INTRODUCTION This study shall be deemed as a continuation of the research conducted as part of the study “Transparency in the Parliament’s Decision Making: Legal Provisions, Applicability and Application”1, produced by the ADEPT association and launched on 19 September 2013. This study is focused on the same object of research – the practices applied by the Parliament of the Republic of Moldova in the process of cooperation with civil society. The methodology, however, has undergone some modifications, including ones that resulted from discussions at the abovementioned round table. The goal of this study consists in assessing the current level of transparency in the Parliament’s decision making, with the following objectives:

Analysis and assessment of developments in the legal and institutional framework aimed at insuring transparency in the Parliament’s decision making (PRECONDITIONS);

Analysis and assessment of developments in the process of implementation of legal provisions concerning the transparency of works, as well as transparency of activities in the Parliament’s working bodies (APPLICATION);

Analysis and assessment of capitalization on the mechanisms of cooperation with civil society, including the Parliament following the public’s contributions (FINALITY);

Formulation of conclusions regarding the current level of transparency in the Parliament’s decision making;

Development of recommendations aimed at improving the situation. Essentially, the study pursues the analysis and assessment of the following indicators and sub-indicators:

This study is focused on assessing the situation during the Parliament’s session of autumn 2013, namely: the period between 26 September 2013 (first plenary meeting) and 24 December 2013 (last plenary meeting) (hereinafter – assessed period). The study has been conducted by using the following research methods:

Analysis of the relevant legal framework, including through the prism of vulnerability of legal norms;

Monitoring the observance of transparency requirements in the legislative course of draft legislative acts (submission, registration, examination, adoption);

Synthesis (generalization) of the collected data, as well as their comparison with the data collected for the periods assessed previously in the study “Transparency in the Parliament’s Decision Making: Legal Provisions, Applicability and Application”;

Exemplification of deficiencies (failed procedure and transparency) by means of case studies (the drafts of legislative acts that were registered, examined and adopted in violation of procedure and transparency requirements).

Research is still mostly qualitative, focusing on the overview of the situation. The main source in collection of information has been the official website of the Parliament (www.parlament.md), as of 10 January 2014.

1. Developments in the legal and institutional framework For the assessed period, no progress has been found in terms of the legal and institutional framework intended to ensure transparency in the Parliament’s decision making. The legal framework contains the same basic regulatory acts that were earlier subjected to a detailed analysis 2, namely:

Law no. 239 of 13.11.2008 on Transparency in Decision Making (hereinafter – Law no. 239/2008);

Parliament Regulations, adopted by Law no. 797 of 02.04.1996 (hereinafter – Parliament Regulations);

Concept of Cooperation between the Parliament and Civil Society, approved by Parliament Decision no. 373 of 29.12.2005 (hereinafter – the Concept);

The Parliament’s Permanent Bureau Decision no. 2 of 16.02.2006 on the Execution of Parliament Decision no. 373 of 29.12.2005;

Instruction on the Circulation of Draft Legislation in Parliament, approved by the Parliament’s Permanent Bureau Decision no. 30 of 07.11.2012 (hereinafter – Instruction);

Regulations on the Organization and Operation of the Secretariat of Parliament of the Republic of Moldova, approved by the Parliament’s Permanent Bureau Decision no. 31 of 12.12.2012

Thus, essentially, the previously identified deficiencies of the legal framework are still present3, namely:

Dispersed nature of legal norms;

Legal gaps;

Inappropriate responsibility and sanctions;

Lack/insufficiency of control mechanisms;

Ambiguous phrasing;

Excessive discretions;

Undetermined norms (blank norms uncovered by subordinate regulations). In the context of legislative developments, we should mention the draft law on the modification and supplementation of Law no. 239 of 13 November 2008 on Transparency in Decision Making 4, produced by the Ministry of Justice for execution of the Action Plan on the Implementation of the Strategy for Civil Society Development for the period of 2012-2015, approved by Law no. 205 of 28.09.2012 (action 1.3.1.2.).5 However, while we appreciate the Ministry’s efforts, we shall maintain the recommendations concerning transparency in decision making that we formulated earlier6. Also, it is evident that the produced draft cannot meet all the needs in ensuring transparency in the Parliament’s decision making, as interventions in the legislation concerning the Parliament’s work, such as Parliament Regulations, are still necessary.

Regarding the institutional framework, which had previously been thoroughly analyzed7, no developments have been found. Thus, legal provisions maintain the same duties in ensuring transparency in the Parliament’s decision making for:

The President of Parliament;

Parliamentary groups;

The Permanent Bureau of the Parliament;

Standing committees informed of the matter;

The Parliament Secretariat. No progress has been found under the aspect of bodies/instruments specially provided for the purpose of increasing transparency in the Parliament’s decision making, either. Thus, in virtue of item 3.5 letter a) of the Concept, the Parliament’s standing committees, according to the conditions provided by Parliament Regulations, were to create under them permanent councils of experts from the representatives of civil society organizations, in line with the main directions of the committees’ activity. Similarly to the previously assessed periods8, we have found no information in this regard on the Parliament’s website.

2. Transparency in Parliament’s activity

2.1. Plenary meetings

According to the information placed on the Parliament’s website9, 27 plenary meetings were held during the assessed period, including:

The agendas of all meetings are placed on the Parliament’s website. In the part concerning transcripts, the Parliament’s website contains the transcripts of 8 (30%) of the 27 plenary meetings.10

Thus, in this respect, compared with previously assessed periods11, we have found a regress: for the session of autumn 2012 all transcripts of plenary meetings are available online, while for the period of 01.01.2013–30.06.2013 the transcripts of 29 (91%) of the 32 plenary meetings are available. Similarly to the session of autumn 2012 and to the period of 01.01.2013–30.06.2013, the Parliament’s website has no video or audio records of the plenary meetings that took place during the assessed period.

2.2. Legislative and voting procedure

For the assessed period, the Parliament’s website contains 154 registered drafts, of which 3 (2%) have been withdrawn, 3 (2%) have been rejected, 82 (53%) have been adopted, and 66 (43%) are still pending examination (Annex 1 to this study).

Presuming that all drafts are registered in compliance with the Instruction (Section 2, Chapter II), we have found unavailability of 2 drafts (nos. 537 and 535) on Parliament’s website, which makes 1% of the 156 drafts that should be on the website. To compare12, for the period of 01.01.2013–30.06.2013 we found 5 drafts missing, which is 2% of the 289 drafts that should have been on the Parliament’s website. Thus, we note some progress in terms of online placement of drafts. Of the 82 adopted drafts (Annex no. 2 to this study), 55 (67%) have been initiated by Members of Parliament (one MP or a group of MPs), 24 (29%) – by the Government, 3 (4%) – by the President of Moldova.

Of the 82 adopted drafts, 48 (41%) are draft laws and 34 (59%) are draft Parliament decisions.

Considering that a web file is produced for each draft act on the basis of a resolution of the President of Parliament, we have found that all additional documents announced online were available for 4 (5%) draft acts out of the 82 adopted, all of them being draft Parliament decisions, specifically:

For comparison13, in the period of 27.09.2012–31.12.2012, all additional documents announced online were available for 5 (5%) drafts out of the 102 adopted, and in the period of 01.01.2013–30.06.2013 – for 11 (9%) drafts out of the 119 adopted. Thus, we find an involution of this aspect during the assessed period. During the assessed period, for the other 78 adopted drafts, considering their specificity (regulatory/non-regulatory nature), we have found the unavailability of the following documents:

Conclusions of committees (one or several committees) – for 61 drafts;

Report of the NAC – for 32 drafts;

Government conclusion – for 30 drafts;

Final version of the draft – for 27 drafts;

Conclusion of the GLD – for 13 drafts;

Draft text in the Russian language – for 12 drafts;

Report (co-report) of the SCIM – for 11 drafts;

Explanatory note – for 8 drafts.

For comparison14, both for the period of 27.09.2012–31.12.2012 and for the period of 01.01.2013–30.06.2013 most of the unavailable documents were the conclusions of standing parliamentary committees. Overall, the absence of the conclusions of standing committees and of other additional documents could also be determined by the celerity with which the Parliament examines drafts, which is not always justified. Thus, not only the public, but also the standing committees, the National Anticorruption Center, the Government, and the Parliament Secretariat (GLD) fail to comment on drafts. Moreover, in such conditions even the standing committees informed of the matter cannot be efficient. The haste with which drafts are discussed could cause the unavailability of syntheses of amendments, proposals and objections, which, according to item 3.1.11 of the Instruction, must be produced by the standing committee consultant responsible for the draft legislative act and for the report, together with the reporting MP, and must include the results of examination of the objections and proposals coming from parliamentary groups, standing committees, MPs, the GLD, the Government and other inquired authorities, as well as those obtained during public consultations. For the assessed period, we have found syntheses of amendments, proposals and objections in additional materials to 11 out of the 48 draft laws, namely:

In this sense, however, there has been some progress, as during the period of 27.09.2012–31.12.2012 syntheses were available for only 5 drafts out of 6615, and during the period of 01.01.2013–30.06.2013 the number was 6 out of 64 drafts16. In terms of the draft legislative acts proposed by the Government and the President of the Republic of Moldova, some progress has been found in the availability of syntheses of proposals and objections to

drafts and of conclusions issued by relevant ministries. For the assessed period, findings are as follows: syntheses to 8 drafts (nos. 487, 484, 474, 469, 425, 424, 412, 391), conclusions of relevant ministries to 18 drafts (nos. 523, 519, 517, 491, 490, 489, 488, 484, 475, 474, 473, 469, 437, 413, 412, 411, 408, 407) out of total 27 drafts proposed by the Government and President of Moldova. During the previously assessed period, 01.01.2013–30.06.2013, syntheses were available for 3 drafts, and conclusions – for 11 drafts out of the 28 drafts proposed by the Government and President of Moldova.17 A remaining problem is the insufficient transparency in the appointment procedures. During the assessed period, we have found 3 draft Parliament decisions on appointment/designation, specifically:

According to item 2.1.7 of the Instruction, draft decisions on individual matters and other decisions that do not contain rules of law shall be mandatorily submitted to the Parliament together with the following acts:

Address of submission of the legislative initiative by initiator;

Act of approval of draft decision, as appropriate; draft decision;

Explanatory note to the draft decision, written according to Law no. 780-XV of 27.12.2001 on legislative acts.

Also, for initiatives on appointment or designation of candidates for certain positions, additional materials shall include:

Documents prescribed by legislation (copies of education documents, application/statement on the person’s agreement to be elected/designated/appointed, curriculum vitae, medical certificate, income and property statement, candidacy list and, if applicable, other necessary documents);

Proposal of election/appointment/designation to a position within public authorities and institutions that are under Parliamentary control;

Results of the contest or selection;

Report on compliance with requirements for the position;

Conclusion of the relevant committee and other documents necessary for each position. Despite these provisions, the three drafts on appointment/designation contain only the following documents:

Draft decision (all three drafts);

Results of the contest/selection (drafts no. 531 and no. 530);

CV of one candidate, although there were 3 pre-selected candidates (draft no. 530). Moreover, in the case of draft decision on appointment of some directors to the Administration Board of the National Agency for Energy Regulation (no. 536), it should be mentioned that it is on the agenda for the plenary meeting of 23.12.201318, although the draft was registered on 24.12.2013. For this draft, we shall

mention the absence of the LAIC report on the Parliament’s website. We shall remind of the provisions of Article 92 paragraph (2) of Parliament Regulations – issues concerning election, appointment or proposals for appointment to official positions are subject to Parliament debates after the presentation of the LAIC report.

Another remaining problem is the unavailability of additional materials for the process of exercising control. Thus, during the assessed period, the draft decision on the annual report of the Broadcasting Coordinating Council of Moldova (draft no. 443) was examined and adopted while the Council’s report is still unavailable online. Government conclusions (the conclusion of the Ministry of Finance) to the draft Parliament decisions on approval of budgets of some authorities are also still unavailable. During the assessed period, we have found the following drafts of this kind:

This situation occurs despite express regulations on the mandatory nature of previous coordination of budgets with the Government (Ministry of Finance). For example, Article 24 of the Elections Code stipulates that the Central Election Commission shall annually present to the Parliament, before 1 October, proposals on including into the State budget the expenses related to its operation and to conducting elections, including activities that it plans to conduct during the following budget year, accompanied by the conclusion of the Ministry of Finance. Moreover, the draft decision on the Parliament budget for 2014 (draft no. 384) is not accompanied on the Parliament’s website by the Government’s conclusion, either, although under Article 150 (1) of Parliament Regulations the Parliament is to approve its own annual budget for the following budget year before 1 July of the current year, preceded by a conclusion of the Government. As a matter of fact, we have noticed that the Parliament approved its own budget with a delay, as its draft was registered on 02 October 2013 and adopted on 12 December 2013. Moreover, we shall also mention the unavailability of the substantiation note for this draft, in contradiction with Article 13 (1) letter l) of Parliament Regulations, which assigns to the Parliament’s Permanent Bureau the task of producing draft Parliament budgets and presenting them to the Parliament for approval together with a substantiation note. Overall, deficient submission, examination and adoption of draft legislative budget acts is still a significant problem. Even the draft Law on the State Budget for 2014 (No. 488 of 03.12.2013) was presented to the Parliament with considerable delays: under Article 15 (3) of Law no. 847 of 24.05.2996 on the Budget

System and Budget Process, the Government is to present draft annual budget law to the Parliament before 01 October 2013. Even more serious violations of procedures have been found in submission, examination and adoption of draft laws on the modification and supplementation of annual budget laws. For all these drafts we have found unavailability of a positive Government conclusion. If drafts fail to receive a positive Government conclusion, their constitutionality may be challenged under Article 73 and Article 131 of the Constitution of Moldova construed through the prism of decisions of the Constitutional Court no. 19 of 29.04.1999 and no. 29 of 22.05.2001. Under the aspect of the voting procedure transparency we have found no progress, and so we shall maintain the findings and recommendations for the previously assessed periods19. Electronic registration of attendance of plenary meetings by MPs and implementation of the electronic voting system shall exclude any temptation to unjustifiably re-examine (revoke) acts that were adopted and entered into force. We shall remind of Parliament Decision no. 104 of 03.05.2013 on Repealing Parliament Decision no. 81 of 18.04.2013 on Appointment of Prosecutor General; the former was subsequently declared unconstitutional by Constitutional Court Decision no. 8 of 20.05.2013.

3. Transparency in the operation of Parliament’s working bodies

3.1. Parliament’s Permanent Bureau

In comparison with the previously assessed period20, no progress has been found in terms of transparency of the Parliament’s Permanent Bureau. The Permanent Bureau is still the most non-transparent working body of the Parliament. The section of “Permanent Bureau Meetings” on the Parliament’s website remains non-functional. The Parliament does not provide even generalized information on this issue. The only information provided to the public is the announcements on convocation of Permanent Bureau Meetings. During the assessed period, the “News” section of the Parliament’s website announced the Permanent Bureau meetings of:

According to the Parliament’s website21, standing parliamentary committees conducted 124 meetings during the assessed period.

4. Parliament’s mechanisms of cooperation with civil society

4.1. Permanent consultations

Under item 3.5 letter b) of the Concept, permanent consultation means provision of draft legislative acts by the Parliament to the civil society, for the purpose of which drafts are placed on the Parliament’s website. The deadline that the Parliament offers for permanent consultation under item 4.3.1 of the Concept is 15 working days from the date when draft legislative acts are placed on the website. Thus, the term of 15 working days is common for all categories of legislative acts. Under the aspect of compliance with the deadlines for the permanent consultation of drafts, during the assessed period we have found non-compliance in the cases of 69 drafts (84%) out of the 82 adopted drafts. At the same time, it should be noted that 5 drafts out of those 69 were debated and adopted on the day of registration.23

Thus, under this aspect, in comparison with the previously assessed periods24, we have found constant regress: during the period of 27.09.2012–31.12.2012 the deadlines for permanent consultation were violated in the cases of 64% drafts, and during the period of 01.01.2013–30.06.2013 – in the cases of 70% drafts. Deadlines for consultation were complied with in the cases of the following draft legislative acts:

The celerity with which the Parliament examines draft legislative acts cannot but discourage public participation. For example, on 21 November 2013 the Parliament modified Law no. 947 of 19.07.1996 on the Superior Council of Magistracy and Law no. 294 of 25.12.2008 on the Prosecution Office, prescribing appointment by the Parliament of 3 members of the Superior Council of Magistracy (hereinafter – SCM) and 3 members of the Superior Council of Prosecutors (SCP) from among professors of law following a public contest organized by the LAIC. Selected candidates were chosen as a result of the contest held on 24 December 2013 according to Parliament Decision no. 342 and Parliament Decision no. 341. The SCM and SCP certainly play an essential role in ensuring integrity in the justice sector. The Parliament’s intention to choose members of the SCM and SCP following a contest should be appreciated, although the related draft laws and decisions were examined in violation of the deadlines for permanent consultation. However, an eventual good intention was jeopardized even greater by the celerity with which the procedures were set into operation. For instance, the Regulations for organizing and conducting the contest for selection of candidates to SCM membership from among professors of law was adopted on 06 December 2013, and on the same day the contest was announced and the dates to submit applications were set for 09–16.12.2013; on 17 December 2013 the list of persons who applied and their CVs and the decision on the candidates that were admitted and invited for interview were published; on 19 December 2013 the interviews were held, and on the same day, after a short deliberation, selected candidates were announced without justifying why they were given preference and not others.

Under the aspect of announcements, we shall maintain our findings, which are partly similar to the findings for the previously assessed periods25, specifically:

They are placed in the “News” section, thus being lost among announcements about protocol agendas and participation of officials in various events;

The period between publication of announcements and the dates of events in the case of a significant number of announcements is too short to encourage the public to contribute to debating issues. As a matter of fact, in the sense of item 4.3.5 letter a) of the Concept, civil society organizations shall be announced about the dates of ad hoc meetings at least 10 days prior;

The terminology used to announce the methods of consultation is confusing, especially in the case of public hearings, with differences between the terminology in Law no. 239/2008 and the one in the Concept;

Six out of the 10 announcements contain no contact information;

In all cases the name of the person directly responsible for the event is not mentioned.

4.3. Following citizens contributions

Similarly to the previously assessed periods26, we have found that the Parliament does not follow public contributions. In the sense of item 1.3 of the Instruction, the reports of the standing committee informed of the matter need to include the entirety of the objections and proposals forwarded by the civil society. In fact, the reports dated with the assessed period contain no mentions about this issue. Such mentions are also absent in the syntheses of amendments, proposals and objections, although, according to item 3.1.11 of the Instruction, they need to include the objections and proposals obtained during public consultations. During the assessed period, some mentions concerning civil society have been included into the explanatory notes to 5 draft legislative acts, all of which were submitted by the Government, specifically:

The explanatory notes to these drafts contain either the summary indication that the drafts were subjected to consultation with civil society (without giving any details), or a general indication to the fact that the draft was placed on the website of its author in order to ensure transparency in decision making, or references to a study produced by a non-governmental organization. According to item 3.6.4 of the Instruction, the Parliament’s website shall contain information about:

Internal rules for the procedures of information, consultation and participation in the process of examination and adoption of legislative acts;

Draft legislative acts and materials related to them;

Results of public consultation (minutes of consultative public meetings, synthesis of recommendations);

Other information. Despite these provisions, the minutes concerning stakeholders’ contribution and the syntheses of recommendations are still unavailable online. During the assessed period, the only piece of information related to the results of public hearings placed on the Parliament’s website has been the press release of 14.11.2013 on the process of the latest public hearings regarding reformation of the pensions system in Moldova.27 In the part referring to civil society representatives, it says exclusively about their confirmed readiness to participate in producing a feasibility study of the pensions system.

CONCLUSIONS AND RECOMMENDATIONS Overall for the assessed period we have found no essential progress in terms of ensuring transparency in the Parliament’s decision making. Legal provisions in the field, where the Parliament is concerned, are still deficient and scattered throughout several regulatory acts. Despite there being a certain institutional framework, it does not seem to effectively contribute to increasing transparency in the Parliament’s decision making. In addition, councils of experts are still not capitalized on. In terms of transparency in the Parliament’s works, we have found an increase in the number of transcripts of plenary meetings that are unavailable online. The video and audio recordings of meetings are still unavailable. We appreciate progresses, although inessential, in the part of the law-making procedure that relates to the placement of draft legislative acts, syntheses (of amendments, proposals, objections) and conclusions of ministries on the Parliament’s website. However, we have found some decline in the number of draft legislative acts for which all additional documents announced online are available. In many cases unavailable documents include conclusions of committees, the NAC report, Government conclusions, final draft of the project, the GLD conclusion, text of the draft in Russian, the SCIM report (co-report), explanatory note. Transparency is still insufficient in the decision making related to the appointment procedures and in the process of the Parliament exercising its functions of control. Also unavailable are the conclusions of the Government (Ministry of Finance) to draft Parliament decisions on approval of budgets of some authorities. Moreover, even the draft decision on the Parliament’s budget for 2014 is not accompanied, on the Parliament’s website, by the Government conclusion. In addition, we shall note the delay with which the Parliament approved its own budget and the absence of the substantiation note. Overall, the deficient submission, examination and adoption of draft legislative acts on the budget are still a serious problem. Even more serious is the violation of procedures established for submission, examination and adoption of draft laws on the modification and supplementation of annual budget laws. The situation with the transparency of the voting procedure has not evolved.

Regarding working bodies, the Parliament’s Permanent Bureau is still the least transparent body, with the only available information still being the announcements regarding the convocation of its meetings. The transparency of standing parliamentary committees has not increased, either: the agendas of their meetings are the only available information in this regard. Under the aspect of the Parliament capitalizing on the mechanisms of cooperation with the civil society, we have found an increase in the number of drafts examined in violation of the deadlines for permanent consultation. The celerity with which the Parliament examines draft legislative acts cannot but discourage

public participation, also determining the absence of conclusions of committees, of the NAC report, of the Government conclusion, of the GLD conclusion, of the SCIM report (co-report). After assessing the Parliament’s efforts in organizing public consultations, we cannot say that public involvement into the Parliament’s decision making has become a truly established practice. This perception is due in part to the fact that the Parliament fails to follow public contributions. In practice, the syntheses of amendments, proposals and objections and the SCIM reports dated in the assessed period include no results of public consultations. The minutes on the contribution of stakeholders are also still unavailable online, and the Parliament failed to provide reports on transparency in decision making, too. Considering the identified problems, which are similar to the ones found in previously assessed periods, we shall maintain recommendations from the study Transparency in the Parliament’s Decision Making: Legal Provisions, Applicability and Application, including the following:

Improving the legal framework (more precise and comprehensive regulation on the following aspects: forms and procedures of public consultations; reception, analysis and synthesis of recommendations; production and publication of reports on transparency in decision making; responsibilities of key actors; an exhaustive list of documents that must be placed online, including those related to the activity of parliamentary groups, the Permanent Bureau and standing committees; clear deadlines; control mechanisms; etc.);

Enhancing the efforts of relevant bodies in order to ensure transparency in the Parliament’s decision making (establishment of councils of experts);

Ensuring compliance with the requirements of the legislative procedure;

Enhancing the transparency of works (ensuring online availability of all transcripts of plenary meetings; placing all draft legislative acts on the Parliament’s website; ensuring availability of all materials related to drafts; electronic registration of MPs’ attendance of plenary meetings; implementation of the electronic vote);

Increasing the transparency of the Parliament’s working bodies (online placement of information on the Permanent Bureau agenda; placement on the Parliament’s website of Permanent Bureau decisions and minutes of the public meetings conducted by standing parliamentary committees);

Increasing the Parliament’s capitalization on the mechanisms of cooperation with civil society (compliance with deadlines for public consultation; following public contributions; production and publication of reports on transparency in the Parliament’s decision making).
