Minutes of the 128th meeting of the Standing Committee held on 6th Ianuary, 2016

The 12Sth meeting of the Standing Committee of the Sugar Development Fund (SDF)under the chairpersonship of Secretary (F&PD) was held on 6th January, 2016. A list ofMembers and Special Invitees who attended the meeting is annexed. At the outset, theMember Secretary, welcomed all the Members and invitees. Following decisions weretaken.

1. ACTION TAKEN REPORT OF 127TH MEETING OF THE STANDING COMMITTEE(AGENDA ITEM NO.1).

The Action Taken Report on the decisions taken in the 127th meeting of theStanding Committee held on OS.10.2015 was considered and accepted. The Committeealso directed that the amount(s) of loan disbursed as a result of the decisions taken in ameeting of the Standing Committee may be placed before the Standing Committeeduring its next meeting.

2. PROPOSALS CONSIDERED FOR DRIP IRRIGATION UNDER CANEDEVELOPMENT SCHEME

(i) Mis NSL Sugars (Tungabhadra) Ltd., Desanur Village, Taluka Siruguppa,Distt. Bellary, Karnataka (Agenda No.2)

[ii] Mis NSL Sugars Ltd. Unit-Koppa Post office Koppa Village, Taluk, Maddur,distt- Mandya, Karnataka (Agenda No.3)

It was observed by the Committee that due to loss of Rs.S3.46 crore in 2013-14 andoverall high SDF loan exposure in the company, IFCI had recommended that GOI mayconsider taking PDCs (post dated cheques) for due repayment of principal and interestbefore disbursement. The committee in view of the financial conditions of the companyas assessed by IFCI, decided not to recommend any SDF loan to the Sugar Factories ofMis NSLSugars Ltd.

(iii) Mis Shetkari Sakhar Karkhana (Chandapuri) Ltd., Taluk Malshiras, Distt.Solapur, Maharashtra(Agenda No.4)

1. The Standing Committee considered the loan application for its canedevelopment schemes namely, Drip Irrigation, involving SDF assistance of Rs. 540.00lakh, (

2. The average DSCRof the sugar factory and the society as a whole is 1.41 and 1.51respectively. FACR of the sugar factory and society as a whole is 1.77 and 1.77respectively as on 31.3.2015. IRR of the project is 28.02%.

3. After consideration of the Screening Committee recommendations and inpursuance of the decision taken by the Standing Committee in its 127th meeting, theStanding Committee recommended SDF loan only for drip irrigation schemeamounting to Rs.243.00 lakh to the sugar factory to be disbursed in two installments.Eligibility of the sugar factory as perthe scheme is as follows:

However, prior to the disbursement of loan, the sugar factory shall give anundertaking to the effect that no loan/assistance has been taken by the Sugar Factoryfrom State Government for the above drip irrigation scheme for which SDF loan hasbeen sought. The sugar factory will also give first pari passu charge on its assets or ahigher security for SDFloan as per FACRbenchmark on the date of creation of charge.

3. MODERNIZATIONCUMEXPANSION WITH BAGASSEBASEDCO-GENERATIONPOWERPROJECT

(i) Proposals of M/s Mula Sahakari Sakhar Karkhana Ltd., Dist.Ahmednagar, Maharashtra for Modernization cum expansion andbagasse based co-generation power.

Modernization cum expansion (Agenda Items No.5)

1. The Standing Committee considered the loan application for modernizationcum expansion of sugar factory at a cost Rs.1988.00 lakhs. SDF assistance of Rs.795.00 lakh has been requested by the Sugar Factory.

3. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDF loan of Rs. 676.44Iakh.

4. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDF loan as per FACRbenchmark on the date of creation of charge.

Bagasse based co-generation power project (Agenda Item No. 11)

1. The Standing Committee considered the loan application for setting up of 30MW bagasse based co-generation power project at cost of 6664.00. SDFassistanceof Rs. 2032.00 lakh has been requested by the Sugar Factory.

2. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan of Rs. 1198.29Iakh.

3. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan as per FACRbenchmark on the date of creation of charge.

(ii) Proposals of Mis. Chhatrapati SSK Ltd., Dist. Pune, Maharashtra forModernization cum expansion and bagasse based co-generation power.

Modernization cum expansion (Agenda Item No.6)

1. The Standing Committee considered the loan application for modernizationcum expansion of sugar plant from 3500 TCDto 6500 TCDat a cost of 7772.36. SDFassistance of Rs. 3109.00 lakh has been requested by the Sugar Factory.

2. The average DSCRof the sugar factory and the company as a whole is 1.96. FACRof the sugar factory and company as a whole as on 31.3.2015 is 6.25. IRRof the project is31.09%.

3. It was found that the sugar factory had taken one cane development loan in theyear 1990 from SDF.However the status of UCwas not reflected in the agenda notes.NCDCofficials confirmed during the meeting that the practice of taking UCfor the SDFloan was not prevailing before the year 2000. Therefore the status of UC was notreflected in the agenda notes. Further, as per the available records, it was also confirmedthat the loan had been fully repaid by the sugar factory and the committee was satisfiedwith the above explanation.

Bagasse based co-generation power project (Agenda Item No. 12)

1. The Standing Committee considered the loan application ofMis. Chhatrapati SSKLtd., Bhavaninagar, Tal. Indapur, Dist. Pune, Maharashtra for Setting up of 18 MWbagasse based co-generation power project at a cost of Rs. 7293.00 lakh. SDFassistance ofRs. 2613.00 lakh has been requested by the Sugar Factory.

2. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan of Rs. 2414.63 lakh.

3. IRRof the project is 31.09%.

4. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan as per FACRbenchmark on the date of creation of charge.

(iii) Proposals of Mis Rajarambapu Patil SSK Ltd., Rajaramnagar, Unit - 1(Walwa/15501) District Sangli, Maharashtra for Modernization cumexpansion and bagasse based co-generation power.

Modernization cum expansion (Agenda Item No.7)

1. The Standing Committee considered the loan application for Modernizationand expansion of sugar plant from 4000 TCD to 7000 TeD at a cost of Rs. 6600.00lakh. SDFassistance of Rs. 2640.00 lakh has been requested by the Sugar Factory.

2. The average DSCRofthe sugar factory and the society as a whole is 2.63 and 1.91respectively. FACR of the sugar factory and society as a whole is 1.49 and 1.73respectively as on 31.3.2015. IRRof the project is 29%.

3. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan ofRs. 2067.00 lakh.

4. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan 'as per FACRbenchmark on the date of creation of charge.

Bagasse based co-generation power project (Agenda Item No. 13)

1. The Standing Committee considered the loan application for Setting up of 28MW bagasse based co-generation power project at a cost of Rs. 12600.00 lakh. SDFassistance of Rs. 4060.00 lakh has been requested by the Sugar Factory.

2. IRR of the project is 17.9%.

3. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDF loan of Rs. 3706.45 lakh.

4. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDF loan as per FACRbenchmark on the date of creation of charge.

(iv) (Proposals of Mis. Sahakar Shiromani Vasantrao Kale Sahakari SakharKarkhana Ltd., District Solapur, Maharashtra for Modernization cumexpansion and bagasse based co-generation power.

Modernization cum expansion (Agenda Item No.8)

1. The Standing Committee considered the loan application for Modernizationand capacity optimization of existing sugar plant, so as to achieve a crushing ratefrom the existing 2500 TCDto 3600 TCDi.e. 150 TCHon 24 hr basis, with smooth andefficient operations. The proposed project has _beendesigned with a view to improve thesteam economy of the plant so as to achieve the steam consumption of 44% at a cost ofRs.3032.51lakh. SDFassistance of Rs. 1137.19 lakh has been requested by the SugarFactory.

2. The average DSCRof the sugar factory and the company as a whole is 3.83 and1.38 respectively. FACRof the sugar factory and company as a whole as on 31.3.2015 is2.45 and 1.93. IRRof the project is 16.03%.

3. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan of Rs. 983.00 lakh.

4. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan as per FACRbenchmark on the date of creation of charge.

Bagasse based co-generation power project (Agenda Item No. 14)

3. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan of Rs. 2268.97Iakh.

4. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan as per FACRbenchmark on the date of creation of charge.

(v) Proposals of Mis Dalmia Bharat Sugar & Industries Limited Distt.Kolhapur, Maharashtra for Modernization cum expansion and bagassebased co-generation power.

Modernization cum expansion (Agenda Item No.9)

1. The Standing Committee considered the loan application for Modernisationcum expansion of sugar plant, from 2500 TCDto 5000 TCData cost ofRs. 7472.28Iakh.SDF assistance of Rs. 2241.68 lakh has been requested by the Sugar Factory.

2. The average DSCRof the sugar factory and the company as a whole is 1.45 and1.20 respectively. FACRof the sugar factory and company as a whole as on 31.3.2015 is1.25 and 1.75 respectively. IRRof the project is 15.31%.

3. The matter regarding eligibility of sugar factory for modernisation cumexpansion was discussed in detail. Based on the recommendations of Sub-Committee,the Standing committee recommended SDFloan for modernisation cum expansion from3500 TCDto 5000 TCD.

4. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan of Rs. 1341.841akh.

5. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan as per FACRbenchmark on the date of creation of charge.

Bagasse based co-generation power project (Agenda Item No. 10)

1. The Standing Committee considered the loan application for Setting up of 23MWbagasse based co-generation power project at a cost of Rs. 13616.89 lakh. SDFassistance of Rs. 2158.811akh has been requested by the Sugar Factory.

2. IRR ofthe project is 16.03%.

3. The matter regarding eligibility of sugar factory either for cogeneration projectwas discussed in detail. Based on the recommendations of Sub-Committee, the Standingcommittee recommended SDF loan for enhancing the cogeneration capacity from15MWto 23 MW.

4. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan of Rs. 688.66 lakh.

5. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan as per FACRbenchmark on the date of creation of charge.

(vi) Proposals of Mis. NSLSugars Ltd. - Unit-Il, (Lessee of Sahakare SakkareKarkhane Niyamit, Aland), District Gulbarga, Karnataka forModernization cum expansion and bagasse based co-generation power.

The following proposals of Mis. NSLSugars Ltd. were considered by the StandingCommittee.

Modernization cum expansion (Agenda Item No. 17)

for deviation in project design from 1250 TCDto 7000 TCD,extension in AAvalidity upto 31.03.2016 and revision in loan amount from Rs. 33.65 crore to Rs. 24.04 crore for itsearlier approved proposal ofmodernisation cum expansion of sugar unit.

Mis. NSL Sugars Ltd. - Unit-Il, (Lessee of Sahakare Sakkare Karkhane Niyamit,Aland), , District Gulbarga, Karnataka for Modernization cum expansion andbagasse based co-generation power.

Bagasse based co-generation power project (Agenda Item No. 18)

for deviation in project design from 34 MWin place of 28 MW,extension in AAvalidityup to 31.03.2016 and revision in loan amount from Rs. 37.18 crore to Rs. 30.62 crore forits earlier approved proposal for baggase based cogeneration power project of sugarunit.

It was observed by the Committee that due to loss of Rs.83.46 crore in 2013-14and overall high SDF loan exposure in the company, IFCI had recommended thatGOI may consider taking PDCs (post dated cheques) for due repayment of

principal and interest before disbursement. The committee in view of thefinancial conditions of the company as assessed by IFCI, 'decided not torecommend any SDF loan to the Sugar Factories of Mjs NSLSugars Ltd.

4. BAGASSEBASEDCO-GENERATIONPOWERPROJECTS

(i) Mjs [ai Hind Sugar Pvt. Ltd., Achegaon, Taluka- South Solapur, Distt­Solapur, Maharashtra (Additional Agenda Item No.1).

1. The Standing Committee considered the loan application of Mjs [ai Hind SugarPvt. Ltd.,Achegaon, Taluka- South Solapur, Distt- Solapur, Maharashtra for Setting up 18MWGreenfield bagasse based co-generation power project at a cost of Rs. 9780.00lakh. SDF assistance of Rs. 682.00 lakh for exportable surplus 11.63 MW has beenrequested by the Sugar Factory.

2. The average DSCRof the sugar factory and the company as a whole is 2.19. FACRof the sugar factory and company as a whole as on 31.3.2015 is 1.39 and 1.46respectively. IRRofthe project is 30.61%.3. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan of Rs. 633.70 lakh.

4. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan as per FACRbenchmark on the date of creation of charge.

(ii) Mjs DSM Sugar Rajpura (a unit of Dhampur Sugar Mills Ltd.), Rajpura,Distt. Bheem Nagar, Uttar Pradesh_(Additional Agenda Item No.2)

1. The Standing Committee considered the loan application of Mjs DSM SugarRajpura (a unit of Dhampur Sugar MillsLtd.), Rajpura, Distt. Bheem Nagar, Uttar Pradeshfor Setting up of 35.5 MWbagasse based co-generation power project at a cost of Rs.13100.00 lakh. SDF assistance of Rs. 5200.00 lakh has been requested by the SugarFactory.

2. The average DSCRof the sugar factory and the company as a whole is 2.14 and2.68 respectively. FACRof the sugar factory and company as a whole as on 31.3.2015 is2.05 and 2.42 respectively. IRRof the project is 30%.

3. The Committee was informed that that LSPEF dues amounting to Rs.1,49,00,897.29 are pending against the factory. The Committee decided that the LSPEFdues must be cleared by the sugar factory before sanction of the SDFloan.

5. ANHYDROUS ALCOHOL OR ETHANOL

(i) Proposal of Mjs Athani Sugars Ltd., Distt- Belgaum, Karnataka. (AgendaItem No. 15)

1. The Standing Committee considered the loan application for Setting up plant forproduction of 30 KLPD (expansion of distillery unit from 30 KLPD to 60 KLPD)anhydrous alcohol or Ethanol from molasses at a cost of Rs. 4500.00 lakh. SDFassistance of Rs. 1800.00 lakh has been requested by the Sugar Factory.

2. The average DSCRof the sugar factory and the company as a whole is 2.66. FACRof the sugar factory and company as a whole as on 31.3.2015 is 2.02. IRRof the project is18%.

3. On the basis of available records and recommendations of the Sub-Committee,the Standing Committee recommended SDFloan of Rs. 1564.68Iakh.

4. The sugar factory will give first pari passu charge on its assets or a highersecurity for SDFloan as per FACRbenchmark on the date of creation of charge.

(ii) Mjs Shri Shivsagar Sugar & Agro Products Ltd., Ajp.Udapudi-591130,Tq-Ramdurg, Distt-Belgaum, Karnataka. (Agenda Item No. 16)

1. The Standing Committee considered the loan application for Setting up plant forproduction of 45 KLPDanhydrous alcohol or Ethanol from molasses ata cost of Rs.5500.00 lakh. SDF assistance of Rs. 1925.00 lakh has been requested by the SugarFactory.

2. The proposal was considered by the committee and it was observed that theNet Worth of the Sugar factory for the FY 2014-15 is negative. The committeetherefore, did not recommend grant of loan to the sugar factory.

6. EXTENSIONOFVALIDITYPERIODOFADMINISTRATIVEAPPROVALS

The Administrative Approval for SDFloan of Rs. 13,87,67,000 was issued to theSugar Factory on 03.05.2013 which was valid up to 02.05;2014. Thereafter, on the requestof Sugar factory, extension in Administrative Approval was granted to them upto02.11.2014. The sugar factory again requested for extension of AA.However, in pursuanceof the decision taken in the 127th meeting of the Standing committee the request has notbeen agreed to.

[ii]. Mis. E.I.D. Parry (India) Ltd., Nellikuppam, District Cuddalore,Tamil Nadu (Agenda Item No. 20)

Mis. E.LD. Parry (India) Ltd., Nellikuppam, District Cuddalore, Tamil Nadu,was sanctioned SDF loan of Rs.2160.00 lakh for modernisation cum expansion ofcrushing capacity from 5000 TCDto 6500 TCDvide administrative approval dated17.7.2009. The first instalment of RS.1080 lakh was disbursed vide sanction lettersdated 30.3.2010 and 13.4.2010.

2. Validity of Administrative Approval for availing the disbursement of secondinstalment by the sugar factory was extended upto 31.8.2012.

3. The sugar factory requested that second instalment may be disbursed and thesugar factory would submit the EIAon receipt.

4. The case was placed before sub-committee meeting held on 31.1.2013. Thecommittee decided that the case may not be closed and extension may be sought afterreceipt of EIA.

5. The EIA has still not been received. It was also informed that UtilizationCertificates for loan disbursed for sugarcane development and SDF loans can not bedisbursed till these ues are received. The sugar factory has submitted an undertakingthat they will furnish all pending UCsbefore 31.08.2016

6. Considering the fact that the first instalment has been disbursed and the SFhasfurnished a Bank Guarantee dated 13.9.2010 for disbursement of second instalment ofloan for an amount not exceeding Rs. 14,45,05,775 and the bank guarantee shall remainin full force upto 10.9.2021, and that the Sugar Factory has also submitted anundertaking to submit UCsby 30.8.2016, the Standing Committee decided to extend thevalidity period ofAdministrative Approval up to 30.9.2016.

Shri Vithal Sahakari Sakhar Karkhana Ltd., Venunagar, Post GursaleTaluka Pandharpur, District Solapur, Maharashtra for relaxation in condition ofAdministrative Approval (M) regarding submission of NOC from PCB (Consent toOperate) at the time of disbursement was discussed in the meeting and it was decidedthat since NOC from PCB (Consent to Establish) is valid at the time of first installment ofloan, and the Consent to Operate is granted after the commissioning of the project, thesaid condition is relaxed for disbursement of first installment of loan in this case. Thiswill apply to other similar cases also.

7. POLICYMATTERS

MONITORING OF CANEDEVELOPMENT LOANSGRANTED FROM SUGARDEVELOPMENT FUND (AGENDA ITEM NO.-21).

The matter relating to monitoring of Cane Development Loan from SDF havebeen under examination of the Department in consultation with the IFD since 2012-13.A meeting under the Chairmanship of AS& FA was also held on 05.08.2013 and it wasinter-alia decided to appoint only those monitoring agencies which are havingScientific/ Research oriented expertise for monitoring work. The matter was alsodiscussed in 121 st meeting of Standing Committee.

2. Accordingly, application were invited from 18 Institutes out of which only 7institutes showed willingness. Based on the strength of technical manpower and area ofspecialization following 3 Institutes have been short listed with the concurrence of IFDfor assigning the work of monitoring of Cane Development loan granted from SDF.

(i) Sugarcane Breeding Institute, Coimbatore, Tamil Nadu.(ii) National Sugar Institute, Kanpur, Uttar Pradesh.(iii) Vasantdada Sugar Institute, Pune, Maharashtra

3. Based on their locations, the cane development loan monitoring work in differentstates was proposed to be distributed amongst the above institutes as under:

(i) Convey actual Utilization.(ii) Impact assessment.

Payment to the monitoring agency will be made in two parts i.e. 50% afterreport is received regarding actual utilization and balance 50% after receipt of reportregarding impact assessment.

(iv) time period for monitoring of Cane Development loan was increased from 3months to 12 months. Utilization Certificates (UCs) be allowed to be submitted in 12months, as often loans cannot be utilized if linked activity cannot be carried out withinthe stipulated time. Accordingly, Administrative Approval and Tripartite Agreement mayalso be amended.

8. REVISION OF NORMATIVE COST OF THE BAGASSE BASED COGENERATIONPROJECTS. (AGENDA ITEM NO.-23)

The Normative cost for arriving at the cost of the project for setting up bagassebased cogen power projects by the sugar factory are fixed by the SDF Division fromtime to time. The last revision in Normative cost was made by the Department in 2006and it was fixed at Rs. 363 lakhs per MW. And in 2010 a modification was made thatboiler pressure less than 67 ata will not be considered for financial assistance. The samenorms are continuing since then. Since the cost of machinery and equipments and otherinputs have escalated over the period of time, it is felt essential now to revise thenormative cost.

2. The NSI, Kanpur, VSI Pune, IFCI and NCDC were requested to sendproposal/comments to revise normative cost to this department for furtherconsideration. After examining the same, the Standing Committee recommended thenorms as proposed by NSI Kanpur as under:

9. LEVY SUGAR DEFAULT (AGENDA ITEM NO.-24)

In the 127thmeeting of the Standing Committee on SDF held on 8.10.15, it wasdecided that the sugar factories are required to clear Levy Sugar obligation beforedisbursement of SDF loan. However, in such cases where levy sugar obligation ispending, the disbursement of loan has been held up.

3. The matter was discussed in the Standing Committee meeting and it was decidedthat when a sugar factory has levy dues payable, the amount of levy sugar at prevalentrates may be withheld and the rest of the eligible amount of loan may be disbursed.After Sugar Factory clears dues of levy the balance of the eligible amount may also bereleased.
