Panic Room DebacleBy now youve probably heard about the kid that was put in the NBISD Safe-Room over at Carl Schertz Elementary School. If you havent, spend a few minutes on Facebook and/or the Google. So far, both the NBISD and the parents that made the complaint against them have refused to answer our questions. Were still putting the puzzle together on this one, and well have our report on the case next week. Spoiler Alert: We already caught somebody lying.
4-Bs Reality Distortion FieldIn going through the 4-B contracts that our readers put up the money for us to get from the City, we discovered that the Board uses a definition of the word loan that seems foreign to us, but is probably familiar to residents of Airstrip One (look it up), where language is considered malleable. In the real world, loans work like this:
If youre you, you go to a bank and the bank lends you some money. You pay that money back from your earning or savings, plus a little bit more that parts called interest. At no time does the bank simply hand you another pile of money to repay your loan from. You can probably already see where were headed here.
If youre Ashley Furniture, a loan looks like this:
The 4-B Board lets you keep 50% of your City sales taxes. You know, the taxes collected from people that buy stuff from you. Then you get a no interest loan from 4-B, which is paid back out of that 50% gift. This is what we call a Michael Meek Loan, or Corporate Welfare. 4-Bs Meek will look you straight in the eye and tell you its not. Well let you decide whos right.
Now that yall see how that works, perhaps you, as a resident of New Braunfels,
can get a 50% rebate on your property taxes, and then use that 50% to pay back a loan that you get from the City. Let us know how that turns out for you.
HZ Gets All Gooey Over 4-B ProjectHere in New Braunfels, weve got three newsrooms, each with its own role to play within the informational eco-system. Theres the Houston-Owned Herald-Zeitung, and KGNB Radio, who take their marching orders from Michael Meek and whoever the current Mayor is, and whose jobs are to promote and endorse actions taken by the City Hall/Chamber of Commerce/4-B Board Industrial Complex. And theres the TX Citizen, whose job is to provide opportunities for discomfort for the Citys power players by explaining whats actually going on. So far, weve all been playing our assigned parts to perfection.
For the last two weeks, this column has been dissecting 4-Bs multi-million dollar deal with the Alamo Colleges Central Texas Technology Center. And City Halls multi-million dollar deal with the Central Texas Technology Center. And the conflict of interest and taxpayer abuse inherent therein. Well recap:
1) Local taxpayers, through 4-B and a $4 million dollar bond issue, have committed over $7 million dollars to the CTTC.
2) Tuition for New Braunfels residents to attend the CTTC is over 244 percent that charged to a San Antonio resident. (Go ahead and let that sink in.)
3) Theres a Jim Poage of Startech listed as sitting on the Board of Directors for CTTC, recipient of millions from 4-B.
4) Theres, coincidentally, a Jim Poage of Startech on the 4-B Board, which gives millions to the CTTC. WHAT ARE THE ODDS?

The spring to suer transition is upon us, and that means one thing for me; completely and uerly debilitating aergies. Every year I think to myself, "The last two or thr decades have bn a fluke. This year wi be like the hay ending to an aergy medicine coercial a year long." I sti believe that year is coming. This, however, is not it. It tk a fit of what smed like 400 snzes in a couple of minutes to aounce its oicial aival, and now there is only misery. I told this to my dad. He only heard complaining and asked that aoying question, "Would you like any chse with that whine?" Which brings me to my next point, wine. And yes, we do have chse with that wine. So if you can make it out of your house to take in some of the enjoyable aspects of the season, stop by and enjoy some vintage wines and a gourmet chse tray. 6) Amazingly enough, 4-B (who gives CTTC the aforementioned millions) has a paid consultant named Rusty Brockman sitting right there in every 4-B meeting. Right there at the table, advising the 4-B Board on whom they should give millions to. Crazy coincidence, right?
Last Thursday, the editorial staff of the HZ did its usual bang-up job defending 4-B, and published a piece titled CTTC a great investment for Seguin, NB that could only be described as a hot, wet #### ### for the Alamo Colleges. Of course, Items 1 through 6 noted above were not mentioned in the article, probably because theyre completely irrelevant.
Why would anybody care about that stuff? If those points had any merit, the HZ Editorial Board totally would have mentioned them. Remember, theyre professionals, and you youre just a reader. If you think those facts should have been mentioned, youre uppity. Might want to dial that back a bit and eat what youre fed. Throw this paper away while youre at it. Theres stuff you shouldnt know about in it.
Hey, remember how upset everybody got when we revealed that 4-B President Tim Zipp was also Vice President in Charge of Medicare compliance for the Scooter Store? The same Scooter Store that 4-B gave millions to in order to keep them from moving to San Marcos? The same Scooter Store that was charged with Medicare fraud (or non-compliance, as it were)? The same Scooter Store that was eventually shut down after a raid by the FBI? Remember that? Same deal here. Both the HZ and KGNB Radio kept the Tim Zipp connection under wraps for years. You know, because of the irrelevance and whatnot. Apparently, theyre far wiser than we. All-pro.
Its near hilarious how this community is continually betrayed by the people that are supposed to keep it in the loop. To the HZ and KGNB: Do your job, or get out of the news
business. Enough of this racing toward the bottom. Enough. Youre like self-proclaimed pit masters that cook over propane with a microwave assist.
The local medias endless ####### of Michael Meeks ##### and ####### is truly impressive. The small-town news writing game doesnt pay much - but the job is loaded with influence. The fact that two-thirds of local newsrooms hand their power over to Meeks crew is a testament to the mans savvy. The writers get paid in hearty handshakes and pats on the back for carrying Meeks water, while he inflates his bank account and increases his influence with the fruits of their labor. Hes an undisputed genius. Theyre an unqualified embarrassment to this profession.
Heres what the HZ did manage to mention in Meeks press release its piece:
the investment that the communities of Seguin and New Braunfels made in helping realize that dream continued to pay off in a big way.
Lets see. Seguin gets top billing as far as credit for making the CTTC dream come to life. Thats nice. Heres what they didnt mention - New Braunfels is in this deal for over $7 million, while (according to 4-B documents presented to City Council) Seguins 4-A stepped up to the plate and dedicated a whopping $1.2 million to the project. Must not be relevant. We shouldnt have even brought that up. Nobody cares about stuff like that.
A continued increase in enrollment has the current facility bursting at the seams.
This would have been a good a time as any to mention that a six hour schedule for Bexar County residents runs $480, while an NB local will pay $1,172 for the exact same services, in addition to their CTTC-supporting sales and property taxes. Hooray! Again, irrelevant. Readers dont care about stuff like this. Voters still would have totally voted in favor that bond had that info been on the ballot. Were certain of it.
(CTTC) has been a major part of workforce training for some of the regions biggest manufacturers including Caterpillar and Continental.
The Caterpillar and Continental plants are located in, and benefit the City of - wait for it - Seguin. IRRELEVANT. Were suckers to think New Braunfels readers would care about that.
The expansion is happening because of continued investments from New Braunfels voters who approved a $4 million infusion in 2013, the New Braunfels 4B board and its counterpart in Seguin, the Seguin Economic Development Corporation.
Lets go over those numbers again. A $4 million dollar New Braunfels bond. Another $3 million in 4-B (New Braunfels sales tax) funds, and roughly 17% that amount from Seguins 4-A. Lets drive this home: Irrelevant. Were naive for even bringing it up. As former NB Mayor Gale Pospisil famously said when caught lying to the public about certain numbers a couple years back, (in order to influence a later-nullified election), The numbers dont matter.
New Braunfels and Seguin have put their money on the table and its been an investment that has paid dividends.
Again. $7 million from New Braunfels. $1.2 million from Seguins 4-A. The private companies cited as beneficiaries are located in Seguin. Local students pay nearly two-and-a-half times what an out-of-towner does. The atmosphere is thick with irrelevance.
The HZ got one thing right. Our investment into the CTTC has indeed paid dividends just not to New Braunfels residents, with the exception of Jim Poage and Rusty Brockman and Michael Meek. They live here. But the rest of us are #####-######, not to mention ##### with multiple #####, barbed #########, blunt ##### and alternating #######, all without the benefit of a ##### ###### or even a ### ## ####.
But were sure thats nothing to worry about.

Carter Appeal to Go Before Third CourtAn appeal by a New Braunfels man who is on trial after comments he made on Facebook, will be argued on Wednesday, June 3, before the Third Court of Appeals in Austin.
Justin Carter was charged with making terroristic threats after he made comments about attacking a generic kindergarten.
In February, 2013, Carter posted on a Facebook thread, I think Ima SHOOT UP A KINDERGARTEN and EAT THE BEATING HEART OF ONE OF THEM. Someone who saw the post alerted authorities.
Carter argued that the post was hyperbole that didnt constitute a true threat and that the charges violated his First Amendment rights. The State, however, argued that the statement was taken as a true threat by authorities and the laws against making terroristic threats apply.
District Judge Jack Robison refused Carters attempt to have the case dismissed, thus prompting the appeal.
The issue concerns sections of Texas Penal Code 22.07, which read:
(a) A person commits an offense if he threatens to commit any offense involving violence to any person or property with intent to:
(4) cause impairment or interruption of public communications, public transportation, public water, gas, or power supply or other public service;
(5) place the public or a substantial group of the public in fear of serious bodily injury.
Carter claims that code is unconstitutionally vague, thus his arrest under the code violates his habeas corpus rights. Prosecutors, on the other hand, contend that Carter can only make a pretrial habeas corpus appeal on constitutional challenges if he shows that the statute always operates unconstitutionally in all possible circumstances, not those as applied specifically to him.
The case boils down to whether Carters comments were First Amendment protected comments, regardless of their obnoxious nature, or were whether they can be perceived as an actual threat.
Scientology Continues to File MotionsIn another appeal concerning First Amendment issues, the Church of Scientology
International filed another motion to Third Court of Appeals asking that the case against it be dismissed. Oral arguments were made before the Court months ago.
Monique Rathbun filed a lawsuit against the Church claiming harassment and spying by its members over public comments about the Church made by her husband, Marty Rathbun. Marty was once the second highest-ranking member of the Church and was instrumental in it gaining tax-exempt status.
The Church contends that its members were protesting Marty and making a documentary about him, which it says are First Amendment protected activities. Because of this, CSI filed an Anti-Strategic Lawsuit Against Public Participation (Anti-SLAPP) motion. As well, the Church argues that its spying on Marty is protected as it was part of an investigation of what it claims were suspected trademark violations by Marty, who was offering Scientology services outside the Church.
In 2014, District Judge Dib Waldrip dismissed the motion, prompting the appeal.
In its recent motion, the Church argues that two recent Texas Supreme Court decisions bolsters its Anti-SLAPP case.
In the first case, Lippincott v. Wisenhunt, CSI states the High Court ruling confirms the Churchs contention that its activities against the Rathbun were protected even if they concerned private communications between Church members. Rathbun had argued that the Churchs activities were not protected since they did not relate to a matter of public concern.
The Church also argues that the State Supreme Courts ruling in Neyland v. Thompson supports its contention that, as an organization, CSIs communications meet the Anti-SLAPP criteria. The Church states in its motion that as a group, it has a common interest in seeing that its religion practices are not adulterated.
While the Anti-SLAPP measure is meant to be fast-tracked through the courts, the Appeals Court has yet to render a decision, the delay of which is also likely due to the continued motions filed by the Church. Rathbuns team does have the right to respond to the Churchs recent motion.

Houston Freezes OverIts late into the month of May, and the Houston Astros are good?
They are! Ive seen the standings to prove it. The Astros, playing in a division with Mike Trout, Albert Pujols, Felix Hernandez, Robinson Cano and the like, have the LARGEST divisional lead of any team in baseball as of May 19th and have the sixth best run differential (+22) in the majors. This is a franchise that has lost an average of 104 games over the past four seasons. They are the first team since the advent of the Major League Baseball draft in 1965 to draft first overall in three consecutive years, an honor bestowed upon the team with the worst record in the league.
Yet here we are, on the door step of the Dog Days of Summer, and the Houston Freaking Astros are sitting on 25 wins (as of this writing). Last season, it took them until June 3 to get that many. The year before that, June 15. Go back a year, to 2012, (Houstons last in the National League), when it wasnt until June 8. The last time the Astros were even remotely competitive was 2008. That was seven managers ago (Cecil Cooper, Dave Clark, Brad Mills, Tony DeFrancesco, Bo Porter, Tom Lawless, now A.J. Hinch). Instagram didnt exist yet.
So where did things first go wrong, and how did they get back to being good again? Starting with the former, the Astros had a great nine-season run, spanning from 1997 to 2005, a run that included six post-season appearances and the franchises only World Series trip, in 2005. Names like Biggio, Bagwell, Berkman, Beltran, Alou, Randy Johnson, Kent, Oswalt, Pettitte, Clemens, Lidge, Wagner the Astros had stars. That was also the problem. These players got old or bolted elsewhere after short stints in H-Town (namely Johnson and Beltran).
Owner Drayton McLane kept trying to catch lightning in a bottle by throwing money at anyone resembling a star player: A six-year-for-100-million-dollars here for Carlos Lee, a trade for a washed-up Miguel Tejada there. Name recognition didnt equate to wins; after the Astros 2005 World
Series appearance, Houston averaged just 78 wins over the next five seasons, and the last thing you want to be in pro sports is average. Not good enough to contend, not terrible enough to rebuild.
But then something great happened. After the 2011 season, when the Astros finished a whopping 56-106, McLane sold the team to businessman Jim Crane, and Cranes first order of business was to turn the Astros into what they desperately needed to be: the suckiest of sucks who ever sucked. Crane hired Jeff Lunhow from the Cardinals to be the teams General Manager after Lunhow had just helped construct a World Series winner in St. Louis. Lunhow and Crane said to Hell with star players, it was time to rebuild the Astros from within the farm system.
Instead of trading prospects for established talent, the franchise worked on scouting and developing their youth, players like Jose Altuve, George Springer, Luis Valbuena, Dallas Keuchel, Luke Gregerson, all major contributors to Houstons red-hot start, with others like Carlos Correra whos tearing up the minors, waiting in the wings. Under the old regime, those players might be starring elsewhere, for large market franchises who skewered the Astros out of their young talent by dangling that 34-year-old, four-time all-star in front of them in a Ill trade you my delicious orange for your boring 3 fun-size Twix bars-like deal. Only for you to realize by the end of the school day that DAMMIT I really couldve used those Twix (its simple math really: caramel-cookie-goodness > peeling a #$*@ing orange).
The team the Astros have now may not the be the draw the Killer Bs once were (and Houstons 24th ranked attendance figure proves it), but rest assured: baseball in Houston is finally fun again.

Dear Pocho: The great thing about your pregunta was that you attached a tweet of some PR hack essentially ejaculating while tweeting that Rubio was speaking to Spanish-speaking employees post-fundraiser. Hell, Democratic politicians in the Southwest have given shout-outs to the help during their speeches for years now, but you dont see Dems freaking out about it, mostly because they realized Mexicans were humans long ago.
I wont elaborate too much on why Mexicans dont like Rubio herego find my columna in the Guardian from last month for a more thorough explanation; the Mexican promises that essay WONT give you a pain in the gulliverbut why gabachos like Rubio is easy: they think hes their brown bullet to make more Mexicans conservatives. The more interesting trend I find is what you pointed out: how gabachos try to shame Mexicans into liking Rubio, just like theyve used Clarence Thomas and Ben Carson into claiming liberal African-American voters who dont appreciate them are traitors to the Race.
Only in America do gabachos have the audacity to tell minorities theyre not minority enough because they dont embrace a tokenand if you dont believe me, witness the campaign to make Carlos Mencia a likeable person.
Hello, Mexican! My wife and I are gabachos living in a 99% Hispanic neighborhood. We are very tolerant folks and actually chose where we live because of its diversity (lots of people of every typelong story).
Unfortunately, our immediate neighbors are putting us in an awkward situation. One neighbor has four pit bulls tethered in his back yard and they bark loudly ALL THE TIME (whether he is home or not). They never go inside his home; just stay outside and bark. The other neighbor has a boomin system in his car and loves to sit in his driveway at he end of his day and clean the car while BLASTING gangsta rap (Im not kidding; this rattles the dishes in our cabinets!). Normally this wouldnt be a problem, but we work out of our house and the incessant noise greatly affects our ability to converse with clients over the phone.
Im totally understanding of the need to be loud every now and again, but not so much when it comes to blatant disregard for neighbors. Do you have any suggestions for addressing the problem without my being shot by gangsta-man or alienating my pit bull-loving neighbor? I want to avoid having them see this as a white-on-brown thing; its more of a I live right next to you and you are ruining my life by your inconsideration thing. Or is it just con estos bueyes hay que arar? ANY suggestion would be greatly appreciated.

On Bee Death and Other LiesWhen it comes to pushback on opinions I express in this column and in my personal life, there can be no question that topics relating to environmentalism get the most. Even my views on religion dont attract the same level of interest, and they never attract the same level of venom. I think that part of the passion over environmental issues comes from the way people of my own age and younger have been indoctrinated by the environmental movement. They have been taught to believe that they are saving the planet and that science supports all of their beliefs.
My own attitude is equally passionate because I once accepted much of the propaganda put out by environmentalists and their allies. It was only later in my life that I came to realize I had been lied to. Smokey Bear, Ranger Rick, Jacques Cousteau, Steve Irwin, and Bill Nye (to name only a few) had used their position and my naivet to sell me a bill of goods, and theres no one more dedicated to exposing a fraud than a rube who has had a peek behind the curtain.
Today, it takes all the willpower I have not to dismiss environmental concerns out of hand, and when I dont, I almost always get disappointed again. My latest bemusement is just the most recent in a long line of environmental baloney, and just one more example of how the environmental movement has lied to us all, repeatedly.
Have you ever heard of colony collapse disorder? Were you under the impression that it was a danger to honey bees in the U.S. and elsewhere, something truly worthy of concern since honeybees are responsible of much of the pollination that goes on in agriculture? Me too. Guess what?
Henry I. Miller has an article at Forbes.com that tackles just this issue and finds, to my surprise, (not again!) that weve been lied to. There may, in fact, be a condition known as colony collapse disorder, and it may affect European honey bees, but it seems unlikely that it will have any real effect on crop production since actual statistics on the
number of honey bee colonies maintained are actually increasing. (That I didnt even think to check makes me feel pretty stupid.) Studies linking the mass demise of bees to the use of neonicotinoid pesticides are similarly dubious.
Why would anyone lie about this? Well, in this case, the hysteria seems to be linked to anti-pesticide groups, but some crossover with organic food enthusiasts and anti-GM crop crazies is likely. No doubt there is some money to be made with this particular bit of crying wolf; thats usually the case. Crony capitalism designed to prop up organic food companies is sure to be part of the mix, but thats not all of it. Underlying almost every environmental apocalypse du jour is an anti-human stance used to promote totalitarian goals.
Climate change is just a thinly veiled attempt to reduce human energy consumption and install the government programs and powers necessary to enforce that reduction. Quality of life and the ability to preserve that life are directly tied to access to cheap, plentiful energy, and the restriction of that energy will result in more than a few deaths. This fulfills the anti-human sensibilities, but the real benefit is in the power to decide how the remaining energy is to be distributed. Im not completely dismissing corruption, mind you, the ability to shell out hundreds of millions to ones political pals is always nice; Im just pointing out that there is a long-term goal that goes beyond all that.
Not convinced?Prior to climate change, the population
explosion was what was expected to do us all in. The idea that the world was overpopulated was all the rage in the late 70s and early 80s. This overpopulation was sure to result in war, famine, and disease. The population explosion needed to be curbed and a new (less capitalist) system needed to be designed to ensure the proper distribution of scarce resources. Even a personal hero of mine, Isaac Asimov, got into the act. He did point out that human ingenuity might very well make room for more people and find them
resources, but he conceded that, in the end, there must be some cap to human population if the species is to survive. The unexpressed question was, why not now?
The scientific debate on population resulted politically in greater access to abortion and birth control. Planned Parenthood benefitted substantially in this country, and its no coincidence that Chinas One Child policy was adopted during this time. The anti-human strain of this argument should be clear, but the real power comes in deciding what population is controlled and what population is allowed. What could be more totalitarian than a government that controls your very ability to procreate?
The honeybees are just one of hundreds of smaller crusades that can be laid at the environmental movements attempts to use science as a cudgel in policy debate: likewise peak oil, nuclear power, extinction, acid rain, and fracking. Placing the origins of this type of thinking with Rachel Carson and Silent Spring is satisfying as it fits nicely with my own age, but probably isnt true. It doesnt take much thought to add Henry David Thoreau or Rousseau to the neo-luddite list if not to the totalitarian one. Theres probably some little known Greek from classic history that Im sadly unaware of, but it doesnt really matter where it started. What really matters is what it teaches.
My father used to tell me. Dont believe anything you hear and only half of what you read. Like so many other things in my life, my father was right about all this. The most immediate indication of this is that my father had misquoted Edgar Allen Poe, or Benjamin Franklin, or someone (apparently you cant trust people who quote people either). More importantly, though, is the lesson that Im still learning: no matter how much you want to believe, you really should take the time to verify.
