PLEASE TAKE NOTICE that the Town Board Meeting scheduled for May 4, 2021 at 2:00 p.m. at Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York will proceed as scheduled.
PLEASE TAKE FURTHER NOTICE, that in accordance with the directive of Executive Order 202.1 issued by Governor Andrew M. Cuomo, as extended by subsequent Executive Orders, the aforementioned meeting will be held without in-person attendance by the public. Instead the public can watch the May 4, 2021 meeting of the Town Board via the following methods:

PLEASE TAKE NOTICE, that a public hearing will be held on the 4th
day of May, 2021 at 2:05 p.m. at Riverhead Town Hall, 200 Howell Avenue, Riverhead, New York, to consider a proposed local law to amend Chapter 289 of the Riverhead Town Code entitled, "Vehicles, Traffic and Parking Regulations"; and
PLEASE TAKE FURTHER NOTICE, that in accordance with the directive of Executive Order 202.1 issued by Governor Andrew M. Cuomo, the meeting will be held without in-person attendance by the public. Councilman Hubbard offered the following resolution, which was seconded by Councilwoman Kent
WHEREAS, the Town Board of the Town of Riverhead has entered into a license
agreement as per Resolution No. CDA-2020-3 dated April 07, 2020 for the short term temporary use of a specified area of the existing taxiway which commenced on April 15, 2020. The aforementioned resolution was subsequently extended as per Resolution No. CDA-2021-4 for a period of one year commencing April 15, 2021 through April 15, 2022, and
WHEREAS, the 2021 Adopted Budget for the Economic Development Fund
(Z14) reflected the original license agreement which ended April 15, 2021 therefore requiring a budget adjustment for an additional eight months of license revenue for the fiscal year 2021. Now, therefore be it
RESOLVED, that the Supervisor be, and is hereby authorized to establish the following budget adjustments;

Councilwoman Kent offered the following resolution, which was seconded by Councilman Beyrodt Jr.
WHEREAS, on April 6, 2021, per Town Board Resolution 2021-201, for the
specific object or purpose of paying the cost of the increase and improvement of the facilities of Riverhead Public Parking District in the Town of Riverhead, Suffolk County, New York (the “Public Parking District”), being the improvements to various parking lots in and for said Town, including original equipment and incidental improvements and expenses in connection therewith, are hereby authorized to be issued $725,917 bonds of said Town pursuant to the provisions of the Local Finance Law.
RESOLVED, that the Supervisor be, and is hereby authorized to establish the

Councilwoman Kent offered the following resolution, which was seconded by Councilman Beyrodt Jr.
WHEREAS, two vacancies exist in the Riverhead Police Department for the
position of Police Sergeant; and
WHEREAS, a request was made from the Suffolk County Department of Civil Service to provide a Certification of Eligibles for the position of Sergeant (Police: Towns & Villages) List #19-5007-125, established November 18, 2019 for the Town of Riverhead; and
WHEREAS, the Department of Civil Service provided Sergeant (Police: Town & Villages) List #19-5007-125, designating Patrick McDermott in position #2; and Anthony Montalbano in position #3; and
WHEREAS, it is the recommendation of the Chief of Police to fill the existing vacancies and Detective Patrick McDermott and Police Officer Anthony Montalbano be promoted to the position of Police Sergeant.
NOW, THEREFORE, BE IT RESOLVED, that Detective Patrick McDermott and Police Officer Anthony Montalbano are hereby promoted to the rank of Police Sergeant in the Riverhead Police Department effective May 5, 2021.

WHEREAS, Police Chief David J. Hegermiller has requested authorization from the Riverhead Town Board for Daniel Froehlich to attend a Marine Law Enforcement Training Program; and,
WHEREAS, this training course will be held in Lake George, New York, from May 3, 2021 to May 7, 2021. There is no cost for registration, lodging or meals for this training. The only cost would be for gas and tolls. Please see attached Training Announcement and Travel budget request.
NOW THEREFORE BE IT RESOLVED, that the Town Board hereby authorizes the attendance of Daniel Froehlich at the aforementioned training; and,

GRANTS SPECIAL PERMIT FOR CROWN CASTLE AT FRESH POND AVE. WIRELESS COMMUNICATIONS TOWER FRESH POND AVE, CALVERTON, NY

Councilman Rothwell offered the following resolution, which was seconded by Councilman Hubbard
WHEREAS, the Town Board of the Town of Riverhead is in receipt of a Special
Permit application submitted by Crown Castle Towers 06-2 LLC, with offices at 2000 Corporate Drive, Canonsburg, PA 15317, to permit the construction of a new 120 ft. tall monopole wireless communications tower with associated ground level equipment; and
WHEREAS, the project site, particularly identified as SCTM No. 600-77-2-2, is a
0.99 acre parcel of land located on the east side of Fresh Pond Ave., approximately 3,900 feet north of the intersection of Fresh Pond Ave. and Middle Country Road (State Route 25); and
WHEREAS, the applicant has also submitted a Site Plan application to the
Riverhead Planning Department, which is under review by the Riverhead Planning Board; and
WHEREAS, the Special Permit application also proposes the removal of two (2)
existing wireless communications towers, one being 120 ft. tall, the other being 122 ft. tall, which are identified as Crown Castle Site Nos. BU856984 and BU878872, located on SCTM Nos. 600-77-3-1 and 600-75-2-1; and
WHEREAS, the construction of a new single tower and the elimination of the two
existing towers in the immediate area will further the objectives of the Town Code because, among other things, it will reduce adverse visual impacts in the area; and
WHEREAS, the permanent removal of the two existing towers is also considered
a prerequisite to the erection of the new tower because Town Code Section 301-277(b)(5) requires separation distances between such towers to be a minimum of 25,000 linear feet; and
WHEREAS, the project site is located within the Agricultural Protection (APZ)
zoning use district, where wireless communications facilities are a specially permitted use by Special Permit of the Town Board, pursuant to Town Code 301-274 B; and
WHEREAS, the applicant has submitted the following plans and information: 1. A two-page property survey, prepared and stamped by Jonathan Franklin
Murphy, LS, last dated April 24, 2020, with one sheet being a property boundary survey, and the other being a 2,500 ft. radius map.

WHEREAS, with regard to SEQR, the proposed Special Permit and Site Plan
applications are considered a Type 1 action pursuant to Town Code §225-11B(4), requiring mandatory coordinated review with involved agencies; and
WHEREAS, by Town Board Resolution No. 2020-365, dated July 21, 2020, the Riverhead Town Board classified the action as a Type 1 action pursuant to SEQRA and initiated a 30 day SEQR coordination period among involved agencies; and
WHEREAS, by letter dated July 21, 2020, the Riverhead Planning Department circulated a SEQR coordination request to involved agencies; and
WHEREAS, by Town Board Resolution No. 2020-550, dated October 20, 2020, the Riverhead Town Board assumed Lead Agency status for the purposes of SEQRA review, and issued a Negative Declaration pursuant to SEQRA, with said resolution making the following SEQRA related findings:
1. The application to construct a new 120 ft. tall wireless communications tower with related ground level equipment and removal of two (2) existing wireless communications towers in the immediate vicinity of the project will reduce the visual impacts of the existing towers as a result of the consolidation of the areas wireless communications facilities into one (1) site.
2. The applicant has demonstrated that the expected Radiofrequency (RF)
levels at the project site will be 6.25% of the Maximum Permissible Exposure

(MPE) levels as established by the Federal Communications Commission (FCC), or roughly 15.995 times lower than the maximum levels deemed safe for continuous human exposure by the FCC.
3. The applicant has submitted a Phase I and Phase II Environmental Site
Assessment report which demonstrates that there are no elevated concentrations of any known contaminants above regulatory levels; and
WHEREAS, the proposed wireless communications tower required relief from the
Riverhead Zoning Board of Appeals for substandard rear yard and side yard setbacks; and
WHEREAS, the applicant sought the desired relief from the Zoning board of Appeals by Appeal No. 2020-038; and
WHEREAS, the applicant was granted the desired relief from the Zoning Board of Appeals on Appeal No. 2020-038, with determination dated January 14, 2021, which was granted with the following conditions:
1. The applicant must provide covenants and restrictions in a form satisfactory
to this board which covenants and restrictions shall be recorded against the properties on which the applicant maintains two wireless communications towers and will run with the land and will preclude the reconstruction of the pre-existing wireless communications towers in conformity with the applicant’s applications and the attendant SEQRA determination; and
WHEREAS¸ the Riverhead Town Board held a public hearing on the Special
Permit application on March 16, 2021, with the record being kept open for written comment until March 26, 2021. Now, therefore be it
RESOLVED, that the Riverhead Town Board hereby makes the following
findings in consideration of the Special Permit application:
1. The site is particularly suitable for the location of such use in the community, as the project site shares its eastern property boundary with vacant wooded land, and shares its norther common property boundary with one (1) single family residential parcel, which the proposed wireless communications tower maintains the required 100% fall zone setback from said northern property boundary. Additionally, the proposed tower’s setback from the existing residential property to the north is approximately 200 ft.
2. The subject parcel is 0.99 acres in size, which is sufficient for the construction of a 120 ft. tall monopole, which has been designed with a “break point” at a height of 75 ft, which, in the event of a collapse of the tower, would result in the fall zone radius being 45 ft. from the base of the tower. The design of the tower is such that in the event of a collapse of the tower, the resulting collapse would pose no negative impacts to neighboring properties or cause any part of the tower to cross any property boundaries.
3. The proposed use is not located unsuitably near to a church, school, theater, recreational area, or other place of public assembly.

4. The proposed access to the site from Fresh Pond Ave. is adequate, as the proposed wireless communications facility will be unmanned, with exceptions for routine maintenance and/or upgrades, and as such, is not expected to generate a significant amount of traffic.
5. In order to ensure the permanent removal of the two (2) existing towers,
located on SCTM Nos. 600-77-3-1 and 600-78-2-1, the Zoning Board of Appeals and the Riverhead Town Board will require covenants to be filed on both properties, which will run with those lands in perpetuity, precluding the owners of the aforementioned properties from reconstructing the towers in like construction and height; and be it further
RESOLVED, that the Riverhead Town Board hereby approves the Special
Permit of Crown Castle at Fresh Pond Avenue to construct a 120 ft. tall monopole wireless communications facility with associated ground level equipment at the site, particularly identified as SCTM No. 600-77-2-2, within the Agricultural Protection (APZ) zoning use district, subject to the following conditions:
1. The applicant must obtain site plan approval from the Riverhead Planning Board and obtain Building Permits from the Riverhead Building Department within one (1) year of the date of this resolution.
2. Councilman Hubbard offered the following resolution, which was seconded by Councilwoman Kent
WHEREAS, Town Board Resolution 2020-98 dated February 24, 2020 classified
the action to demolish an existing building and construct a 2-story, medical professional office with a first floor of 5,340 sq. ft., a second floor of 5,307 sq. ft., and an unfinished basement of 5,340 sq. ft., and associated improvements including construction of parking for seventy-six (76) vehicles as Type I pursuant to SEQRA and directed the Planning Department to circulate a request for the Town Board to be the Lead Agency for the proposed action; and
WHEREAS, the 30 day Coordinated Review period began on February 5, 2020 and ended on March 5, 2020; and
WHEREAS, as per correspondence from the Suffolk County Planning Commission dated February 7, 2020 it had no objection to the Town assuming Lead Agency status for the action; and had the following comments:
1. The Suffolk County Planning Commission reserves the right to
comment on this proposed action in the future and wants to be kept informed of all actions taken pursuant to SEQRA and to be provided with copies of all EAF’s, DEIS’s, and FEIS’s, etc. Please note that pursuant to New York State General Municipal Law section 239 and Article XIV of the Suffolk County Administrative Code, prior to approval, this action should be referred to the Suffolk County Planning Commission for review.
WHEREAS, as per a letter from PSEG dated February 10, 2020, that agency
offered the following comments: 1. The EAF and any supporting documentation should include a description an
analysis of impacts of any necessary electric utility upgrades to support the project.
2. Once design is obtained, an evaluation of potential impacts associated with the upgrades (if required) should be included. In particular, significant increases in pole heights which may result in visual impacts (i.e. pole height increases of more than 10 ft.), extent of ground disturbance, and proximity to wetlands should be evaluated and analyzed.

WHEREAS, there are no wetlands on the site or in proximity to the site; and
WHEREAS, as per e-mail correspondence received on March 17, 2020 PSEG
had the following comments: 1. This new building will be powered from pole 113 which is in the
northeast corner of the parcel and shown on the site plan. The existing pole is fairly new and can be used without having to replace it. We will either install a transformer on the pole or the customer will install a pad mounted transformer on the site and run cables to the pole.
WHEREAS, no other responses to the request for Lead Agency and Coordinated
Review were received; and WHEREAS, Planning Staff has provided the following assessment: 1. Professional offices are a Specially Permitted use in the Rural Corridor (RLC)
Zoning District provided they are within ¼ mile of the Hamlet Center (HC) or Village Center (VC) Zoning Use Districts.
2. The site is within ¼ mile of the Hamlet Center (HC) Zoning Use District to the east.
3. The proposed professional medical office use is in keeping with that of other uses in the vicinity, such as the veterinary office adjacent to the east and the insurance office across Main Rd.
4. The residential property adjacent to the south will be buffered by open space of 40 ft. in depth and by a double row of evergreens in the 10 ft. buffer required by Town Code section 301-236A(2) and the fact that the house on the property is approximately 190 ft. away.
5. The closest residential property of the two residential properties to the west is approximately 80 ft. away from the site to be developed and the proposed double row of evergreens in the 10 ft. buffer will provide a buffer to both residences.
6. There are no nearby residential uses to the east. 7. Adequate provisions for emergency access will be ensured through site plan
review by the Fire Marshal. 8. Although eleven (11) parking stalls back out into the main driveway, there is
sufficient queuing area provided in the driveway for vehicles entering the site before the parking stalls begin.
9. Proper access will be ensured by the requirement for a permit from the New York State Department of Transportation.
10. Nuisance impacts such as noise and vibration from delivery trucks and dumpster emptying can be mitigated by conditions of the Special Permit limiting these activities to during typical business hours.
11. Protection during construction of the “Witches Hat,” a structure that is a Town designated landmark just east of the site, which was formerly a roadside stand, will be ensured by conditions of site plan approval.
12. PSEG determined that existing infrastructure could serve the proposed project within minimal upgrades, consisting of transformer and other minor improvements; and
WHEREAS, the Town Board has considered the Special Permit application,

FEAF, and the SEQRA record to date, the report and recommendation of the Planning Department, the requirements of the Town Code, as well as other relevant planning, zoning, and environmental information. Now, therefore be it
RESOLVED, the Town Board may assume Lead Agency status, for the purposes

TOWN OF RIVERHEAD HOME IMPROVEMENT SELECTION POLICY
Councilwoman Kent offered the following resolution, which was seconded by Councilman Beyrodt Jr.
WHEREAS, the Town of Riverhead receives Federal, State and county funding to implement its Home Improvement Program; and
WHEREAS, the Home Improvement Program is instrumental in advancing the goal of maintaining affordable and workforce housing by encouraging eligible residents to access funds to repair their homes so that the housing stock remains stable and affordable and Homeowners are not forced to sell their homes due to daunting repair costs; and
WHEREAS, the Town’s Home Improvement Program has been in place for approximately 30 years, expending approximately more than $1 million dollars in grant funds since 2008, averaging over $15,000 spent per household and to date has assisted:
approximately 750 households;
more than 75% households with senior citizens;
75% households in mobile home communities;
approximately 25% households with a disabled individual
WHEREAS, eligible households earning at or below 80% of the area median income; and
WHEREAS, many participating homeowners are seniors over the age of 60 that reside in mobile home communities, Long Islands last truly affordable unsubsidized housing; and
WHEREAS, upon the recommendation of the Riverhead Senior Citizens Committee the Community Development Department adopted a selection policy that prioritizes seniors in February 2015 (Town Board Resolution #96) and further clarified and updated certain provisions in the policy to better serve the needs of residents in February 2019 (Town Board Resolution #121);
NOW THEREFORE BE IT RESOLVED, that the Home Improvement Program is available subject to the following general requirements:
1. NO PARTICIPATION IN PROGRAM PREVIOUSLY. ALL RECEPIENTS WILL ONLY BE SERVICED ONE TIME

2. HOMES MUST BE OWNER-OCCUPIED. APPLICANTS MUST HAVE LIVED IN THE HOME FOR A MINIMUM OF 48 MONTHS PRIOR TO SUBMITTING AN APPLICATION.
3. APPLICANTS MUST HAVE VALID HOMEOWNERS INSURANCE
4. WHEN DETERMINING INCOME ELIGIBILITY THE INCOME OF ALL OCCUPANTS OF THE RESIDENCE MUST BE INCLUDED APPLICATIONS WILL BE ADDRESSED IN THE ORDER WHICH THEY ARE RECEIVED AND SUBJECT TO THE SELECTION CRITERIA SET FORTH BELOW. The Town reserves the right to change the priority of projects due to health and safety emergencies or other extenuating circumstances.
5. Due to limited funding and an effort to serve more residents, an estimate of repairs necessary to bring a manufactured / mobile home up to code will be undertaken by the Town of Riverhead. A mobile home will be deemed beyond repair under the Riverhead Home Improvement Program if the estimated amount of repairs exceeds $35,000.
6. Should an applicant wish to continue in the process, they must undertake and complete repairs necessary to reduce the estimated scope below the $35,000 threshold. At the request of the homeowner, the Town of Riverhead may provide an estimated itemized list of necessary work to assist the homeowner in determining how to get the estimated project cost under the $35,000 total project cost to be covered under the town program. The Town of Riverhead reserves the right to move to the next applicant on the waiting list until this is done. Failure to notify the town that repairs were undertaken and completed by the homeowner within 12 months will result in the application being considered withdrawn, in which case a new application would need to be filed and the homeowner will be placed at the end of the waiting list.
And be it further,
RESOLVED, that the Town Board hereby establishes the following Home Improvement Program Priority Selection Criteria which selection criteria is further subject to the applicable rules and criteria of the funding programs available at the time the application is made:
HOME IMPROVEMENT PRIORITY SELECTION CRITERIA:
1. ELDERLY (over age 60).
2. Households with children under 12 years of age or occupied by a person
with disabilities and/or a VETERAN

AGREEMENT, made this ________day of _________________, 2021 between
the Riverhead Water District (hereinafter referred to as “District”) with offices at 200
Howell Avenue, Riverhead, New York 11901 and Camp Equities LLC (hereinafter
referred to as “Owner”) with address of PO Box 864, Aquebogue, New York 11931.
WHEREAS, Owner has requested that the District provide single family
residential water service to property located at 782 Reeves Avenue, Riverhead, New
York (SCTM# 0600-43.00-1-1.9) as more fully described in the attached Schedule A, and
WHEREAS, District agrees to supply water to a single family residential property
located at 782 Reeves Avenue, Riverhead, New York identified as Suffolk County Tax
Map No. 0600-43.00-1-1.9 under the following terms and conditions:
1. Owner consents to pay and shall pay the District district-wide tax as
same shall be levied as though the premises were within the District.
Owner consents to such assessment and tax.
2. Owner shall be responsible to pay all District service installation fees
and charges. Owner shall be responsible to pay the then current
applicable key money charge at time of hookup.
3. Owner shall pay for metered water at prevailing District rates.
4. This Agreement shall run with the land and be binding on the heirs,
successors, and assigns of Owner. Owner shall cause this Agreement
to be recorded with the Clerk of Suffolk County and filed with the
Riverhead Town Clerk and Riverhead Board of Assessors.
5. Owner agrees to join in any extension of the Riverhead Water District
that would include this parcel and to consent to such extension in
writing.
6. Owner shall be responsible to pay any additional expense in an amount
to be reasonably determined by the District to locate the meter and
meter service pit in the public right of way if the distance between such
meter and meter service pit to the nearest available main exceeds the
customary distance for service to a lot abutting a main.

services at no charge for one-year pursuant to the terms and conditions of its cable franchise renewal agreement with CSC Acquisition-NY, Inc. (commonly then known as Cablevision) and subsequently with Altice USA, the successor-in-interest; and
WHEREAS, G & G Technologies, Inc., is an authorized Leightronix cablecast

Resolution 2021-316
AUTHORIZES THE SUPERVISOR TO EXECUTE AN AGREEMENT WITH BRONZINO ENGINEERING, P.C.
Councilman Hubbard offered the following resolution,
which was seconded by Councilwoman Kent WHEREAS, the Town Board of the Town of Riverhead has been working to revitalization Downtown Riverhead for many years and has met with success in many respect, and WHEREAS, despite this success, Downtown Riverhead still has not seen the level of private investment required to create true downtown revitalization, and WHEREAS, the current configuration of buildings located on East Main Street blocks views and access to one of the Town’s greatest assets, the Peconic River, and WHEREAS, the Community Development Agency has been working to bring full revitalization to Downtown Riverhead through public private partnership in the East Main Street Urban Renewal Areas, and WHEREAS, the Community Development Department has sought funding opportunities and other designations to assist and facilitate the work of the CDA to create a vibrant downtown community where tomorrow’s workforce will want to live, work and raise families; and
WHEREAS, the creation of a Town Square along the Peconic River, opening up views and driving foot traffic to the riverfront and creating a public gathering space which would also provide recreational amenities, art exhibition and performance spaces has been a long stated goal in the Town’s many planning documents over the past 20 years and meets the stated goals of the LIREDC in catalyzing economic development, providing environmental justice, removing blight, improving water quality and creating environmental sustainability; and WHEREAS, in 2019 the Empire State Development Corporation offered funding for downtown revitalization projects through its Consolidated Funding Application (CFA) Round 9, the and Town was awarded $800,000.00 toward the development of the long recommended Town Square connecting East Main Street to the riverfront, and WHEREAS, in furtherance of the by Resolution # 399 adopted on August 4, 2020, the Town Board unanimously authorized the purchase of properties 117 East Main Street and 121 East Main Street and contract for option agreement and/or purchase of 127 East Main Street (collectively referred to as "Town Square Project") subject to the terms set forth above and permissive referendum requirements; and

WHEREAS, in addition, the Town Board, by Resolution # 400 adopted on August 4, 2020, unanimously authorized purchase of properties 117 East Main Street, 121 East Main Street and 127 East Main Street, Riverhead, NY and monies for demolition costs related to 117 East Main Street and 121 East Main Street subject to provisions of Local Finance and permissive referendum, and WHEREAS, in order to proceed with this aforementioned Town Square project, the Town of Riverhead will be demolishing two of the buildings it is acquiring and due to the location of the buildings and proximity to nearby buildings the Town requires the assistance of a professional engineer with experience in this type of engineering, NOW THEREFORE BE IT RESOLVED, that the proposal dated April 21, 2021 from Bronzino Engineering, PC. is accepted by the Town and the Supervisor is authorized to sign the attached professional services agreement prepared by the Office of the Town Attorney; and be it further

CONSULTANT/PROFESSIONAL SERVICES AGREEMENT
This Agreement made the day 2021 between the TOWN OF RIVERHEAD, a
municipal corporation organized and existing under the laws of New York, with its office located
at 200 Howell Avenue, Riverhead, New York, 11901, (“Town’) and Bronzino Engineering,
P.C. 100-3 South Jersey Avenue, East Setauket, NY 11733, ("Consultant").
In consideration of the mutual promises herein contained, Town of Riverhead and Consultant agree as follows:
1. SCOPE OF SERVICES During the term of this Agreement, Consultant shall furnish professional design services to
Town regarding demolition of 117 and 121 East Main Street, Riverhead, NY including the
creation of design drawings, and construction administration services as set forth specifically
in the attached proposal , which terms and conditions are incorporated and made part of
this agreement.
2. TERM OF AGREEMENT
The Agreement shall commence, upon Town giving notice to commence and shall end when
construction has been completed on the demolition of the aforementioned buildings and the
filing of any necessary reports.
3. PAYMENT
Payment for these services rendered by Consultant to the Town of Riverhead shall be due and
payable as set forth in the proposal dated April 21, 2021 for Scope 1: Design Drawing and
Scope 2: Construction Administration Services which payment shall be a fee not
greater than $20,150.00. Payments shall be made within thirty (30) days of the submission
of an invoice and as set forth herein. Note, the Town may require the submission of
documentation, including time records for performance-based contracts solely for the purposes
of verification of completion of the project or a portion of the project and the request that
consultant provide same shall not convert the performance contract to an hourly rate contract.
The Town shall not have any liability for any other expenses or costs incurred by Consultant
except for reimbursable costs for printing and permit fees or any additional service
previously approved by the Town,. Invoices for services and reimbursable expenses shall
contain the following statement signed by Consultant, or if this Agreement is with a firm, an
officer or authorized representative of the firm: "I hereby certify, to the best of my knowledge
and belief, that this invoice is correct, and that all items invoiced are based upon actual costs
incurred or services rendered consistent with the terms of the professional services
agreement." Invoices shall reference this Agreement or otherwise be identified in such a
manner as Town may reasonably require.

4. RIGHTS TO DOCUMENTS OR DATA All information and data, regardless of form, generated in the performance of, or delivered under, this Agreement, as well as any information provided to Consultant by Town, shall be and remain the sole property of Town. Consultant shall keep all such information and data in confidence and not disclose or use it for any purpose other than in performing this Agreement, except with Town's prior written approval. In the event that the legal right in any data and information generated in the performance of this Agreement does not vest in Town by law, Consultant hereby agrees to assign and assigns to Town such legal rights in all such data and information. Final payment shall not be due hereunder until after receipt by Town of such complete document and data file, or a certification that there is no such information created by the services performed under this agreement, and receipt of all information and data which is the property of Town. The Town shall use the documentation for this project only. These obligations shall survive the termination of this Agreement
5. PUBLICITY
Consultant shall not, without the prior written consent of Town, in any manner advertise
or publish the fact that Town has entered into this Agreement with Consultant shall not,
without the prior written consent of the Town, provide, release or make available for
inspection any document, data, written material of any kind without the prior written consent
of at least three members of the Town Board or by resolution of the Town Board.
6. ASSIGNMENT AND SUBCONTRACTING
Performance of any part of this Agreement may not be subcontracted nor assigned without,
in each case, the prior written consent of at least three members of the Town Board or by
resolution of the Town Board.
7. RECORDS
Consultant shall keep accurate records of the time spent in the performance of services
hereunder. The Town shall, until the expiration of seven years after final payment under
this Agreement, have access to and the right to examine any directly pertinent books,
documents, papers and records of Consultant involving transactions related to this
Agreement
8. CHANGES
The Town, by resolution of the Town Board or written request by at least three members
of the Town Board, within the general scope of this Agreement, may, at any time by written
notice to Consultant, issue additional instructions, require additional services or direct the
omission of services covered by this Agreement In such event, there will be made an
equitable adjustment in price and time of performance, but any claim for such an adjustment
must be made within 15 days of the receipt of such written notice. In the event that the
Consultant determines that a change order is required, Consultant shall obtain written
approval of the Town, by resolution or written consent of at least three members of the
Town Board, and if the change shall require the payment of additional compensation,

Consultant must obtain the written approval of three members of the Town Board or resolution
of the Town Board for the additional compensation prior to commencement of work regarding
the change order. It is agreed and understood that no oral agreement, conversation, or
understanding between the Consultant and the Town, its departments, officers, agents and
employees shall effect or modify any of the terms or obligations of this Agreement or
schedules annexed hereto and made a part hereof.
9. NOTICES
Any notice shall be considered as having been given: (i) to Town of Riverhead if mailed by
certified mail, postage prepaid to Town of Riverhead, Attention: Dawn C. Thomas, 200 Howell
Avenue, Riverhead, NY 11901; or (ii) to Consultant if mailed by certified mail, postage
prepaid to Bronzino Engineering, P.C. 100-3 South Jersey Avenue, East Setauket, NY 11733.
10. COMPLIANCE WITH LAWS
Consultant shall comply with all applicable federal, state, and local laws and ordinances
and regulations in the performance of its services under this Agreement In carrying out the work
required hereunder Consultant agrees not to make any communication to or appearance before
any person in the executive or legislative branches of the local, state or federal government for
the purpose of influencing or attempting to influence any such persons in connection with the
award, extension, continuation, renewal, amendment or modification of any contract or
agreement. Consultant may perform professional or technical services that are rendered directly
in the preparation, submission or negotiation activities preceding award of a Town
agreement/contract or to meet requirements imposed by law as a condition for receiving the
award but only to the extent specifically detailed in the statement of work. Professional and
technical services are limited to advice and analysis directly applying Consultant's
professional or technical discipline.
11. CONFLICT OF INTEREST
Consultant hereby represents and covenants that neither it nor any of its employees or
representatives has or shall have, directly or indirectly, any agreement or arrangement with any
official, employee or representative of the Town of Riverhead which any such official,
employee, representative shall receive either directly or indirectly anything of value whether
monetary or otherwise as the result of or in connection with any actual or contemplated
application before any department of the Town, contract with the town for sale of any product
or service. Consultant further represents and covenants that neither it nor any of its employees
or representatives has offered or shall offer any gratuity to the Town, its officers, employees,
agents or representatives with a view toward obtaining this Agreement or securing favorable
treatment with respect thereto. Consultant further represents that it will not engage in any activity
which presents a conflict of interest in light of its relationship with Town.
12. DISCLOSURE
The Town shall have the right, in its discretion, to disclose the terms and conditions of this
Agreement (as it may be amended from time to time), including but not limited to amounts paid
pursuant hereto, to agencies of the local, state and federal government.
13. DISPUTES If Consultant fails to perform any of its obligations hereunder in accordance with the terms hereof, then after reasonable notice to Consultant not to exceed thirty (30) days, and an 3

RATIFIES AUTHORIZATION FOR SUPERVISOR TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH DR. MARTIN R. CANTOR
Councilwoman Kent offered the following resolution,
which was seconded by Councilman Beyrodt Jr.
WHEREAS, the Community Development Department intends to submit applications for funding for federal DOT Raise 2021 funding and the NYS Downtown Revitalization during the next several months, and
WHEREAS, the Community Development Department is preparing the
applications and has been advised that an economic analysis of the immediate and long term economic impacts of the project is required specifically for the Raise 2021 application and that this analysis must be prepared by a qualified economic professional, and
WHEREAS, Martin R. Cantor, PhD., CPA has submitted a proposal for the
aforementioned work which will, more specifically include: a Benefit Cost Analysis (Economic Benefits) of 1) Creation of a TOD at the TOWN’s Long Island Railroad Station Transportation Hub, 2) construction of a new TOWN Square connecting pedestrians from Main Street to the Peconic Riverfront, 3) construction of pedestrian walkways linking the tourist venues on East and West Main Street in Downtown Riverhead, and
WHEREAS, The economic benefits will be provided in a written report, which will prove useful to the Town of Riverhead in future Downtown revitalization planning analysis and grant applications, and
WHEREAS, grant funds previously obtained are available to cover the costs
associated with the preparation of the BCA at a cost of $5,000.
RESOLVED, that the Town Board hereby authorizes the authorization for the Supervisor to execute the attached professional services proposal.

WHEREAS, the Town of Riverhead has raised grounds for denial and certain defenses to that claim; and
WHEREAS, the parties have negotiated a compromised settlement in the
amount of $3,500.00; and WHEREAS, considering the costs attendant to commencement of lawsuit,
proceeding to discovery, and going to a trial, together with the attendant uncertainties of litigation, it is in the best interest of the Town to agree to the terms of the Settlement.
NOW, THEREFORE BE IT RESOLVED, that the Town Board, be and hereby authorizes the Settlement of the claim made by PRG as agent for Altice in the amount of $3,500.00; and be it further

Councilwoman Kent offered the following resolution,
which was seconded by Councilman Beyrodt Jr. WHEREAS, the Town of Riverhead Veterans Advisory Committee and Business Improvement District, together with support from residents and business in the Town, created and sponsored a Hometown Hero Banner Program to honor local veterans, both living and deceased, serving in all branches of the United States armed forces with each banner featuring the individuals name, photo, military branch of service, and era of service and displayed along Main Street beginning in April through June (in observance of Memorial Day) and September through November (in observance of Veteran’s Day); and WHEREAS, Town Law §64 (13) and (14) provides that the Town may support Veteran’s organizations and commemoration programs of historical events, or otherwise to promote the general, commercial and industrial welfare of the town; and WHEREAS, the Town Board supports the Hometown Hero Banner Program and acknowledge that this program is a creative way to educate and connect our young people with those who served our country and a way to show public appreciation for local service members; and WHEREAS, Wedel Sign Company, located on West Main Street, Riverhead, New York, expressed its desire to donate two signs (an approximate value of $450.00) to the Town of Riverhead to honor PFC Garfield M. (“EEAC”), submitted a Chapter 255 Application for the purpose of conducting their 24th Annual Community Mosaic Street Painting Festival having street chalk drawing, music, arts and crafts exhibits, the sale of fine arts and food concessions, to be held on EEAC grounds and parking lot at 133 East Main Street and E. Main Street, between Roanoke Avenue and East Avenue, Riverhead, New York, on Sunday May 24th, 2020, having a rain date of Monday May 25th, 2020, between the hours of 8am to 5pm adopted by Town Board Resolution #786-2019; and
WHEREAS, during the time period of the event the Covid-19 pandemic caused special events to be postponed and or cancelled.
WHEREAS, the applicant has requested the dates of the event be rescheduled
again to a later date of September 5th, 2021 and cancel the previous date change adopted by resolution #427-2020 for May 30th, 2021 due to the safety of the public at this event; and
NOW THEREFORE BE IT RESOLVED, that the Town Board members are in

APPROVES SPECIAL EVENT CHAPTER 255 APPLICATION FOR SCRAMBUL INC. (SCRAMBUL RUNWAY CHALLENGE)

WHEREAS, on February 16, 2021, Scrambul Inc., submitted a Chapter 255 Application for the purpose of conducting A Scrambul Runway Challenge Drag Racing Event at Calverton Enterprise Park, Calverton, New York, on June 19th and June 20th, 2021 between the hours of 7 am to 7 pm having a rain date on June 26th and June 27th, 2021 and
WHEREAS, EEAC has completed and filed a Short Environmental Assessment
Form in accordance with 6 NYCRR 617; and WHEREAS, the applicant has paid the requisite Chapter 255 Application fee of
$350.00; and
WHEREAS, the Town Clerk’s office of the Town of Riverhead has reviewed all documents regarding said application.
WHEREAS, a Comprehensive Liability Insurance Policy naming the Town of
Riverhead, as an additional insured in the amount of $1,000,000 per occurrence and $2,000,000 general aggregate. If serving alcohol, Liquor Liability Insurance naming the Town of Riverhead as an additional insured in the amount of $2,000,000 per occurrence and $2,000,000 general aggregate will also be required. Insurance coverage must include set-up and break-down time and must list the name, date & location of the event under description of operations. If certificate of insurance is not received 30 days prior to the commencement of the event, the application shall be deemed incomplete and will be DENIED
NOW THEREFORE BE IT RESOLVED, that the Town Board of the Town of
Riverhead hereby has classified the action as a Type II under SEQRA NYCRR 617.5 C (21) and requiring no further environmental review; and be it further
RESOLVED, that the Chapter 255 Application of Scrambul Inc. for the purpose of conducting A Scrambul Runway Challenge Drag Racing Event at Calverton Enterprise Park, Calverton, New York, on the aforesaid date and time, is hereby approved; and be it further
RESOLVED, that any tent installations, including the obtainment of any necessary tent permits, and any all electric shall comply with the applicable provisions of the Building and Fire Code of New York State, the National Electrical Code and

a. All alcohol servers must be TIPS (Training for Intervention Procedures) approved by New York State
b. Alcohol service and consumption shall be limited to the licensed premises (beer garden) more fully delineated on the submitted site map.
c. Alcohol service shall be limited to beer, cider, wine and/or champagne. d. Alcohol service shall be limited to two (2) drinks per age-appropriate
customer at one time. e. Licensee shall possess and provide, prior to participation, a valid New
York State Liquor Authority catering permit, or other appropriate permit regarding off-premises alcohol service and comply with all applicable permit requirements including all other applicable municipal laws, rules and regulations
