Nov. 19, 2013 /PRNewswire-USNewswire/ -- New mortgage rules will take effect in January of 2014 and the residential real estate market could be in for some major changes. What affect will this have on people seeing to purchase or refinance a home?

“The new rules will be put in place to protect consumers, ensure that borrowers are qualified and able to repay their mortgages. They will add rules that provide for in-creased background checks and licensing requirements for those who originate mort-gages,” says Daryl Mitchell Mortgage Banker with Legacy Mutual Mortgage.

“Licensed Mortgage Bankers, like those of us at Legacy Mutual Mortgage, are subject to rules in the same way lawyers, doctors, CPAs and other licensed professionals are li-censed and are subject to annual reporting and continuing education,” Daryl continued.

New rules are as follows:

• Borrowers’ debt-to-income ratios can’t exceed 43 percent compared to the current rate of 45 percent. The lower the debt-to-income ratio, the more affordable the property should be for the buyer.

• However, a temporary exception will be granted for loans that are eligible to be sold or insured by Freddie Mac, Fannie Mae, FHA or VA. This will help buyers because the vast majority of borrowers’ loans are purchased by the “three Fs.”

• Origination fees can’t exceed three percent of the loan. This makes loans more affordable for consumers, but mortgage brokers will struggle, according to Daryl.

• Interest-only, negative amortization and balloon house loans can’t be resold into the secondary house loan market. According to Daryl, these types of loans are higher risk products and have a higher default rate than conventional fixed or adjustable rate mortgages. Jumbo loans will be harder to qualify for as well because more cash reserves and credit scores over 700 may be required.

• Mortgages that don’t meet the standards for a “Qualified Mortgage” (QM), as de-fined by the Consumer Financial Protection Bureau (CFPB), could expose lenders to lawsuits. However, borrowers won’t be able to sue lenders who follow the rules.

• Homeowners also will get renewed protections when they fall behind on payments. This will help reduce foreclosure rates, which benefits homeowners, neighborhoods and the economy overall.

“Since the financial crisis of 2008, lenders have been tightening lending standards, so these rules won’t affect the majority of those seeking to buy or refinance,” says Daryl. “Regardless, it is always best to work with a licensed mortgage originator/ Banker to find the mortgage that meets the new requirements as well as the individual needs of each buyer or home owner.” Legacy Mutual Mortgage is locally owned and operated in San Antonio. What it is a home inspection?A home inspection is a non-invasive, visual examination of a residential dwelling (house), which is designed to identify observed material defects within specific components of the home.As part of your full home inspection, we will thoroughly inspect the:• Roof, Chimney & Hearth• Gutters, Flashing & Drainage• Attic/Crawlspace• Exterior Cladding Foundation• Driveway & Sidewalks • Deck & Porch• Doors & Windows • Garage• Basement/Crawlspace • Floors, Walls & Ceilings • Fireplace• Bathrooms • Kitchen• Ventilation • HVAC System• Plumbing System • Electrical System

The house should be prepared for the Fall and Winter as follows:Plumbing: Consider insulating exterior hose bib’s. Although are temperatures rarely get below freezing in San Antonio, when this happen it could be a costly repair and inconvenience.Roof: Check you roof for any damage or missing shingles, Clean the gutters, and valleys, after all the leaves have fallen. If the downspouts drain in to an underground system, check to make sure it is clear of debris and functional.

Exterior: Caulk or seal all openings and gaps around the house; check for loose or dried out caulking around pipes, ducts, faucets, air conditioner refrigerant lines and re apply fresh caulk, sealant or insulation also replace any damaged or worn weather stripping around windows and doors.. This will protect the house for water and insect intrusion and will help keep the heat inside the house helping your energy bill.Smoke Alarms: Smoke alarms should be located inside every bedroom, and one in a common area (hallway) on every level. Replace the batteries in your smoke alarms and carbon monoxide alarms and test them using the built-in test buttons.Electrical: Check that the exterior outlets are GFCI protected to prevent property damage or injury as most folks like to place their Christmas decorations in the exterior of their house.Furnace and air conditioning: Consider having a professional furnace tune-up performed annually. The rule of thumb is to have a professional service every spring (to get ready for summer) and every fall (to get ready for winter). Replace the batteries in your thermostat. Clean or replace the furnace filter - this should usually be done every month.Fireplaces: Have the flues professionally cleaned on any wood burning fireplaces if they get used regularly. Install if possible glass doors in your fire place . Glass fireplace doors greatly reduce the chances of sparks or logs tumbling out of the fireplace which can damage tile or wood flooring, destroy carpeting and melt linoleum. If you have a gas log installed in a wood burning fireplace with an adjustable damper, make sure there is a damper stop installed to prevent the damper from getting closed all the way. “If a gas source is present as with a log lighter, the damper should remain partially open at all times. There are bolt on damper stoppers for this purpose.

Do you submit inspection reports in Spanish?The entire inspection can be done (verbally) in Spanish and I understand the way construction is performed in Mexico, being a native of Mexico City myself. I can help the client to understand the differences of the various ways of construction, by the time we finish the inspection the client would have a complete understanding of their new investment. However the report has to be provided in English by Texas law - the client is always encouraged to take notes.
