilgit Baltistan has to show his loyalty with Pakistan if he/she wants employment. No one is entitled to get any job, unless he/she is given clearance certificate by ISI. Even the people are not given loans from the banks on property mortgage if ISI does not allow. The locals are given sub-ordinate and low grade employment after the production of loyalty certificates. The pay scale of NLI (Northern Light Infantry) is lower than their counterpart in Pakistan Army. There is no criteria for the promotion of the soldiers of Gilgit Baltistan and Chitral, who are always subordinated by Punjabis and Pathans, the Pakistani nationals. In civil services like Judiciary, Administration, Police, Education and other departments, Pakistani nationals are always preferred over the local indigenous people and their pay scale and promotion is always higher, because this is the Last Colony of 21st Century Article 26Education shall be directed to the full development of the human personality and to the strengthening of respect for human rights and fundamental freedom. It shall promote understanding, tolerance and friendship among all nations, racial or religious groups, and shall further the activities of United Nations for the maintenance of peace.

In religious, educational institutions and other departments hate and discrimination is the key in Pakistan as well as some other Muslim countries. Other than the officially recognized races, ethnic and religious groups are totally discriminated, cornered and even killed publicly or privately, if he/she does not follow the official lines of group. International Covenant on Economic, Social and Cultural RightsAdopted and opened for signature, ratification by General Assembly resolution 2200 A (XXI) of 16th December 1966. Entry in to force on 3rd January 1976 in accordance with Article 27.

Considering the obligation of the States under the charter of the United Nations to promote universal respect for, and observance of, human rights and freedom. The 2 million indigenous people except Pakistani settlers are even not aware of UN guaranteed Economical, Social, Cultural, Civil and Political Rights. In spite of its abundance in Gold mines, Uranium, Aquamarine, Ruby, Emerald and other precious and Industrial mines, water resources, besides huge tourism potential, and trade with China, the people of this area live below poverty line, because all their esources are plundered by Pakistanis and spent in Pakistan. About 2000 Minerals leases have been given to Pakistani nationals and Chinese by ignoring this UN resolution. The people of this region do not know what Social rights in UN documents mean. The hospitality of this region was exemplary and the social character was so high that no other area of the world can be compared, but this was before 1971. Late Zulfiqar Ali Bhutto, the then Prime Minister of Pakistan, hatched conspiracy to hold its iron grip after 1971 by sending his immoral civil and Military force, not only to disturb its social behavior but also legal, economical and ethic values of Gilgit Baltistansystematically. Due to Pakistani slow invasion, the Unique Culture and economic independence, besides the high valued social behavior of this region, has also been disrupted by its Military and civil regime with the help of its corrupt nationals and media. Pakistani occupying regime has been providing huge funds to promote their own culture and language and discourage the unique culture, history and languages of Gilgit Baltistan and Chitral. The people of this region are not made aware of Civil and Political Rights, due to continued foreign occupation since 16th November 1947.

The Civil and Political Rights given by Universal Declaration of Human Rights is meaningless as far as this disputed region is concerned. The following UN

resolutions are also being ignored by Pakistan. UNCIP RESOLUTIONS of 13 Aug. 1948 and 5th Jan 1949TRUCE TERMS 28 APRIL 1949Pending a final solution, the territory evacuated by the Pakistan troops will be administered by The Local Authority under the surveillance of the commission. UNCIP GENERAL PROVISIONA. The territory evacuated by the Pakistan troops will be administered by the local authority under the surveillance of the commission.B. Immediately upon the acceptance of these terms, the commission would enter in to consultation with the Government of India regarding the disposal of the Indian and state armed forces and with the local authorities regarding the disposal of the armed forces in the territory to be evacuated by Pakistani troops, with a view to initiating implementations of point 4 (A) and (B) of the commission’s resolution of 5th January, 1949. C. If before expiration of the seven weeks contemplated in point II.A decisions are reached in the consultations for the initial implementation referred to in III.B above the schedule of withdrawal of the Pakistan Army as provided for II.A above may be extended to three months, in order to facilitate the implementation of decision relating to point 4 (b) of the commission’s resolution of 5th January, 1949. D. It will be made publicly known throughout the state of Jammu & Kashmir that peace, law and order will be safeguarded and that all human and political rights will be guaranteed. UNCIP Truce Terms

Immediately upon the acceptance of these terms, the Commission would enter into consultations with the Government of India regarding the disposal of the Indian and State armed forces, and with the local authorities regarding the disposal of the armed forces in the territory to be evacuated by Pakistan troops, with a view to initiating implementation of point 4 (a) and (b) of the Commission’s resolution of 5 January 1949.

(c) Other provisions were made for the release of prisoners of war and for the publicity to be given throughout the State of Jammu and Kashmir to the fact that peace, law and order would be safeguarded and that all human and political rights would be guaranteed. The truce terms also provided that they should be without prejudice to the territorial integrity and the sovereignty of the State of Jammu and Kashmir. Instead of carrying out a swift withdrawal of its troops within three months, as stipulated in Truce Terms of UNCIP of 1049 to pave the way for Local Authority under the Surveillance of UN, Pakistan multiplied its troops a thousand times more and civil, political and fundamental rightswere snatched by its Military, Intelligence Agencies and religious fundamentalists. Pakistan does not give any legal or constitutional protection to this disputed part of the world, because of its biased and discriminatory policies, neither the UN has ever askedPakistan to implement its Resolutions of 13 August 1948 or 28th April 1949 nor it implements the Universal Declaration of Human Rights itself. Pakistan has continuously been hoodwinking International community by giving different names, designations and packages to its unlawful occupations without the actual handover of the power and the area to its indigenous people by following world-acclaimed democratic procedures and UN resolutions. The territorial integrity and sovereignty given by UNSC (in UNCIP Resolutions) was also violated by Pakistan in giving 2500 Sq. Miles area to China in 1963 and Shhenaki Kohistan and Chitral was also annexed with its NWFP province (now Khyber Pukhtonkhowa). The resumption of work in construction of 3 mega dams out of 7 proposed Mega Dams on this disputed land is also a serious violation of territorial integrity and sovereignty given by UN in its resolutions. The successive Pakistani civil and military governments have been introducing prejudiced text-books and practicing colonial system by not following its obligation of Universal Declaration of Human Rights and other UN resolutions and by encouraging and facilitating the people on sectarian lines for divide and rule purpose. So the people and the

strategically important area could be controlled by maintaining fear and threat. Employment in all departments including Administration, Courts, Police, Education and other Civil and Military departments are made based on fundamentalist sectarian lines and their sympathy towards Pakistan. Those youth are discriminated who do not support ISI’s fundamentalist approach and Pakistani occupation and who give reference to the UN resolutions and demand for fundamental Human Rights and Justice. Pakistan does not consider the 2 million people of Gilgit Baltistan deserving of human rights, nor of fundamental rights, because of its new colonial status under Pakistan’s occupation. The 2 million people of Gilgit Baltistan do not have the right of freedom in spite of these beautiful wordings of UN and UNCIP resolution, because the fundamentalist country Pakistan does not bother for any rule of law in this colony.Pakistan is crying foul for self-determination and human rights for the people of Indian side of Kashmir only on the basis of religion. Self-determination, in Pakistan’s diction, is to merge the territory of Jammu & Kashmir into its own territory- nothing more or less. On the other hand, Pakistan itself has colonized its occupied part of Gilgit Baltistan and J&K, instead of ensuring freedom for all,Pakistan has virtually turned it into a SLAVE CAMP for all the indigenous people. In practice all the above mentioned GOLDEN WORDS of UN have become a black warrant to terrify the indigenous people of Pakistan occupied Gilgit Baltistan.

Pakistani system in this ColonyJUDICIARYJudiciary doesn’t exist as full and independent judiciary in Gilgit Baltistan. There are two Kangaroo Courts, called as Chief Court and Appellant court, whose members (not called Judges) are appointed by the Pakistani minister for Kashmir and Gilgit Baltistan Affairs on contract basis. These judge appointments are not made on the merit basis, but rather solely on the political and religious considerations and money matters. Members/Judges loyalty is not with Law or Justice but broadly to act under the direction from Pakistani regime and bureaucrats who are holding administrative, financial and judicial powers in the Area. Military and its ISI is

the real invisible government, which dictates the so-called members/Judges on different cases of their interest. It is ironical that the 2 million local indigenous people of this disputed land have no right to seek Justice anywhere, because it does not fall under the constitutional jurisdiction of Pakistan and its courts. There is no High Court and Supreme Court for the 2 million indigenous people of Gilgit Baltistan. FREEDOM OF EXPRESSIONFreedom of expression or fundamental freedoms occupy centrality in the domain of human rights that are linked with each other, which can’t be separated or selective, and can only be ensured when there is independent Judiciary and free media, transparent political process guaranteed by the constitution of that land. As I have tried to elaborate above about the condition of Judiciary and Constitutional position of Gilgit Baltistan that completely determines the political course of Pakistan controlled Areas.There is no freedom of expression. The number of charges of seditions is the highest in the whole world. Their only fault was to express their views in public. Many nationalist workers and religious people were tortured, sent behind bars and many were killed, when they dared to express their views against Pakistani occupation.Whereas media was never allowed to function and flourish as authorities have widely been discouraging any attempt to launch any indigenous media in Gilgit Baltistan.Numerous instances of victimization and banning of the weekly and monthly magazines have been reported by Pakistan based media and complaints were lodged in the UN human rights commission in Geneva. The monthly Kargil Editor in Chief Manzoor Parwana, and Editor Shezad were arrested and the magazine- Kargil, was banned. Editor of Kargil Manzoor Parwana and Shehzad Agha were also charged under the sedition cases when they reported the stories about the Kargil war. KARGIL INTERNATIONALwhich was printing stories of those

killed from Balawaristan (Pakistan Occupied Gilgit Baltistan) in Kargil War 1999 and was vocal about the way government of Pakistan portrayed local soldiers of NLI as Mujahideen (Terrorists) and the issue of killing local soldiers as mercenaries was linked with the status of the region- was banned. A book written by me (Abdul Hamid Khan Chairman Balawaristan National Front) under the title of THE LAST COLONY OF 21st CENTURY (Urdu and English) , was banned and sedition charges against me (the author) were framed. There are number of cases registered against the political and human rights activists who largely refused to subscribe to the pro-Pakistan school of thought. Media persons working for print and electronic media are continuously being harassed by law enforcement agencies when they expressed their dissent against the government policies in Gilgit-Baltistan. During the last year the house of Gilgit Press Club’s president Khurshid Ahmad was bombed thrice to intimidate him when he asserted that the local journalists would not print the controversial material of different militant organisations. In October 2005, the bureau chief of Karakorum Publishing Network Manzar Shigri was detained by Pakistani rangers when he insisted to take a snap of an injured person outside DHQ hospital Gilgit. The local newspapers are denied their right of advertisements, whenever they criticized government policies. The occupying regime continued with its policy of banning local trade unions. In 2004 the local administration banned the Northern Areas Lecturers Association in education department. In addition to this, the government banned unions and association in government departments, such as NAPWD, Northern Areas Transport Cooperation, and Post Office. DEMOCRACY/REPRESENTATIONThe Area remains void of genuine political representation since Pakistan’s control on 16th Nov 1947. No credible political institution could be evolved in last 62 years except some dummy Northern Areas Council (NAC) to Northern Areas Legislative Council (NALC) which had been created in 1970s when serious grievances of people began to surface in the political form as a result of continued denial of right to represent through election. However, in spite of the so called representation

like NAC, NALC, political domain is completely controlled and run by the Pakistani President, Prime Minister and minister, who head this so-called Assembly like the previous NALC and assume all superior and administrative powers that turned this political body into mockery, who exercise all powers and can dissolve this elected body when they wish so.Only religious and pro-Pakistani political parties in Balawaristan (Pakistan Occupied Gilgit Baltistan) are given free hand for propagation. There is no freedom for the nationalists, who oppose the occupation of Pakistan. On political front the local administration has always been imposing section 144 to ban all political gatherings by giving free hand to pro-Pakistani religious and political parties only. Recently during UNHRC Session March 2010, ISI broke into houses of 3 leaders of GBDA in Gilgit City, including Adv. Ehsan Ali a prominent leader of GBDA who is also an ex president of Gilgit Baltistan Bar Council and another Adv. Wazir Shaif’s. This rampage continued and a third leader of GBDA Mr. Sultan Madad’s GBDA house was also broken into, who had been invited for UNHRC Session Geneva. His passport was stolen along with other documents. This was the intention of ISI to keep the people of this disputed region away from UN bodies and international communities on one side and to harass the nationalists on the other. While Pakistan Army had announced a couple of months before that it has ended the interference of ISI in politics, but in Gilgit Baltistan and PoK it has increased its interference to a more dangerous level, where civilian government has no role to play. On 27th April 2010. Mirza Wajahat Hassan, Presidnet Gilgit Baltistan Thinkers Forum (GBTF) and Chairman of APNA, Arif Shahid, Genral Secretary APNA, Prof. Mohammad Abdul Rezaq Khan Khalique, Ex President of JK NAP and Spokesman of APNA, Sardar Saghir Chairman JKLF, Mr. Sabir Kashmiri, Jammu & Kashmiri Liberation Front (JKLF) Rauf Kashmiri Group, Col. (Retd) Nadir Hassan, Mehmood Baig, Ex resident Bar Council Jammu & Kashmir Muzafarabad and Mr. Mohammad Farooq Advocate, Chairman Karakorum National Moment (KNM) were arrested and forcibly sent to exile to Rawalpindi Pakistan by the orders of Pakistan Army.GBDA had organized a public gathering on 28th April and invited its

Alliance, the APNA to address the audience in Gilgit against the Karachi agreement of 28th April 1949. STATE SUBJECT RULE It was introduced and promulgated by the then rule of Jammu & Kashmir in 1927 similar to the present Universal Declaration of Human Rights to protect the territorial integrity and sovereignty, but the occupying re-gime of Pakistan has revoked the State Subject rule practically, as a result Pakistan has changed the demography of this disputed part by settling its own Pakistani nationals largely extremists from the NWFP/Pukhtoonkhowa, besides Afghan, Chinese and other people, in the disguise of businessmen. State Subject Rule is still valid in both the part of J&K. The world witnessed hue and cry of the people of J&K, when forest land was given to Amarnath Yatra Committee last year. HUMAN RIGHTSHuman rights abuses are widespread and common in Gilgit Baltistan for many decades but unfortunately absence of local media, independent judiciary, misrepresentation and distortion of facts have helped Islamabad to hide its illicit practices normally carried out in the disguise of political authority. Large population faces severe human rights abuses that encompass political, religious, gender, ethnic and economic deprivation. Area faces serious and widespread discrimination in the form of economic, social and political spheres.A few glimpses of some Human Rights violations- a local government official Nazir Ahmad from Kashorote Gilgit was forced into death by the then Chief Secretary Mahmood Khan. SSP Amir Hamza was first dismissed from service and when he was restored by the Supreme Court of Pakistan, he was given poison during treatment in Karachi, Pakistan and he died in Hospital. Mr. Saif-Ur-Rahman, a member of NAs Legislative Council, was killed in 2005 by using a terrorist by ISI, when he tried to bring religious harmony among Shia Muslims and Sooni Muslims of Gilgit.In the year 2005 Ghazi Anwar Khan, finance secretary of Karakorum National Movement, set himself ablaze in Kabul as a protest against the excesses of

the government of Pakistan. Constantly hounded by ISI and after an attempt on his life Ghazi Anwar Khan fled to Afghanistan, where he committed suicide, when UNHCR denied him asylum. On 11th Oct 2005, some Al-Qaida terrorists opened fire on a prominent Shia leader in Basin (on the directives of ISI), 8 kilometer from Gilgit City on the Ghazer road. As a result 3 innocent men (Shia Muslim) were killed and others wounded. One attacker who was killed by security guard of Agha Zia, his body was taken away by ISI, so far nothing has been reported about the attacker. Two of the Terrorists got away towards the other side of the river Ghazer, while one injured terrorist was arrested by the local Police. Some documents and Identity cards of Kohistan NWFP Pakistan was found from his possession. This terrorist was admitted in DHQ Hospital Gilgit by the Police. Soon he was forcefully taken away by the Pakistani Rangers by the immediate orders of General Musharraf, due to fear of exposure of Pakistani intrigue. The Pakistani aim to kill the local Shia indigenous people is to settle the terrorists (Al-Qaida and Talibaan) from NWFP and other parts of Pakistan, without the hindrance of the local indigenous people. When the local people protested against this and argued that the killer of Agha Zia should not be taken anywhere unless the local Police interrogation is completed, Pakistani Rangers opened fire on the public and took the terrorist and kidnapped a young Muslim (Shia) student of fifteen years named Maqsood Hussain along with him. On the next day the dead body of this innocent teenager was found. The colleagues of the deceased student protested over the murder on 13 Oct 2005 in the morning and were peacefully dispersing when the Punjabi Rangers opened indiscriminate firing on the students and the unarmed civilians and killed many. On 8th Jan to 13 Oct 2005 Pakistani Rangers killed 75 people in Gilgit city.A teenage girl Kaneez Zehra d/o Mohd Issa age 19 Resident of Eidgah, Astore and Fareeda Begum d/o Akbar Khan age 22 resident of Chongrah, Astore were killed by the occupying regime on 25th May 2006. RELIGIOUS FREEDOMThe intensity of oppression can be understood from the event when government declared Schools and Public buildings as Jails when jails were insufficient to accommodate the detainees. More than 100 Shia Muslims (whose fault was to only protest peacefully against the biased Islamic Syllabus)

were languishing in School and the private building near Radio Sta-tion turned into a Jail in Gilgit. The dispute erupted when government decided to teach one-sect curriculum in the Schools that created serious opposition from Shia community, the protestors were detained and are still languishing in Jails. Religious oppression is another feature of this disputed territory where religious bigotry is openly exercised by the zealots from other sects to marginalize the majority Shia population while opponents are supported by the intelligence agencies, government officials and local sect that share the sectarian hatred. Religious persecution is underway to victimize the political opponents since political oppositions are advanced by the same sect. Government of Pakistan intentionally has been depriving majority of the sect by giving almost 90 % of the employment to a particular sect, which has only 38 % population. The intention of this discrimination was not to appease the beneficiary sect but to create sectarian gap among the local people with the evil intention of Divide and Rule.There is no free movement or speech for majority Shia religious group. Aprominent Shia Leader of Gilgit Baltistan Syed Agha Zia –Ud-Din was killed on 8th Jan 2005 by ISI trained terrorist in Gilgit , because of his firm opposition to the imposition of one-sect syllabus in the Schools. He was killed by ISI, with the intention to create sectarian tension among the local indigenous people. Shia Central mosque Gilgit was bombed by Pakistani forces. A Shia School teacher Bilal Hussain Qazalbash was kidnapped by ISI on 10 Sep 2005 from Gilgit . A case was registered against ISI in Lahore High Court Bench by the family, where Military regime and its ISI denied his kidnapping. After many months, Qazalbash was handed over to Rawalpindi Police with a truck load of arms and falsely involving him in an arms smuggling case, when it is well obvious that a hostage or detainee cannot possibly smuggle arms into the Pakistan ISI world. His only fault was that he belonged to Shia sect, which does not take part in ISI sponsored terrorism. In 1988 during General Zia’s regime, hundreds of innocent Shia were killed in a genocide, those who took shelter in Army Camp Bunji were forced to convert into Wahabi sect, which is the sect of most Pakistani generals. Even crops, trees, plants and animals were not spared by the ISI sponsored Pakistani and Afghan terrorists. Many Shia mosques along

with Holy Qurans were torched. Hundreds were killed and many women and teenage girls were kidnapped and have not been recovered so far.

The religious discrimination against the Shia sect is openly exercised and carried out even in the military forces where Shia Muslims are not allowed to perform their religious duties in cantonment areas. Many Army officers from Shia sects are not promoted to the higher ranks- they either retire before the time or their promotions are withheld. Reasons only seem to be religious extremism, because Shia in Gilgit Baltistan are victims of state policies , apparently Islamabad’s intentions to provide shelter to the extremists and terrorists are exposed since majority Shia population do not share such extremist views. In Gujranwala cantonment of Pakistan during Eid festival on 20th October 2006, more than 15 NLI (Northern Light Infantry)soldiers (from Gilgit Baltistan) were dismissed and sent behind bars by Lt. Colonel Fateh Mohammad, Commanding Officer of 14 NLI, because of their prayers (Shia prayers do not match with the Wa-habi fanatical prayers).

The Kalash are minority even in the Kalash valleys. They are less than 4,000 or less than 20 per cent of about 17,000 population. The rest of the population are Muslims including a large number of converts. The rate of education among Kalash women is 18 per cent and it’s 15 per cent among the men where overall literacy rate is 25 per cent. Compared to boys, there are more Kalash girls in schools. These are neglected valleys with only one high school in the three valleys, two middle schools and around 10 primary schools. The Kalash with their unique culture, traditions, rituals, values, festivals and attire are not be found anywhere else in the world. The Kalash are considered ‘infidels’ and their habitations are known as ‘Kafirastan’ — the land of infidels — amongst the local Pakistani community. The Kalash valleys are located in Chitral in the northern district of Pakistan’s Khyber Pakhtoonkhwa province bordering Afghanistan. They lead a centuries-old primitive way of life with a religion which has no name, no written book or prophets. They are now concentrated in three valleys which are called ‘Kalash gooni’ among the Kalash and the ‘Kafir Kalash’ (land of infidels) amongst others. The three Kalash valleys — Bumburet, Rumber and Birir — are situated to the south west of Chitral town at distances of 40, 43 and 36 kilometres respectively. The biggest valley is Bumburet while the smallest is Birir.

Kalash, with its fresh water streams, lakes, waterfalls, forests, orchids and plentiful sustenance by way of walnuts, apple, mulberries, pears, graphs, apricots and peach is a virtual natural haven. Wildlife abounds as do goats and cows. The mellow sun during summer compensates for the heavy snow in winter.

But it is not just the place which fascinates, also the women of Kalash — who legend says are part-fairy and part-human because of their ethereal beauty. Local people say the Kalash woman can make a man lose his religion. But still they are considered impure in their own community;

they are also called “whiter than the white”.Coming back to the origins of the Kalash, Saifullah Khan, 55, headman of the Kalash tribe in Rumbur valley, insists the Kalash are descendents of Alexander. “Our forefathers told us that some soldiers of Alexander’s army came to Chitral and ruled the area for a couple of centuries before being pushed to these valleys,” he said while sitting on his rooftop set against the backdrop of smoky black houses built with stone and wood on the mountain slopes in such a way that one house’s roof serves as the terrace or courtyard of another.

For Khan (the Kalash have Muslim names), their origin is not important to them. “All I am trying to do is to keep our unique culture alive as we are seriously threatened with extinction if our people keep on embracing Islam,” he said. His views were seconded by Turab Khan who is also known as Irfan. I met him in Birir Valley after two hours of travel on the raw mud-and-stone pathways carved into steep mountains that offer a clear view of the rivers and streams snaking through the deep valleys.“All I know is some people of Alexander’s army stayed back and settled in the areas known as ‘Red Kalash’ now known as Nooristan in Afghanistan but later they were eliminated by Muslim armies,” he said. Some of the vanquished moved to Chitral and then settled in Kalash centuries ago, he added.

Durdana, a 25-year-old woman with big blue eyes is well known in the Kalash community and has also been to Athens on a trip arranged by the Greek government. She insists the tribe’s forefathers were from Greece.

“I went to Greece and our blood samples and DNAs also matched their blood when they conducted tests on us. Most of our community also believe that some of Alexander’s soldiers stayed back and settled in Chitral,” said Durdana, who works as an assistant at the Kalash museum set up by the government.Rehmat Deen, a Kalash school teacher, also held firm to the view that some descendants of Alexander came to the region from Nooristan in Afghanistan. “Some customs, rituals and traditions do match with Greeks and this leads us to the conclusion that most of us are of Greek origin,

though Alexander’s soldiers joined him from different countries around the world,” he added.The Kalash feel threatened by the outside world as their number are dwindling with every passing day. Many Kalash are accepting Islam and the influence of other cultures. With more members of the community getting educated, people are also reluctant to follow their primitive traditions and rituals.

“We want government to move all of us at one place and make a protected sanctuary for us,” said Irfan espousing the view that the world would be deprived of the Kalash’s unique culture if immediate steps were not taken to protect the tribe and its unique way of life.Irfan, who also runs a social organisation in Birir said the tribe did not face any threat from militants but the pressure was more from members who were embracing Islam. “Though, no one forces us to convert, we are under constant pressure from own converts to quit our way of living,” he added. “Recently, a couple of our sacred worship places were also ransacked but we did not react because we the Kalash are very peace-loving people,” he said. Saifullah Khan said the government did provide protection to the tribe even as it lived in fear of the increasing Muslim population in its areas. Akhtar Hussain, in-charge of the Kalash Museum in Bumburet, alleged the young Kalash were being constantly brainwashed to convert. “Some 12 to 15 Kalash, mostly girls who get married to Muslim boys, get converted every year and this number is on the rise,” he said.Hazrat Kareem, a Muslim teacher at the only high school in Bumburet, did not agree with the claim that the Kalash population was dwindling but seemed to agree that there is an immediate need to preserve the Kalash culture as it is fast losing its identity in contact with the modern world.Timeless fashionThe Kalash are known for their unique way of dressing, especially the attire of their womenfolk.All women wear black robes called ‘Piran’ and it takes at least nine metres of cloth to make one dress. and colourful embroidery coupled with beads, shells and coins.The Kalash attire is centuries old and has not changed much from its original form. As the belief goes, the women of Kalash started wearing black in honour of a prince called ‘Kala Shehzada’ (black prince) who ruled them centuries ago.The women wear an extraordinarily large headgear called ‘Kopus’ embellished with buttons, beads and shells, which in some cases tops two kilogrammes in weight.The cost of one dress varies from Rs2,500 (Dh110) to Rs6,000 (Dh180), which is a lot of money for the average Kalash.Women’s robes cover the entire body right down to the feet and are tied around the stomach with a belt called ‘Chehare’. They make four to five dresses a year to coincide with festive occasions.Kalash men normally wear shalwar-kameez, a combination of long tunics and trousers, with Chitrali caps that could be black or white.Boy’s birthA woman has to move to Bashali (secluded house) to give birth and has to stay there for at least 10 days. Even if a boy is born, he is not considered a ‘man’ until he is six years old. The boy has to live with women and he is not allowed to wear pants or pyjamas (trousers) for six years since his birth. A big celebration is held when a boy turns six and wears a ‘shalwar’ or pants. After that he eats only with men and not with women. A goat is also sacrificed to mark the occasion and the meat is eaten only by the men.Hostoric link Alexander the Great (356-323 BC), who conquered the Persian empire and annexed it to Macedonia, is considered one of the greatest military geniuses of all times. In the winter of 327 BC, Alexander passed through what is now Pakistan during his campaign to invade the Indian subcontinent. It is not known exactly where he crossed, but it’s believed that he went up the Kunar River in Pakistan, close to where the Kalash live now, and crossed a mountain pass intowhat is now Bajaur Valley................NOTE: In my opinion, Kalash are the only indigenous people of Chitral, besides few others. In the Present population less than 30 percent people are indigenous including Kalash, others are old or new migrant from other neighbouring areas. It’s possible, some Alexander soldiers may have settled there and merged themselves in to Kalash for their safety, but they were not

conquerors, Chitral and Gilgit has not been conquered by Alexander. Kalash are not Macedonian as some people claim for many reasons. Some people from Hunza also claim that they are Macedonians, while the fact is that except some migrant the people of Hunza are Brooshoo which is an indigenous tribe of Gilgit Baltistan, whose language, tradition and history is unique. The reason by some people of Kalash and Hunza is more economical than the factual. Whatever the origin of the people of Kalash they should be protected from the fundamentalists Pathans of both Pakistan and Afghanistan. The only way which can protect their culture and even existence to protect them under Un organizations. Those who have been converted in to Islam should be settled down in other Muslims area to avoid their use or influence against the other Kalash, who are still stick in their culture. FREEDOM OF MOVEMENTThe freedom of movement of the local indigenous people were limited and monitored.

The leases for mining of precious metals have been given to foreign companies like Pakistani and Chinese by Pakistani colonial power, which themselves do not have any right on this land, it is totally illegal. chemicals for explosion the mines, as a result glaciers are melting and high mountain rocks are sliding. I request to the UN and environmental experts to intervene and take up it seriously against human interference in natural phenomenon as an urgent issue. A live example of this abuse is the recently formation of Attabad, Hunza water dam, which has caused grave consequences to the existence of the whole region. The impact as climate change, which the region is witnessing in the shape of mountain sliding and heavy rain due to the newly born natural water dam of only 35 KM long, as a result of use of toxic material in the thousand blasting by Chinese and Pakistani companies to explore the mines on high altitude mountains. PHOTO: REUTERS GILGIT: Thousands of people displaced by the Attabad ‘landslide’ lake in Hunza, especially women, are developing psychological problems due to the unending crisis, says Wazir Baig, Speaker Gilgit-Baltistan Assembly. The lake was formed in January when a massive landslide blocked the flow of the Hunza river, damaging the strategic Karakorum Highway, submerging four villages upstream and killing at least 20 people. According to an official tally, 25,000 people have been displaced by the ever-swelling lake. It’s not over yet as official efforts to drain out the lake have not succeeded and many more villages downstream are at risk, if the lake bursts its banks. “I’ve met displaced people living in temporary camps. I’ve found that they, especially their women, are developing physiological problems because they have lost everything, even the hope of returning to their homes,” Baig told The Express Tribune in an exclusive interview after visiting the disaster-hit areas.

It’s not easy to spend such a long time in camps, especially for those women and children who are used to living in big houses,” said Baig, himself a resident of Hunza.Last month, Pakistan Army engineers successfully created a spillway by breaking huge boulders to drain out the 23-kilometre-long lake. However, contrary to their expectations, it hasn’t drained out the lake and efforts to widen it have so far remained unsuccessful. Desperate to go back to their villages, displaced people have threatened to widen the spillway at the risk of their own lives, if officials remained “apathetic” to their plight. Baig said the situation of the spillway was confusing as it hasn’t drained out the lake. “We are being kept in the dark about the situation,” he added.

He said people were evacuated from downstream villages on the advice of experts and now it was their responsibility to take a decision about their repatriation. “We have left it to experts to take a decision about the repatriation of the displaced people,” he added. Baig plans to take up the issue with higher authorities because, according to him, the situation could fuel anti-government feelings among the displaced people. Baig said he wasn’t satisfied with the compensation amount being offered to the lake affectees. “I was chairman of the committee constituted by the government to assess losses in Attabad. We had submitted a report to the home secretary, indicating estimated losses of Rs780 million. But the compensation package offered by the government is much below our expectations,” he said. Baig said that the January 4 landslide had destroyed 141 houses in Attabad besides damaging standing crops and other valuables of local people. He called upon the government to take the issue seriously to avoid a humanitarian crisis in the region.

HISTORY/ CULTUREHistory is witness that the people of this region has inherited culture that coexisted with other cultures for centuries as this region had been the transit to India and central Asia through silk route and the local indigenous culture was intact till Pakistanis stepped in. The region being part of State Jammu and Kashmir and its administration and cross cultural interaction has further enriched this old civilization, where different languages, faiths and tribes have collaborated against the enemy when their local culture was in danger. In very difficult times local culture managed to maintain its tolerant and plural essence but since Pakistan took over the administration, the heritage, traditions, and civilization continue to decay as political,social and religious freedom has almost been denied to the people. History has been distorted by resolving to communal and sectarian approach under Pakistan’s control to promote the Arabic culture by terming it as Islamic Culture against the unique ancient culture of this region. In my personal view religion has no culture; spiritual beliefs are not a tangible thing. Culture differs from region to region according to the geography and traditional heritage of the people, whereas, beliefs of one religion do not vary much from place to place. After 9/11, the propaganda of Arabic culture thrust (which is violent and intolerant) in the name of Islam, has further been made to strengthen the fanatic ideology. This phenomenon of extremism has been used against the Shia majority population of the area to create extremist culture across the region as Pakistan ISI had disfigured the tolerant and unique culture through pan-Islamism. Pan-Islamism has been the driving force behind all the activities of militancy ISI had sponsored within Pakistan or its neighboring countries. Unfortunately, in this pan-Islamism, majority of Shia in Balawaristan (Pakistan Occupied Gilgit Baltistan) were not fitting in and Pakistani regime decided to change the demography by eliminating hurdles. As a result of this policy the religious suppression against the Shia population increased and many sectarian riots were engineered between two sects within indigenous population that claimed hundreds of lives, culprits and perpetrators were given impunity by the occupying regime of Pakistan and thus leaving bitter memories among the survivors, which would

help in divide and rule policy for the colonial master. JOB OPPORTUNITYThis area is rich in natural resources estimated to be over 2500 Trillion dollarsof worth (Minerals like Gold mines), Ruby, Uranium and other precious and semi precious minerals, Water, Tourism, Forest, KKH, Tax, Custom, Wild Life and Air Routes etc have not been taken into account. Although Area is devoid of economic development as majority of the male population has to migrate to Pakistani cities in search of their livelihood, because the resources are not in the hands of the local people due to Pakistani occupation. However, despite jobs being available in the Area in government sector, people face severe discrimination based on their religious and political beliefs. Nationalists are largely the victims of this political discrimination systematically practiced by Pakistan in government jobs as well as other sectors which are apparently operating to mitigate the people’s economic hardships but in reality running on bank policies of the apartheid, against the nationalist political activists averse to the policies of Pakistan. This apartheid policy does not exist only in government services or banks but in education, development institution, administration, Police, and Courts where it is widely practiced. Though apparently they use the pretext of merit but that merit remains confined to the discretionary powers of the Pakistani and their puppet appointment authority. Even such discriminatory practices are widespread in sanctioning loans, mortgages and seats to the professional colleges. Discrimination with Local employees, like Police, Administration, Para-Military, Education, Health and other departments are not only harassed but arrested or dismissed by Pakistan Military and Civil administration, if they did not fulfill the evil designs of occupation regime. Those indigenous people who occupy higher but not highest jobs in the region also face serious and variety of discrimination in terms of salaries and promotions too. For example the salary of the Police Sepoy in Pakistan is twenty thousand and Gilgit Baltistan is eight thousand. Local Police officers DIG Raja Muzaffar, DIG Mir Afzal, AIG,

Hashmatullah, SSP Shaukat Rasheed and SSP Mohammad Hanif were detained and sent behind bars in fake cases when they refused to give bribes to National Accountability Bureau (NAB) and other departments of Pakistan Army and its ISI. While the Pakistani nationals, who commit heinous crimes of sectarian murder and involved in financial embezzlements and bribery, are free to do so with impunity in Gilgit Baltistan, due to the blessing of occupying regime and its Military power. many illiterate and even educated un-employed youth of a particular sect are brainwashed, trained and then sent across the borders to India or Afghanistan, where they get killed and their families are paid a meager amount by ISI. There is no medical / engineering, law or any professional college or even polytechnic institution.There is no command of the locals over the Police.There is no command of the locals over the administration.There is no command of the locals over the Education.There is no command of the locals over the Finance. The only thing FREE in this part of the world is TERRORISM in the name of religion, ONLY by the help of Pakistan under the direction and guidance of ISI.

Religious and political opponents are crushed brutally by using local Police (headed by Pakistani officer), Pakistani forces, the ISI and its terrorists. HISTORICAL BACKGROUNDPakistan Occupied Balawaristan (Gilgit Baltistan, Chitral and Shenaki Kohistan).Chitral was part under Maharaja of state Jammu & Kashmir suzerainty, which is now part of NWFP/Khyber Punkhtoonkhowa due to apathy and lack of interest of the Indian government and the UN. Balawaristan (Pakistan Occupied Gilgit Baltistan, Chitral and Shhenaki Kohistan) is an important area of the disputed Jammu & Kashmir (J&K), bordering with China, Afghanistan, Central Asia, Pakistan and India, whose fate is still to be decided according to the UNCIP resolutions 1948-1949 .

Instead of carrying out withdrawal of its troops and civilians within 12 weeks according to UNCIP Truce Terms 28th April 1949, Pakistan cheated UN and got agreement with 2 men of Pakistan Occupied Kashmir (PoK) and took over the control of Gilgit Baltistan without the knowledge of UNCIP and the people of this region. On the other hand Pakistan gradually increased the number of its troops by creating a law and order situation for its own interest. Now there are more than 30,000 regular troops, 5000 Militia like Punjab Rangers, Frontier Constabulary, 5000 members of Intelligence agency, besides its 40,000 armed civilians (Pathans, Punjabis and other foreign nationals who are responsible for the deteriorating law and order situation and drug smuggling. Humiliation, kidnapping, torture and target killing of innocent indigenous people is a daily routine of Pakistani forces and its agencies. OCCUPATION OF CHITRALSaif-ur-Rehman Mehtar (Ruler) was sent to prison by government of Pakistan and later he was killed by Pakistan in 1954 on Lawari Pass. The state of Chitral, which was a tributary of Maharaja of Jammu & Kashmir, was taken over illegally and un-democratically by the government of Pakistan in 1950. Chitral State became a full-fledged agency and a political agent was posted there who was known as Wazir-e-Azam till 1969. On the other side Pakistan took control of Shenaki Kohistan and merged it with its Pukhtoonkhowa province illegally without any democratic procedure, which were part and parcel of Chilas, Diamar of Balawaristan. DIVISION OF SUB CONTINENT PRINCIPALThe British government differently treated the whole Jammu & Kashmir state including Balawaristan {Pakistan Occupied Gilgit Baltistan (OGB)}, unlike India and Pakistan. Otherwise they would have freed the whole state of Jammu & Kashmir according to the will and wishes of Maharaja of Jammu & Kashmir OR handed over to Pakistan or India.

Kak on 17th July, 1947,before the partition of great India, vide No. B 480/47 P.B. is as under.His Highness the Maharaja Bahadur has been pleased to command that :The administration of the entire Gilgit Baltistan i.e. former Gilgit Wazarat north of the Indus and all political districts is taken over on 1st August 1947.1. The budget for the Gilgit Frontier province will be sanctioned, when full details are known and have been sanctioned. Some Historical glimpses of events12 August 1947: The J&K Government headed by Moharaja Hari Singh (ruler) proposes ‘stand still’ agreements with India and Pakistan.

15 August 1947: Pakistan Government accepts the proposal of ‘stand still’ agreement with Moharaja of J&K. The Authority of Maharaja over J&K including Gilgit Baltistan has been endorsed by Pakistan by making STANDSTILL agreement, because agreements are made with sovereign authorities.

20 October 1947: Invasion of J&K by tribal fighters initiated by Pakistan.

26 October 1947: Signing of the Instrument of Accession by the Maharaja thereby integrating the State of J&K into the Indian Union.

27 October 1947: Indian troops landed in Kashmir and drove out Pakistani forces and their Pathan tribals.

1 January 1948: India refers the Kashmir issue to the UN Security Council.

13 August 1948: UNCIP (United Nations Commission for India and Pakistan) passed its first resolution about J&K including Gilgit Baltistan issue.

5th Jan 1949: UNCIP passed another resolution.

28th April 1949: UNCIP passed Truce Terms between India and Pakistan, which orders Pakistan to withdraw all its troops including its citizens from its occupied territories within an extended period of 3 Months and followed by India to withdraw bulk of its forces.On the same day of 28th April 1949 Pakistan made a fraudulent agreement with 2 puppet leaders (who had no mandate of Gilgit Baltistan) of its occupied J&K and took over the control of Gilgit Baltistan illegally and un-democratically.State Subject RuleIn 1927 Maharaja Hari Singh made State Subject necessary for all the Residents of the state including Gilgit-Baltistan-Chitral region to protect their culture, language, economy and other interests of these indigenous people. The Pakistani authorities have abolished the State Subject rule without any legal authority and transferred more than half of the land of the local residents to mostly the Pakistani Pathans, Chinese, Afghanis and Punjabi migrants, the retired Army Personnel, bureaucrats and Politicians including PML Chief and Ex Prime Minister Nawaz Sharif and ex Minister of Musharraf regime Mr. Nisar Meman. This has threatened the existence of identity of local residents. Chitral- had been excluded from the map of POK & Gilgit Baltistan in 1969- is on the hit-list of ISI, so as to plunder their culture, language and resources.

LATEST HISTORY Ninety days after taking over the charge of Gilgit Agency and political districts, Gilgit Scouts revolted and arrested Governor Ghansara Singh on 1st Nov. 1947. Thus the Maharaja lost control over Gilgit. Baltistan, was a Tehsil of Ladakh, felt to Gilgit Scouts in 1948. Raja Shah Raees Khan and the then Captain Mirza Hassan Khan of 6th J&K Infantry, respectively became President and Commander-in-Chief of the newly born State- The Republic of Gilgit, on 1st Nov. 1947. Unfortunately, some simpleton military low ranking persons were acquainted with the neighbour Muslim state Pakistan to send an expert for subsidiary duties in administration, because there was no political setup at that time.On 16 Nov. 1947, 15 days after separation of Gilgit Frontier Province from Jammu & Kashmir, a third class magistrate

(Naib Tehsildar) namely Sardar Alam was sent by the government of NWFP of Pakistan to discharge his duties as a temporary helper to the newly born Gilgit State. Then on one side, Mr. Alam paved the way for Pakistan from the very beginning by making sectarian differences among the locals, and on the other side the government of India took the case of the whole Jammu & Kashmir, including Gilgit Baltistan, to United Nations Organization on 1 January 1948.

UNCIP.The stand of India & Pakistan in United Nation Commission for India and Pakistan (UNCIP) is reproduced, so the postulates of both the countries could be re - examined in that context, in which Pakistan agreed to withdraw all its forces and armed personals, tribesmen and citizens from the state of Jammu & Kashmir including Gilgit Baltistan (Balawaristan) within a period of 7 weeks. But later on, UNCIP accepted the request of Pakistan to extend the period of withdrawal from 7 weeks to three months (12 weeks), while India agreed for withdrawal of bulk of its forces subject to the complete withdrawal of all Pakistani forces and civilians (Pathans of Frontier Province of Pakistan) and other Pakistani citizens, who were not citizens of Jammu & Kashmir State and Balawaristan (Occupied Gilgit Baltistan). The UNCIP record 1950 page No.111-112 iii (A), is as under: -THE GOVERNMENT OF PAKISTAN AGREES1. To withdraw its troops from the territory of the state of Jammu and Kashmir in seven weeks As follows :a. During the first three weeks twenty infantry battalion, plus the corresponding proportion of artillery and supporting units.b. During the following fortnight the remainder of the Pakistan troops, with the exception of eight infantry battalions.c. By the end of seven weeks, all Pakistan troops, including their ammunition, stores and material, will have left the territory of the state.2. That having secured the withdrawal of the tribesmen from the territory of the state of Jammu and Kashmir, it shall secure the withdrawal of Pakistani nationals still in the territory of the state and not normally residents therein, who have entered the state for the purpose of fighting.

THE GOVERNMENT OF INDIA AGREES1. To withdraw the bulk of its forces from the state of Jammu and Kashmir in stages submitted by the Commission shall have notified the Government of India. The withdrawal will begin as soon as the commission will have notified the Government of India, the tribesmen and Pakistan nationals, not normally resident in Jammu & Kashmir territory who have entered the state for the purpose of fighting, have withdrawn and that the Pakistani troops are being withdrawn from the state of Jammu & Kashmir.

TRUCE TERMS 28 APRIL 1949Pending a final solution, the territory evacuated by the Pakistan troops will be administered by The Local Authority under the surveillance of the commission.III (I.D) Observers will advise the commission and or the plebiscite administrator regarding developments in the sparsely populated mountainous region of the territory of Jammu & Kashmir in the north (i.e. Gilgit Baltistan).Without prejudice to the provision of point 8 of the resolution of 5th January1949, showed the commission and or the plebiscite administrator may request the Government of India to post garrison at specified points.On the other hand Pakistan had treacherously signed a fraudulent agreement with the leaders of PoK about taking over the control of Gilgit Baltistan on the same date on 28 April 1947 when UNCIP passed Truce Terms. This was the first violation of UNCIP resolution committed by Pakistan.PAKISTAN AND J&KStandstill Agreement signed by Pakistan with Maharaja of J&K on 15th August 1947, which was the endorsement of the legitimacy of Maharaja over the state of J&K . But after few days of the agreement Pakistan invaded J&K on 20th October 1947, which indicates its double standards and untrustworthy national attitude. Pathan invaders patronaged by Pakistani forces killed innocent people and looted the property and abducted women and sold them in the brothels of Peshawar. This is on the record of UNCIP. As a result of this aggression, Maharaja was compelled to accede his state to India, to save the lives, property, and dignity of his people.

BNF STANDAfter accepting proposal of withdrawal of its forces and civilian from its occupied J&K and Gilgit Baltistan in UNCIP, government of Pakistan has become as an irrelevant self-made attorney for J & K generally and for Balawaristan (Gilgit Baltistan) particularly, because it has no legal authority to remain as the occupier, after signing Stand Still agreement with the Maharaja.Besides many examples, one such is below:PAKISTAN CHINA AGREEMENTPakistan-China border agreement on 2nd March 1963. Delimitation and demarcation of Sinkiang-Kashmir (the name Kashmir was used for Gilgit by both the signatories) border agreement article No.6 is as under:The two parties have agreed that after the settlement of the Kashmir dispute between India and Pakistan, the sovereign authority concerned will reopen negotiations with the government of the Peoples Republic of China on the boundary treaty to replace the present agreement...Though, in this fraud, ex-prate, illegal and immoral agreement, Pakistan and China both accepted and recognized that Pakistan has no sovereign authority over the territory of Balawaristan (Occupied Gilgit Baltistan). Pakistan has no right to handover 2500 Sq. miles area to China, to create its physical link with China for its own vested interests by constructing road (Karakoram Highway) on the soil of Balawaristan. Pakistan was not and still is not a legal government of Gilgit Baltistan by all the documents and laws. In an objection letter against Pakistan and China agreement on 16th March 1963 to the President of Security Council, India declares the China-Pakistan border treaty against UNCIP resolutions. In a reply, the then Foreign Minister of Pakistan, Mr. Zulfiqar Ali Bhutto, clarified the actual and legal position of the said treaty and said that the boundary agreement (between Pakistan and China) does not affect the status of the territory of Jammu and Kashmir, it does not affect the imperatives of demilitarization of the state. It does not derogate one jot or title from the right of self determination of the people. According to the above - mentioned statement of Z.A.Bhutto in UNSC, government of Pakistan does not have sovereign power over Balawaristan, nor the disputed nature of Balawaristan has changed even after a lapse of 62 years.Moreover, the Government of Pakistan has admitted to the right of self-determination of 2 million people of Balawaristan (Gilgit Baltistan).

PAKISTANI COURTIn the Supreme Court of Pakistan appeal No.33 – 1965, Noor Hussain versus State case can be studied as follows: Any territory which does not constitute part of the Republic of Pakistan is defined in the constitution of 1962 as a foreign territory.It means that Gilgit Baltistan is a foreign country and not a part of Pakistan according to 1962 constitution.The same situation applies for the constitution of 1973.In another writ petition No.5961, 1978, in the Lahore High Court, Dilawar Shah versus Judicial Commissioner (the then judicial dictator of Balawaristan), Mr. Justice Javed Iqbal adjudicated that :Northern Areas (Gilgit Baltistan), which are administered by the federal government directly are not part of any province. These areas are also not included in the tribal areas list as per 246 of the constitution, the learned counsel submitted that under clause (d) article 1 (2) of 1973 constitution above, a territory can be included in Pakistan by accession or otherwise. He conceded that so far there is no such legal instrument which is recognizable. Relying on Sakhi Daler Khan versus superintendent in charge recovery of abducted women PLD 1957 W.P.Lahore 813.We are of the view that constitutionally we are unable to find any merit in this writ petition, which is accordingly dismissed.16th May, 1981.Fauzia Saleem Abbas, a local lady and ex-Counselor of Northern Areas Council had filed a writ petition (Petition No 11 and 17 of 1994 THROUGH Al Jehad Trust of Pakistan) in the Supreme Court of Pakistan against the denial of basic Human Rights to the people of occupied Balawaristan (Gilgit Baltistan) in 1994. In reply against this petition:Attorney General of Pakistan Ch. Muhammad Farooq against petition No 11 and 17 0f 1994 in S. Court of Pakistan stated:The Chief Court Northern Areas shall exercise all powers and perform all functions which were being performed by the Court of Judicial Commissioner- being the highest court of judicature in the Northern Areas.

before delivering any judgement regarding the disputed areas of Jammu & Kashmir (J&K) such as Balawaristan. If a tradition of capturing disputed areas through courts is initiated today, then any other powerful country can also make Pakistan as its constitutional part tomorrow, because, as a matter of fact there are several countries which are more powerful than Pakistan.If Supreme Court of Pakistan has any sympathy with the people of this region, it can only direct the government of Pakistan to comply with the UN resolution in this regard. The constitution of Pakistan or Parliament of Pakistan has nothing to do with the issue of Gilgit Baltistan or PoK, because these areas are not a part of Pakistan. The only obligation of Pakistan to UN is to call back its forces, agents and citizens. Local Authority under the surveillance of the UN should have been given to the people of Balawaristan. According to the UN resolutions, the sovereignty and integrity of the disputed region would not be affected. But government of Pakistan violated this clause of UN resolution by encroaching Shandoor, Bhasha and Babosar pass besides its intention to build 7 mega dams on this land without the will of the people. What punishment has been given against the Government of Pakistan by the Supreme Court of Pakistan for Human Rights Violation of the people of Balawaristan, since 16th Nov. 1947? What has the Court done to compensate the 2 million people of this disputed region? Had the Supreme Court gone through the statement of Shahzad Iqbal, Deputy Secretary of Pakistan, made in Lahore High Court on behalf of the government of Pakistan stating that, under article 1 Sub Section 2 of the constitution, Northern Areas (Balawaristan) is not a part of Pakistan.It has also been admitted by Pakistan Government that granting of constitutional rights to Balawaristan by annexing it with Pakistan would be against the Pakistani stand adopted at international level. In an agreement, made with China On March 3,1963, Pakistan cunningly described the areas of Balawaristan as Jammu & Kashmir instead of Hunza or Shoomshaal (Balawaristan).

Court against a writ petition No 11-17 of 1994:Function of the Council subject to the responsibilities of the Government of Pakistan under the UNCIP Resolutions and the orders and directions as may be issued by it and subject to financial limitations as it may impose from time to time, the following shall be the powers and functions of the Council, namelya) To make the laws with respect to the municipal functions as may be specified by the government of Pakistan.g). to perform and exercise all powers and functions which may be exercised and performed by a Local Council in Pakistan. PAKISTANI STANDA statement was submitted in Lahore High Court, by Mr. Shahzad Iqbal Deputy Secretary Kashmir Affairs and Northern Areas (Balawaristan) Affairs Division of Pakistan on behalf of Government of Pakistan, against writ petition No.862,1990. The Petition was filed by Mr.Qurban Ali, Adv. Shahbaz Khan and Fida Mohammad Nashaad versus State of Pakistan and government of Pakistan.A paragraph of the said statement is as under : -a. In terms of article 1 (2) of the constitution of Islamic Republic of Pakistan, Northern Areas (Balawaristan) does not form part of Pakistan. This area is linked with the main Kashmir issue which is under consideration in the UN for the last 50 years.Second paragraph of his statement : -b. Grant of constitutional status tantamount to unilateral annexation of Northern Areas (Balawaristan) with Pakistan, which will be against Pakistan stand on Kashmir issue in international fora.c. Till a decision of this dispute (meaning the whole J & K dispute) government (Pakistan) is administering Northern Areas (Balawaristan) in accordance with the provision of United Nations Commission for India and Pakistan (UNCIP).Mr. Shahzad continues his statement and says :d. While administering Northern Areas (Balawaristan) in accordance with the provision of UNCIP resolution in exercise of its powers as provincial government for the area had been extending federal laws

to these areas through special powers as are considered necessary and expedient in public interest.

SUPREME COURT OF PAKISTANHeaded by Justice Ajmal Mian on 12 May 1999. It may be observed that the geographical location of the Northern Areas (i.e. Balawaristan) is very sensitive, because it is bordering India, China, Tibet and USSR, and as the above areas in the past have also been treated differently, this court cannot decide what type of government should be provided to ensure the compliance with the above mandate of the constitution, nor we can direct the people of Northern Areas should be given representation in the Parliament as, at this stage, it may be in the larger interest of the country because of the fact that a plebiscite under the auspices of the United Nations is to be held. In regard to the right to access to justice through an independent judiciary, it may be observed that the Northern Areas (Balawaristan) has a Chief Court, which can be equated with a High Court, provided it is manned by the persons of the stature who are fit to be elevated as judges to any High Court in Pakistan.Its jurisdiction is to be enlarged so as to include jurisdiction to entertain Constitutional Petitions inter alia to enforce the Fundamental Rights enshrined in the constitution.We therefore, allow the above petitions and direct the Respondent Federation as under:To initiate appropriate administrative/legislative measures within a period of six months from today to make necessary amendments in the constitution / rules / notification / notifications, to ensure that the people of Northern Areas (Balawaristan) enjoy their above fundamental rights, namely, to be governed through their chosen representatives to have access to justice through an independent judiciary inter alia for enforcement of their Fundamental Rights guaranteed under the constitution.

GENERAL PROVISION OF UNCIPA. The territory evacuated by the Pakistan troops will be administered by the local authority under the surveillance of the commission.B. Immediately upon the acceptance of these terms, the commission would enter in to consultation with the Government of India regarding the disposal of the Indian and state armed forces and with the local authorities regarding the disposal of the armed forces in the territory to be evacuated by Pakistani troops, with a view to initiating implementations of point 4 (A) and (B) of the commission’s resolution of 5th January, 1949.C. If before expiration of the seven weeks contemplated in point II.A decisions are reached in the consultations for the initial implementation referred to in III.B above the schedule of withdrawal of the Pakistan Army as provided for II.A above may be extended to three months, in order to facilitate the implementation of decision relating to point 4 (b) of the commission’s resolution of 5th January, 1949.D. It will be made publicly known throughout the state of Jammu & Kashmir that peace, law and order will be safeguarded and that all human and political rights will be guaranteed.

BNF. The truth is that, UNCIP provision does not allow Pakistan to rule over the State of Jammu & Kashmir and its strategically important part i.e. Balawaristan (Pakistan occupied Gilgit Baltistan). According to UNCIP provision or UN resolution, Pakistan has no right to extend its Parliamentarian/Federal/Presidential/ Provincial/ Military or any other laws to Balawaristan.KANA division or Parliament or Judiciary of Pakistan or other judicial, administrative/ representative of Pakistan based in Balawaristan (Occupied Gilgit Baltistan) or Islamabad or anywhere in Pakistan have no right to extend / exercise any ordinary or special powers to this area, without popular will and representation of the 2 million people of Balawaristan. As far as the interest of the people of Balawaristan is concerned, what the representative of Pakistan has mentioned in his statement before Lahore High Court is malevolent and baseless. Because, no people of the world would stamp on the orders of their slavery and thus the people of Balawaristan have never asked Pakistan

to impose its colonial laws over them. But on 16th November 1947, Pakistan had treacherously entered in to Balawaristan (Gilgit Baltistan) in the name of religion. As far as Mr. Shahzad’s statement, that Balawaristan is not part of Pakistan and he has also expressed the opinion and compulsion of Pakistan to grant constitutional status to Balawaristan is concerned, it’s correct. In the statement before Lahore High Court he did not submit any document regarding the so-called fraudulent paper of accession of Mirs with Pakistan and 28th April 1949 Karachi agreement as legal instrument, which endorses the stand of BNF that Pakistan has no legal authority over Balawaristan.In the light of the above mentioned documentary proof, what is the justification for Pakistan, its parliament, civil and military administration, judiciary, force, intelligence agencies and other departments to be involved in the matter of Balawaristan? As far as the interest of 2 million people regarding the outlandish laws is concerned, no such political party exists in Balawaristan, which has ever recognized the Pakistani setup and its laws. Not to mention of a party, every single person except ISI agents, is fed-up with the Pakistani occupation and colonial rule, whether or not he/she is educated or illiterate.On 9th April 1993 an all party conference was held for the first time in recent Balawaristan’s political history, where more than a dozen local based Pro-Pakistan, religious and political parties and pro-independence nationalist parties were gathered under the leadership of the pro-independence nationalist party - Balawaristan National Front (B.N.F.) in Gilgit. They formed Alliance and unanimously condemned the Pakistani occupation and its system since 16th November 1947; as a result Pakistan was compelled to announce its fraud package to overcome the unrest. UNCIP. It will be made publicly known throughout the state Jammu and Kashmir that peace, law and order will be safe guarded and that all human and political rights will be guaranteed.BNF.According UNCIP resolutions of 13th Aug.1947 and 5th Jan.1949, to maintain law and order is the duty of the Local Authority but not the Pakistani agents stationed in Balawaristan. your attention towards the UNCIP’s important resolution regarding Local Authority in the Pakistani Occupied Kashmir (POK) and Balawaristan (Pakistan occupied Gilgit Baltistan)

UNCIPPart II section A.3 of the resolution of 13th Aug.1949 provides, that pending final solution, the territory of the state evacuated by the Pakistan troops would be administered by the LOCAL AUTHORITY under the surveillance of the commission.BNF: In the presence of all the above mentioned commitment of UN and its Security Council, what legal and moral right is left to Pakistan to im-pose its civil and military administration in Balawaristan by violating UN and UNSC resolutions, while UNCIP resolution also provides guarantees of no prejudice to the territorial integrity and sovereignty of the state of Jammu and Kashmir including Balawaristan in its general provision?This is the part of the world, where kangaroo courts Chief Court and Appellant Court have been established on contract basis, where no right of writ petition against human rights violation is allowed, while death sentences and other major punishments or awards are granted without any further appeal in any High Court or Supreme Court against the illegal decision of a contract based pro-Pakistani member of the court whose duty is to fulfil the ambitions of Pakistani occupying regime. Neither the agency of Gilgit-Baltistan, nor its successor, Northern Areas, has found any place in the Pakistani constitutions drafted in 1956, 1962 and 1973 and amended constitution of 2010. It is virtually a forgotten colony for the government of Pakistan in terms of rights but remembered only in terms of cruelty and atrocities. Gilgit Baltistan (Balawaristan/Bloristan) is constitutionally part of the whole Jammu & Kashmir and thus is a part of India. It’s to mention that Indian Parliament has also passed a resolution in 1995 regarding Pakistan Occupied Gilgit Baltistan and Pok but again ignored Chitral and Shhenaki Kohistan.But India also does not bother about its constitutional obligation in the context of Balawaristan (Gilgit Baltistan) while Chitral and Shenaki Kohistan were also part and parcel of Jammu & Kashmir under Mahraja’s suzerainty.The indigenous people of Gilgit Baltistan are facing serious loss of

properties and life from the River Indus, which had not been taken into account before India held Water Treaty with Pakistan in 1960, which does not suit to a democratic country like India. Indus Water Treaty also does not allow Pakistan to build any dam on disputed land and change its demography and geography.The new plan of building 7 dams do not only bring grave consequences to the environment and human life of this disputed land but to the agriculture and even drinking water of Sindh and lower Punjab of Pakistan also. The deployment of 7 division troops to safeguard all these dams besides a huge number of Pakistan’s notorious intelligence agents and the resulting impact on the local indigenous population is beyond imagination, if 7 DAMS are built.By keeping in mind the disputed nature of this part, Pakistan should be stopped from constructing Mega Dams (Diamar Bhasha Dam, Bonji Dam, Hanzel Dam, Skardu Dam, Kharmang and Khapolu Dam) in disputed Gilgit Baltistan on Indus River, which will cause more than half of the indigenous population to vanish completely. Besides the displacement of more than a Million population out of a total 2 million, the destruction of thousands of years old civilization, the drastic change of environment, the melting of glacier would bring un-bearable crisis to the region in future. Royalty (70% to NWFP and 30% Royalty to Balawaristan as proposed by Pakistan) and ownership is another serious question. The ownership issue should also be solved by international community- not by Pakistan- according to the wishes of the people of Gilgit Baltistan to avoid any future conflict. I avail myself of this opportunity to elucidate some facts about the ALARMING situation of China’s new designs to occupy Gilgit Baltistan with the blessing of Pakistan and the stealthy process of this occupation is already underway with a huge presence of Chinese nationals in our area. To occupy our lands by leasing mountain heights and construction of 7 Mega Dams and roads everywhere.

China had already occupied many of our areas like Taghdumbash and Raskam areas of Hunza including Azghar, Kuktash, Arsar, Uprang, Uruklu, Aliksu, Tashmani and Aksu which were part and parcel of

Hunza (the old name of Hunza is Kanjut) before 1947. Later Pakistan ceded major part of Shomshaal, Hunza to China in 1963 for the construction of Karakorum Highway (KKH), which is mostly used for the Military purpose between Pakistan and China. Besides this China has recently constructed 16 Airstrips on Karakorum Highway (KKH) which link Pakistan with China through this constitutional part of J&K. Pakistan is violating all human rights and other international obligations and wants to occupy this region permanently by giving a major share to China with impunity. Pakistan is also strengthening its occupation by giving more than 2000 leases of highest mountains which are full of precious and industrial mines including Copper, Gold and Uranium to China and its own citizens illegally by simultaneously violating State Subject Rule, UNCIP Resolutions and Universal Declaration of Human Rights. In the absence of proper and impartial Judiciary and public Representation, there is no meaning to safeguarding the people’s rights. Gilgit Baltistan is ruled by the occupying regime of Pakistan and its Military. Our people have neither any representation in Pakistan nor in Gilgit Baltistan. As a matter of fact people of this region are treated as Colonial Slaves of Pakistan even in the 21st Century. This is the only part of the world, where 2 Million indigenous people including local Police, Judiciary, Administration, Education and all government departments are facing worst kind of humiliation and discrimination in the hands of Pakistan’s occupying civil and Military regime. Installation of Nuclear weapons near Skardu Airport beneath the mountain is a yet another conspiracy against this region; which is enough to exterminate the whole population if they explode any time.We appeal to the world community, The United States and The European Union to persuade China not to involve itself in the occupation process of Balawaristan (Pakistan occupied Gilgit Baltistan) by taking lease of precious mines, by constructing Railways and Dams to change its environment, demography, geography and political dispensation.World community should take serious notice of ISI’s new attempt to bring the disputed parts of Jammu & Kashmir, Occupied Gilgit Baltistan and Chitral as their war field. Pakistan wants to perpetrate a genocide of the

local owners of the Dams and nationalists after Swat, by using the pretext of Talibaan, so the resistance power against the Pakistani occupation is perished. Pakistani forces killed 3 innocent protestors in Chilas and many were injured by discriminate firing on the peaceful protestors, who were against the forceful construction of Diamar Basha dam.The imposition of Sharia law is Pakistan Army’s and its ISI’s modern nuclear bomb against the region. The world community should also take notice of the fate of non-Muslim communities of (Kalash) of Chitral, besides Brelvi, Shia and Ismailia Muslims after the one-sect Sharia laws get imposed. There is no common Sharia law in the whole Muslim world. But Talibaan and Al-Qaeda want to extend their own brand un-Islamic laws by the help of Pakistani forces and its intelligence agency, which is completely unacceptable.The question of democracy, good governance and justice is a dream under illegal, unconstitutional colonial rule of Pakistan. All fields of life in this region are presenting the look of the Stone Age today. The culture, traditions, natural resources and identity, dignity and life of indigenous people have been destroyed and the people living here for centuries have been divided in terms of religion, sect, language and ethnicity in order to stop their fight against the new colonial power of Pakistan. There is no other way to compensate for the exploitation except freedom from the occupation of Pakistan. Package Protects Pakistan and China’s Military and Economic InterestOn 29th Aug. 2009, Mr. Syed Yousuf Reza Gilani, Prime Minister of Pakistan, announced a package for Balawaristan (Pakistan Occupied Gilgit Baltistan) by terming it as self-governance and Internal Autonomy. The so-called package has been finalized by a high powered Committee under the Chairmanship of Mr. Qamar Zaman Kaira, (A Pakistani National and not elected from Gilgit Baltistan) Minister of KANA Islamabad. Despite making high claims of granting SELF-GOVERNANCE or INTERNAL AUTONOMY, a so-called Legislative Assembly and a Council similar to a civil puppet cabinet under a Martial Law administrator has been introduced, which is tantamount to betrayal with 2 Million people of Balawaristan (Pakistan Occupied Gilgit Baltistan) for a 5th time by these package dramas since 1971.

Chairman of the Council (Prime Minister of Pakistan, who is not elected by the people of this region) is the Supreme Authority in this package. This arrangement is being seen as a major ploy to control the elected representatives of Gilgit Baltistan, so as to use the new political setup as rubber stamp to get approval for the construction of 7 Mega Dams including Diamar/ Bhasha Dam, Bonji Dam and also to merge Gilgit Baltistan into Pakistan by ignoring the will of the 2 Million people as well as the UNCIP resolutions. A new designation is given to the local puppet Chief Executive as Chief Minister, but the CM would not be authorized to form his cabinet. The elected legislative assembly would not be able to elect the chief minister, President of Pakistan appointed governor, and Ministers without any democratic procedures. The newly introduced Gilgit Baltistan Council like in PoK has also been selected by open auction in return for bribe by the President of Pakistan. It was learned publicly, that a Bank employee was nominated for governorship for 50 million rupees, but later he was dropped because he could only arrange 10 million Rupees. This power mechanism is a clear indicative of future plan of Pakistan to exploit the resources of this region of Jammu & Kashmir dispute. As per the order of President of Pakistan (which has not been protected by any law or constitution), Gilgit Baltistan (GB) shall have a council which will consist of the prime minister of Pakistan, the governor selected by the president of Pakistan, six members nominated by the prime minister from amongst the federal ministers and members of Parliament of Pakistan, the chief minister of GB, and six members to be elected by the assembly in accordance with the system of proportional representation. And let us not forget the federal minister for Kashmir affairs and Gilgit-Baltistan is supposed to act as an ex-officio member of the council.The council (composed of 8 Pakistani including Prime Minister and other Ministers and 6 locals(puppets) selected by Pakistani officials) have powers over post ,telegraphs, nuclear energy (with the hidden intention to dump nuclear waste in this region, otherwise what prompted Pakistan to give the nuclear energy powers to the Council of Gilgit Baltistan, which is disputed region and have no nuclear plant, or with the future intention to install nuclear weapons on this disputed land ),designs, copyright,

trademarks, aircraft and air navigation regulation etc, railways (to build railways to supply Chinese items to Europe and Gulf via Gawadar port of Balochistan), matters related to incorporation and winding up of corporations, education, tourism and amongst other things, newspapers, books, and printing presses. All the powers rest with the government of Pakistan firmly even than before. So the world community should see itself what rights and what constitution we have , everything is controlled by Pakistani regime here from post to media. There is also a Legislative Assembly of 24 locally elected(actually those are also selected by Pakistani regime in rigged elected, who support occupation of Pakistan) representatives from the region itself and 9 are selected directly by the orders of Pakistani regime. Surprisingly, this Gilgit Baltistan Assembly has the power to legislate on protection of wild animals, prevention of cruelty to animals, money lending and money lenders, botanical, zoological and anthropological surveys, betting and gambling( which is unknown in this region). The irony is this Legislative Assembly has to present resolution on animals and plants and have no right to legislate for the interest of the human beings of this disputed region. This is joke of Pakistan played with the European Union and UN as well as with the people of Gilgit Baltistan, which is like making fun of word Democracy.There are other restrictions on the assembly itself under Article 44 of the order, whereby they cannot discuss about foreign affairs, Defence, Internal security and Financial plans of the area. Such fraudulent instruments are creating destruction to the social economical and ethnical rights and right of FREEDOM of the indigenous people. The presence of Pakistani forces is posing a grave threat to the life, dignity, fundamental economic, social, political and the very existence of the indigenous people. It may be called a failure or apathy from the part of the UN that, in spite of the UNSC guarantee, the territorial integrity and sovereignty of this land. UNCIP resolution is being violated by engulfing Shandur, Baboosar, Kohistan, Chitral and ceding parts of Hunza to China and now in the shape of Bhasha Dam, Bunji Dam and 5 other mega dams, destroying and submerging huge rare monuments, and displacement of the indigenous people, which obviously changes the demography as well as geography of this disputed colony under Pakistan. Three people were killed and many were injured by Pakistani occupying regime in Chilas, when they protested against the

forceful occupation of their lands for Bhasha Diamar dam. It is irony that the socio-economic, cultural, democratic and fundamental rights and right to freedom for the 2 million people, as guaranteed by UN, according to the Universal Declaration of Human Rights is openly dishonoured. The government of Pakistan and its emissaries always misguide the international community and deny each and every crime of its regime and intelligent agencies.Without indigenous control over local language, culture and resources, Social values cannot be protected as given by Universal Declaration of Human Rights. The people of this region are not made aware of Civil and Political Rights, due to continued foreign occupation since 16th November 1947. We appeal to UN and UNHRC and Specially European Union to send special reporters / experts to assess the situation of Gilgit Baltistan, to ascertain the mysterious activities of Chinese and Pakistani forces on the higher mountain of about 80 Sq KM area Shimshaal and 1200 Sq Km of Choopoorsan of Gojal Hunza and Chhahlt of Nagir where according to some sources missile has also been used on mines. Its urgent need of the time to know the ground reality and Pakistani official propaganda, and present unbiased facts which are more devastating than what has been mentioned here. We strongly believe that in the presence of huge number of Pakistani forces and its Intelligence agency the definition of autonomy or Self-Rule is an eyewash to the world community, which is trickery for gaining time to strengthen the Pakistani occupation with the full fledged help of government of China. The Gilgit Baltistan Legislative Assembly and Council are not authorized to discuss security and internal matters besides foreign and defense matters, because this is a resourceful region as well as war zone for launching terrorist activities of Pakistani forces across the borders. The increase of the number of judges in this so-called package without giving powers, like that of High Court and Supreme Court, is meaningless. The 2 million indigenous people will now be more deprived than ever after the implementation of this package. Any person can be kidnapped and killed by the forces, intelligent agencies, and even by the kangaroo courts, without giving them the right to appeal in High Courts and Supreme Court. According to the constitution and law of Pakistan and UNCIP resolutions Gilgit Baltistan does not fall in the legal jurisdiction of Pakistani courts. Pakistani imposed lower Court (Any Pakistani Session Court Judge or retired High Court Judge) who was being appointed as Judicial Commissioner in the past. Now the same powers of Judicial Commissioner were given to Court name Chief Court or Appellant Court consist 3 or more than 3 persons who award death sentence or life imprisonment to the local indigenous people of Gilgit Baltistan without giving them the right to appeal in High Court or Supreme Court of Pakistan or elsewhere. The following were given death sentence without giving them the access to High Court and Supreme Court. What is the justification for consulting these Pakistani self-claimed Stake holders, all of whom have no legal or constitutional authority to impose their own branded laws against the wishes of the people of an area which is not part of Pakistan according to its own constitution and Court verdicts, besides, UNCIP Resolutions. The engineer of the so-called Package is GHQ (Pakistan Army Headquarters Rawalpindi) and not the so-called democratic government of Pakistan. In my evaluation the following are the reasons behind this new Pakistani Package move.1. To safeguard Pakistan and Chinese economical and military interest, Pakistan wants to merge this disputed and most strategically important part of J&K with its NWFP/Khyber Pokhtoonkhowa Province in the near future with the help of the so-called Assembly and Council by making use of them as RUBBER STAMP.2. To show the International Community and particularly European Union and USA and Donor Agencies including World Bank, IMF and Asian Development Bank, that Pakistan wants to re-address its illegal occupation, by making fake announcements of Self-Rule and Autonomy.3. The so-called Package holds its iron grip over the neck of Balawaristan’s 2 million people and particularly the nationalist parties if and when it’s fully functional. Pakistani forces will be acting more freely and ferociously than before because the clause of this packages which gives impunity to Military and its Intelligence Agencies. Because in the absence of an indigenous Parliament, High Court and Supreme Court, victims (indigenous people) have no right to access Justice against Pakistani colonial atrocities.To settle these boundary disputes between Balawaristan and Pakistan, Pakistani Prime Minister has announced to establish a Boundary Com-mission during his package announcement. According to the source, a Pakistani Judge from NWFP (Pukhtonkhowa, Pakistan) and another Judge from Gilgit Baltistan (who gets salary from Islamabad) have been deputed

It’s understood that the partial judges will favour their benefactor party (Pakistan) and not Balawaristan, because they are Pakistani employees- not impartial judges.Though this is a world recognized phenomenon and law that a Judge should always be impartial. It defies the rules of justice that a party to a dispute delivers a judgment on the dispute. Pakistani national, whether a serving or retired Judge or any person or a Pakistani employee from Gilgit Baltistan who gets salary, promotion and other benefits or interest from Pakistan cannot be entrusted with impartial judgment.Besides this, China has constructed 16 Airstrips on Karakorum Highway (KKH), which is mostly used for the Military purposes (Missiles and nuclear parts have been supplied to Pakistan via this Road in the past) between Pakistan and China.

As per the order, Gilgit Baltistan (GB) shall have a council which will consist of the prime minister, the governor selected by the president of Pakistan, six members nominated by the prime minister from amongst the federal ministers and members of Parliament, the chief minister of GB, and six members to be elected by the assembly in accordance with the system of proportional representation. And let us not forget the federal minister for Kashmir affairs and Gilgit-Baltistan is supposed to act as an ex-officio member of the council.The council (8 Pakistani imposed and 6 locals selected by Pakistani) has powers over post and telegraphs, nuclear energy, designs, copyright, trademarks, aircraft and air navigation regulation etc, railways, matters related to incorporation and winding up of corporations, education, tourism and amongst other things, newspapers, books, and printing presses. All in all, there are 55 items in the council list, and most have ensured that the council, in which the government of Pakistan is handsomely represented, is equipped with subjects of the utmost importance and relevance. On the other hand, there is also a Legislative Assembly of 33 locally elected representatives from the region itself. Out of the 33 available seats, 24 will be for those directly elected from the different areas of GB, six consist of reserved seats for women, and three for technocrats. Surprisingly, this GB assembly has the power to legislate on many items such as protection of wild animals, prevention of cruelty to animals, money lending and money lenders, botanical, zoological and anthropological surveys, betting and gambling, and amongst other things, “inquiries and statistics for the purpose of any of the matters in the list.”

In addition to this, there are other restrictions on the assembly itself under Article 44 of the order, whereby there can be no discussion within the same about matters relating to foreign affairs, defence, internal security and fiscal plans of the federal government.

Legally Pakistan has no stand on Gilgit Baltistan like the other disputed parts of Jammu & Kashmir, on the other hand the claims made by government of India over Gilgit Baltistan (Balawaristan/Bloristan) are legal and constitutional but has nothing to implement all the above UN resolutions, charters, as well as its own constitution for the freedom of the 2 million enslaved people. India has not bothered about its constitutional obligation in the context of Balawaristan (Gilgit Baltistan) while ignoring that Chitral and Shenaki Kohistan were also part and parcel of Jammu & Kashmir under Maharaja of J&K suzerainty.

We the people of Balawaristan reject this new Pakistani package, because this will create more deprivation, lack of Justice and snatch our freedom forever. We appeal to the world community not to allow Pakistan to kill the innocent people of Balawaristan by cunningly using the pretext of fighting the Talibaan, so as to be able to build Dams in its own interest and to maintain its colony with the assistance of a veto Power country- China. World Community should also put pressure on Pakistan to withdraw its troops and civilians, Afghan and Pakistani Taliban, terrorist groups and their master the ISI from Balawaristan (Pakistan Occupied Gilgit Baltistan) and PoK, abiding by UNCIP resolutions to carry out free, fair and impartial referendum for a Constitutional Assembly under the supervision of UN . This is the only peaceful and democratic way of deciding the future fate of this disputed territory- THE LAST COLONY of 21st Century,. This is also the only solution to avoid any future conflict between Pakistan, India, China, Russia, USA or Europe in the future.

I, on behalf of Gilgit Baltistan Democratic alliance(GBDA), condemn this Martial Law order of FCGB (Field Commander Gilgit Baltistan) in this last Colony in the hands of the so-called democratic government of Pakistan.Baltistan Democratic Alliance (GBDA) based in Gilgit and All Parties National Alliance (APNA) which is based in Rawalpindi Pakistan are alliance. This is an alliance of the nationalist parties from Gilgit Baltistan and Pakistan Occupied Jammu & Kashmir, while GBDA is based in Gilgit, which therefore demand for freedom from the colonial occupation of Pakistan.On 27th April 2010. (Retd) Nadir Hassan, Mehmood Baig, Ex resident Bar Council Jammu & Kashmir Muzafarabad and Mr. Mohhad Farooq Advocate, Chairman Karakorum National Moment (KNM) were arrested and were forcibly sent to exile to Rawalpindi Pakistan by the orders of Pakistan Army. Article 9No one shall be subjected to arbitrary arrest, detention or exile.Whereas, recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world. Arbitrary arrest, torture, detention and exile is the daily routine of the occupying regime of Pakistan, because of no higher and independent judiciary system and representation in any Parliament. Human Rights organizations and independent media is out of question in this area. Hundreds and hundreds of local people were put behind bars for their religious and political differences and many political leaders including Mr. Wajahat Hassan, Ex member of NA Council and Col. Nadir Hassan were arrested and were forcibly sent to exile to Pakistan from their home in Gilgit on 1st Nov. 2009, when they tried to hold peaceful public gathering during election campaign. Indigenous people are given death sentences without giving them any right to justice in any High Court or Supreme Court. Article 19:Everyone has the right to freedom of opinion and expression, this right includes freedom to hold opinion without interference and to seek, receive and impart information and ideas through any media and regardless of frontiers.The people of Gilgit Baltistan cannot even dream of the freedom of ex-pression. The fundamentalist religious groups, pro-Pakistani parties and terrorist groups have been given the freedom of expression and movement. It has already been mentioned that more than 200 people are facing sedi-tion charges, when they only tried to peacefully express their views in the public. Many people had been sent behind bars when they tried to express themselves. Many have been tortured, kidnapped and thousands were kil-led by declaring them as Sooni or Shia

Article 20:1. Everyone has the right to freedom of peaceful assembly and associ ation.2. No one may be compelled to belong to an association.Only the Pro-Pakistani and religious fundamentalist parties have the right to assembly. Even in the last so-called elections, hundreds of GBDA (Gilgit Baltistan democratic Alliance) workers and leaders were detained, tortured, threatened and exiled, when they announced for a peaceful assembly on 31st October 2009. People are compelled to join Pakistani parties and groups by threatening them with economical bars. International Covenant on Civil and Political RightsAdopted and opened for signature, ratification by General Assembly resolution 2200 A (XXI) of 16th December 1966. Entry in to force on 23rd March 1976 in accordance with Article 49 Preamble:Considering that, in accordance with the principles proclaimed in the charter of the United Nations, recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world, Recognizing this, in accordance with Universal Declaration of Human Rights, the ideal of free human beings enjoying freedom from fear and want can only be achieved if conditions are created whereby everyone may enjoy his economic, social and cultural rights, as well as his civil and political rights, as well as economical, considering the obligation of the States under the charter of the United Nations to promote universal respect for, and observance of, human rights and freedom.

The 2 million indigenous people, except Pakistani settlers, are not even aware of UN guaranteed Economical, Social, Cultural, Civil and Political Rights. In spite of abundant Gold mines, Uranium, Aquamarine, Ruby, Emerald and other precious and Industrial mines, huge tourism potential, trade with China, water resources, the people of this area live below poverty line, because all their resources are plundered by Pakistanis and are spent in and sent to Pakistan. About 2000 Minerals leases have been given to Pakistani nationals and Chinese by ignoring this UN resolution. The people of this region do not yet know what Social rights in UN

documents mean. The hospitality of this region was exemplary and the social character was so high that no other area of the world could be compared to it, but this was so before 1971. Late Zulfiqar Ali Bhutto, the then Prime Minister of Pakistan, hatched a conspiracy to hold Pakistan’s iron grip over this area after 1971 by sending their immoral civil and Military force, not only to systematically disturb its social behavior but also the legal, economical and ethic values of Gilgit Baltistan. Due to Pakistani slow invasion, besides its high valued social behavior, the Unique Culture and economic independence of this region has also been disrupted by its Military and civil regime with the help of its corrupt nationals and media. Pakistani occupant regime has been providing huge funds to promote their own culture and language and discouraging the unique culture and languages of Gilgit Baltistan and Chitral. The people of this region are not aware of Civil and Political Rights, because of this occupation since 16th November 1947. On 28th April 1949 UNCIP had inked a TRUCE TERMS agreement between India and Pakistan. According to the Truce Terms Pakistan had to withdraw all its forces from Gilgit Baltistan and its occupied Jammu & Kashmir within the period of 3 months. The UN commission had notified that while India had to withdraw bulk of its forces, Pakistani nationals and their forces had to be withdrawn from this region. On the other side, government of Pakistan had made a fraudulent agreement with two leaders of its occupied J&K, Sardar Mohammad Ibrahim and Choudhry Ghulam Abbas by keeping the people of Gilgit Baltistan in the dark.This is an irony, in spite of clear UNCIP resolution for withdrawal of Pakistani forces, Pakistan multiplied its forces by 1000 folds and settled its fundamentalist nationals on the soil of Gilgit Baltistan. This conspiracy has become an open secret of ISI, in which the disputed territory of Jammu & Kashmir (J&K) state had to be turned into ashes before invasion of J&K and Ladakh on Indian side, due to this deteriorating situation the unrest will be caused among the people of concernd territory. dozen youth of Hanzel village some 15 Kilometers to the north of Gilgit city. They were killed by ISI and Jamaat-e-Islami when they refused to cross LoC (Line of Control between India and Pakistan in J&K). When their parents approached the local Police headed by Pakistani Pathan to register a case of murder against ISI and Jamaat-e-Islami, they refused flatly and the kins were warned of dire consequences if they blamed ISI again. No case could be filed against Pakistani occupants and their notorious agency the ISI. The occupants are not content with it, but are continuously involved in making differences between the different ethnic groups. Moreover the innocent un-employed youth and teenagers are being trained in different training centers of Balawaristan viz. A secret building of billion of rupees of cost has been constructed near Sonikote Helipad for ISI consisting of 30 canals (4 acres) of land to command the terrorism within as well as across the border and underground torture cells have been established to crush the nationalist political party leaders and workers, who are struggling against the illegal occupation of Pakistan by violating UNCIP resolutions, to establish their own independent sovereign state. BNF warned the occupants for not using the borders of Baltistan and Astore for penetration of its terrorists as a result, the vast area and population of Baltistan and Ladakh Kargil was badly affected and hundreds became homeless and many innocent civilians lost their lives for nothing. The rapid settlement of Pathans of NWFP province of Pakistan, unveils itself the nefarious designs of Pakistan against this disputed part of State of Jammu & Kashmir, who are being involved in storing sophisticated arms in Pakistan Army camps. NLI Market, ISI Headquarters Gilgit, FC and Khyber Rifles camps and other secret places terrorists camps and non-locals position under the supervision of Pakistan Army and ISI are deployed in Balawaristan (Occupied Gilgit Baltistan). These non-locals have premeditated by distributing the properties of locals among themselves by propagating the fear of the proposed invasion of Talibaan in near future. While Saudi Arab plays the card of Osama and Pakistani fundamentalist groups like Moulvi Fazal Rahman and Qazi Hussain Ahmad etc by the help of Pakistan Army and its ISI are well against the interests of US. As you are well aware that Saudi Arab is playing anti US games, has close links with these notorious organizations, sponsoring them through ISI to promote Wahabism (the fundamentalist sect of Saudi Brand Islam), all over the world against US and non-Muslims.Saudi Arab is calmly funding Pakistan in building trenches for Wahabi terrorists in the name of mosques throughout South Asia and Gilgit Baltistan particularly to control Central Asia. The building of mosques and religious schools (Islami Madrasas) are being intensified throughout Pakistan and Indian Kashmir by spending billions of dollars. Saudi Arab also provides funds to these terrorists bases through a Karachi Pakistan based organization name “Sadiqi Trust” .The example of such activities can be observed if survey is made carefully in the valleys of Yasen, Goopis and Ishkoman (Gilgit region) which link with Afghanistan and Central Asian countries. 60 Million Rupees have been given to a Wahabi worker of Immit village of Ishkomen valley near Afghanistan border to purchase lands for Wahabi terrorists up to till now. But unfortunately USA was not bothered by these type of terrorism unless the terrorists directly attacked on USA. The terrorism is a long process of Wahabi Islamization sponsored by the friendly country of USA i.e. Saudi Arab .Because of its Wahabi origin and ambition to spread this belief throughout the world by money power, these elements do not respect the right of other nation and religion and even other Muslim sects. Talibaan have detained US and European aid workers in Afghanistan besides Afghan nationals by framing charges of spreading Christianity, while Talibaan itself had massacred thousands of innocent human beings of Afghanistan accusing them non-Wahabi.USA and Europe must not allow any permanent person to be a religious leader in mosques by following the tradition of Turkey. No Islamic Schools (Madrasa) should be allowed to function. All Schools buildings must be changed in to normal Schools and normal subjects should be allowed. Nobody should be allowed to stay inside the mosques immediately after the congregational prayer because individual can offer his pray in his own place and the mosques should be locked immediately after the congregational prayer.Separate Islamic Madrasas (Schools) or Islamic teaching inside the mosque or Schools must not be allowed. A person should be allowed to teach Islam to his children in his house or he should be allowed to appoint a teacher in his house. Moreover USA and Europe donate these terrorist Wahabi Muslims Talibaan on the humanitarian bases while they do not accept the humanity and used these aids against other human beings of Afghanistan, USA and Europe.It is really sad to say that the visa policy encourages Wahabi fundamentalists and drug smugglers of Pakistani nationals (mostly Pathan and Punjabis) to visit and settle in USA and Europe particularly . As a result more and more fanatics are being settled in USA and Europe and they establish their network against other religions and sects. The motto of these Wahabi fanatics is to convert infidels (they call Christians, Jews and others as infidels) and even other Muslim sects in to Islam or to destroy them. The grip of fanatics over USA and Europe can easily be watched and observed in the media like voice of America (VOA), British Broadcasting Corporation (BBC) and Voice of Germany (VOG), which propagate Wahabi terrorists theology and stand of such countries like Pakistan throughout their programs and encourage terrorism. The reporters and representatives of these media never expose the terrorists but encouraged them. They always try to blame non-Muslims by defending and clarifying the terrorist stand.Saudi Arab the friendly country of USA is on the top of the list, which provides huge funds to build terrorist network with the help of Pakistan, throughout Asia and rest of the world. In this context they initially build mosques and Islamic Schools (Madrasas) to promote Wahabi fanatics, where the main aim is to convert non-Muslims and even the person of other sects in to Wahabism, otherwise destroy them by terming them as KAFIRS (infidels). Saudi Arab does not fund any one on purely humanitarian basis and it does not build any Hospital or general School and any charity works except to promote fundamentalism by mosques as terrorist camps and religious Schools. Pakistan provides men resources, training and brain washes against non-Muslims and even non-Wahabi Muslim in its ISI sponsored training camps. Afghanistan (Talibaan) acting like a third person by complying the orders of Pakistan Army (ISI) and Saudi Arab and provide shelters to terrorists and harboring terrorism against other Muslim sects and non-Muslims like Christians and Hindus. This is not a question of one Osama, this is the whole system and organized network, which has been established in the Afghan war against USSR. If Osama will be killed by USA or any one he will become a hero of Muslims because of the Wahabi propaganda. Unless and until the whole terrorist network is broken the threat to the USA, Europe and other people of the world cannot be erased. USA should kill the whole system and let Osama to live. If his source of funds (Saudi government) is killed he cannot survive, as Osama and he will become an ordinary beggar. It is my humble suggestion, that after demolishing the whole terrorist network, Osama must be dragged to the same spots of New York and Washington DC bare foot, where his terrible act was carried out. He must be dragged between theses cities on foot daily till his death. He should not be killed or given a chance to appear in any respectable court. Those who do not respect humans must not be treated like humans, maybe I am wrong but this will hamper other terrorists to follow Osama path in future.This is an essential that first of all USA must cut the financial sources (Saudi Arab) and routes of terrorism, then catch the training instructors of Pakistan Army and its ISI and finally the terrorist within Pakistan, Afghanistan, USA, Europe and elsewhere.
