WARDEN FILES MONDAY IN SUPERIOR COURT;
MAYOR & CITY ATTORNEY IN FULL RETREAT
On Monday morning October 03, 2011, Tucson Activist RoyWarden will file preliminary motions in Pima County Superior
Court, setting the stage for the filing of a suit next week tooverturn Tucsons version of the Civility Accord and current
rules which now prohibit speech before the Mayor andCouncil the Mayor deems impertinent, slanderous or a
personal attack.
For a view of the current version of the suit, Google Wardenv. Tucson Mayor Bob Walkup, though Warden says he will
make several cosmetic and procedural changes to the suitprior to filing the final version with the Court next week.
Meanwhile, regarding the City of Tucsons legal position:Mayor Walkup, who was so full of bluster and confidence on
September 20, 2011 when he warned Warden would bearrested on the following week should he continue to utter
the words the Mayor deemed impertinent and slanderous,
now seems flustered and embarrassed.
Perhaps Tucson Municipal Court Presiding Judge Riojas, who
attended the September 26, 2011 Meeting of the Mayor andCouncil and heard for himself Wardens offensivecommentary, set the Mayor straight, because when KGUN
reporter Kevin Keen asked him, should Warden have beenpermitted to speak, the Mayor replied:
That's a subjective call. Intermixed with that wasreading a transcript. So when does it cross over? My
judgment was: let's see what the adjusted rule,recommendation is from the city management. We'll
just take it from there. But I detect that thedemeanor today was better. It wasn't as course as
it's been in the past.
When KGUN 9 On Your Side followed up and asked theMayor about the issue of repetition and if repetition could be
the grounds to stop a speaker, Mayor Walkup said the new
rules the council will be considering will hopefully answerthat.
It could include repetition, but now that gets a little hard to

We'll just wait and see what happens.
Warden says he agrees with the Mayor that, well just have
to wait and see what happens, but Warden says whatever
the Mayor and Council decide to do in the future regardingtheir rules is irrelevant; the only thing that matters now is
what happens in Pima County Superior Court.
In America, its well settled law: we dont let policemen,
and Mayors, arbitrarily and capriciously decide, on a speakerby speaker basis, what political speech is lawful and what
political speech is not, says Warden.
Weve got courts of law, and judges, to protect our rights
from government intrusion, and to determine what those
rights really mean.
Warden suggests the public, the media, and Mayor and
Council Google Warden v. Tucson Mayor Bob Walkup tobetter appreciate whats coming.
Mayor Walkup is finally waking up to the sad fact that hes
waist deep in a swamp full of alligators. And Tucson CityAttorney Mike Rankin helped put him there.
Mayor Walkup doesnt have the good sense to back down,apologize to the citizens of Tucson and rescind the current
policy, which unconstitutionally inhibits free speech, saysWarden.
So Im going to Pima County Superior Court, and later toFederal Court, to make him.
