Overview of Company and Facility Location Garden Homes Management, Corp. (the Company) is located in Stamford, Connecticut. The settlement involves renovations conducted by the Company’s employees or agents in properties that the Company owns or operates in Connecticut. The settlement also involves lease transactions for such properties. The properties were constructed prior to 1978. Violations The Consent Agreement and Final Order (CAFO) settles allegations in a Complaint that the Company committed violations of the Toxic Substances Control Act (TSCA); the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E; and the Residential Lead-Based Paint Hazard Reduction Act’s Disclosure Rule, 40 C.F.R. Part 745, Subpart F. In the Complaint, the United States alleged that the Company committed the following violations: • RRP Rule Violations: Failure to obtain initial firm certification. Failure to provide an EPA-approved lead hazard information pamphlet to the tenant or

adult occupant before commencing renovation. Failure to ensure that an individual performing renovation activities was either a certified

renovator or trained by a certified renovator; and failure to ensure that a certified renovator was assigned to the renovation to carry out required responsibilities.

Failure to retain records necessary to demonstrate compliance. • Disclosure Rule Violations: Failure to provide prospective tenants the EPA-approved lead hazard information pamphlet

prior to such persons becoming obligated under lease contracts. Failure to include a Lead Warning Statement in or attached to lease contracts before

prospective lessees become obligated under the leases. Failure to include a statement disclosing the presence of known lead-based paint and/or

lead-based paint hazards, or indicating no knowledge of the presence of lead-based paint and/or lead-based paint hazards, in or attached to lease contracts.

Failure to include a list of records or reports, or a statement indicating none is available, in or attached to lease contracts.

Pollutant Reductions It is expected that potential lead exposures and environmental contamination will be significantly reduced because the Company has taken prompt steps to come into compliance with the rule. Health and Environmental Effects Lead exposure affects the nervous system and can cause a range of health effects, from behavioral problems and learning disabilities, to seizures and death. Children six years old and younger are most at risk. If not detected early, children with high levels of lead in their bodies can suffer from: • Damage to the brain and nervous system • Behavior and learning problems, such as hyperactivity • Slowed growth • Hearing problems • Headaches • Anemia • In rare cases of acute lead poisoning from ingestion of lead, seizures, coma and even death. Lead can accumulate in our bodies over time, where it is stored in bones along with calcium. During pregnancy, lead is released from bones as maternal calcium is used to help form the bones of the fetus. This is particularly true if a woman does not have enough dietary calcium. Lead can also be easily circulated from the mother's blood stream through the placenta to the fetus. Mothers with high levels of lead in their bodies can expose their developing fetuses, resulting in serious and developmental problems including: • Miscarriages, • Premature births or low birth weight, • Brain damage, decreased mental abilities and learning difficulties, and/or • Reduced growth in young children. Civil Penalty The Company will pay a civil penalty of $54,644, and will perform a window replacement Supplemental Environmental Project valued at $20,000.

The Whalley Glass Company

Overview of Company and Facility Location The Whalley Glass Company (the Company) is located in New Haven, Connecticut.

The settlement involves renovation projects conducted at properties located in New Haven, West Haven and Madison, Connecticut. The properties were constructed prior to 1978. Violations The Consent Agreement and Final Order (CAFO) settles violations, alleged in a Complaint, of the Toxic Substances Control Act (TSCA), and the Renovation, Repair and Painting Rule (RRP Rule), 40 C.F.R. Part 745, Subpart E. In the CAFO, the United States alleges that the Company committed the following violations: • Failure to obtain firm certification.

• Failure to ensure that a certified renovator is assigned to each renovation and discharges all of

the duties charged to a certified renovator under the RRP Rule. • Failure to: (a) provide a copy of the required lead hazard information pamphlet to the property

owners; and (b) obtain either a written acknowledgment that each owner received the pamphlet or certificates of mailing at least seven days prior to renovations.
