As a driver, quitting a company has certain obli-gations that are governed by either provincial or fed-eral laws. They are usually there for the protection of both parties and can be accompanied by fines or penalties by labor boards if parties don’t comply. How-ever, Lease/Owner Opera-tors terminations are under custom contracts that can vary in both time and pen-alties. Conflicts would ulti-mately be decided by civil litigation, if it gets that far.

As an accountant I have reviewed hundreds of trucking company con-tracts. Sixty to seventy percent of them are very similar. I have even had oc-casion to predict which law firms wrote them, based on the sentence structures on the first page. Some contracts are organized logically while others are revised and added to nu-merous times as custom events spark specific new

terms. Sometimes amend-ments are made to amend-ments in bold font and ex-pression, clearly revealing a completely new writer. One could easily piece to-gether the story that would have motivated the owner to personally write it in.

The obligations provid-ing termination of any con-tract are usually specific for both parties. A 30 day no-tice is standard but not uni-versal. Some notices must include a clause requiring it be “written” or even sent by registered mail. Some (al-be-it few) even have specific penalties such as $2,500 if not in written reg-istered mail format.

When someone has read hundreds of contracts, it becomes much easier to classify and categorize the authors and revealing the mindset of the manage-ment team or owner.

When there is a ten-dency to have clear and/or numerous “penalties”

in the contract, the reader (operator) begins to emo-tionally distance themself from the writer (owner). The reader asks why so many fines? Why so many penalties, when the compe-tition doesn’t have any?

It’s understandable that companies wish to cover their potential losses… but at what cost to their reputa-tion?

The issue is really a fi-nancial time/risk tug-of-war. It’s a battle of trust: the driver doesn’t want to starve to death because of the last 30 days and the company’s freight power needs sometimes can’t af-ford the unpredictable drop in power. Both feel vulner-able and both wish to cov-er their back.

Leaving a company for another is often awk-

ward… like meeting an old girlfriend in front of the wife… or maybe more like a current girlfriend in front of the wife. There is too many trust variables to accurately predict the out-come.

The trucking compa-ny that considers itself a leader in the industry will extend trust first. Trust breeds trust. There is a long list of companies that have superb exit plans for their operators. In my personal experience some-where between 50-60% of companies operate with honor in termination, but of course that leaves about 40-50% who sow seeds of doubt and pain.

If you read a contract that has too many penal-ties and fines for leaving,

maybe reconsider the qual-ity of management or own-ers at that company. Actual “fines” and “penalties” for leaving without WRITTEN notice (in my opinion) is NOT industry standard. I personally estimate the list-ing of a penalty like this to be less than 20%.

If the company doesn’t display trust, it may not be trust worthy.

But, I have also seen my share of operators who are not trustworthy. They lie, cut corners, constantly blame someone or some-

thing else and too often wonder why nobody trusts them. With several decades of experience behind me I can confidently say, rarely do they ever get ahead fi-nancially. Rarely do they stay at a good company, and rarely do they make good employer choices. It may appear that they get away with specific EVENTS but never (that I’ve witnessed) get ahead in life and/or wealth long term.

Many months ago I was interviewing a poten-tial new employee who was excited to possibly be

a part of our firm. After a lengthy interview, in what they thought was a benefit statement, the person indi-cated they would be able to make themselves available immediately. They didn’t feel obligated to give a two week notice considering

how their boss was cur-rently treating them. Need-less to say they were not hired.

An honest trustwor-thy person (or company, through its owner) is the only type of person who will be able to consistently

attract personal and finan-cial wealth. b

LeddarTech, owner of the patented Leddar LED-based detection technology, is pleased to announce that it has signed a cooperation, de-velopment and licensing agreement with Valeo, one of the world’s lead-ing automotive suppli-ers.

This cooperation be-tween LeddarTech and Valeo will enable Valeo to develop a new infrared sensor for series-produced vehicles and cross a new threshold in its effective deployment of road obsta-cle detection and tracking functions. As factory staff prepared the newest engineering development from Titan Trailers, Founder and Pres-ident Mike Kloepfer set his mind back to the origins of his firm.

“We started out with the newest ideas in grain trailers for local farm truck-ers. 40 years later, after everything Titan has built, here we are rolling out a completely unique con-cept in grain trailer design. Again.”

The latest innovation from the fertile minds of Ti-tan engineering is a hopper trailer that sheds more than

2000 lbs. from the weight of previous trailers, offer-ing operators the potential to earn dramatic increases in their profit-per-load. Unibody: The Right Idea

Kloepfer took on the effort to rethink hopper design early in 2012. Still closely connected to farm communities, he under-stood that lower weight was still their ultimate goal when purchasing a new grain trailer. “We didn’t set out to create a unibody trailer,” says Kloepfer. “We were out to see how much weight we could take out of a grain trailer without

compromising strength and performance. When we combined the modular hopper structure with our Thinwall aluminum body, we realized we had a uni-body design. Unibody was the solution, not the objec-tive.” At home in farming country

Kloepfer himself grew up in the small town of Harley, Ontario, located in the rich stretch of On-tario farm country that’s bisected by the Highway 401 corridor from Que-bec to Michigan. assembly and landing gear. By eliminating crossmem-bers from the design, Titan was able to set the hoppers lower in the body and re-duce the overall height of the trailers. With both the 4-axle and 5-axle units that were at the Titan dis-play in the recent Outdoor Farm Show in Woodstock, Ontario, the sidewalls are now 6 inches lower than previous models. The uni-body feature provides bet-ter visibility into the trailer while being top loaded. As well, the trailers actually sit lower than the roof of the trucks, so there’s less wind drag and as a result, less fuel is consumed on the highway. Details for strength and productivity

In true uni-body fashion, the outer skin welded to the internal hopper structure achieves uniform strength and re-silience throughout the trailer, while discarding the weight of the traditional chassis. sign allows Titan to pre-build its hopper sections and simplify final assembly with the Thinwall body. Its centre section is a key point of the trailer’s strength. It acts as a 3 ft. high support beam that eliminates the need for heavy crossmem-bers.

Daimler Trucks North America (DTNA) announces a new cus-tomer loyalty program for owner-operators and small fleets. Known as Truck Bucks, this loyalty program will be aimed at rewarding customers with parts and service specials at Freightliner, Western Star, Detroit and Thom-as Built Buses service locations.

Customers enrolled in Truck Bucks will receive discounts and special prod-uct incentives. Specials will include discounts on select parts and services designed to introduce customers to the full breadth of DTNA’s aftermarket offerings. This program is designed to be customer-friendly with dis-counts applied at check-out without the need for cou-pons or further action by the customer.

“Truck Bucks is a great opportunity for us to re-ward our customers for their loyalty to the DTNA
