RESOLUTION NO. 05-2012 A RESOLUTION OF THE TOWN OF GRANT-VALKARIA, BREVARD COUNTY, FLORIDA; GRANTING A CONDITIONAL USE PERMIT, CUP-2012-02 TO MARCEL KRUSZESKI; ALLOWING FOR A SINGLE-FAMILY RESIDENTIAL SECOND KITCHEN FACILITY IN ACCORDANCE WITH BREVARD COUNTY CODE SECTION 62-1947 ON THE PROPERTY DESCRIBED HEREIN; PROVIDING FOR CONDITIONS; PROVIDING FOR REVOCATION; PROVIDING AN EFFECTIVE DATE.
WHEREAS, Marcel Kruszeski owns the following described real property in the Town of Grant-Valkaria:
PROPERTY DESCRIBED AS FOLLOWS: Parcel ID: 29-38-34-00-00543.0-0000.00 (COMPLETE LEGAL DESCRIPTION ON FILE AT TOWN HALL) (hereinafter the “Property”); and
WHEREAS, Marcel Kruszeski requests the following Conditional Use Permit for the Property:
1) Conditional Use Permit (CUP) No. CUP-2012-02 to allow for a single-family residential second kitchen facility at 6155 Highway 1, Grant Valkaria Florida 32949 in accordance with Chapter 62, Article VI, Division 4, Subdivision II.
WHEREAS, sections 62- 1340 (3) and 62-1947, Brevard County Code, as adopted by the Town of Grant-Valkaria on the date of the Town’s incorporation, provides for a single-family residential second kitchen facility may be a conditional use in the RU-1-13 zoning classification; and WHEREAS, the Property is currently zoned RU-1-13; and WHEREAS, the Council has determined that reasonable conditions may be imposed on the CUP. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF GRANT-VALKARIA, BREVARD COUNTY, FLORIDA, that: SECTION 1. Marcel Kruszeski is hereby granted a conditional use permit, CUP 2012-02, to allow the single-family residential second kitchen facility on the Property subject to the following conditions:

A. The second kitchen facility and the area or quarters it serves shall be integrated architecturally, both internally and externally, with the single-family residence. Externally, the structure shall have both the appearance of one residence. Internally, there shall be direct access to the kitchen facility and its area from the living area or quarters of the single-family residence.
B. The area or quarters to be served by the kitchen facility shall not exceed 600 square feet, excluding the kitchen facility and bath area.
C. A floor plan of the entire single-family residence, including the additional kitchen facility, shall be submitted to the Town in order to illustrate compliance with the conditions set forth in subsections (A) and (B) of this section, and the floor plan shall be binding upon all future construction plans in regard to the single-family residence and second kitchen facilities.
D. No portion of the single-family dwelling unit shall be utilized for rental purposes, and the single-family dwelling unit shall be served by only one electrical meter.
E. The single-family dwelling unit shall continue to be utilized by no more than one family as defined under this chapter.
F. Applicant shall apply to the Council for an amendment to the CUP in the event of future expansion of the Property and any improvements requiring a permit located thereon;
G. The Applicant shall comply with all requirements as set forth in applicable Brevard County ordinances and codes, as adopted by the Town on the date of the Town’s incorporation, and future codes and ordinances of the Town including special event permits.
H. The conditional use may be transferred to other owners but shall only apply to the property at 6155 Highway 1.
SECTION 2. Any violation of any of the conditions set forth in section 1 of this Resolution may result in a revocation, change in conditions set forth in section 1 or other action the Council deems appropriate with respect to any CUP granted herein. Before the Council takes any action on a CUP due to an alleged violation of any condition in section 1, the Council will provide the owner a notice of hearing and an opportunity to be heard at the scheduled hearing. SECTION 3. This Resolution shall take effect immediately upon its adoption.
