SUBJECT: Eerik HEINE

' 1. The information in paragraph 2 is that which wasreceived by the undersigned after a perusal of the INS, In-telligence Section files located in Room 547, 119 D Street

2. The following is pertinent:—

a. Ati request, INS made a completeand thorou,fl cneck or t ir files and records on Sub-ject. INS' first record on Subject dates back onlyto 1961. INS has no record of HEINE having enteredthe USA in 1957, 1958, 1959, or 1960: INS feelsquite certain that their records are 'accurate andwould have reflected UEINE's travels ' during the per-iod from 1957 through 1960 providing he used histrue name in travelling to the USA. 4) US Code 1001, Title B: Making falsestatements or writings.

S) US Code 1423, Title' 8: Misuse of evidenceof citizenship or naturalization.

c. If HEINE received any assistance from partiesin the USA in travelling illegally or for purposesother than stated, the parties in the USA would, orcould, be subject to the following:

1) US Code 1324, Section 274, TitleA: Bring-ing in and harboring certain aliens.

2) US Code 1327', Title A: Aiding or assisting• subversive aliens to enter the USA.

d. The INS files on HEINE reflect that he, on alloccasions during the period from 1960 through 1964,had obtained a 13-2 Visa which is "for pleasure only"under, the US Code, Title A. According to Mr. McCartney,a 8-2 Visa does not authorize HEINE to engage in otheractivities like, —TO'r example, showing a film duringwhich he collects funds. According to Mr. McCartney,HEINE could, and would, have been deported from theUSA during the period from May to July 1963 when hewas travelling throughout the country showing film andcollecting funds. This was strictly prohibited andcontrary to the designated purpose for which he hadobtained a visa. A B-2 Visa does not even permit theholder of it to use the visit to a foreign country toseek out work-in order to relocate to that country.Mr. McCartney showed to the undersigned several casesof individuals who had been deported after it had beenproven that they had obtained a 8-2 Visa under falsepretenses inasmuch as they had resigned from theirjobs, sold their businesses, et cetera, and inasmuch .as there was concrete indication that they had misusedthe purpose of the 8-2 Visa to establish themselves inthe USA. (Note: HEINE resigned from his job in Canadaimmediately priorto coming to the USA in May 1963;also, we have information that he had intended to usethe travels through the USA to feel out where amongthe Estonian colonies in the USA he could best settleand establish himself. He has since denied emphati-cally to the Canadian authorities that he ever intendedto move or to live in the USA.)

e. Mr. McCartney indicated that, because of hisillegal activities in the USA, the INS could stilltake action to institute expulsion procedures againstHEINE and to black list him.

E. Mr, McCartney suggested that the Agency checkthe American consulates in Canada for a complete re-cord of HEINE's visa applications to the USA; further,he recommended that a check be made at the visa officeof the: State Department as, McCartney feels, HEINEwould have been obliged to provide considerable back-ground data when initially applying for an entry visato the USA.

g. Attached herewith is a reproduction of the en-tirety of the cards which INS has on record concerningHEINE. These reflect that HEINE made only the follow-ing trips to the USA:

Destination1) 1961: April 16 to 17 Buffalo, New York

2) 1961: Ottober 11 to 16 Estonian House, NYC

3) 1962: September 29 toOctober 5 Estonian House, NYC

4) 1963: May 3 to 15 Estonian House, NYC

5) 1963: May 9 to July 15 Estonian House, NYC

6) 1963: September 7 to 10 Estonian House, NYC

7) 1963: November 30 toDecember 1 Buffalo, New York

8) 1964: April 3 to 8 Mr. ElMar KEERD

.h. Mr, McCartney indicated that, according to theattached cards, HEINE overstayed his 9 May to 15 July1963 visa as a result of which he betame the subjectof an INS investigation. INS.has since recalled theSeattle INS Office investigation file and will makethis available toC of the Office of Security.
