Held at the Oulton Park race circuit in Cheshire, theevent gave invited guests their first chance to put thevehicle through its paces on UK roads.
New Actros is the ultimate premium truck for long-distance transport. From the outset, designers andengineers were determined to provide the best possiblecomfort, driving dynamics, safety, productivity andoperating economy, as well as a sweeping range of cabsizes, engine ratings and options, allowing customers totailor vehicles perfectly for any application.
The current Actros holds the Guinness World Recordfor fuel economy at 40 tonnes gvw, but road tests haveshown the new model is seven per cent more frugalwhen specified to meet Euro 5 emissions regulations,while the ultra-clean Euro 6 version shows a four percent improvement.
The 81 guests took turns to head out on a 17-mile testdrive, carefully chosen to simulate a variety of typicaldriving conditions.The route included single- and dual-carriageway roads. Each of the four demonstratortrucks provided for the event made 10 journeys - a totalof almost 700 miles covered on the day.
On each trip, the mpg figure achieved was recorded and at the end of the day the winner was Craig Stewart,logistics manager at Widnes-based Ray Stewart Haulage, who averaged an impressive 11.4 mpg in the 510bhp V8-powered Actros 2551, and 11.8 mpg in the 450 bhp Actros 2545 model. Between journeys, guests alsoenjoyed ‘hot laps’ of the Oulton Park circuit in two-seater racing cars piloted by professional drivers.
Transport manager Mark May of food waste and animal by-products recycling specialist John Pointon &Sons, summed up the feelings of many when he said: “It was a great day, very informative and enjoyable, andsuperbly organised.The new Actros is brilliant.The driving experience was fantastic and if the fuelperformance figures are to be believed it will be an unbeatable all-round package.The previous Actros is avery good truck - but this new one is a huge step forward.”
Actros astounds

The new Mercedes-Benz Actros premiumlong-haul tractor unit range was the starattraction for some of the North-West’sleading road transport operators, at a
launch event staged by leadingdealer Enza.
From 2013 onwards, the German vehicle manufacturer said all its trucks and tractor units used for
on- and off-road applications in the construction sector will be known under the name Arocs.
The new dump trucks, all-wheel drive dump trucks, concrete mixers, tractor units and drop-side chassis vehicles will be available as two-, three- and four-axle vehicles, with 16 output variants ranging from 238 bhp to 625 bhp.
The engines have been designed to meet the future Euro 6 emissions standard, and the trucks will be available for order as a Euro 6 version only.
The BlueTec 6 engines are designed as in-line six-cylinder engines with exhaust-gas turbocharger and intercooler to provide good tractive power at little more than the engine’s
idling speed. Maximum tractive power ranges from 1000 to 3000 Nm and will be achieved by the four engine sizes: 7.7, 10.7, 12.8 and 15.6 litre. The latter is completely new and comes in the form of the new OM 473 engine.
Mercedes said the Arocs will also be setting an example with its drive system. The engine’s power will be transmitted by the PowerShift 3 automated transmission, fi tted as a standard. Drive programs are available which have been specifi cally developed for the vehicle’s varied range of applications.
The drive confi gurations offered for the Arocs range from the 4x2 two-axle version with rear-wheel drive to 8x8/4,
a four-axle vehicle with all-wheel drive and two steering front axles. Four-axle versions with one front and three rear axles, a wide range of air-sprung vehicles, or a load-optimised concrete-mixer chassis with single-tyred drive tandem are examples of the variety of new Arocs versions available straight off the production line.
The Arocs has seven cabs available in 14 different versions. As supplements to the compact 2.3 m cabs in L, M or S versions, the new Arocs can also be fi tted with spacious 2.5 m variants with a level cab fl oor.
Although release images of the Arocs were not available as
Truckstop News went to press, the German manufacturer said the design is as unusual as the complete truck, which features steel elements on the bumpers, a robust radiator guard and optically integrated construction-specifi c folding entry step.
New for the Arocs are the product groups Loader and Grounder. The Arocs Loader has been fully optimised to reduce its kerb weight, and Mercedes-Benz said the result provides payload-optimised 4x2 tractor units which are among the lightest vehicles in the construction sector – as well as 8x4/4 concrete mixers with 32-tonne maximum permissible weight.
The Arocs Grounder is designed for operating under extremely diffi cult conditions. According to Mercedes, it is extremely stable and resilient and has been manufactured to be uncompromising and robust for the toughest jobs on the construction site.
The Arocs will premiere at the Bauma trade fair in April 2013.

handling thatʼs much like a car. “To put things into perspective, we can even offer independent frontsuspension, although initially only on left-hand drive vehicles. This world-first takes handling to unsurpassedlevels in the truck world,” Nilsson said.
Also of benefit to drivers are improved seats and drivingposition, optimised to provide a better view of the road. This isaided by an increase in the cabʼs usable window area and aninnovative slimmer rear-view mirror design.Stalks and controls are arranged in priority so the most
important ones are now closest to the driver, and thesteering wheel now has a neck tilt function – another
world-first in the truck world.Safety is high on the agenda, An all-new cabstructure features more upright A-pillars, whichgive the cab an additional 1 m3 of interior space.This means an extra 300 litres (10.5 cu ft) ofstorage capacity, as well as greater comfort onboard.“The cab is optimised both for work andleisure time,” Nilsson said. “A better bed,integrated parking cooler, new lighting and lownoise levels among other features, all increase
the chance of pleasant relaxation and a goodnightʼs sleep, which in turn means drivers are less
tired and more alert.”Production of the Volvo FH will start in spring 2013
for the European market.

Mercedes-Benz has announced Arocs, a new specialist truck for construction work, which is set to follow on the heels of the new Actros for long-distance transport and the Antos for heavy-duty short-radius distribution.

Using wireless technology to link a road train, in which a lead truck controls a convoy of
vehicles driving behind it, is now technically feasible. According to Volvo Trucks, the technology was demonstrated at the conclusion of the Safe Road Trains for the Environment (SARTRE) project – in which the Swedish truck-maker was a participant.
Although it may take some time for wireless road trains to become a reality, Volvo said the technology brought about through the project could be put to use for other purposes to make the traffic environment considerably safer in the near future.
The EU-financed SARTRE project recently presented the results of three years of research and trials. Representatives from the EU Commission and experts in transport technology from Europe, the US and Japan got to see a fully functioning wireless road train in operation at Volvo’s proving ground in Sweden. In the lead was a Volvo FH truck, closely followed by another Volvo truck and three cars. The building of test vehicles, car-to-car communication and sensors for the control of nearby vehicles has been underway for three years.
Volvo claimed these technical achievements now make it possible for multiple vehicles in a road train to integrate smoothly with other traffic on public motorways. The entire road train is interconnected through wireless technology, which ensures the trailing cars
follow exactly in the track of the lead vehicle – as though the train consisted of a single vehicle. The result is the driver in a trailing car can relax, perhaps read a book or
watch TV, while the car drives itself. “The gaps between the vehicles
are much smaller than in normal traffic, but it is as safe, or even safer to be part of the road train, since
it is lightning-quick computers and not human beings who respond to even the slightest change in any of the cars in the train,” said Andreas Ekfjorden, project manager for Volvo Trucks’ portion of the SARTRE project.
One of Volvo Trucks’ most important roles in the project was to determine exactly what information needs to be transmitted back down the road train to enable the other cars to follow the lead truck.
“All the vehicles in the road train have a roof-mounted antenna so they can receive information from the lead vehicle’s computer system,” Ekfjorden said. “For instance, if the lead truck starts braking, all the other vehicles in the train brake at exactly the same time.”
The cars’ fuel consumption drops the most as a result of the reduced air drag in the compact convoy of vehicles, but the lead truck’s fuel consumption is also cut. This will make it profitable for haulage firms to provide lead trucks – vehicles that join the convoy could pay a fee, thus benefiting the truck operator.
In addition, the results of the SARTRE project show a truck with a trained driver and comprehensive equipment package contributes to heightened traffic safety that actually benefits other road users.
“It’s fantastic that a truck driver can drive from A to B with at least one car trailing behind, while at the same time cutting both fuel consumption and carbon dioxide emissions. And, not least, that he can replace several car drivers and thus boost safety,” said Lennart Pilskog, director public affairs at Volvo Trucks.
However, there are still challenges to overcome. Reliability needs to be improved, which must be on a par with that of an aircraft’s autopilot before road trains can emerge as a truly viable transport solution on public roads. Plus, it has to be absolutely clear who is responsible for driving a trailing vehicle, and exactly when that responsibility is transferred.

Truck drivers could take responsibility for steering trailing cars if SATRE convoy tech becomes a reality

a partnership that led to major successes at the 2012 edition, Iveco and FPT Industrial have supplied Team De Rooy with vehicles, engines and spare parts.
The provided vehicles embarked via cargo ship with an estimated 700 race, assistance, organisation and press vehicles from the Port of Le Havre in the north of France. The journey to South America will take 21 days, crossing the Atlantic Ocean and passing through the Panama Canal.
Recognised as the world’s premier off-road rally, garnering millions of followers each time, the race sets off on January 5 from Lima, Peru, and ends on January 20 in Santiago, Chile, crossing through Argentina.
The Petronas De Rooy Iveco Team will compete at Dakar 2013 with two 4x4 New Trakkers (Evolution 3), two 4x4 New Trakkers (Evolution 2), and one Iveco
Powerstar, a vehicle produced and sold by Iveco in Australia.
All the vehicles are equipped with FPT Industrial’s Cursor 13 engines, which generate up to 840 bhp.
Rally truck 1, an Iveco Powerstar, sleeper cab version, will be driven by 32-year-old team leader Gerard de Rooy, winner of the Dakar 2012. will be driven by Italian driver Miki Biasion, a Dakar veteran who has previously competed three times in the race car category and five times in the truck category.
Rally truck 4, an Iveco New Trakker Evolution 3 day cab version, will be driven by team-newcomer René Kuipers, a seasoned motorbike and car rally racer from the Netherlands. French driver Jo Adua, a seven-time Dakar competitor, will drive the final rally truck 5, an Iveco New Trakker Evolution 2.
A Glasgow haulage firm has been refused permission to operate HGVs after the
country’s traffic commissioner, Joan Aitken, disqualified its directors from the industry.
Ronald Brady and Patricia Brady lost their repute after a public inquiry heard they had used an operator licence in another company name to operate vehicles for a new business, which is illegal.
The traffic commissioner also found their other company, Way Ahead Couriers Ltd, had run without a transport manager - a mandatory requirement - for a decade, operated more vehicles than it was allowed to, failed to produce records to enforcement officers, did not collect data on employees’ driving duty as required and changed operating premises without permission.
Additionally, the TC heard how vehicles operated by the business had attracted mechanical prohibitions and
were found to be overloaded, while drivers had committed offences.
Mr and Mrs Brady applied through RJB Transport Ltd for a new licence after the authority held by Way Ahead Couriers Ltd was revoked by the traffic commissioner. However, prior to the revocation they had continued to use discs issued to Way Ahead Couriers Ltd, despite the company having ceased trading three years earlier.
Ordering the disqualification of Ronald Brady, Aitken concluded: “I am not prepared to be more lenient to a director who has been so neglectful of his duties and who did not have a proper transport manager in place. There is such a catalogue of failings in this case, it is a bad one, with few redeeming features.”
She added: “Traffic commissioners have duties to road safety and the licence undertakings are there to reflect what has to be done to achieve safe operating.”

Temperature-controlled distribution specialist Peter Green Chilled has ordered six more New Actros
tractor units from Mercedes-Benz, after the first four ordered proved an all-round success.
“We’ve had our first New Actros for a month now and the drivers are really pleased with them, not least because they’re so quiet and smooth,” said transport manager Colin Davis.
“These trucks are already matching the fleet average in terms of fuel efficiency which, considering they’re still virtually brand new, is very impressive. Once they start to bed in, the mpg performance is only going to get better.”
The next batch of New Actros will be delivered, like those already on the road, by City West Commercials of Avonmouth. Once again, all will be 2545 models
with flat-floored BigSpace cabs and 450 bhp engines mated to Mercedes PowerShift 3 automated transmissions.
The same dealer also supplied
Peter Green Chilled with five 6x2 tractor units from the established Actros range in July, which is still being offered alongside New Actros.
Those trucks, all 460 bhp 2546 variants with flat-floored MegaSpace cabs, were the first to wear three-pointed stars that the company has specifically ordered, and were out straight onto continental work.
The Actros and New Actros tractor units are the subject of CharterWay contract hire agreements with Mercedes-Benz Financial Services. Most routine maintenance is being undertaken by City West Commercials’ mobile technicians at the operator’s headquarters in Evercreech, near Shepton Mallet.

Between journeys, guests alsoenjoyed ‘hot laps’ of the Oulton Park circuit in two-seater racing cars piloted by professional drivers.

ATS Euromaster’s parent company, Euromaster Group, has expanded operations into a 17th country, Turkey – the number one European market by
volume for truck tyres.Euromaster will be represented in Turkey via a
franchised network of Michelin dealers, adding 230 centres to its already extensive European network. The company said this is expected to grow to more than 300 centres in Turkey by the end of 2013.
The deal increases the number of Euromaster Group outlets across Europe to 2250 centres, of which approximately 790 are franchised outlets.
Peter Fairlie, group sales director at ATS Euromaster, said: “It’s unlikely our car or van fl eet customers will venture as far as Turkey by road, but a number of heavy truck customers do. This expansion ensures they will continue to have access to the widest possible European network in the event of a tyre-related breakdown.”
Euromaster Group now provides service to customers in Austria, Czech Republic, Denmark, Finland, France, Germany, Italy, Netherlands, Norway, Poland, Portugal, Romania, Spain, Sweden, Switzerland, Turkey and the UK.
In the UK, ATS Euromaster operates exclusively via a wholly-owned network of more than 350 centres, supported by a select number of network partnership agreements with independent dealers in towns where there is currently no ATS Euromaster presence.

T he Co-operative Group has become one of the fi rst customers for a dramatically styled aerodynamic truck
body launched by Gray & Adams.The Dolphin is so named because
its streamlined profi le evokes that of the ultra-effi cient aquatic mammal often seen in the waters of the Moray Firth, close to Gray & Adams’ Fraserburgh headquarters.
Designed to maximise fuel-effi ciency and thereby cut CO2 emissions, it also features all-new leading-edge cappings that follow the 3D curvature of the roof, and a vortex generator to smooth the airfl ow around the back of the vehicle.
The Co-operative’s two Dolphins were built at Gray & Adams’ Dunfermline production facility and are fi tted to 26-tonne Scania chassis with roof-mounted, adjustable air defl ectors by Hatcher Components.
The Carrier Supra 950 refrigeration unit is mounted above the cab roof. And despite the fact that the body’s roofl ine then tapers towards the rear of the truck, there is still suffi cient interior space to accommodate the roll cages used by The Co-operative to transport its frozen and chilled product – in fact, the reduced roof height offers an environmental benefi t,
because energy is not wasted on cooling empty and unrequired loadspace.
Both vehicles have entered service at The Co-operative Group’s recently opened, £22-million regional distribution centre in Avonmouth, from where they are being used to supply smaller stores and convenience outlets throughout the South-West.
Ken Thompson, logistics service transport fl eet manager for The Co-
operative Group, said: “We’re always keen to explore any opportunities to cut costs, especially our fuel bill, while at the same time reducing our carbon footprint and improving our environmental profi le.

W essex Water is running its first Mercedes-Benz tractor units after the New Actros came out on top in a comprehensive
evaluation exercise that involved drivers and other colleagues from the company’s sludge operations team.
Mercedes-Benz dealer Pentagon Commercials won the order for the regional water and sewage treatment business’s 10 tractor units, which work with tank trailers. All are 2545 models with ClassicSpace cabs and fuel-efficient 450 bhp engines mated to Mercedes PowerShift 3 automated transmissions.
Wessex Water’s New Actros are now working round the clock, seven days a week, hauling waste from sewage works to larger processing facilities.
The company serves an area of 10,000 km2 that includes Dorset, Somerset, Bristol, most of Wiltshire and parts of Gloucestershire and Hampshire.
Prior to the arrival of its New Actros, the only truck on the Wessex Water fleet to wear a three-pointed star was an 8x4 Axor 3243K hook-loader, which was supplied by Pentagon last year and is based in Bristol.
Wessex Water group manager for fleet & plant Martin Crocker said: “When the time came to replace the sludge operations team’s previous tractor units, we decided to trial products by three manufacturers – and to give the drivers a key role in the decision-making process. So we went out on the road with the drivers to make sure we had a complete understanding of the operation, then conducted a series of debrief sessions.
“The drivers were initially a bit daunted by the prospect of going from a manual gearbox to the fully automated PowerShift 3 transmission of the New Actros. But once they’d tried it, they were quickly won over – the feedback on the Mercedes’ two-pedal system was overwhelmingly positive, while they also loved just about everything else about the cab too.
“And while the New Actros was a firm favourite with the drivers, it was also the most fuel-efficient of the demonstration units we tested.”
The new tractors are operating from different locations, but the workshop team at Pentagon’s Poole depot will undertake most of the inspections and maintenance.
Water Winner for neW actros
T he Freight Transport Association said it has welcomed the chancellor’s decision to cancel January’s 3p per litre fuel duty
increase – but is disappointed he did not go further and abandon all planned rises before the next election and move to reduce fuel duty by 3p a litre.
James Hookham, FTA’s managing director, policy & communications said: “This early Christmas present from the chancellor is a good start, but we will not let this issue go. Spiralling fuel costs have a devastating impact on haulage businesses, their customers and ultimately everyone through the price of goods on the shelves, and the campaign for a fairer deal will continue.
“January’s rise would have cost a 10 vehicle freight operator around £14,000 - which
could be one employee’s wages. While we are relieved the immediate danger has passed, in order to get the UK back on the road to economic recovery, it is vital we have a cut in fuel duty and a long-term strategy to prevent future rises and uncertainty.”
The FTA was quick to point out research commissioned by FairFuel UK from the National Institute for Economic and Social Research (NIESR) has found that a 3p reduction in fuel duty could generate an additional 75 thousand jobs, grow the economy overall by 0.2 per cent at a net cost to the Treasury of £3bn. The FTA said its contention is that taken together, these increases in disposable income for consumers and free cash for businesses would be spent or invested elsewhere in the economy, leading to the re-ignition of economic growth.

I refer to the letter from Andrew Jones, published in your December issue.
I work as an HGV instructor, and am constantly surprised by the way a lot of drivers simply misunderstand the drivers’ hours and working time regulations.
Andrew Jones is correct in stating the 10-hour night rule relates to the total working time in a 24-hour period. Breaks and periods of availability do not count towards this.
If a driver starts at 3 am on a Monday morning, any work done in the period to 3 am on the following Tuesday morning counts towards this, even if a driver has taken a daily rest period. This is clearly stated in the guidance issued by VOSA.
I have encountered many drivers who, like Karen Bancroft, think this relates to the spread over (length of working day). However, this is clearly incorrect, as you can see in the VOSA guidance.

STOBART DRIVERS’ CHARITY SINGLE
E ddie Stobart has released its fi rst Christmas music single, with a special rendition of 12 Days of
Christmas recorded in aid of Help for Heroes.
Performed by Eddie Stobart Truckers, 10 stars of the Channel 5 series Eddie Stobart: Trucks & Trailers, the single was released on December 17 and is available as both a music and video download, priced 79p and £1.29 respectively.
Produced at the famous Sarm Studios in London’s Notting Hill, home to one of the world’s best-known Christmas hit singles, 12 Days of Christmas was recorded over December 1-2.
The special parody 12 Days of Christmas features revised lyrics making fun references to the work Eddie Stobart does in delivering Christmas goods to the nation. Lines from the song include ‘Four frozen turkeys’, ‘10 mince pies’ and ‘seven spotters spotting’ – referring to the 25,000 members of the Eddie Stobart Members Club.
Stobart said it has always had a close affi nity with the armed forces, with over 10 per cent of Eddie Stobart drivers coming from a military background. The Christmas single will help raise some funds for Help for Heroes and support the benefi cial work it carries out across the UK.

P erth-based refrigerated transport specialist McLaughlan Transport Ltd has added another DAF XF105 to its 37-strong fl eet. The decision was
based on the overall cost of buying and running the model, with an initial batch of three having covered 600,000 km and delivered 10 per cent better kilometres per litre than the fl eet average.
The latest arrival is a 6x2 mid-lift axle FTG model, which will run with a tri-axle Gray & Adams refrigerated trailer taking fresh produce from Scotland around Europe. With journeys that can see it travel as far afi eld as Greece and the south of Spain, the new DAF is expected to cover around 180,000 km a year.
Managing director George McLaughlan said the XF105 meets all their expectations in cost terms. “It’s competitive in terms of its initial price and is proving to be both fuel effi cient and reliable, the latter being particularly important when moving fresh produce and working to timed delivery slots.”
Driver Donald Martinson said he was pleased with the performance of the truck, and with the comfort of the large Space cab, featuring an air-suspended driver’s seat with armrests and seatbelt, powerful auxiliary cab heater and air conditioning.
McLaughlan opted for the 460 bhp rating for the 12.9-litre MX engine in its new 105. At 44 tonnes gross weight, it gives a comfortable power-to-weight ratio of 10.45 bhp/tonne; and with a torque output of 2300 Nm between 1000-1410 rpm, move-offs are made easier whatever the load or road conditions. The engine is matched to a 12-speed AS-Tronic automated gearbox.
The new truck will be maintained in McLaughlan’s own well-equipped workshop, with support from the supplying dealer, Lothian DAF.

B ermondsey-based waste and recycling company RTS Waste Management has taken delivery of
its fi rst Renault Kerax 460.35 6x4 tractor unit through Renault Trucks distributor, MV Trucks.
The purchase follows impressive fuel results from the current Renault Premium Landers on its fl eet which, in some cases, has seen fuel consumption down by nearly 50 per cent.
The company has added a total of nine new Renault trucks to its 26-strong fl eet in the last 12 months, with another two on order, marking a move away from Mercedes.
As well as the Renault Kerax, which will be used to haul waste to landfi ll and the incineration tip, RTS Waste Management has recently added two 6x2 Renault Premium Lander 380.26 dustcarts and two 8x2 Renault Premium Lander
460.32 roll-on/roll-off rear-steer hookloaders with drawbar. Each of the new Renaults is equipped with the automated Optidriver+ gearbox and undertakes waste removal and recycling for clients in the construction industry across London and the South East.
RTS Waste Management director, Mark Redmond, said: “The Renaults are performing much better on fuel than the other trucks on our fl eet. Recent fuel fi gures have shown that by replacing Mercedes with the Renault Premium Landers, we have almost halved our fuel costs on the dustcarts.
“We have also been very impressed with Renault Trucks’ Optidriver gearbox, which makes a big difference in reducing driver fatigue – a particular issue when operating in Central London. This has been refl ected in reduced insurance claims,” he added.

One of the offences some drivers have committed is using a mobilephone while driving. The legislation defines this offence as follows:
No person is to drive a motor vehicle on a road if he is using ahand-held mobile telephone or a hand-held device of a specifiedkind. No person is to cause or permit any other person to drive amotor vehicle on a road while that other person is using a hand-held mobile telephone or a hand-held device of a specified kind. Noperson is to supervise a holder of a provisional licence if theperson supervising is using a hand-held mobile telephone or ahand-held device of a specified kind at a time when the provisionallicence holder is driving a motor vehicle on a road.
Exemptions from prosecution are fewA person does not contravene any of these provisions if, at the
time of the alleged contravention: they are using the telephone orother device to call the police, fire, ambulance or other emergencyservice; they are acting in response to a genuine emergency; and itis unsafe or impracticable for them to cease driving in order tomake the call (or, in relation to the supervision of a provisionallicence holder, for the provisional licence holder to cease drivingwhile the call was being made).
Under the Road Vehicles (Construction and Use) Regulations, amobile telephone or other device is to be treated as hand-held if itis, or must be, held at some point during the course of making orreceiving a call or performing any other interactive communicationfunction. An ‘interactive communication function’ includes the
following: sending or receiving oral or written messages; sendingor receiving facsimile documents; sending or receiving still ormoving images; and providing access to the internet.
If you’re caught using a hand-held mobile phone or similardevice while driving, you can expect to get an automatic fixedpenalty notice. This means you’ll get three penalty points on yourdriving licence and have to pay a fine of £60. However, your casemay go to court. If it does, you may also face disqualificationfrom driving on top of a maximum fine of £1000. If you weredriving a PCV or heavy goods vehicle, you could face amaximum fine of £2500.
Also if the matter were considered of a serious nature youcould face prosecution for other road transport related offences,which carry more serious sentences.
Repercussions are hard-hittingHowever, if you are the holder of a vocational licence the
implications of a mobile phone offence do not end there. You arelikely to be called to vocational driver conduct hearing in front ofa traffic commissioner. The senior traffic commissioner hasissued a document entitled ‘Statutory Document No 6 VocationalDriver Conduct, which gives a detailed view of vocational driverconduct. Here I have reproduced the paragraph on the use ofmobile phones “A specific starting point is provided in respect ofthe use of hand held devices such as mobile telephonesbecause of the prevalence of this offence in recent years.
Parliament has recognised theinherent dangers caused bydrivers of motor vehicles whenusing mobile telephones whiledriving and brought forwardspecific legislation. There hasbeen an unacceptable increasein the number of vocationallicence holders using mobile telephones without a hands freedevice while driving large goods and passenger carryingvehicles. This practice is unacceptable and presents an unduerisk to road safety. Studies have indicated that even the use ofhands-free devices can distract a driver to the extent that theymay be prevented from applying the requisite care and attention.A report for an offence received from an enforcement agency thata vocational driver has used their mobile telephone while drivingwithout a hands free device in the last three years will result inthat driver being called to a hearing before the trafficcommissioner. Each case will be decided on its own facts andmerits and the presiding traffic commissioner will be keen toascertain the reason the driver is engaged in the telephone call.In cases where drivers are speaking with their employers or theircustomers, the traffic commissioner may consider the effect thismight have upon the operator’s repute”.
So you are likely to be called to a hearing in order to showcause why an order should not be made. The guidelines which atraffic commissioner will be considering are to suspendvocational entitlement for 14 days, 21 days if driving acommercial vehicle, to commence with immediate effect. For asecond and/or subsequent offence to multiply accordingly, forexample, second offence in a commercial vehicle 2 x 21 days.
Vocational licence holders should bewareusing mobile phones while driving
Continuing his review of successfully completedaccident claims, Steven Hinchliffe looks at justone situation experienced by a reader ofTruckstop News that resulted in an award ofpersonal injury compensation.
All of the accident victims mentioned in these articles are actualclients of my firm, Hinchliffes Solicitors. They have kindly giventheir permission for the disclosure of their details, and in particularof their real life experiences of incidents resulting in personalinjury claims, and the steps taken to make a successful accidentcompensation claim. All of these clients contacted my firm afterseeing our details in Truckstop News.
In this article I highlight a fairly common situation where a driveris required to deliver and unload a lorry or trailer that has beenpacked by someone else - either a fellow employee of the samecompany, or by an employee of an entirely different companyperhaps even based abroad. It is often the case that your ownemployer will be held responsible for compensating you for aninjury caused by a defective load, no matter who packed it. If youare self employed or an agency driver, you also benefit from thesame rights enjoyed by the employees of the company you arecontracted to work for. However, it is worth noting that if you werein charge of loading the vehicle the accident may be found to havehappened entirely due to your negligence, in which case a claimfor compensation would probably not be successful.
As with previous articles the common trend remains the effecton the injured person’s life, and although using the process of lawto make personal injury claims as a means of redress cannot trulycompensate for the trauma and inconvenience suffered, it canassist in requiring the guilty party to provide medical treatmentand rehabilitation, in addition to financial relief by way of awardsof compensation. As previously indicated, under the current lawand procedures the basic aim of an accident claim is to try andreturn the injured party to the position that he or she wouldotherwise have been in had the accident not happened.
CASE STUDY - INJURY CAUSED BY ADEFECTIVE LOAD
In the summer of 2010, HGV driver Mr R of Telford (namewithheld at client’s request) was strapping a load that hadalready been placed on a trailer by a colleague when an itemfrom the load fell, striking his head.
To successfully claim personal injury compensation from anemployer the injured person’s solicitor must have extensiveknowledge of the Health and Safety Regulations that havebeen breached, and be able to comprehensively set out detailswhen first contacting the employer. Without this level ofawareness the employer’s insurers will almost certainly try andexploit any perceived deficiencies or weakness in the case inan effort to avoid having to pay the injured person their rightfulcompensation.
In Mr R’s claim, the allegations of breaches of Regulationwere as follows:-
(a) Failed to take suitable and sufficient steps to prevent theitem within the trailer from falling, contrary to Regulation10(1) of the Work at Height Regulations 2005.
(b) Failed to take suitable and sufficient steps to prevent ourclient being struck by the item, contrary to Regulation 10(2)of the above Regulations.
(c) Failed to ensure that the trailer was loaded in such a wayas to prevent unintended movement of the contents,contrary to Regulation 10(4) of the above Regulations.
(d) Failed to ensure the trailer was loaded in a safe manner.
(e) Exposed our client to a danger or a trap and a foreseeablerisk of injury.
He suffered a painful cut to the top of his head and, as waslater confirmed in the medical report obtained in support of his

claim, there was also some affect on his pre-accident hearingdifficulties.
My firm sent a detailed letter to his employer, who passedthis on to their insurers. Within just over 2 months the insurersaccepted responsibility for the accident. By this time steps werealready well underway for Mr R to be examined by an ENTsurgeon so that a comprehensive medical report, setting outfull details of the injuries and their consequences, could beobtained. Once this was available and had been approved byMr R, a copy was sent to the insurers, together with details ofhis very modest financial losses incurred as a direct result ofthe accident.
Settlement negotiations then started, with offers and counteroffers being put forward by both sides. Within a few weeks itwas possible to reach an acceptable settlement at a total figureof £2250, the vast majority of which was to compensate Mr Rfor his pain and suffering. He kept the full sum recovered, asmy firm’s costs and the expenses we had incurred in dealingwith the claim (eg paying for his medical records and themedical report) were subsequently negotiated with the insurersand paid separately.
Fortunately, despite the accident circumstances Mr Rsuffered only a relatively minor injury, and this was reflected bythe level of compensation he recovered. His employer’sinsurers took a sensible approach to the claim and handledmatters with reasonable efficiency, which meant it was possibleto reach agreement and for Mr R to be in funds in just under sixmonths from the date the first letter was sent to his employer.This also had the effect of keeping the legal costs to aminimum.

DIGITal Tachos aND DrIver carDs
Digital tachographs have been with us for several years now, yet there are still areas of their use over which there is confusion. I was asked recently if I could run through some of those issues can cause frustration. The European Regulations governing drivers’ hours and record keepings (561/2006) at Article 26 stated it amended the regulations governing the use of tachographs (3821/85), which are the Regulations relating to recording equipment on road transport. Some of the Regulations which were amended were ones relating to the requirements for production of records. The law now states that: Where the driver drives a vehicle fitted with recording equipment in conformity with Annex I, the driver must be able to produce, whenever an inspecting officer so requests:
(i) the record sheets for the
current week and those used by the driver for the current day and the previous 28 days;
(ii) the driver card if he holds one, and
(iii) any manual record and printout made during the current day and the previous 28 days.
Annex I relates to analogue recording equipment. In other words, the Regulations state if you are driving a vehicle fitted with an analogue tachograph, you must be able to produce your driver card if you hold one – regardless of whether you have used it.
This is made law in Great Britain under Section 97 of the Transport Act 1968. So what is likely to happen if you fall foul of this? If the enforcement is being undertaken by a VOSA officer, then in these circumstances the VOSA sanctions policy states that if a driver uses a vehicle when the driver has failed to produce tachograph record sheets, driver card or
print-outs at the roadside, then the sanction may be a fixed penalty or prosecution.
But driving a vehicle with a digital tachograph requires the driver to take certain steps to ensure full compliance. When driving a vehicle equipped with a digital tachograph, drivers should ensure the instrument is calibrated; make sure their driver card is inserted into the correct slot from the moment they take over the vehicle, and that it is ready for use, before the vehicle moves; record the country in which they begin and end their daily work period. This must always be carried out at the time of the start or end of the period, even if the card is not to be withdrawn or inserted (for example, if the card is left in overnight).
Drivers must carry sufficient supplies of type-approved print roll on board the vehicle so a printout can be produced if requested; and ensure all duties conducted since the driver card was last removed
from a tachograph are manually entered onto the card record, using the manual entry facility on the tachograph.
Drivers must ensure the tachograph is working properly and the daily working period the mode button is used correctly to record other work, periods of availability, and rest and breaks. Reasonable steps must be taken to protect the card from dirt and damage.
Drivers must use only their own personalised driver card to record driving and other activities they undertake. Any use of someone else’s card is an offence and may amount to an offence of falsification which could lead to imprisonment.
If engaged on a double-manning or multi-manning operation, then the drivers must make sure their driver card is placed in the correct slot (slot 1 when they are acting as driver, and slot 2 when co-driver on a double-manned journey), when they take over driving.
Digicards must be made
available for downloading by their employer, as well being able to be produced at the roadside, as already mentioned.
Digital tachographs will default to recording ‘other work’ for driver 1 and ‘availability’ for driver 2 when the vehicle stops, and drivers must use the mode switch correctly to ensure rest and break periods are recorded correctly.
If a digicard is lost, stolen or damaged (or malfunctioning), a driver may drive without the card for a maximum of 15 calendar days (or longer if this is necessary for the vehicle to be returned to its premises) provided the driver produces two printouts – one at the start of the journey, and another at the end. Both printouts must be marked with the driver’s name or driver card or licence number, so the driver can be identified and any manual entries needed to show periods of other work, availability, and rest or break; and finally must be signed by the driver.

Overview & eligibilityIn accordance with section 94 of the Employment Rights Act 1996(“The ERA”), every eligible employee has the right not to be unfairlydismissed.
Unfair dismissal is a statutory claim that can only be brought byan employee (as opposed to a third party or contractor) withinthree months (less one day) from the date of dismissal, and isintended to provide a fair remedy where an employer has actedunfairly or unreasonably.
Following a change of the rules on April 6, 2012, any employeewho commenced their employment on or after this date is requiredto have two years’ continuous employment before they can bring aclaim for unfair dismissal. For those employees who began workbefore this date, only one year’s continuous employment is needed.
The five permitted reasonsFor an employer to defend a claim for unfair dismissal, they mustbe able to show the only or principle reason for the dismissal wasone of five permitted reasons under the ERA:
1. The actions of the employee amounted to misconduct (ERAs.98(2)(b)):
1.1 This can either be a single act of serious misconduct, or aseries of acts that are less serious;
1.2 Misconduct has been held to include: violence at work; theftor dishonesty; unauthorised absence from work; disclosure ofconfidential information etc.
2. The employee lacked the capability or qualifications to do theirjob (ERA s.98(2)(a)):
2.1 Capability should be assessed with regards to an employee’s“skill, aptitude, health or any other physical or mental quality”(s.98(3)(a) ERA);
2.2 The capability must relate to the work that the employeewas employed to do (s.98(2) ERA);
2.3 A dismissal will relate to an employees qualifications if itrelates to any “degree, diploma or other academic, technical orprofessional qualification” relevant to the employees position(s.98(3)(b) ERA).
3. The employee was made redundant (ERA s.139(1)) and oneof the following circumstances is relevant:
3.1 The employer is ceasing (or intending to) to carry on thebusiness for the purpose of which the employee was employed(business closure);
3.2 The employer is ceasing (or intending to) to carry on thatbusiness in the place where the employee was so employed(workplace closure);
3.3 There is a reduced requirement to carry out work of aparticular kind, or to carry out work of a particular kind where theemployee was employed to work (reduced requirement foremployees).
4. The employee’s continued employment would contravene anyduty or restriction imposed by any enactment (ERA s.98(2)(d))e.g.:
4.1 The employee was dismissed because continuedemployment would breach immigration rules;
4.2 The employee was dismissed because they had lost theirdriving licence, and driving was a requirement of the job.
5. The dismissal was for “some other substantial reason” (ERAs.98(1)(b)):
5.1 It is only necessary to establish a reason for the dismissalwhich is of a kind which could justify the dismissal of theemployee in question; it is not necessary to show that it didactually justify the dismissal (Willow Oak Developments Limited–v- Silverwood [2006] IRLR 607);
5.2 Some examples include thereplacement by a better qualifiedemployee (Priddle –v- Dibble [1978] 1 ALLER 1058), and dismissal because of aclash of personalities between employees(Gorfin –v- Distressed Gentlefolk’s AidAssociation [1973] IRLR 290).
There used to be provision for retirement to be a permitted fairreason for dismissal under the ERA, however this was removedas of April 6, 2011 and is only relevant if the person has alreadybeen dismissed for retirement under the old law.
Procedural FairnessOnce the employer has shown dismissal was for a permittedreason, the tribunal then must consider whether in thecircumstances (including the administrative resources and size ofthe employer), the employer acted reasonably or unreasonably intreating that reason as sufficient to dismiss the employee (s.98(4)ERA).
Any relevant Code (eg, the ACAS Code of Practice onDisciplinary and Grievance Procedures) should be considered bythe tribunal. A failure to follow the Code, insofar as it applies,gives tribunals a discretionary power to increase or decrease theunfair dismissal award by up to 25 per cent if they consider theemployer’s/employee’s failure unreasonable.
Remedies availableIf the tribunal finds in favour of the employee, it can order one ofthe following:1. Reinstatement - the employee returns to their job with no lossof money or security2. Engagement - the employee gets another job with the sameemployer3. Compensation - the combination of a basic award (a formulabased on age, length of service and one week’s pay) plus acompensatory award to compensate the employee for thefinancial loss he has suffered as a result of the dismissal.

In this article I highlight an accident involving a slip onwater in a trailer where a major contributing factor was poorlighting. It is not uncommon for drivers to work at night inunlit trailers and poorly lit yards and be injured in accidentsthat would not have happened if proper lighting wasavailable.
As with previous articles, the common trend remains theeffect on the injured person’s life, and although using theprocess of law to make personal injury claims as a means ofredress cannot truly compensate for the trauma andinconvenience suffered, it can assist in requiring the guiltyparty to provide medical treatment and rehabilitation, inaddition to financial relief by way of awards ofcompensation. As previously stressed, under the current lawand procedures the fundamental aim of all accident claimsis to try and return the injured person to the position that heor she would otherwise have been in had the accident nothappened.
CASE STUDY - WORKING IN THE DARK!In late November 2006 Mr D J Trower of Telford, Shropshire,
working as a heavy goods driver, contacted my firm for helpwith a claim following an accident at work earlier that month,which happened at around 3.15am in a yard in Telford operatedby PR Transport Ltd. Mr Trower had just started his shift andwent to the back of the trailer to check the load matched thedetails on his delivery sheet. The floodlight closest to thevehicle was not on so he tried to switch on the light inside thetrailer, but this did not work. As no torch was provided he had torely on light from his mobile phone. After checking the load hewalked towards the rear of the trailer, and was about to lowerthe roller shutter when he slipped on water on the floor that hedid not see in the poor available light. He lost his balance andthe roller shutter came down, striking his hand.
My firm sent a detailed letter to the company setting outallegations of negligence and breaches of regulations, whichincluded the following:-� Failed to maintain our client’s workplace in an efficient state,
in efficient working order and in good repair, contrary toRegulation 5 of the Workplace (Health, Safety and Welfare)Regulations 1992.
� Failed to ensure that the floor of the trailer remained freefrom any substance likely to cause our client to slip, namelythe water, contrary to Regulation 12(3) of the aboveRegulations.
� Failed to ensure that our client’s workplace had suitable and sufficient lighting, contrary to Regulation 8 of the above Regulations.
� Caused or permitted the light within the trailer to be or tobecome, or to remain broken, defective or otherwise outof repair.

� Exposed our client to a danger or a trap or a foreseeablerisk of injury.We also gave an outline of the cuts and injuries to the
thumb and fingers on his hand and noted that because ofswelling the use of his hand was affected for even thesimplest tasks.
Within a few weeks the company’s insurers made contactand agreed to provide Mr Trower with private physiotherapyand ultrasound treatment to assist his recovery at no cost tohim. Shortly afterwards the insurers accepted responsibilityfor the accident.
By this time we had arranged for Mr Trower to beexamined by a medical expert, following which a report wasprovided confirming the extent of the injuries and treatmentrequired. His financial losses were also investigated andfound to be modest, and once we had Mr Trower’sagreement to disclose the details to the insurers we did soand invited them to put forward settlement proposals.
The claim was subsequently settled, with Mr Trowerreceiving compensation for his injuries of £3,250, togetherwith the sum of £25.92 for financial issues. He kept the fullamount as the legal costs incurred by myfirm in handling the claim were negotiatedand paid by the insurers separately.
It took just under 6 months from the time the initial letter was sent to the company toagree the amount of compensation MrTrower would receive.

In this article I highlight an accident at work where my client was injured when pallets fell onto him from the forks of a forklift truck.
As with previous articles, the common trend remains the effect on the injured person’s life, and although using the existing process of law to make personal injury claims as a means of redress cannot truly compensate for the trauma and inconvenience suffered, it can assist in requiring the guilty party to provide medical treatment and rehabilitation, in addition to financial relief by way of awards of compensation.
CASE STUDY - INJURY DUE TO NEGLIGENT OPERATION OF A FORKLIFT TRUCKIn August 2011 we were contacted by Mr M Askham of Sheffield. He told us that while working as a HGV driver he was involved in a work related accident the previous month within the yard of Palletland Ltd in St Helens. He was at the yard to collect a load of pallets and stayed in his cab while a Palletland employee started loading the trailer using a forklift truck. Adopting his usual procedure, once the trailer was three quarters full, Mr Askham got out of his cab to get the webbing and straps ready to secure the load. About 5 minutes later the FLT driver shouted a warning and he instinctively put up his hands to cover his head, but was struck in the back by pallets falling from the FLT. He suffered an injury to his back and side causing significant pain for several weeks and taking around 3 months to heal.
The day after the accident his boss rang Palletland to check that an accident book entry had been made, but was told that because they felt Mr Askham was entirely at fault by getting out of his cab, no entry would be made.
We subsequently wrote to Palletland setting out why they were considered responsible, and included the following allegations:-
(a) Failed to ensure that the task of loading the trailer was properly planned by a competent person, appropriately supervised and carried out in a safe manner, contrary to Regulation 8(1) of the Lifting Operations and Lifting Equipment Regulations 1998.(b) Failed to take any or any suitable or sufficient steps to prevent injury to our client by the fall of the pallets, contrary to Regulations 10(1) and 10(2) of the Work at Height Regulations 2005.(C) Exposed our client to a danger or a trap and a foreseeable risk of injury.
The company passed the letter to their insurers, who also denied responsibility and because we felt Mr Askham had a reasonable chance of succeeding, in due course Court proceedings were issued. During the process of preparing the case for a trial the company’s solicitors put forward an offer to settle the claim for £1,568.10. As the injuries were not severe they were never going to merit a large award of compensation, and this offer represented about 85% of what we thought the claim was worth. In a case such as this, there was always the risk that a Judge would consider Mr Askham to have been partly at fault and when all his options were explained to him, he was concerned that the Court might award him less than the offer. He therefore sensibly agreed to accept this sum to bring an end to the matter. He kept the whole amount, as Palletland’s insurers paid my firm’s costs separately.
Statistics suggest that each year approximately 8,000 FLT accidents occur in the workplace resulting in injury. A major cause is inadequate training, but contributing factors also include unsuitable premises, poor flooring and design of the FLT operating area, and insufficient maintenance.
Employers have an obligation to assess the use of FLTs and to ensure that safe work systems are in place. Failure to do so can result in either an employee or another party required to be on their premises being hurt, and might lead not only to a successful personal injury claim, but perhaps a criminal prosecution.
FLT drivers must be properly trained, and that training carried out by a competent instructor. It should include basic training on the use of the machine, then training specific to the tasks to be undertaken, and finally the driver should complete the tasks under supervision. They should also be re-assessed from time to time.
Areas within a workplace where vehicles are allowed should be as flat as possible and clear of obstructions. Roads, gangways and aisles must be large enough for FLTs to pass safely, and if possible pedestrians should be kept away from areas where FLTs are in operation. When this is not possible, there should be warning notices and FLTs should be fitted with audible and visual warning devices.
Companies who cut corners in their health and safety procedures not only risk putting people in danger, but might also jeopardise their own future.

TRANSAID GETS ROYAL APPROVAL
H er Royal Highness The Princess Royal, patron of road transport and logistics industry
charity Transaid, has commended the organisation for increasing the number and scope of its projects in Africa which has resulted in more people benefi tting than ever before.
In a speech at Transaid’s annual showcase in Canary Wharf on November 28, guests heard how Transaid has grown its reach over the last year from 11 projects to 17, with its teams now working in nine countries: Ethiopia, Ghana, Madagascar, Malawi, Nigeria, Rwanda, Tanzania, Uganda and Zambia.
Addressing the 70-strong audience of transport industry executives, hosted by Barclays Corporate, The Princess Royal said: “There is real value in what Transaid does and the ability to grow the impact of the charity’s work is increasing all the time. Transaid has the expertise to make a real difference to many people’s lives in Africa and the continuing support of the industry is crucial to this cause.”
Transaid chief executive Gary Forster said: “We are a small, but ambitious charity determined to make a signifi cant difference in the developing world.
“We are very grateful to The Princess Royal for her continued patronage, and to all of our
supporters – both individuals and organisations – who are committed to helping us achieve our goal of saving and improving thousands of lives in Africa.”
Forster reported that during 2012/13, Transaid’s revenue is forecasted to exceed £1 million for the fi rst time in the charity’s history – with the increased funding being key to extending its reach yet further.
He added: “Next year marks our
15th anniversary and we plan to continue this development apace. As the charity moves forward we also hope to make our transport and logistics expertise available to other organisations working in Africa, so even more communities can benefi t from the solutions we can implement.”
Transaid is planning a series of fundraising events to mark its milestone anniversary, including a mix of hiking and cycling events to be held in the UK, Europe and Africa. Full details will be announced later this month.

ROADS TO RUIN
A new survey conducted by road safety and breakdown cover company GEM Motoring Assist revealed
just how unhappy Britain’s drivers are with road conditions in the UK.
GEM’s latest poll revealed 87 per cent of UK drivers agree that not enough maintenance work or regular inspections are carried out across the country’s roads. What’s more, a mere one per cent of respondents described current road markings as ‘excellent’, and three per cent as ‘very good’, with the majority describing UK road surfaces as ‘poor’.
Furthermore, a huge 86 per cent have noticed a greater number of potholes appearing in the last 12 months. More than half blamed the fl oods earlier in the year for causing road conditions and markings to deteriorate; yet despite the problems, only 19 per cent of drivers said they would happily see a small increase in Vehicle Excise Duty for pothole repair work.
David Williams MBE, CEO of GEM Motoring Assist, said: “We know the weather at this time of year really has an effect on our roads, particularly as ice and frost are destructive to road surfaces and can also worsen existing damage. Yet it is up to the government to ensure surface and markings maintenance work is regular to help manage these problems and stop them from getting worse.”
When it comes to white line road markings, more than 76 per cent of drivers said they know of lines that need repainting. Yet, more promisingly, 63 per cent said they are aware of white lines that have been repainted in the last six months. This follows the Road Safety Markings Association’s recent survey, which further highlights the urgent need for improved road markings on motorways and dual carriageways.
“There is much damning evidence showing the state of our roads is being neglected by the government,” Williams added. “Not only are motorists unhappy with the current conditions, but road safety is seriously compromised when road markings and surfaces are below standard. It is something the government should be addressing well before the UK’s drivers should have to start complaining.”
GEM’s poll also revealed 53 per cent of motorists who have driven abroad believe road markings and road conditions are better in other European countries than in the UK.

GIST RENAMES DUTCH BRANDS
U K supply chain operator Gist is rebranding its Dutch supply
chain brands Van Dongen, Soonius and Peeman Transport to consolidate its brand as a single entity, in place of the separate brand names it currently promotes.
In a statement, Gist said its decision to move to one brand across Europe is intended to reduce confusion over the many existing sub-brands and to promote its larger, value-adding supply chain expertise.
Gist provides supply chain operations for major retailers as well as managing global
end-to-end supply chains for fresh produce, fl owers and plants. The business specialises in managing time- and temperature-sensitive products.
Martin Gwynn, chief executive, Gist, said: “The move to one Gist brand is an exciting change; it will reinforce to our customers and the industry as a whole the value and expertise we offer throughout the supply chain. Although business in each area will continue as usual, and we anticipate this move will deliver further value for our existing and future customers.”

Andrew Wise appeared before the industry regulator at a hearing in Eastbourne, and was told he would not be able to use either of his vehicles on November 24 and 25.
The licence holder, who is now operating as Wise Skip Hire Ltd, was also told he could not continue to hold an operator’s licence as a sole trader if in practice the operations were being
carried out by a limited company. Mr Wise the person was an entirely
different legal entity from Wise Skip Hire Ltd. In effect, the limited company had been operating without a licence. Mr Denton revoked the sole trader licence with effect from December 31.
The inquiry was called after Wise applied for his vocational driving licence – allowing him to drive HGVs – to be restored. His disqualifi cation, imposed for driving while already disqualifi ed for six months under the ‘totting up’ procedure, had ended on August 9.
At the hearing, Mr Denton considered whether to grant Wise a licence to drive professionally again, and if the conviction should affect his repute as a licence holder.
After hearing evidence from Wise, of Hallett Road, Little Dunmow, he determined his existing operator’s licence would be suspended for two days and his LGV driving licence restored, but issued a warning to him in respect of his conduct.
Mr Denton took into account that Wise had been subject to an extra three-month period without his LGV driving licence after his disqualifi cation expired, while he waited for the conduct hearing.
Turning to an application made for an operator’s licence in the name of the limited company, the regulator granted Wise Skip Hire Ltd a temporary licence to allow the submission of the necessary paperwork for the full licence to his offi ce.

Driver agency ADR Network has found evidence of a serious shortage of younger drivers entering the road transport
industry, based on what the fi rm claims to be the largest report on agency driving ever undertaken.
The survey was based on the views of 1000 drivers drawn from across the operating sites of the business. The research was completed in the summer of 2012, with analysis and report writing launched soon after.
The fi rm said the research was undertaken to provide an understanding of the dynamics within the agency driver market place, from the perception of those who work within it.
As expected, the age profi le of the drivers showed 87 per cent of the workforce were in the 36-60 age group, with only eight per cent of drivers younger than 36. This age profi le is seen as being broadly representative of the sector, which suggests a serious shortage of younger people entering the profession.
However, the fi rm said it does acknowledge older drivers are often attracted to agency work because of the fl exibility it can provide. But this need for fl exibility need not necessarily mean shorter working weeks, as the clear majority of drivers in the survey are keen to work four or more days per week.
When agency drivers were asked if they were in favour of the recent Agency
Worker Regulations, a surprising 70 per cent said they did not see any benefi t in the regulations.
The issue of driver supervision was also explored, with the majority feeling that in their day to day duties, drivers were largely unsupervised, suggesting the professional nature of driving is perhaps underestimated by others.
On the topic of CPC training, at the time of the survey the majority of respondents had not started their training. Typical reasons cited were cost and older drivers planning to retire in the near future.
Commenting on the survey, ADR Network MD Andrew Waldron said: “We wanted to understand more about the world of agency driving from the perspective of the drivers themselves.
“For me, there are two issues here that are probably linked. Firstly, that the role of drivers is perhaps underestimated in terms of just how much responsibility drivers have; and secondly, that we are just not attracting enough young people into the profession. As an industry, there is still much to be done to attract younger people into driving. All the agencies need to unite in this.
“We also need support from the government and Schools when it comes to conveying the benefi ts of driving as a profession,” Waldron added. “It seems crazy that we have a pool of unemployed youngsters, yet a shortage of people coming into the profession.”

It felt like anenormous challenge, and itʼs challenges thatget me going.”

“My favourite kind of shoot is whensomeone tells me something is impossible tofilm. When I hear no, it makes me want tomove mountains,” he said.
“Faith Dickey is the same way. Tell her ʻnoʼand it will fuel her. She humbled and amazedmyself and the entire crew with her courage.This stunt started off as a way to test theprecision of Volvoʼs massive 16-wheeledtrucks, and ended up being just as much atestament to guts and courage,” added Rubin.
The film was recorded on an almostcompleted new stretch of motorway in
Croatia, with no oncoming traffic. The stuntlooks very dramatic but, as youʼd expect,safety was of paramount importance for VolvoTrucks, as well as for stunt co-ordinator PeterPedrero.
“Stunts are not for the reckless. Safetyalways comes first. You have to prepare forthe worst possible scenario at all times andplan for how to deal with it. Preparation downto the tiniest detail, meticulous planning -theyʼre absolutely vital,” Pedrero said.
The aim of the film is to highlight thedriveability and superior handling of Volvoʼslatest truck model – the new Volvo FH. Thestunt was possible to carry out due to theexcellent stability and handling of the newVolvo FH. It was thanks to this stability thatboth trucks could maintain a steady gapthroughout the stunt.
“Itʼs not enough simply to say we are good.We wanted to demonstrate just how muchprogress weʼve made in the area of bothdriveability and handling,” said Ulf Nordqvist,project manager for the new Volvo FH series.

that streamlines the load-handling process to speed up the time it takes to load and unload a vehicle, and improve driver safety.
Volvo said the gains are lower costs for haulage fi rms and a better working environment for drivers. “For a haulage fi rm, it is important to have high productivity, which is all about transporting freight from point A to point B in the safest and most effi cient way possible,” said Christer Pehrson, business manager, long haul at Volvo Trucks.
One area of the transport sector where effi ciency can be improved is loading. To check the weight of the cargo is properly distributed, the driver currently has to climb up into the cab several times during the loading process to check the load indicator in the instrument panel. Other load-related functions, such as raising or lowering the truck, are also currently performed from inside the cab. All this takes a lot of time, can be very tiring and represents a risk of driver

Specialist commercial vehicle insurance company Towergate has announced it has entered into a three-year agreement with RAC to provide
commercial motor and small business products under the RAC brand.
The agreement commenced on November 21, 2012 and covers a range of commercial motor products, from single trucks through to large commercial fl eets. It will also include SME products for all types of small businesses. The products will be available online via RAC or over the telephone.
Towergate said the partnership presents a signifi cant business opportunity for both companies. RAC, which is entering the commercial motor and SME space, already has a customer base of two million private members and fi ve million corporate members.

V auxhall has partnered with commercial vehicle conversion specialist VFS to produce a new Movano Caged Tipper.
The latest conversions are available as a purpose-designed cage for the existing Movano Tipper core conversion, or a custom-built VFS caged tipper based on a Movano chassis cab. A utility cab conversion based on the Movano double cab is also available to provide even greater versatility.
The cage is 2 m high with a galvanised mesh and rear doors that open to 270 degrees. The vehicle includes a full-height sliding door and a rear header bar with marker lamps for optimum visibility. The assembly is painted in dark grey to match the original tipper body structure, while all handles, latches and door retainers are highlighted in ‘traffic’ yellow.
The tail-lift features a folding aluminium platform and the external controls are mounted within a dustproof and waterproof enclosure, while an instrument panel and operation instruction signage are all included.
The cage is available on Vauxhall core conversion tippers, or alternatively a custom-built VFS caged tipper is available on Movano chassis or crew cabs.
“The Movano Caged Tipper is the ideal vehicle for a wide range of trades and public
services, including waste and scrap collection and construction,” said Steve Bryant, brand manager, Vauxhall Commercial Vehicles. “It offers customers the flexibility to easily load and carry different payloads, while the cage provides excellent space and security.”
The cage is available from £1560 (plus VAT) and the tail-lift is available from £2480 (plus VAT). Prices for specific custom builds are available from VFS on request.

Movano caged tipper is a collaboration between Vauxhall and conversion firm VFS
S t rathaven-based Asset Alliance Ltd (AAL) has secured a £1million plus deal involving one of
Scotland’s leading haulage firms, Currie European Transport, and German trailer manufacturer Krone.
The contract will see Asset Alliance supplying 50 new Krone 4 m tri-axle curtainsiders built specially to suit Currie European’s operation and meet with European Code XL regulations.
The deal was put together by John McLaughlin, head of leasing for AAL, after detailed negotiations with Currie European MD, Stephen Turner.
Commenting on the deal,
McLaughlin said: “We had originally considered investing in a supply of refurbished trailers for Currie European, but after talking with Stephen Turner it was clear there were concerns about future Code XL implications.
“So AAL looked at how we could meet the company’s requirements and provide simplistic flexibility to their operation with the replacements.
“We then discussed various supply options, with Currie European finally opting for the Krone product. AAL then arranged a consultative meeting with the company, ourselves and Krone to conclude the order, which has turned out to
have been a well-engineered piece of business for all concerned. As a bonus, Currie European also benefits from strong trade-in values supported by AAL and Krone, which helped to seal the deal.”
Under the terms of the contract, the first trailer was delivered in mid-December 2012.
Stephen Turner, Currie European MD, said: “We are delighted John has continued his support to Currie European by providing the required funding to enable us to place a substantial trailer order with Krone. Asset Alliance Ltd delivered a thoroughly professional service and were involved at each stage of this process, which assisted immensely.”

ALK Technologies has launched an updated European version of CoPilot Truck, a truck-
specific satellite navigation app for HGVs. The new version brings the latest truck-specific, turn-by-turn guidance and routing technology to a driver’s iPhone, iPad or Android device.
“CoPilot Truck provides a powerful, yet affordable sat nav that professional drivers can trust, running on their choice of smartphone or tablet,” said David Quin, head of consumer applications at ALK Technologies. “Our latest version is the ideal in-cab companion to help professional drivers reduce their fuel costs, prevent wasted mileage and avoid trouble caused by taking inappropriate routes.”
Unlike standard in-car navigation apps, CoPilot Truck provides routes based on the size of vehicle being driven and the load being delivered. It automatically takes into account height and weight restrictions, such as low bridges and tunnels, as well as HGV-restricted and prohibited roads.
CoPilot’s maps are stored onboard the phone or tablet, not downloaded each trip, providing turn-by-turn guidance throughout Europe without large mobile data roaming charges. Drivers can choose to download the whole of Europe to their device or add and remove countries needed for specific trips.
The new version of CoPilot Truck features a completely redesigned user interface with clear non-distracting map displays and intuitive context-sensitive menus; new vehicle
set-up wizard making it easy for drivers to input precise dimensions of their vehicle and load, and the ability to save the details as a profile for future use; advanced routing options include drag-and-drop route editing and a choice of alternate routes; the latest updated commercial-grade European street maps and truck restrictions from NAVTEQ; enhanced driver alerts including warnings of truck-specific hazards ahead, such as sharp bends and steep inclines – plus much more.
Existing owners of the CoPilot Truck app will receive the new version for free through an app update. The new version of CoPilot Truck is available for iPhone, iPad and iPad Mini immediately from iTunes from £149.99, including maps of the whole of Western and Eastern Europe.

EUROLINERS GO THE DISTANCE
International haulage operator Denby Transport said it is so confi dent in the engineering quality of Euroliners from Schmitz Cargobull that it is planning
a lifespan of 15 years for its four new fl eet additions.
The Lincoln-based company – which will predominantly use the Euroliners to carry general haulage into France and Belgium – said it favours running its trailers for as long as possible, with the right periodic maintenance and refurbishment programme, as it believes this to be more cost-effective.
“Much like an aircraft, which can remain in service after more than 25 years, there is no reason why a sound, well-engineered trailer shouldn’t last a whole lifetime on a fl eet,” said Peter Denby, managing director of Denby Transport. “It comes down to whether they are mechanically fi t; curtains and fl oors can be replaced when necessary, but a robust chassis is the key to longevity.
“I have every reason to believe that the Schmitz trailers will stand the test of time based on the solid spec and good value for money we gain from our existing equipment.”
The fabric sliding roof of Schmitz Cargobull Euroliners makes them good
fi t for the diverse cargo carried by Denby Transport – such as heavy machinery, which requires loading through the roof. As well as maximised internal load height, the Euroliner’s lightweight design also offers a competitive payload capacity with space for 34 Euro pallets.
As well as the standard four loading points, the new Euroliners have been specifi ed with additional safety-conscious modifi cations including Schmitz Cargobull’s ROTOS running gear – with innovative braking technology and a roll stability program designed to help prevent vehicle roll-overs – and added braking sensors.
“Not many other operators can say they are 100 per cent international. Because of our geographical reach, we need to run robust European spec trailers which are backed up by immediate spare parts availability wherever needed. This is where Schmitz excels,” added Denby.
The four new trailers join an existing fl eet of 125 specialist trailers and 50 Euro 5 tractor units.

Renault Trucks has announced it is to adopt an organisation with two heads. Bruno Blin has just been appointed senior vice president
for Renault Trucks commercial and senior vice president of the Volvo Group’s truck sales area in South West Europe. He will take up his functions on January 1, 2013.
The appointment follows the departure of Renault Trucks president Heinz-Jürgen Löw in November.
Peter Karlsten, executive vice president Volvo Group Trucks and head of the trucks distribution in Europe, Middle East and Africa, said: “The current restructuring within Renault Trucks needs to be seen in a wider context, where the whole Volvo Group is being restructured, including all its truck brands, so each brand can develop to its full potential.
“In June, Renault Trucks’ entire renewed product range will be launched, which will strengthen its market position. When all organisational changes and product renewals are in place, Renault Trucks will be stronger and more competitive than ever before.”

Gloucester-based Ermin Plant Hire has added a new Mercedes-Benz Axor 6x2 to its fl eet, mounted with an
Andover Trailers plant body with double-cranked beavertail and fuel-saving fold-forward ramps.
The striking ‘golden yellow’ rear-steer rigid with front and rear air suspension replaces a 1996 M-registration truck, which also featured an Andover Trailers plant body, and will operate across the company’s six depots.
It joins a 28-strong commercial vehicle fl eet used to guarantee the fast and effi cient delivery of more than 3000 items of plant and tools to customers across an area spanning Gloucestershire, Oxfordshire, Shropshire, Somerset, Warwickshire, Wiltshire, Worcestershire and South Wales.
The Axor is being used to deliver the largest items of plant, which range from eight-tonne excavators to telehandlers, forklifts, boom lifts, cherry pickers and dump trucks.
Neil Jones, operations director of Ermin Plant Hire, said: “Our delivery fl eet operates across six busy depots, meaning maximum reliability and uptime is critical. We treat our trucks the same as we do our plant, picking suppliers very carefully.
“Our previous Andover Trailers plant bodies have performed well and lived up to the demands of making multiple deliveries each day. The design team built the body to our precise specifi cations, so it’s a perfect match for our requirements.”
The 9.3 m body features a hardwood fl oor with 1 m wide x 2.5 m long hydraulic fold-forward ramps, which can be lowered fl at onto the deck to minimise aerodynamic drag on the road. Hydraulic steady legs ensure a stable platform when loading and unloading plant, while a remote and radio-control Ramsey BH550 hydraulic winch is mounted on the front bulkhead to assist with loading.

A 44-tonne DAF XF105 tag-axle tractor is the choice of sports surface specialist J Mallinson
(Ormskirk) Ltd to move its plant and equipment to race tracks and sports stadia around the country.
Managing director John Mallinson took advice from driver Michelle Cubbin when it came to choosing the right truck for the job. Site access is sometimes an issue, and the added manoeuvrability provided by the lifting rear axle was a factor in the decision. And with Michelle spending nights away on more distant jobs, the comfort of the Space cab on the big DAF was also a key consideration.
“On top of that, it looks smart and does the job extremely well,” she said. “I like the fact that I have
510 horsepower at my fingertips, as this helps me overcome wind resistance when carrying large pieces of plant – which are not very aerodynamic – and to maintain good average speeds on longer trips.”
Recently the truck was used to carry equipment for a major pitch reconstruction contract at Twickenham rugby stadium, and Michelle was able to make full use of the large Space cab. “I found the bunk extremely comfortable,” she said. “And the fold-away gear lever is a real boon, as it allows you to move out of the driving seat and across the cab quite easily.”
The Euro 5-compliant DAF means Mallinson can take it anywhere within the M25, as it complies with the requirements of London’s Low Emissions Zone.
“We work at several sites inside the LEZ, including QPR and Watford football grounds, and with this truck we don’t have to worry about meeting the emission standards,” John Mallinson said.
The DAF runs at up to 44 tonnes with a King tri-axle step-frame plant trailer. With 510 bhp (375 kW) from its 12.9-litre MX engine, the truck has a power-to-weight ratio of 11.6 bhp per tonne. A 16-speed manual gearbox is also fitted.
DAF dealer North West Trucks of Huyton, Liverpool supplied the DAF and will carry out routine servicing and any warranty work under the three-year full manufacturer’s warranty.

FTA is go For gAs
T he Freight Transport Association (FTA) has called upon the government to provide
the necessary assurance to freight operators to embrace gas as a viable alternative to conventional diesel in its new Gas Manifesto.
FTA said there is a wide range of decarbonisation measures to make moving goods by road more carbon efficient. However, to reduce reliance on conventional fossil fuels such as diesel, the UK must look to alternative fuels that offer further carbon savings – including natural gas and, ultimately, biomethane.
FTA’s Gas Manifesto provides a vision for how this could be brought to fruition. Natural gas can be used as a road fuel either as a liquefied natural gas (LNG) or a compressed natural gas (CNG), producing less harmful emissions than conventional fuel. However, when biomethane produced from waste is used, carbon savings in excess of 60 per cent can be made when compared to an equivalent diesel vehicle.
The manifesto supports the
development of a national refuelling infrastructure on the main motorway networks. For smaller operators, public refuelling stations would give confidence to invest in gas-powered HGVs as part of planned vehicle replacement cycles, as well as benefit larger companies. The Treasury also urgently needs to confirm at least a seven-year rolling guarantee for road fuel gas duty rates to provide certainty to support vehicle and infrastructure investment.
Rachael Dillon, FTA climate change policy manager, said: “Gas is a credible option for industry to make serious reductions in carbon emissions while serving the needs of the economy in delivering goods and services. However, to significantly increase gas-powered HGVs on UK roads, government needs to support the development of a national refuelling infrastructure on main motorway routes to enable long-
distance trunking for vehicle fleets. Government needs to give greater consideration to the requirements of the operator, and ultimate purchaser, of low carbon vehicles to shape policy that benefits, rather than hinders investment.”
John Lewis Partnership is a member of FTA’s Logistics Carbon Reduction Scheme (LCRS), and said it believes biomethane represents a low-carbon alternative to diesel. Justin Laney, general manager - central transport, John Lewis Partnership, commented: “John Lewis Partnership has a very ambitious target to reduce carbon emissions from its truck fleet. We believe the best fuel to achieve that is biomethane gas. Biomethane is not only excellent for reducing emissions, it is also good for investment, jobs, and balance of payments. If the fuel duty differential between gas and diesel was fixed for a longer period, and Green Gas Certificates were allowed in transport carbon reporting, then two of the main barriers to adoption would be removed.”

Scottish building and civil engineering contractor Dunne Group has chosen a New Actros from Mercedes-
Benz to spearhead an expansion into the South of England.
The company bought its New Actros 2545 tractor unit to service a newly opened depot in London, and it is now trunking daily from the Central Belt of Scotland.
Dunne Group is based in Bathgate and has depots in Manchester and Leeds, as well as its new London site. The company operates divisions specialising in building, civil engineering, concrete flooring, pre-cast concrete and plant hire.
Supplied by Edinburgh dealer Western Commercial, the vehicle has an aerodynamic StreamSpace cab and is powered by a 450 bhp straight-six engine, driving through the latest Mercedes PowerShift 3 automated transmission.
Dunne Group runs a fleet of 35 trucks in which 8x4 tippers feature heavily, and bought the New Actros and a pair of new Montracon 45 ft flatbed trailers solely to supply its London outpost.
Operations director John McCormack said: “We’ve won several large contracts in and around London recently, and
decided to open a depot from which to service them.
“We already run some Actros so we know they are efficient and reliable, while the new model is also a strikingly good-looking vehicle. It’s making an average of 10 trips up and down the M6 and M1 each week, which means it’s highly visible and is certainly fulfilling our requirement for a smart flagship truck to raise the profile of our business.
“The New Actros has hit the ground running with some very promising early fuel returns,” McCormack continued. “We won’t take any precise readings until it’s had time to bed in, but the indications are certainly positive.
“Meanwhile, the cab is extremely well-appointed and comfortable, and the PowerShift 3 gearbox and superb new chassis make it a pleasure to drive.”
Dunne Group is also signing up to a Mercedes-Benz Repair and Maintenance Contract, under which Western Commercial will maintain the new truck and an Actros concrete pumping vehicle.
“We’re very happy with the service we receive from Western,” McCormack concluded. “They’re efficient, professional and always there when we need them.”

F or almost a decade, scores of European truck drivers have been coming to Canada to
ply their trade. Many of them have succeeded in creating a new life for themselves and their families and some have not. The purpose of this article is to offer some advice, based on the experiences of corporate immigration and recruiting specialist VRV Global, for truck drivers who are thinking about crossing the pond to drive in Canada.
VRV Global has been assisting a Canadian transport company, H&R Transport, in recruiting European truck drivers since 2005. Together with our colleagues at H&R Transport, we constantly analyze the experience that the European drivers have in their adjustment to life in Canada and we revise our hiring and settlement processes to ensure the greatest likelihood of success. We respect the fact that the drivers who apply for this job and this life are making a huge personal, life-changing decision and our goal is to help each individual, and their family, make the right choice.
Here’s what we’ve learned:1. Moving to Canada is a family decision and the entire family should be involved in the process. Make
sure that this is discussed with spouses, exes, children, parents and siblings. Will they accompany you or come along later? Will parents and siblings visit you in Canada? In our experience, most of the people who return to Europe, do so for family reasons.
2. How will your past affect your ability to work as a truck driver and live in Canada? Canadian employers will usually only hire drivers who have clean driver abstracts. Also, Canadian immigration rules prohibit the admission of people who have criminal records or serious medical problems. This applies to
family members as well. Medical problems and criminal records are intensely private and you may not want to share this information with an employer. However, immigration officials will find out and it is better to disclose issues to immigration officials to see if they can be overcome. Many Canadian transport companies require their drivers to cross the Canada - US border frequently. Compliance with immigration legislation in both Canada and the US is critical.
Also, some Canadian provinces allow long-haul drivers to apply for permanent residence. To be eligible, applicants must take a language
test, have a minimum of a high school diploma and three years of driving experience before coming to Canada.
3. Be prepared for life in Canada. Moving to Canada can be a costly venture. While it is true that Canadian employers of workers in low skilled jobs are required to provide new hires with a return ticket to Canada, and new drivers will have a permit to work in Canada, it may take some time before money starts to come in. It may take several weeks to obtain a drivers license and it may take some time before the first pay package arrives in your bank account. We recommend drivers have at least $5000 (£3000) to bring to Canada. People with families may want to bring even more money with them.
There is also not much point in bringing appliances and furniture to Canada. It is expensive to bring personal goods to Canada, so be very selective in what you bring.
4. What is the long term plan?
Most drivers come to Canada with a work permit valid for two years. These work permits can be extended, but only to a maximum of four years. In some provinces, spouses can also obtain open work permits. After four years, most temporary foreign workers are required to return to their country of origin for four years before being eligible to return to Canada. Four years may be long enough for some drivers. Others may want to settle down in Canada. Fortunately, there are provincial immigration programs that allow for this but it is important to learn about the programs and apply for PR long before the four year deadline as it can take as long as two years to complete the process.
The Canadian transport industry employes 260,000 drivers. Our economy is growing and our population is aging. This means that there is growing requirement for European drivers. The chance to come to Canada to work is a fantastic opportunity for the right person.

Q) A few weeks ago, we sacked a driver on the spot for stealing. We were shocked and surprised when a few weeks later we were called to an Employment Tribunal as a result of the driver claiming unfair dismissal. Things went from bad to worse when we rang our legal protection insurance company about making a claim only to be told that they wouldn’t deal with the claim as we hadn’t sought advice before dismissing the employee. Is it normal for legal expenses insurers to require customers to take advice from their helpline before dismissing a member of staff?
A) Most legal protection policies require policyholders to take advice before taking action against an employee. This is because employment law is such a legal minefi eld that unless a fi rm has in-house expertise, knowing exactly what to do in a particular set of circumstances can be very diffi cult. So taking advice before taking action against an employee is essential if the benefi ts of having legal protection cover are to be realised.
Q) I’m an owner-driver with just the one truck. My whole livelihood depends on that one truck being on the road. That means it’s essential that if my truck’s damaged, I get it back on the road as soon as possible. So when my truck was damaged a few weeks ago, it was deeply frustrating that it took several weeks to get it back on the road. When I talked to my broker about this, he just said that’s fairly normal and there’s little we can do about it. What do you suggest we do?
A) Our advice is to fi nd a broker that’s willing and able to provide
you with the service that you need. That means a broker that can place your cover with an insurer that will guarantee that if a truck hasn’t been inspected within, say, two working days, repair work can go ahead providing the garage takes photographs of the damage and retains the damaged parts for inspection.
Q) I’m an owner-driver. I’m also an RHA member and use the RHA Conditions of Carriage. One of my customers says the £1,300 per tonne limit under RHA Condition is insuffi cient and wants me to up this fi gure to £5,000. I always thought the RHA Conditions are set in stone and cannot be altered in any way. Is that correct?
A) The only thing that that can be altered under the RHA Condition is in fact the per tonne limit of liability. This can be increased, or it can be replaced with an overall load limit. Assuming you go ahead with what your customer has requested, make sure you talk to your broker fi rst and get your transit insurance cover suitably amended.
Q) A lot of my work involves making ‘just-in-time’ deliveries for a manufacturer. I recently had a scare when the delivery I was making to that customer was severely delayed due to the motorway I was travelling on being closed due to an accident. I was fortunate on this occasion that my arriving late didn’t hold up the production line; had it done so, the production manager told me that I would have been help responsible. How do I best protect myself against this risk?
A) Our advice is to make sure that you agree trading conditions with all your customers that make it clear, inter alia, what the extent of your liability is in the event of there being a consequential loss resulting from a late or missed delivery. RHA Conditions state that unless a ‘special interest’ in delivery has been notifi ed and terms agreed, a member’s liability in the event of consequential loss shall not exceed the carriage charges, regardless of the circumstances giving rise to such a loss.
Q) A majority of our work involves moving customers’ trailers containing their goods. We own the tractor units, our customer owns the trailers. Who’s responsible for insuring the trailers?
A) Liability for loss or damage to trailers under arrangements such as you describe requires careful investigation. Make sure you agree with your customer the point at which liability for trailers attaches, the point at which liability ceases, and your maximum liability for their trailers. Then ask your broker to arrange appropriate cover.
Q) Hi, as a driver working direct with different hauliers could you tell me what type of public
liability insurance I require to be a self-employed HGV driver? Thanks.
A) Public Liability cover is designed to protect your business against legal liability for damages in respect of injury, loss of, or damage to, property, and nuisance or trespass arising from business activities.
To avoid an overlap between third-party motor cover and public liability insurance, the former typically restricts cover to the use of motor vehicles and the latter typically excludes legal liability arising from motor vehicles other than plant such as forklift trucks used on own premises in areas where the Road Traffi c Act does not apply.
Exclusions should be looked at closely to make sure there is no exclusion of essential cover. Particular consideration needs to be given to whether extensions are required for cover that is likely to be excluded from standard public liability policies such as contractual liability and fi nancial loss.
Cover will be provided up to an agreed indemnity limit. What constitutes an adequate indemnity limit depends on the nature of your business. The

needs of an owner-operator may differ signifi cantly from those of an international logistics operation. The issue is made more complex by the fact that the limit of indemnity needs to be suffi cient to cater for a claim that may not be settled until many years after the event that gave rise to the claim. An indemnity limit of at least £5m should be considered even by an owner-driver.
