5 Approach Channel E/ESE direction of 12,000 m long, with a depth of -16.0 m CD and 160 m wide
The channel is aligned to 280° - 100° from turning circle for a length of 700 m, 244° - 64° N for about 2km from the shore and subsequently it is proposed to be joined by suitable curve having a diameter of “a 10thlargest vessel as per the norms”, to the part of channel aligned perpendicular to the bed contours in the bearing of 300° - 120° N. The width of the channel will be 180 m.

5. (3overnment, after careful consideration of the matter, issue the following orders:
· (a) Revenue Department is authorized to provide land to an extent of Ac.5324 to the Director of Ports, Kakinada to be jointly identified by the Director of Ports and the District Collector, Krishna District;
(b) Chief Commissioner of Land Administration, A.P., Hyderabad is authorized to hand over advance possession of the Govt land to an extent of Ac.1623 to the Director of Ports, Kakinada, out of the total extent of Ac 5324; and

Concessionaire shall, in respect of the above Port Assets, have no liability regarding any compensation payment on account of land acquisition or rehabilitation andlor resettlement of any Persons afiected thereby.
b. The Concessionaire shall, subject to complying with the tenns and conditions of ihis Agreement, remain in peaceful possession and enjoyment of the land mentioned in Clause 3.1 above during the Concession Period.
3.10 External Infrastructure
a. G3P.P shall provide external infrastructure viz. road connecting the nearest National Highway to the Port boundary, water supply upto. Port boundary and power supply from nearest substation upto Port boundaly as per the State Support Agreement.
b GoAP shall make "Best Efforts" for providing external rail connectivity between nearest national rail network and Port boundary.
3.1 I Approvals
a. GoAP shall provide "No Objection Certificate", i e consent for establishment of ~~~

5. GoAP shall extend all possible assistance to secure all statutory and other approvals from various state government entities and departments as may be required from time to time. GoAP would provide administrative support for time bound state clearances

d. Nothing contained in this Clause shall relieve the Concessionaire of its obligations under this Agreement to obtain the clearances and lo keep them in force and effect throughout the Concession Period.
e. Concessionaire shall be responsible for the compliance with all necessary legal requirements under the Applicable Laws.
f. The Concessionaire shall bear the costs of obtaining ail the approvals.
3.12 Fiscal Incentives
a. GoAP hereby undertakes to forego revenue streams from the Project, in the following forms, as per the APIDEA andlor other Applicable Laws: i. Exemption from sales tax on all inputs required for project construction; ii. Exemption from stamp duty and registration fees on Project Agreements 1
Financing Agreements, Land Lease Agreement registered in the State; iii. Exemption from payment of segniorage fees i.e, cess on minor minerals during
construction period. b. In cases found appropriate, GoAP may, at the request of the Concessionaire, issue
recommendatory or supporting lelters to any Government Authority recommending any permissible tax or duty Concessions or benefits to the Concessionaire andlor the Port Project.
3.13 Exclusive Right GoAP hereby agrees that no party other than the Concessionaire shall have the right :o develop a new port, within 30 km on either side of the original Port Limits of the Machilipatnarn Port, during the Concession Period under this Agreement.
