Volume 22 July/August 2008 Issue 4 Builder Bulletin Awards of Excellence 2007 On June 12, the Frederick County Builders Association celebrated the work of its members at the annual Awards of Excellence banquet. After a good dinner in the relaxed atmosphere of the Hollow Creek Golf Club, Darby Jones led the evening’s presentation, with Betsy Lingg as her sidekick. With builders showcasing their best projects, H.F. Payne Construction was awarded top honors for their $1 million+ townhome at Baker Park, NIMA Custom Homes won two Custom Home awards, Advantage Homes received an award for their Braxton model, and Lancaster Craftsmen Builders walked away with three trophies for New Home Design, Custom Home and Outdoor Living. In the Remodeling Division, Dertzbaugh Construction (two awards), Drafting Expressions, Maryland Heritage Custom Builders and Past & Present Construction came out on top; Past & Present Construction even with an unprecedented perfect score for their downtown Frederick addition! Frost Miller Group and Power Marketing & Advertising each accepted two awards for their work in the Media Marketing Division. Seawright Homes’ Orchard at New Market received awards for Best Community Entry Monument, Best Single Family Project, and Best Sales Model in the $500,000 - $650,000 price range. In addition, David Denny from Seawright Homes was named Best Construction Superintendent of the Year for Small Volume Builders for his extensive knowledge in managing the construction of new homes. The Superintendent of the Year for Large Volume Builders was Barry Springirth from Drees Homes, and Mike and Lisa Willard, from M.W. Willard, can call themselves Tradesperson of the Year, after a nomination from Drees Homes. Drees Homes swept out with a dozen awards (you have to enter to win!) in four divisions, with many of them for their new Linton at Ballenger project. Loiederman Soltesz Associates proved that reusing an old farmhouse can be a winning proposition for Best Integration of a Historical Feature, and Ken Walker Construction’s log home won accolades for Best Custom Home. All of Dan Ryan Builders sales people were honored in the Million Dollar Club, but top honors there went to Betsy Cain of Mackintosh Realtors, with her incredible sales volume of $13,477,999, and that’s in a bad year! The Sales and Marketing Council hasbeen infused wi th a new andinvigorating life. It is headed up byBarry Weller and a great Board. Theyhave an excellent program plannedthroughout the rest of the year. Checkthe FCBA website for dates and times.

The Land Use Council has a difficultroad ahead keeping track of the changesto the County Comprehensive Plan andAPFO. They are considering somechanges to help address these issuesand others that continually confront ourorganization. There will be more lateras information becomes available.

The Code watchdog committee has metover the past 6 months on the new 2006International Residential Code. Theymet wi th the County Outreachcommittee. The County Committee wasvery receptive to most of the revisionsthat we requested. In addition, theyappeared in front of the BoCC andpresented very convincing argumentsfor adopting the other items that werenot accepted by the County Committee.Included among these items are windowsill height, arc fault protection and childresistant outlets. The BoCC will voteon the adoption of the Code on the 17th.Our thanks go out to Ken Abrecht andhis committee for an outstanding job.

There will be no General Membershipmeetings over the summer (July &August ) ; however, the Board ofDirectors will be meeting.

As part of the County’s public outreacheffort for the 2008-2009 update of theFrederick County Comprehensive Plan,the Community Survey Results June2008 report was released by the CountyPlanning Staff. Of all the questions inthe survey (please read the entire docu-ment) the one that stood out was ques-tion #28. The question asked…if youwere to consider moving soon what typeof housing would you likely choose?The results were 87.5% of the respon-dents said a single family detachedhouse. This clearly means the AmericanDream is still alive and very strong de-spite the no or slow growth mentalityout there believed to be in the majority.Despite this mentality and even duringweakening economic conditions peoplestill overwhelmingly want their ownsingle family home.

The current Board of County Commis-sioners has delivered on their campaignpromise of controlled if not anemicgrowth. First the 2-year SubdivisionMoratorium and recently the all but for-gotten almost conclusion of the NewMarket Region Plan stripped of thou-sands and thousands of units. And nowthe ongoing Countywide Comprehen-sive Plan Rewrite. The Land Use Coun-cil has repeatedly challenged the pipe-line numbers and questioned where thegrowth will occur as areas such asBallenger Creek and Urbana are builtout. The answer appears to be that theMunicipalities will make up the differ-ence. But let the buyer beware…thereare groups out there that do not wantthe growth there either.

If 87.5% of the respondents say theywould like a single family home, we needto make sure the LAND USE decisionsof the County support that dream. Dur-ing the comprehensive rewrite make sureyou stay involved. The new CountywideLand Use Maps that will be coming outsoon will set the stage for zoning re-writes next year. The focus needs to be

on economic development and part ofthat development is LAND USE oppor-tunities. Let facts, not ideology guidethe way. Our voice needs to be heard orthe no growth mentality will prevail. Letthe market prevail. If you or someoneyou know has property in FrederickCounty, tell them to watch the develop-ment of these land use maps very closelyand PARTICIPATE, PARTICIPATE,PARTICIPATE.

Alan Barney P.E., raised in suburban Mary-land where he still works and lives, is FCBA’sspotlight member of the month. After earn-ing a degree in water resource engineeringat UMD., Alan landed a job with Charles P.Johnson & Associates (CPJ) in their SilverSpring office with the help of a college friend.This summer marks his 10th year with thefull-service civil engineering firm that hasprovided land planning, engineering andsurveying services to the public and privatesector since 1971. CPJ, which has grown tofive offices and 100 employees, also has anenvironmental services division. Alan is theirengineer assigned to the Frederick area whilehis primary focus is on storm water man-agement.

Growing up, Alan had aspirations of becom-ing an architect and adopted I. M. Pei, theworld famous architect, as his role model.

Pei’s East Building addition to the NationalGallery, which opened in 1978, left an indel-ible impression on young Alan, although hiscollege education took him in a different butsomewhat related direction, Alan now en-joys a vicarious relationship to architecturethrough his wife, Nicole, a structural engi-neer who works for a firm heavily involvedin historic restorations.

And what occupies the personal time of ahousehold headed by two professional en-gineers? Hint: not football or soccer, two ofhis favorite sports. No, it’s two little engi-neers that rule his world now; daughters,Maya age 3 and Gabi age 2. Both are a littleyoung for a career path, but Alan sees prom-ising signs of artistic inclinations in his old-est (and is secretly thinking, “my daughter,the architect”). So far Gabi is keeping mumon her ambitions.

This summer, the Barney family is headedto Spain for a much anticipated visit withhis wife’s family. Perhaps, Alan will sneaktime to indulge his love of reading biogra-phies and historic novels, especially theBritish Naval series by noted author, PatrickO’Brian. No question he’ll make time for

another of his passions - international cui-sine, especially Italian and, since his mar-riage, Spanish, of course.

In a moment of reflection, Alan admits thathe’s always been fascinated by the innategenius of the ancient Roman engineers whomasterminded the incredible system of roadsand aqueducts centuries before calculatorsand computers. Which reminded me to askhim if he knew how to use a slide rule? “No,but I once saw one in a museum.” He didn’tuse those exact words, but I interpreted thatfrom Alan’s polite but mocking tone. Ap-parently, slide rules faded into history quitesome time before he entered college. (GuessI’ll save thepocket pro-tector ques-tion for an-other time.)

The faltering economy is hurting hard-work-ing families across our community. Soaringgas and food prices are pinching pocket-books and the mortgage crisis is hitting con-sumers and the housing industry very hard.

The housing industry plays a critical role inthe nation’s economy. Congress is currentlyconsidering a variety of measures to helpbolster housing and the economy and averta recession. But what do these proposalsmean to you — the average citizen?

The House and Senate have each passedhousing stimulus provisions designed tohelp struggling home owners, jump-start thehousing market, save jobs and restore con-sumer confidence. But the packages are notthe same. And the entire effort could be de-railed if the two sides — and the WhiteHouse — can’t agree on a single, compre-hensive package.

Here are some of the key elements that needto be included in a final housing stimuluspackage that the President can sign into lawin order to truly benefit Americans and getour economy moving in a positive directiononce again.

Temporary home buyer tax credit. The abil-ity to deduct the mortgage interest you payfrom your taxes is already a great financial

incentive to own a home. With a tax credit,first-time home buyers will be able to reducetheir taxable income the first year after buy-ing a home and get a bigger refund or a lowertax bill.

This will help get the ball rolling and sellhomes that have been sitting on the marketfor months. Sellers will in turn buy newhomes. Demand will increase, and homeprices will stabilize. Stable prices will pro-tect both existing home owners who mayneed to refinance their loans, and sellers whocan’t afford to take a loss.

FHA modernization. The FHA programhelps get affordable mortgages for borrow-ers with less-than-ideal credit ratings or lim-ited down payment cash. But the currentprogram has outdated systems and proce-dures. If it’s not modernized, declining ac-tivity and inefficient processes could resultin taxpayers bearing some of the costs.

The limits for FHA-eligible loans need toincrease to be more in line with current homeprices; the amount of money required as adown payment by borrowers who provethey will be able to make the payments needsto be lower; and the FHA program needsmore flexibility so it can operate more effi-ciently and be more responsive to changesin the marketplace.

What Will A Housing Stimulus Package Do For You?GSE reform. Freddie Mac and Fannie Maeare government-sponsored enterprises(GSEs) that help lenders give more moneyto more home buyers. Changing the waythey are regulated will allow more programsto be offered and free up funds for homepurchases or to refinance troubled loans.

Mortgage revenue bond program. This pro-gram helps finance the purchase, rehabilita-tion or improvement of single-family resi-dences for low- and moderate-income fami-lies and individuals. Expanding this programwill help distressed borrowers who need torefinance their home loans, and will meanless homes will go into foreclosure. It willalso provide more mortgages for first-timehome buyers.

Net operating loss carryback. Businessesthat lose money in 2008 and 2009 would beable to use those losses to offset taxes theypaid for the previous four years, instead ofthe two years allowed in the current law. It willgive businesses that are suffering additionalfinancial resources to get through the economicdownturn, which will help them avoid layingoff employees or even shutting their doors.

More than half a million homeowners couldbenefit if these provisions are included in thefinal housing stimulus package that is adopted,which would in turn help all Americans.

School is out and summer is finally here!Jumping into the backyard swimming poolis a great way to cool off and enjoy timewith friends and family. While the pool isa great place to have fun and relax, it is anunfortunate reality that drowning is oneof the leading causes of death for chil-dren nationwide.

To help you ensure your backyard pool issafe the Association of Pool & Spa Pro-fessionals (APSP) offers these tips for ad-ditional “layers of protection”:

Fencing: Isolate the swimming pool witha minimum four-foot-high enclosure totemporarily close off a pool, spa, or hot

tub not being used when children arevisiting.

Safety Covers: Install an impenetrable cas-ing that completely covers the pool, spa,or hot tub to prevent access to the waterwhen there is no supervision.

Alarms: Get an alarm, which are availablefor doors, fences, and as a clip-on for chil-dren, to detect unwanted entrances to yourpool, spa, or hot tub.

Rope and Float Lines: Place a rope or floatline across the pool to let swimmers knowwhere the deep end separates from theshallow end.

Rescue Equipment: Locate equipmentsuch as a life ring or shepherd’s hook nearthe pool in an easily accessible spot, andensure they are kept in good condition.

These can be used to pull someone tosafety when in trouble.

Posted Emergency Information: Post CPRinformation and warning signs, as well asthe emergency telephone number — 911— near the pool, spa, or hot tub.

Outside Telephone: Keep a cordless orpoolside telephone nearby so you don’tleave children unattended while you an-swer the phone. It’s also a good idea tohave one handy to summon help, if needed.

These are great ways to help ensure thatyour family remains safe while enjoyingone of the summer’s most popular activi-ties. It is important to remember, however,that these should not replace adult su-pervision. When children have access toany body of water, a designated adultshould always be alert and aware.

The Membership Committee invited all first yearmembers to a ‘Freshmen Lunch’ at MexicaliCantina in May. The lunch was an opportunity fornew members to learn more about the associationand meet other members.
