1. Introduction Det Norskc Veritas (DNV) has been appointed by the the UK Maritime and Coastguard Agency (MCA) as one of the Nom­inated Bodies (NB) authorised to undertake type approval of Marine Equipment. This delegation is provided to DNV' s Brit­ish Committee under the UK Statutory Ins trument (1996) No. 147. This came into effect on the !st March 1996.

The details of the scheme are provided in the Merchant S hip­ping Notice No. MSN 1735 (M+F) Amendments No. 2. This certification note is provided to describe the system and its op­eration within DNV's Certification Services.

DNV provides its own type approval of equipment. This serv­ice is described in the Ce1tification Note No. l .2 - Type Ap­proval.

T yp e Approval

The world-wide experience in safoguarding quality is laid down in intcmational ly recognised standards, such as ISO/THC Guides for third-purty certification, and the European Stund­ards presently being developed for the EEA countries (EU and F.FTA countries). These standards, together with rules and ex­perience ofDet Norske Veritas, fo rm the basis ofDet Norske Veritas' Certification Services.

1.1 Background for DNV's MCA type approval ln accordance with its international and national responsi­bilities, stemming in part from the 'J nternationaJ Convention for t11e Safoty of Life at Sea (SOLAS), the Maritime and Coast­guard Agency (MCA) and its forebears have for many years undertaken the "type approval" of marine equipment, mainly of a safety or pollulion prevention nature, for use on board United Kingdom ships. To gain such type approval a prototype which is represent.alive of the build standard of the equipment is subjected to a technical appraisal of its design, examined and tested, and if found satisfactory, a type approval certificate is issued. The advantage of the type approval process is that a manufacturer is thus assured that the equipment will be accept­ed without detailed examination of each individual item during the ship's routine sunreys and !he shipowner can purchase such equipment with similar assurance.

'1.2 Equipment subject to type approval Equipment subject to type approval is listed in the annex Lo MSN 1735 (M+F) Amendments No. 2 and Appendix B .

It should be noted that type approval of Navigation Equipment and Radio Equipment have been delegated to the UK Defonce Research Agency only.

For equipment not listed but which requires type approval, manufacturers are advised to contact the MCA.

After the RU Directive on Marine Equipment became mandatory { ! 999-01 -0 l), the Conformity Assessment Procedures specified in said dire<:tive have to be followed. ONV has been appointed as a Notified Body on behalfof Norwegian Maritime Authorities for all equipment categories covered by the Directive.

2. Type Approval Principles

2.1 Choice of manufacturer seeking type approval In recent years there has been s ignificant development of spec­ifications and res ting requirements for many items of equip­ment which should ensure that equipment is manufactured to consistent and satisfactory standards. It has been decided therefore that new arrangements should be made to widen the choice of manufacturers seeking approval of their equipment with anticipated savings in costs.

It should be noted however that where equipment is of a novel nature, or subject to significant design changes, or the specifi­cations or testing requirements are not considered to be suffi­ciently developed or experience of their usage is limited, the MCA will undertake the necessary approval procedure.

Enquiries for this type of equipment should be referred to MCA.

2.2 DNV as nominated body (NB) Procedures have been agreed between MCA and DNV. DNV "persons" (as referred to in the Merchant Shipping (Delegation of Type Appr.oval) Regulations 1996) and hereinafter referred to as Nominated Body (NB) may undertake the examination, testing and certification of the equipment lis ted in the annex for which type approval is normally appropriate.

2.3 Scope of Service

2.3.1 Type approva l applies to a wide range of systems, product!; and materials. Type approval may be a self-contained, i ndcpendent service or an element in the product certification process.

2.3.2 The scope is to assess systems, products and materials to con­formity with standards and specifications.

2.3.3 The Type approval consists of the fo llowing three clements:

/Jesign assessment to ver ify that the design of a system, prod­uct or material conforms to a given standard and speci­fications.

Type testing to verify that a system, product or material has lhc ability to meet specified test requirements.

Certificate retention survey to verify that the conditions stated when the certificate was issued, are complied with at any time during the validi ty of the certificate.

Each of these clements is described in detail in clause 4 of this Note.

Type testing may be waived for certain products and materials that cannot be subjected to a realistic test.

2.4 Type approval to latest standards Equipment for new ships or for fitting on hoard existing ships, where requi red to be type approved, should he type approved lo the latest standards.

3. How to Obtain a Type App1·oval

3.1 Application for type approval

3.1.1 The type approval should he applied for in writing to any office ofDNV. Application fonn s can be obtained from a local DNV Station.

3.1.2 t\. manufacturer or person wishing to gain type approval of equipment for use on UK ships should submit an application to DNV. The application should include:

the name and address of the manufacturer and, ifthe appli­cation is lodged hy an authorised representative, his name and address a written dl!Claration that the same or a similar application has not been lodged with another NB the teclmical documentation and test requirements as stat­ed in Specification Sheets for each product as given in MSA 1735 (M+F) Amendment No. 2 the applicant is to place at the disposal of DNV suflicient specimens representative of the production envisaged. DNV may request further specimens if needed for carrying out the test programme.

3.2 Quotation

3.2.1 A quotation for type approval may be obtained on request and by submitting information on:

system/product/material to be type approved field of application (if known) standards/specifications to be applied tests already carried out location of production and testing facilities.

3.2.2 The quotation will normally include information on:

scope of work documentation to be submitted (see below) documents to be issued by DNV conditions for retention and renewal of certificate proposed work schedule price and conditions of payment.

4. Elements of Type Approval

4.1 Design assessment

4.l.1 The scope is to assess that the design of a system/product or material conforms to given standards and specifications.

4.1.2 The design assessment may vary i.:onsiderably in extent from one product to another and is to be defined in each single in­stance.

4.1.3 The design assessment will normally comprise the following documentation which is to be submitted to DNV :

main drawings of system/product (or other equivalent doc­umentation) instruction manuals (if any) design calcu lations (if any) information regarding marking of the product by manu­facturer's type designation (or other marking) for unam­biguous traceability between product and certificate of type approval. reference to design standards, specifications, etc. specification of applied materials operating characteristics test results (hereunder results from possible type tests) type testing programme (see below) proposed field of application (if known) functional description

documentation of reliabi lity by calculation and/or in serv­ice experience (ifrequired).

4.2 Type testing

4.2.1 The scope of type testing - also called initial testing- is to ver­ify the abili ty of a system/product or malerial to meet specified requirements by subjccling the test sample to physical, chemi­cal, environmental or operational stresses.

4.2.2 The test sample (e.g. prototype) is to be built in confonnity with the approved plans, using tooling, methods and processes comparable to those platllled for subsequent production.

4.2.3 The test sample is to be examined for workmanship and for conformity with drawings and specifications prior to testing.

4.2.4 The type testing will be performed in accordance with an es­tablished test programme which the clicnl and DNV have agreed upon prior to the commencement of the testing.

4.2.5 Type approval tests are to be conducted by a United Kingdom Accreditation Services (UKAS) laboratory, accredited labora­tories or an equivalent laboratory recognised by DNV. A rec­ognised laboralory in this context may be a laboratory that can document compliance with the relevant requirements in EN ISO/lEC 17025 :2000 The laboratory at DNV's Head Office, rwvik, Norway, is an accredited laboratory.

4.2.6 If the test results for some reason do not comply with the re­quirements, DNV may require renewed testing, or supple­mentary tests, or it may reject the design. DNV will provide reasons for the rejection of any tests petformed.

4.2.7 Upon completion of the testing according to the type testing programme, the client is to submit a copy of the test repo11, signed by himself and endorsed by the representative of DNV. DNV will inform lhe clients when more than one copy is re­quired.

4.2.8 In consultation with the MCA, DNV may waive the require­ment for any test specifically cited in a pcrfonnance standard providing it is satisfied that lhe sample has met the criteria of a specification superior to that of the prescribed test.

5. Type Approval Certificate

5.1 Certjfjcatc

5.1.1 A certificate of type approval will be issued by DNV when the system/product/materials in question has been found to meet all specified requirements, i.e. upon acceptance of design as­sessment and results of type testing.

5.1.2 Where the equipmem meers the provisions of the relevant ap­plicable instruments and test and performance standards, DNV will issue a certificate of type approval to the applicant. The certificate will contain the name and address of the manufac­turer, details of the equipment, technical documentation, con­clusions of the examination, conditions for its validity and the

necessary data for identification of the ar,proved type.

5.1.3 The applicant must inform DNV of all modifications to the ap­p roved product which must receive additional approval where such changes may affect the confonnity with the requirements or the prescribed conditions for use of the equipment.

5.2 Type approval at subsidiaries and licensees Manufacturers being licensees or true suhsidiaifos nf certifi­cate-holders or companies possessing a statement "Design As­sessment for Type Approval" will normally have Lo apply for type approval , and procedure for granting the certificate will be as for initial apl)roval.

However, a simplified procedure to obtain type approval may be considered, provided conditions that will be decided case by case, are folfilled.

5.3 Validity period

5.3.1

All new certificates of type approval will be valid for a period of up to 5 years.

5.3.2 Unless specifically required otherwise, existing type approval equipment already fitted on board s hips will continue to be ac­cepted providing it continues to operate and function satisfac­torily. If such equipment needs to be replaced, then it should be replaced with equipment for which a current certificate of type approval is in force.

5.3.3 If so requested by the manufacturer and provided tl1e re­quirements have not been changed, the existing MCA lypc ap­proval certificate may be replaced by a DNV MCA certificale of type approval upon lransfor of MCA certificates.

A copy of the MCA certificate and the test reports referred to therein is to be submitted to local DNV Station for forwarding to MTP.

5.4 Re-submission

5.4.1

Where a submission has been rejected after completion of the type approval procedure by DNV, the manufacturer will be re­quired to modify the equipment to take account of the reasons for non compliance before making a new submission to DNV, which is to be accompanied by a new application form. The documentation shal l clearly show the original test report refer­ence.

5.4.2

Upon receipt of the re-submission, together witl1 the applica­tion fonn, DNV will re-open the approval procedure.

5.5 Renewal of type approval

5.5.l The certificate holder should apply for renewal of the certifi­cate at least 3 months before the period of validity expires.

The intention of the renewal survey is to check that the condi­tions for type approval have not been altered during the valid­ity period of the certificate, and to check that any new rnles, if applicable, have been complied with.

This may be done by means of a certificate retention survey as specified below, or in another appropriate manner, dependent on I.he changes of the product and the extent of any applicable new rules.

5.6 Certificate retention survey

5.6.1

The scope of the survey is to verify that the design of the prod­uct type, material composition and the product type designa­tion marking and other conditions stated on the Type Approval Certificate are not altered since the certificate was issued.

5.6.2 The certificate retention survey may take place at time of re­newal of the certificate of type approval, and thus constitute one possible basis for tl1c renewal.

5.6.3 For certain systems and products, a certificate retention survey may be required for the retention of the certificate.

5.6.4 The main clements of the certificate retention survey arc :

Witnessing of tests/ inspection on factory samples, se­lected at random from the production line (where practi­cable) Review of twc approval documentation Review of possible changes in design, materials and per­fonmmcc Ensure tractability between manufacturer's product mark­ing and certificate of type approval

5.6.5 A certificate retention survey report will he issued and submit­ted to the client when the product in question has been foru1d to meet all requirements.

5.7 Retention of type approval documents

5.7.1

The manufacture r or his authorised representative is to keep with the technical documentation copies ofcertificates of type approval and their additions for a period of al least Len years af­ter t11e last product has been manufactured.

5.7.2 The certificate of type apl)roval amVor their additions and the annexes to the certificates will be kept at the disposal of the MCA and DNV for the period specified in paragraph 5.7.1

Appendix A Regulations for the Type Approval Service

A.l Publication

A.1.1 Publication by the certiticate·holder: A certificate-holder has the right to p\1blish that he is the ho lder of a certificate of type approval, issued by Dl\1\/.

If the certificate-holder wishes to publish only part of a test re­port or other document related to type approval issued by DNV, he shall have a written agreement from DNV.

The certificate-holder shall not claim product properties or functions in his publications that could mislead purchasers to believe that performances or properties of the product or its use are covered by the type approva l, when in fact they are not.

A. l.2 Publication by DNV

A.2 Suspension, withdrawal and cancellation of certificate

A.2.1 Suspension of certificate: A certificate may be suspended for a limited period for the fol­lowing reasons:

if non-conformity with the requirements are found but are of such a nature that immediate withdrawal is not neces­sary.

- in case improper use of the document.<; is not rectified by suitable retractions and appropriate remedial measures by the client

A suspension will be fonnally confinncd by DNV in writing. The MCA will also be advised.

DNV shall specify conditions and requirements for the abol ­ishment of the suspension.

A.2.2 Withdrawal/ cancellation of certificate: A certificate may be withdrawn/ cancelled if:

manufacturer fails to comply with due settlements of his financia l obligations inadequate measures are taken by the manufacturer i11 case of suspension there has been any other serious contravention to the re­quirements of the type approval service or the procedures ofDNV

- the manufacturer does not wish to prolong the certificate the standard or rules arc changed and the manufacturer ei­ther will not or cannot ensure conformity with the new re­quirements if the submission, after finalisation of the type approval procedure, is found to be non-compliance due to the equip­ment being found not to meet the appropriate standard(s) the applicant will be notified, in writing, of the non com­pliance.

A withdrawal/cancellation will be fonnally confirmed by DNV in writing.

DNV shall specify conditions and requirements for the abol­ishment of the withdrawal/cancellation.

A.3 Appeal

A.3.l

Jn cases of dispute, the manufacturer has the right to appeal de­cisions taken to a board not directly connected to the same or­ganisational unit who has carried out lhc commission.

Summary

This Notice covers changes to equipment listed in Annex A.2 of the European Council Directive 96/98/EC of 20 December 1996 on marine equipment and EU Commission Directives 98/85/EC of 11 November and 2001/53/t::C of 10 July 2001. The ch anges have been introduced by Commission Directive 2002/75/EC of 2 September 2002, and apply where no detailed internationally agreed testing standard exists. Equipment listed in the amending armex will continue to be type approved by the UK's Nominated Bodies 1tt1til international standards are agreed and the products a rc moved to Annex A.l of the Marine Tiquipment Directive and into MSN 1734 (M l·F).

1. Introduction

1.1 The Merchant Shipping (Delegation of Type Approval) Regula tions 1996 SI (1996 No 147) provide for Nominated 13od ies to undertake the "type ilppmval" of marine equipment, of a s<Jfcty or pollution prevention nature, for use on board United Kingdom ships. This legislation was supplemented by The Merchant Shipping (Mar.ine Equipment) Regulations 1999 (SI1999 No.J 957) which implemented the European Council (l:iC) Directive 96/98/liC of 20 December 1996 on marine equipment (fhc MED). This introdltred EU Notified Bodirs for type approv<il of MED Annex A.1 listcd equipment (sec MSN 1734 (M+F) for further de tails).

1.2 Commission Directive 98/85/EC of ll November 1998 and 2001/53/EC of 10 July 2001 further amended the list of equipment fur which no agreed intemational standard existed but require type approval.

2. Ame1tdment to MSN 1735 (M+H Annex

2.1 !n response lo changes to the testing standards developed by those orga nisations listed in Article 2(n) of the MED, the EC Commission has again ii;sued an amending d irective that update:; the list o f equipment for which no agreed international testing standards currently exi:;t. The i\nnex to MSN 1735 (M+F) and M~N 1735 (M+F) Amendment 1 arc revoked and replaced by lhe amending Aru1ex of this Notice.
