Concerning Cosmetics and Personal Care Products
Part One: Perfumes and Their Products
Pursuant to the constitution and on:
- UAE Federal Law No. (1) of 1972 concerning the functions of the Ministries, the
powers of Ministers and the laws amending it,
- UAE Federal Law No. (28) of 2001 regarding establishing the Emirates Authority for
Standardization and Metrology and the laws amending it, transactions and its
executive regulation,
- UAE Federal Law No. (24) of 2006 regarding consumer protection and its
amendments,
- Emirates Conformity Assessment Scheme (ECAS)
- And according to Board of Directors Decree no. () in session no. () Held on
Date………..

Have decided the following:
First Clause
The Technical Regulation No. ( ) for the year 2012 concerning perfumes and their
products, attached with this decision, is considered a mandatory regulation to be
implemented in the United Arab of Emirates.
Second Clause
The Board Directors of the Emirates Standardization and Metrology Authority shall add
any necessary amendments to the attached regulation and its annexes.
Third Clause
A. The concerned authorities shall implement this decision.
B. And this decision to be published, attached with the Technical Regulation, in the official
gazette to be implemented within six months from the date of publishing.

Chapter One
Objectives
This technical regulation aims to control the process of offering, trading and selling of perfumes and
their products in the UAE markets in order to provide a high level of protection to the consumers and
the environment and to ensure smooth functioning of the internal markets. This is achieved by the
identification of:
1. UAE standards which are applicable for perfumes and their products based on this regulation.
2. . Mandatory requirements and conditions that are to be complied by the manufacturers, traders
and sellers.
Chapter Two
Scope
2-1 Scope of the Application:
This technical regulation applies to perfumes and their products mentioned in Annex (1), excluding
perfumes and their products incorporated in detergents , air fresheners. as well as cosmetics and
personal care products.
Chapter Three
Terms and Definitions
Article 3-1 For the purposes of this technical regulation, the following terms and definitions
shall apply:
- Country: The United Arab Emirates
- Authority: Emirates Authority for Standardization and Metrology (ESMA)
- Board: Board Directors of the Authority
- Director General: Director General, ESMA
- Regulation: Technical Regulation no. () for the year 2012 concerning the “ Perfumes and Their
Products”
- Competent Authorities: All those federal and local governmental authorities of the country who
have been authorized to implement the rules of this technical regulation.

- Notified Authorities: Bodies that have been assessed by ENAS to be assigned as notified bodies
in the context of monitoring compliance of products entering the gulf market with related
approved safety requirements.
- Customs office: All seaports, airports, and land ports or at any other place where there is an
office of customs that is authorized to complete all or some of the customs procedures.
- Standard: A document stating the features, description, properties, quality, dimensions and
specifications or the safety and security requirements of a commodity material, service. It also
includes the terms, symbols, test methods, sampling, packing, labeling and marks.
- Perfumes and Their Products: Any perfume or perfumery product offered for sale, such as
Musk, Dehin Al Oudh, incense and other perfume types, which emit a pleasant odor so that it
can be used as a perfume.
- Supplier: Means any natural or legal person who manufactures perfumes and their products
producor who has such a product designed or manufactured, and markets under his name or
trademark, or who under their own name, or under a trade name, design, import or enclose and/or
pack and/or sell perfume products or any person modifies a product to comply with the applicable
requirements of this regulation.
- Emirates Conformity Assessment Scheme (ECAS): The system that verifies the fulfillment of
the approved standards, either directly or indirectly like inspection, testing, examination,
calibration or granting the products conformity certificates, and which is applied by the authority
according to the general regulation of Emirates Conformity Assessment Scheme that has been
granted by Board Directors of the Authority by decision No. (8) for the year 2009.
- ECAS Registration Certificate: A certificate of conformity issued to the product complying with
a relevant UAE Standard(s) or to any adopted national/regional and international standards by
ESMA.
- The Emirates Quality Mark granted according to this technical regulation: It is a distinction
mark granted to a certain product, and indicates that the manufacturing organization is complying
with the requirements of this technical regulation and that its production system meets other
requirements set by ESMA under this regulation.
Chapter Four
Implementation Responsibilities
Article 4-1 Responsibility of the Authority :
1. Identification of standards applicable to perfumes and their products as per this technical
regulation and listing them in Annex 2, after adoption.
2. Supervision and control on the conformity of the referred products in this regulation to its
requirements and provisions specified in this regulation.

Article 4-2 Responsibility of the Competent Authorities:
1. Monitor the compliance of suppliers with this regulation and the conformity of their products
to the standards listed in this regulation through inspection, physical and laboratory checks.
2. Coordinate with the Authority regarding their role in market surveillance and implementation
of this technical regulation.
Article 4-3 Responsibility of the Supplier:
1. Supplier has to comply with the rules of this regulation when manufacturing and /or importing
perfumes and their products to the market.
2. Suppliers shall keep all the information and documents that show the test results on perfumes
and their products that have been imported into the markets.
3. Suppliers shall cooperate with competent authorities, at request from the latter, on any
required action to eliminate the risks posed by products which they have made available in
the market. In particular, suppliers shall provide the competent national authority with all the
information and documentation necessary to demonstrate the safety of their products and their
conformity with the requirements listed in this regulation.
4. Supplier shall ensure that, while the product is under their responsibility, storage or transport
conditions do not jeopardize its compliance with the requirements set out in this regulation.
5. In case ESMA, competent authority and the accepted authority are unable to identify the
source of non-conformity to this regulation, it shall be ensured that the violated party is
responsible for the non-conformity case.
6. On the request of health authorities, the supplier shall provide the detailed material safety data
sheet (MSDS) without any fees or delay.
7. The nomenclature used in the MSDS should be based on the most recent edition of the
International Union of Pure and Applied Chemistry or International Nomenclature of
Cosmetic Ingredients or European Pharmacopoeia or United States Pharmacopoeia, or any
other approved standard references. Plants and should be identified by its genus and species.
8. To ensure the safety of perfumes and their products, products placed on the market should be
produced according to good manufacturing practise from an accredited body by the Authority.
Besides, manufacturers should comply with (ISO 9001) for Quality Management Systems,
(ISO 14001) for Environment and (OHSAS 18001) for Occupational Health and Safety.
Article 4-4 Responsibilities of Licensing Bodies:
Accreditation bodies have to take the Authority approval, by official document, for licencing
companies and institution that has commercial or industrial activity pertaining to perfumes and their
products.

Article 4-5 Responsibility of custom departments:
1. Custom departments shall inspect shipments of perfumes and their products at all entry points,
and ensure that only registered shipments that have ECAS certification are released to enter
the country.
2. In the case of finding a non-registered product in ECAS, the customs department shall stop
the shipment to enter the country and shall cooperate with the authority to take appropriate
action(s).
Chapter Five
General Requirements
Article 5-1 Perfumes shall be categorised (see below Table) according to the percentage of perfume
in the solution:

Chapter Six
Safety and Quality Requirements
Article 6-1 International Fragrance Association (IFRA) Standards shall be referred for the use of
ingredients in perfumes and their products i.e. Prohibited, Restricted and Specified Ingredients.
Article 6-2 The supplier has to provide documentation that shows the results of tests and checks done
to on their products for safety and quality as per the Annexure (3) from an accredited laboratory .
Article 6-3 The supplier has to declare any allergens (if present) as per annex (4) if their concentration
exceeds a the threshold value of 0.001%.
Chapter Seven
Labeling and Packaging Requirements
Article 7-1 Supplier has to comply with packaging and labeling requirements in the Gulf Standard
(UAE.GSO ISO 22715:2008) concerning Cosmetics -packaging and labeling. The information shall
be visible, legible, inedible and declared in clear Arabic and English languages.
Article 7-2 Pictures and illustrations which are inconsistent with the prevailing social customs and
values in the UAE shall not be used as well as any religious phrase.
Article 7-3 Medical claims claiming for any medical benefits of perfumes and their products shall not
be used.

Article 7-4 The supplier has to comply with the article 6-3 and declare these allergens on the label.
Chapter Eight
Metrological Requirements
Article 8-1 Perfumes and their products have to comply with the metrological requirements of the
GSO Emirates Standard (UAE.S GSO OIML R87:2007) as well as the technical regulation of
metrology legislation in the country issued by the Board of Directors Decree no. (1/5) held on 18-06-
2009.
Chapter Nine
Conformity Measures
Article 9-1 Conformity Assessment:
1. Perfume and their products have to comply with all requirements specified in the chapters
(6,7,8,9).
2. All the perfumery products are required to be registered with the Emirates Conformity
Assessment Scheme (ECAS). For that reason, all products shall comply with model (B) that
has been explicated in ECAS.
3. Products that are granted the ECAS Registration Certificate, Emirates Quality Mark or other
certified external conformity mark by the authority is considered confirm to the requirements
of this Technical Regulation.
Chapter Ten
Violations and Penalties
Article 10-1 When any violation is committed against any provision(s)/rule(s) of this regulation, all
measures, actions and penalties shall be taken against perpetrator or the responsible person as
stipulated in Federal Law no. (28) for the year 2001 (for establishing ESMA), its amendments,
systems and regulations issued according to that, or according to laws and legislations applied in the
country.
Article 10-2 In case of finding any violation(s) regarding the fragrances safety or have doubt on that,
the Director General will take necessary immediate action(s) to resolve the issue. This includes
instructing the responsible party/ authority to implement all the required actions for resolving
violation, or directing the ESMA inspectors or others who have been authorized by ESMA to
withdraw/ recall the product(s) or any other necessary action(s). It shall be ensured that the violated
party bears all the related costs.

Chapter Eleven
Transitional Provisions/ Rules
Article 11-1 The supplier is given a time period of six months from the date of publishing this
regulation in the official gazette to comply with the requirements of this technical regulation.
Chapter Twelve
Transitional Provisions/ Rules
Article 12-1 On the request of the authority and/ or competent authorities, the supplier shall provide
with all the information and documentation necessary to demonstrate the conformity of their products
with the requirements listed in this regulation without any fees or delay.
Article 12-2 The authority and the competent authorities authorized by ESMA are entitled to
withdraw samples of perfumes and their products at all entry points for the purpose of checking and
testing to ensure the conformity of these products to the requirements and provisions of this
regulation.
