    In pursuance of the provisions of section 9 ofthe Act aforesaid I prohibit(a) The taking of allspecies of fish by means of nets, known as ''pilchardnets'' and ''whiting nets,'' as defined in paragraphs(c) and (d) respectively of the Proclamation dated24th October, 1940, and published in the GoicrsvnrentGazette dated 1st November, 1940, in those portionsof Western Australian waters described in ScheduleE hereto, from 1st October, 1944, to 31st March, 1945,both inclusive; (b) The taking of all species of fishby means of nets known as ''garfish nets'' as definedin paragraph (e) of the Proclamation aforesaid, inthat portion of Western Australian waters known asKoo,nbana Bay from 1st August, 1944, to 31st March,1945, both inclusive.

    In pursuance of the provisions of section 19 ofthe Act aforesaid I hereby amend the Proclamationaforesaid dated 24th October, 1940, by omitting para-graph (b) relating to ''set nets.''

    SCHEDTJLES.Schedule A.The whole of the waters of the

    entrance to Lesehenault Inlet upwards from its Junc-tion with Koombana Bay and of the waters of Les-chenault Inlet (including all tributaries) upwards toa line drawn from Turkey Point to the northernmostend of the Turkey Point channel, and thence to thenorth-eastern corner of Leschenault Lot 1.

    Schedule B.Tlie whole of the waters of the CollieRiver and all its tributaries and all that portion ofLcschenault Inlet lying within a radius of one-half-mile of the northernmost extremity of Bar Island.

    Schedule C.The whole of the coastal waters inthe vicinity of Bunbury known as ''Hungry Hollow,''being those waters lying between the westerly exten-sions of Clifton street and Beach road, in the munici-pality of Bunbury, and within a distance measuredrectangularly from the foreshore of one-half-mile.

    Schedule D.The whole of the waters of Leschen-ault Inlet lying to the north of a line drawn fromTurkey Point to the northernmost end of the TurkeyPoint channel, and thence to the north-eastern cornerof Leschenault Lot 1.

    Schedule E.The whole of the waters of KoombanaBay and of Lesehenault Inlet lying to the north ofa line drawn from Turkey Point to the northernmostend of the Turkey Point channel and thence to thenortli-eastera corner of Leschenault Lot 1.

    AT a meeting of the Executive Council held in theExecutive Council Chamber, at Perth, on the 12th dayof April, 1944, the following Order in Council wasauthorised to be issued.

    Workers' Compensation Act, 1912-1941.ORDER IN COUNCIL.

    WHEREAS it is enacted by section 10 of the Workers'Compensation Act, 1912-1941, that it shall be obliga-tory for every employer to obtain from an incor-porated insurance office approved by the Minister ap011ev of insurance for the full amount of the lia-bility to pay compensation under this Act to allworkers employed by him but that if an employerproves to the satisfaction of the Minister that suchemployer has established a fund for insurance againstsuch liability and has deposited at the Treasury securi-ties charged with all payments to become due undersuch liability the Governor ala)' by Order in Councilexempt such employer from the operation of the saidsection; and whereas Millars' Timber mind TradingCompany, Limited, of St. George's House, Perth, be-ing an employer within the meaning of the said sec-tion, has, in accordance with the regulations, dulymade application that it be exempted from the opera-tion of the said section and has proved to the satis-faction of the Minister that it has established a fundfor insurance against the liability to pay conlpensa-tiou under time said Act to all workers employed byit and has deposited at tile Treasury securities (towit the sum of 5,000) charged with all payments tobecome due from the said Company under the saidliability: Now, therefore, His Excellency theLieutenant-Governor acting with the advice and con-sent of the Executive Council and in exercise of thepowers conferred by the said Act doth hereby exemptthe said Millars' Timber and Trading Company,Limited, as such employer aforesaid from the opera-tion of section 10 of the Workers' Compensation Act,19] 2-1941, for the period which shah end on the 15thday of September, 1945.

    HIS Excellency the Lieutenant-Governor in ExecutiveCouncil, acting under the provisions of the Ceme-teries Act, 1897, and the Acts amending the same, hasbeen pleased to approve of the following By-laws forthe control and management of the Wannautal PublicCemetery.

    Public Cemetery, Wannansal-By-laws.By virtue of all powei-s in that behalf vested in

    the Board of the Wannainal Cemetery, the said Boardmakes the following By-laws:-

    All fees and, charges payable to the Board asset forth in Schedule A shall be paid at the timesand manner therein mentioned, unless otherwiseordered.

    Any person desiring to inter any dead body inthe cemetery shall make an application in the formcontained. in Schedule B.

    All applications for interment shall be made atthe office of the Board in such time as to allow atleast eight working hours' notice being given to theofficer at the cemetery prior to the time fixed forburial, othem-wise an extra charge shall be made.

    The Board shall cause all giaves to be dug, andvaults, brick gm-ayes, or graves to be re-opened asand when required.

    Every coffin shall have upon the lid an approvedmetal plate bearing the name of the deceased stampedor otherwise indelibly inscribed in legible characterthereon. No coffin not complying with this by-lawshall be admitted to or be interred in the cemetery.

    Every grave shall be at least 7ft. dee1) at thefirst interment, and no interment shall be allowed inany grave with a less depth than 3ft. from the topof the coffin to the original surface of the surroundingground.

    In the ease of an application for interment inany private grave or vault to which the deceased hadno claim during life, the written and verified con-sent of the grantee shall be handed in with the appli-cation.

    No burial shall be allowed to take place in thecemetery nor shall any coffin be allowed to enter timecemetery unless a certificate front a District Registrarof Deaths that the death has been registered rn aCoroner's order for burial is handed to the Secretary,at tile latest, upon the funes-al entering the cemetery.Should tile undertaker or his representatives be till-able to produce the said certificate from the Registrar,he shall give a written guarantee to produce santewithin three days, and satisfactory reasons must be

    given for tile non-production of such certificate ill thefirst instance. In default of the production of tilesaid certificate w-ithiu three days, the undertaker'slicense may he suspended until such certificate is pro-duced. The certificate will be retained, but theCoroner's ordem- shall be returned to the person de-livering the same.

    The hours for burial shall be as follows:-Weekclays-from 8 n.m. to 4.30 p.m.; Sundays from 2 p.m.to 4.30 p.m. And no burial shall be allowed to takeplace, nor any coffin allowed to eater the cemetery,at any other hour except by written permission of theBoard.

    .10. The time fixed fot- any buiial shall be the timeat which the funeral is to arl-ive at the cemetery gates,and, if not punctually observed, the undertakeriesponsible shall be liable to a fine of lOs. 6d.

    ii. If for any reason the funei-al shall, on as-rivalat the entrance gates of the eentetem-y, remain therefor more than 15 minutes prior to proceeding to thegraveside, undei-takers responsible shall be liable toa fine of ten shillings and sixpence.

    Every funeral shall enter by the principalentrance, and no vehicle, except the hearse and mourn-ing coaches shall be permitted to enter the cemetem-y,or stand opposite the entrance gates. 1-lom-ses shallnot be allowed to proceed faster than at a walkingpace within the cemetes-y, and shall proceed at andby such roads as directed by the Superintendent orothem- officer of the Board. from time to time. Anydrives- or other person failing or neglecting to observesuch directions may be forthwith expelled fm-out thecemetery. No bicycle, shall be ridden within thecemetery.

    If application he made to the Board to exhumeany corpse for the purpose of examination or identi-fication, or for the purpose of its being buried else-where in accordance with the wishes of time deceasedor of his family, an order from the Governor or thewarrant of a Coroner or of a .Justice of the Peaceissued in accordance with the law' antimorising thuBoai-d to pci-nut of the exhumation insist be attachedto the application form.

    Children under the age of ten years enteringtime cemetery must be in charge of sonic s-esponsiblepe iso n.

    Smoking shall not be allowed within time ceme-tei-y, not- any fireworks diseham-ged therein.

    No dogs shall be admitted into the cemetery,and any found thei-e shall be liable to be destroyed.

    Any person violating the mules of proprietyand deeoruui, or committing any nuisance or trespass,or injuring any ti-ce, shrub, flower, border, grave orany ei-ectiou, or in nay way infringing these by-lawsshall be expelled from the cemetery.

    No person shall remove any plant, tree, shrub,fiowes- (othem- than withes-ed fiowei-s, which are to beplaced in the receptacles provided by the Board forsame), or any article front any grave without firstobtaining a permit from the Board or their represen-tatives.

    No person shall pluck any tree, plaist, shrub,or flower growing iii any portion of time cenmetery.

    No pet-son shall remove or carry out of om.attempt to cari-y out of the cemetemy any tree, plant,shrub, or flower, without the wi-itten authomity of theBoard or theim representative.

    No pemsomi shall proniote or advertise, or carry onwitlun the cemnetem-y any trade, business, os calling, eitherby solicitation, distribution of circuhai-s, by cards orotherwise, or by any other system of advertisementwhatsoever, without the writtQn consent of time Board,any asmy person imifrimigiug this by-law shall be expelledfrom the cemetery.

    No person employed by us- under time Board shahbe permitted to accept any gratuity whatever, mior shalllie be pecuniarily interested in any woi-k us the cemetery,other than the remnunet-ation lie receives front time Board,and any such pemsosi proved guilty of accepting anygratuity, or being pecuniam-ily interested in any suchwork, shall be liable to summary dismissal.

    Subject to time by-laws, and to the directions ofthe Board, the Secretary shall exercise a gemieral super-vision and control over all matters pem-taimung to thecemetem-y, ineludhig time conduct of all funem-als and in-termnents within time cemetery.

  • Any person requiring an '' Exclusive Right ofBurial'' in any part of the cemetery shall apply to theBoard, in writing, specifying the location of the grave,and whether it is proposed to erect a brick grave orvault, and in each case submitting plans and specifica-tions of the proposed work. Such application shall alsostate the names of any already deceased person whoseremains it is proposed to inter therein.

    Upon being satisfied of tile matters aforesaid,and of the suitability of the said work, plans, and speci-fications, the Board may authorise the construction anderection thereof, or if no work is to be done, may issuea ''Grant'' ill the Form ''C'' in the schedule.

    Upon tile completion of the work aforesaid, theBoard ulay, if and when suc.h work is done to theircomplete satisfaction, issue a ''Grant'' in tile formprescribed.

    Ever)- sucil grant shall be subject to the by-lawsfor tile time being, and no interment in any such graveor vault shall be allowed unless upon production of the''Grant'' aforesaid, nor shall any such grave or vaultbe opened, unless with the consent of the Board.

    Every coffin placed in any such bricked grave orvault shall be bricked in, cemented, and any space sur-rounding such coffin to he filled ill witil charcoal, dryearth, or other suitable material, and covered with aslab of stone, slate or iron, unless special written exemp-timi he obtained froiii tile Board.

    In the event of suel exemption being obtainedfrom the Board, each coffin placed in any brick graveor vault shall be properly lead-lined and hermeticallysealed.

    If application be made for an ''interment'' inany grave or vault of the remains of any person otherthan tile person to whom the grant was issued, or hisregistered assign, tile written and verified consent ofsuch grantee or assignee shall be produced, together withthe ''Grant of Right of Burial.''

    Should tile grantee be unable to produce the''Grant of Right of Burial'' on making applicationfor a grave to be re-opened for tile purpose of interment,through having lost same, the said grantee, shall makea sworn declaration to this effect, and shall pay the feefor a copy of such ''Grant of Right of Burial,'' asprescribed in Schedule A, before the interment takesplace.

    Any person desiring to place or ereet, or to alteror add to any monument, tombstone, or enclosure in anypart of tile cemetery must first obtain the written consentand approval of the Board and otherwise comply withsection 23 of the principal Act (61 Vict., No. 23).

    Every tombstone, nonunient, or enclosure shallbe placed on proper and substantial foundations, whichf required by the Trustees or their officers, shall extendto the bottom of the grave.

    The materials used iii every sucil erection shallbe subject to the approval of tile Superintendent or otherofficer appointed by the Board and any niaterial rejectedshall be immediately renioved from tile cemetery by thecontractor for the erection. All refuse and other rub.bish remaining after any work is completed shall beimmediately removed from tIle cemetery by the personcausing the same.

    Should any work by masons or others be not coin-pleted before a Sunday, they shall be required to leavethe work In a neat and safe condition, to tile satisfac-tion of tile Superintendent.

    Monumental masons and other tradesnien shall,before commencing any work within the cemetery,deposit with the Secretary to the Board, tile sum often shillings wInch shall be forfeited if the provisionsof either of the two preceding by-laws be not compliedwith to the satisfaction of tile Superintendent.

    All material required in the erection and com-pletion of any w-ork shall, as far as possible, be pre-pared before being taken to the cemetery, and all mate-rials required by tradesmen, shall be admitted at suchentrance as tile Superintendent shall direct, and novehicle conveying any such materials with wheels lessthan 4 inches broad shall be permitted to enter tilecemetery.

    No catacomb shall be allowed.Monumental masons shah not be permitted to

    carry on work within tile cemetery during other thanthe hours specified for tile opening and closing of thegates on week days, Saturday and Sunday excepted, when

    no work is to be done from noon Saturday to the open-illg of gates on tile Monday morning, without tile writ-ten permission of tile Board.

    Subject to the approval of tile Board, eacil appli-cant for an ''Order for Burial'' shall, within threemonths from date of the application, enclose tile gravementioned in sucil application with a kerbing of tiles,slate, or stone, and shall cause to be placed thereon anumber plate bearing the number of the grave or vault.Every grave, vault, monuni eat, tombstone, kerbing, orany other erection, silall he maintained and kept inthorough repair and proper condition by, and at tile ex-pense of tile grantee. Should the grantee 's residencenot be known, or be out of the State, the Board to havepower to do the w-ork and keep an account against thegrantee. No mounds shall be allowed.

    No wooden fence, railing, cross, or other woodenerectiOn shall be allowed on or around any grave orvaul 1.

    No trees or shrubs shall be planted on airy graveexcept sucll as shall be approved by the Superintendent.

    All workmen whether employed by the Board orby any other person shah at all times whilst within theboundaries of tile cemetery be subject to tile supervismomlof the Secretary or Superintendent and silall obey suchdirections as that officer may find it necessary to give;and any worknlemr permitting any breach of these regu-lations and by-laws or refusing or neglecting to complywith any directiolls of the said Secretary or Superin-tendent shall be removable from the cemetery.

    Licences for grave dressing or decorating maybe issued by tile Board in tile form contained in ScheduleII; such hicenccs to he renewed annually in the monthof July.

    Any persom tak ig part in dressing or attendingto ally grave shall comply witil tile foilowing rules:-(a) No rubbish, soil, sand, or other material, removedin dressing a grave shall be placed on any Otiler grave,and if placed on any adjoining groulld shall be removed.immediately tile work is completed. (b) No sand, soil,01 100111 shall be taken from any portion of tile cemeteryfor tile purpose of dressing any grave, except with thepermission of tile Superintendent. (c) The dressing ofall graves and tile wheeling and carting of any materialshall be subject to the supervision of the Superintendent.(ci) Woric in all cases to be carried 011 with due despatclland only during regulation hours.

    Prior to conducting any interment within thecemetery or making use of tile cemetery, for any pur-pose comlnected witll imltermmldilts, every undertaker shallpay to tile Board all annual fee of 1 is. and shall attile time of making such pa)-ment give his assent inw'riting to such conditions 05 tile Board may deem fitto impose. Upon such assent beimlg given, and paymentof the fee 111044, he shall receive a ''permit'' to holdgood fluting good behaviour amid until tile first day ofJuly following, and unless in the possession of such a'permit'' no undertaker shall be allowed to engage iii

    or early olmt any duty or work within the cemetery.The Board may decorate graves from time to

    time, when desired by the grantee so to do. If thegrautecs do not desire tile Board to carry out this woric,tile grontees mllay either do it themselves om- employ anyperson licensed by tile Board for that purpose.

    No person, except tise relatives of the deceased,the Board or those licensed by the Board, shall be per-mnitted to decorate all)' grave.

    If fo tile purpose of re-opening a grave theBoard fimid it necessary to remove edging tiles, plants,grass, shrubs, etc., from off the grave, the persomi soordering the me-opening shah pay to the Board tilecilarge laid down in Schedule A.

    Notwithstanding anything contained in the exist-hmg by-lairs to the contrary, permission may be grantedto the Defence Department of the Commonwealth toerect headstones on the graves of deceased soldierswithout paymnent of any fee.

    Fm'ce ground may he granted if it is proved tothe satisfactiomi of the Board-(a) That the deceasedwas a returmied soldier, and that lie died as the resultof injumics lie received in the late war, and (b) that therelatives of tile deceased are in necessitous circum-stances: Provided that such grant shall be made subjectto tile comidition that only the remains of deceasedsoldiers shall he immtcrred in the grave.

    The Board niay maiutain the graves of deceasedsoldiers, free of cost, for a term of seven years.

    Any person committing any breach of any ofthese by-laws and regulations or of any other rules, regu-lations or by-laws lawfully made under the authority ofany Act relating to cemeteries, shall for every suchoffence be liable to a penalty not exceeduisg 5; and incase of a continuing breach, a further sum not exceeding1 for every day during which such breach continues,and shall be forthwith removable from the cemetery bythe Board, the Superintendent or other officer of theBoard, and shall be treated as a trespasser and may beproceeded against accordingly.

    A plan of the cemetery showing time distributioiof the land, compartments, sections, situation and num-ber of grave, and a register of all certificate of ''Rightsof Burial'' shall be kept at the office.
