Resolution # 13-2017 Senior Citizens Exemption Supervisor Tucker is interested in increasing the existing Senior Citizens Exemption income level for the Town of Caton from $18,500 to $20,500. pertaining to Permits for Large-Scale Solar Energy Systems in the Town of Lindley NY.
OLD BUSINESS Page property purchase-discussion of whether to purchase the property to be able to

At 6:04 pm Supervisor Tucker called the Public Hearing Meeting to order with the pledge to the flag.
Public Hearing for proposed Local Law No. 1 of 2017-title of law is “Senior Citizens Exemption”. Intent of law is to increase allowed income amount for the Senior Citizens’ Exemption to $20,500.
Supervisor Tucker opened the Public Hearing at 6:04 pm and closed the Public Hearing at 6:05 pm, with no public comment heard.

Planning Board-Chairman Lord submitted updated reports to Town Clerk for required training. Also, Ed Rial’s term will be up on 12/31/2017 and he will be resigning. Jennifer Card is interested in filling that position.
Park-Board reviewed the park maintenance proposal created by Councilman Michaloski. Audit dates-will be done next month.

On motion of Councilwoman Card seconded by Councilwoman Fitzsimmons the following resolution ADOPTED ROLL CALL VOTE-AYES 5 (Card, Fitzsimmons, Michaloski, Scott, Tucker) NAYS-0 RESOLVED to approve purchase of a new pc for Town Clerk’s Office at cost of $599.
Old Caton School exemption status-there has been questions as to whether the building is being used as a school or for another purpose. Owner is currently receiving an exemption for a school, but Town CEO recently tried to contact owner and both driveways were blocked. Supervisor suggests a letter be drafted by Attorney Maio requesting verification of building usage and physical inspection of property.
Senior Contract-Councilman Scott suggested the Board research the current Senior Citizen Contract that was drafted up by Attorney Maio last year for the Caton Senior Citizen group because after speaking to someone at NYS OSC and NYS Association of Towns, he feels the contract we have is incorrect. Supervisor Tucker stated that this issue was taken care of last year by Attorney Maio. The Board was
satisfied with the contract he proposed and therefore adopted it.

6 pm-Supervisor Tucker brought the meeting to order with the pledge to the flag.
Sheriff Jim Allard-is attempting to introduce himself to every Town in Steuben County since being elected in November. Officer Allard discussed several items pertaining to the depth of law enforcement:
Steuben Sheriff’s Agency is the only department with a Tactical Team in Steuben County and members are NYS certified as SWAT operators.
Commented on the assembly of several police agencies that all worked together on the lengthy murder trial recently held in Steuben County that pertained to Town of Caton. The Court security did a great job and the work that all of the officers did was fantastic.
Illegal drug use is the number one item the Sheriff’s Department is dealing with right now. Drug overdoses are up to two to three a week.
Mr. Allard would like to see all of the Steuben County deputy sheriffs trained as EMT’s.
Caton Constable Mike Smith is doing a great job and is appreciated by Mr. Allard.
The Town Board thanked Mr. Allard for taking the time to attend the meeting and all of the information he related to the Board.
Steuben County Update by Carol Ferratella-provided pamphlets on drug abuse signs and mentioned the County Roadside Cleanup letter.

Code Officer Al Buckland-reviewed, discussed, filed. Al introduced himself to the Board and also stated that the Board needs to review the building permit fees.

Dog Control Bruce Akins Jr-none received. Bruce recently went over the Dog Control Agreement and had questions concerning # 9, pertaining to the hold harmless clause. Clerk to forward to Attorney Maio for review.

Survey Map-Superintendent Card delivered a survey map of Steuben County Caton DPW Shop Plat located on the Corduroy Road. The Steuben County DPW Highway Department is planning for a new building on their Corduroy Rd property. However, they are needing slightly more acreage to expand and is asking the Town of Caton to convey (a) 0.826-acre piece to the County out of (a) 16.76-acre parcel that borders their property.

Supervisor Tucker brought the April 12, 2017 Town Board Meeting to order with the pledge to the flag.
Steuben County District Attorney Brooks Baker Attorney Baker talked to the Town Board about several subjects that the D A’s office deals with including indictments, STOP DWI program, trials, welfare fraud and mostly the epidemic rise in overdose deaths associated in particular with an increase of heroin use in Steuben County. The Board appreciated his presentation and thanked him for taking the time to attend one of our meetings.

• Steuben County Legislators recently passed a resolution that if a town wants to take their sales tax in cash, their “credit” against the County tax will be reduced by the same amount that they take in cash.

Supervisor Tucker briefly talked to the Board about the NYS Governor’s push for local municipalities to engage in shared services. There have been a few meetings with Steuben County and the State and there will be another mandatory meeting on Monday May 15th with the NYS Association of Towns, pertaining to the subject of shared services.

He has also been meeting every other Friday with the architect for the proposed new highway building.
Don Haussener and Supervisor Tucker have opened up a temporary construction building bank account to keep track of all expenses pertinent to the new highway building only.
Supervisor received notice from NYS that the Town of Caton has another $45k coming from NYS CHIPS and found out from NYS DOT that some of the CHIPS money can be used for the new highway building.
Old highway building is in the process of getting cleaned out and items are being put into storage containers.
Municipalities are not eligible for solar grants.

Amendment to Resolution # 22 of 2017 Town Clerk received advice from Attorney Maio that in order for the Town of Caton to legally transfer land to Steuben County, a resolution stating that the transfer is subject to a permissive referendum must be included in the motion and advertised to the public.

Budget Transfers Recently the Town Board of the Town of Caton has authorized the purchase of a new copier for the Town Clerk’s Office, and
desires to finance this purchase by using money from the General Fund Office Equipment Reserve, and
the use of Office Equipment Reserve Fund money and the purchase of the copier was not anticipated in the 2017 Budget, therefore
On motion of Councilwoman Fitzsimmons seconded by Councilman Scott the following resolution ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Michaloski, Scott, Tucker) NAYS 0-RESOLVED that the Town Board of the Town of Caton modify the 2017 General Fund Budget by appropriating Office Equipment Reserve Fund moneys (A511) in the amount of $3,570 and increasing General Fund Appropriations (A1410.2R) in the same amount.
Resolution # 34-2017
The Town Board has previously indicated its authorization to initiate the development of plans to construct a new highway garage, and
the Town Supervisor in his capacity as the Chief Fiscal Officer of the Town has authorized the establishment of a Capital Projects Fund in the Town’s accounting system,
and the establishment of a separate bank account to track all revenue and expenditure transactions of this construction project.
There is also a need for start-up money to finance architectural and other preliminary costs of construction project,
and no budgetary appropriations were provided for this purpose in the 2017 adopted Budget. The Town Board now desires to modify the 2017 adopted Budget to provide budgetary authority for transferring start-up funds from the General Fund to the newly established Capital Projects Fund.
On motion of Supervisor Tucker seconded by Councilman Michaloski the following resolution ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Michaloski, Scott, Tucker) NAYS 0-RESOLVED that the Caton Town Board hereby appropriates $20,000 to provide start-up costs and liquidity to pay bills for the Highway Garage Construction Project by transferring this amount from budget account A9950.93 (Building Repair and Renovation Reserve Fund) to account A9901.0 (Transfer to Other Funds).

Carol gave an approximate 20-minute talk to the Board concerning Highway Fund Balance.
Carol will be revising the 2016 AUD Report due to the fact that the new dump truck
purchased for the Highway Department arrived at the end of 2016 and was recorded as an
account payable, but did not get paid for until 2017. Payment came out of a Reserve Fund
rather than the unrestricted fund balance, which did not agree with the software program,
therefore; Carol did not take that into account when she drew up the resolution concerning
this transaction.

Steuben County Update o Legislator Ferratella reported that there are 130 parcels is in this year’s County Tax
Auction which will take place on July 14th, 10:00 am at the Campbell-Savona High School.
o Supervisor Tucker reported that the Steuben County Mobile Work Program workers did an excellent job of cleaning the outside of the Town Hall. They were here for three days and repaired and painted the masonry cracks on the side of the building as well as the entrance door and window sills.
o The Town is scheduled for six days of cemetery mowing with the Mobile Work Program
for this year. Workers are planning to mow three Caton cemeteries during the first week
of July and at the end of August. Town Clerk will send out a thank you card to the
workers to show our appreciation for all of the work they have competed.

Old Business o Deputy County Highway Superintendent Doug Rafferty-has been in touch with
Supervisor Tucker to converse about the Birch Creek Rd/Hittown Rd intersection.
o New Highway Building-
Supervisor displayed proposed blueprints of the planned highway building. Supervisor
Tucker stated that the new building may cost approximately $100k to $125k more than
anticipated due to new safety codes from NYS. Supervisor Tucker and Deputy Supervisor
Card are planning on meeting with Chemung Canal Bank to investigate loan options if
necessary.

RESOLVED that the Town Board approves a 1.98-hour/Qtr. Standard Work Day for
Councilman Timothy Scott, a 2.67-hour Standard Workday for Court Clerk Kim Clark and a
27-hour/Qtr. Standard Work Day for Deputy Highway Superintendent Ronald Kasper. This
resolution will be posted on the Town’s website starting today, June 14, 2017, and will
continue for at least thirty days.
Councilwoman Card and Councilwoman Fitzsimmons thanked Supervisor Tucker for all of the time and work he has put forth to see that the Highway Department gets its new building.

Comprehensive Planning Update Committee-
Chair Janice Glover gave a copy of proposed survey to Town Board members to review and discuss. Janice stated that each member has put 36 hours in to writing the survey. The purpose of the Comprehensive Plan is to see how residents would like the Town to grow or not grow, stay the same or not, etc. Committee members are satisfied with the proposed survey they have designed and Councilman Scott stated that, Planner Chelsea Robertson, from STCRPDB, said she approved of the plan. August 15th at 6 pm is the next Comprehensive Planning Update Committee meeting.

Sue Dunn, a Peer Educator from the Cancer Education Project at St. James Mercy Hospital in Hornell- Ms. Dunn has requested to be put on the agenda to give a twenty-minute discussion concerning her participation with the above project.
St. James Mercy Hospital is part of a state-wide effort to use local educators to speak with men and women in their communities about breast and prostate cancer.
The general initiative aims to help women and men be aware that regular screening is a key to early diagnosis and to encourage them to speak to their health care providers.

Steuben County Update-Carol Ferratella spoke to the Town Board concerning the Shared Services Panel and that the ballot vote
must be in by the 15th. Free Services for Cancer Patients-contact Steuben County Public Health Office in Bath. Steuben County DPW-approved ice control sand for County bids available on DPW website.
Councilwoman Card Recently, Councilwoman Card, Supervisor Tucker, Assemblyman Philp Palmesano and Steuben County Youth Bureau Coordinator, Bill Caudill, attended one of the Caton Summer Park Program sessions. It was a very informative gathering and Councilwoman Card is hoping that in the future our Park Program Director, Apryl Clary and Directors from other Town Park Programs could get together to share ideas for the local Youth Programs.
Also attending was Jairam Hathwar, a Corning student from Painted Post; and one of the winners of the 2016 National Spelling Bee. Jairam has pledged that he would like to attend our Park Program next year as a volunteer.
The Caton Park Program attendees appreciate that the winner of the National Spelling Bee and Mr. Palmesano and Mr. Caudill took the time to visit their Park Program. A thank you note will be sent to all.

Old Business o New Highway Building-
Supervisor Tucker has provided Board members with a copy of “Bid Results and Recommendations-New Town Garage” put together by AJH Design. The printout contains a tabulation of the bid results received from August 31, 2107 for the addition to the town highway garage.
Supervisor talked at length with Board members explaining the costs and financing etc. If the need arises to finance part of the Highway Project, the Town is pre-approved for a loan of up to $300k through Chemung Canal Bank at an approximate 3.6% interest rate for five years, and if the Town chooses to refinance with another loan company at a lower rate and pay off the Chemung Canal loan, CCTC has stated that there would be no penalty for that action.

Supervisor Tucker also stated that he has talked to NYS and CHIPS money may also be used to finance some of the new building project.
The Town Board is also looking to see if the $25k allocated in Retirement Capital Reserve Fund and the $50k allocated in the Workers Comp Insurance Reserve Fund could be used to help pay for the highway project. This question will be forwarded to Accountant Carol Golden.
The Town would like to consider completing the excavation and backfill operations with our own labor and material for the General Trades Contract and Plumbing Contract, which would save approximately $38k, if the Building Innovation Group and DFM Mechanical Services is awarded the base bids and alternates, as suggested by AJH Design Company.
Project Budget Summary A summary of the contract awards and proposed change orders is as follows:
General Trades Contract: $551,931. Contract Award: -$38,456. Delete Excavation and Backfill:
HVAC Contract: Contract Award: $38,900.

o Walt Maxwell, representing Caton Fire Department-would like to be the “go-to” for all and any training services that are required (or not) by NYS with the Town of Caton. Recently, the Fire Department purchased a defibrillator for the Town Hall and would like to set up a training class for all the people employed by the Town for use of that. Also, the Fire Department is willing to evaluate the fire extinguishers in both Town buildings at no cost. Walt has agreed to let the Town know when their training meetings are scheduled.

On motion of Supervisor Tucker seconded by Councilwoman Fitzsimmons the following RESOLUTION ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Michaloski, Card, Tucker) ABSTAINED 1 (Scott) to correct the accounting error in the Preliminary 2018 Budget by transferring $50,014 from “Transfers to Capital Reserves” (which reduces fund total from $90k to $39,986) to “Permanent Improvements” (which increases fund total from $140,166 to $190,180) and, to accept the modified revised budget as corrected on November 8th , 2017, that is to be put before the Public Hearing.

Board members received latest copy of 2017 Comprehensive Town of Caton Comprehensive Plan Survey. After discussion and on motion of Supervisor Tucker seconded by Councilman Scott the following RESOLUTION ADOPTED VOICE VOTE-AYES 5 (Fitzsimmons, Card, Scott, Michaloski, Tucker) NAYS O-RESOLVED to approve the latest version of Comprehensive Plan Survey and to put it out on the Caton website for residents to view and / or print.
NYS DOT has issued a speed limit of 45 mph on the Ginnan Road after completing a study as requested by Ginnan Road residents. Town is responsible for putting up speed signs and also, a warning stop sign to be placed ahead of the existing stop signs that are at each end of the Ginnan Road.

Steuben County DPW will soon be requiring municipalities to pay upfront for books of landfill tickets. Previously, tickets were given to the Town from the County. Town received $.75 per ticket sold and balance went to the County. County decided to make the Town pay for tickets before selling or no longer sell tickets and return remaining tickets to DPW.

Meeting open to the Public Thanks to the Highway Department and Caton Fire Department for taking care of fallen trees during a recent wind storm.
Dave Hopkins is responsible for 9-1-1 and Tim Marshall is responsible for Emergency Services Department.
Apparently, a cell tower has been erected near Kelly Hill Road and Councilman Michaloski has been trying to correspond with Tom O’Mara, Senator Schumer’s office and Tom Reed to get more cell coverage for this area.
Will the highway building project be covered completely by Capital Reserve Fund.

At 6 pm Supervisor Tucker called the meeting to order with the pledge to the flag.
Volunteer Firemen Presentation Caton volunteer firemen Bobby Joe Richards, Walt Maxwell, Bob Smith and Ben Crowl attended the meeting. The Fire Department presented the Town with a defibrillator for the Town Hall.
Mr. Richards is a certified EMT and gave a detailed presentation concerning the need for the ambulance service. Anyone wishing to discuss, may contact Dan Clayton at NYS DOH.
He said that the Caton Fire Department is more than happy to train anyone who needs NYS required training for CPR and safety training, including the Summer Park Program employees. The Town Board thanked the Firemen for attending, their presentation and the defibrillator.

Supervisor Tucker Stated that Ben Crowl, Fire Commissioner, will now be giving him a monthly report of the fire department incidents.
Old Business Highway building has really progressed since the last meeting. Footer and foundation walls
have been poured; electric pole has been moved; steele, roofing and metal is scheduled to be here late next week. Building will be going up soon.
New Business A list of December budget adjustments prepared, by Bookkeeper Don Haussener, was given
to each board member. There are eight General Fund and three Highway Fund adjustments that need to be reconciled and all transfers are scheduled to come out of contingency.

Charter Communications (former Time Warner now Spectrum) Franchise Agreement Attorney Maio previously reviewed proposed contract with the above. On motion of Supervisor Tucker seconded by Councilwoman Card the following RESOLUTION ADOPTED ROLL CALL VOTE-AYES 4 (Fitzsimmons, Card, Michaloski, Tucker) NAYS 0-RESOLVED to sign and approve the above Franchise Agreement as presented.
Transfer of Corduroy Road property to Steuben County In September of 2017 Attorney Maio submitted (a) 0.826-acre plot (tax parcel # 390.00-02-013.000 on the Corduroy Road) to be conveyed from the Town of Caton to Steuben County. Planning Board previously approved the subdivision and the Town Board previously approved the transfer. Attorney Maio stated that the final survey map has been completed and as soon as he obtains copies he will file with Steuben County.
Steuben County Attorney Maio reported that the Steuben County Public Safety Committee had a meeting about response times with the volunteer departments. Previously, the rule was they would wait 9 minutes to get a response from the initial agency and now it has been changed to 3 or 4 minutes.
Paul Michaloski update on cell service Councilman Michaloski has been trying to contact NYS representatives to talk about the lack of cell service in the Town of Caton. He stated there has been no response from NYS.
Meeting open to the public People do not realize what they are getting when they receive ALS in Caton. Does the Town have capital reserve funds? Residents need to be patient when they call for emergency service. Why do so many different municipalities attend emergencies? Thanked Diane Card for the last four years of service to the Town. Glad the grader is up in running. Roads are like washboards.
Motion by Councilman Michaloski seconded by Councilwoman Card to close the meeting at 7:05 pm. Motion carried.
