In exercise of the powers contained in section 101 of the Fisheries M

anagement

Act 2002, the M

inister makes the follow

ing Regulations:

These Regulations m

ay be cited as the Fisheries Managem

ent (Processingand Export) R

egulations 2008.

2.Interpretation

In these Regulations-

(a)the term

s and phrases defined in the Fisheries Managem

ent Act

2002 shall be given the same m

eaning in these regulations, unlessthe context requires otherw

ise;

(b)unless the context otherw

ise requires-

“Act” m

eans the Fisheries Managem

ent Act 2002;

“Inspector” means a person appointed under regulation 19 of these

regulations;

“Codex A

limentarius” m

eans the collection of internationally adoptedfood standards com

piled by the Joint FAO

/WH

O Food Standards

Programm

e;

“export” means to take or cause to be taken out of the K

ingdom of

Tonga for comm

ercial or potentially comm

ercial purposes, and includesproviding com

mercial sam

ples, but does not include the export ofquantities of less than 20 kilogram

s in weight for the purpose of

domestic consum

ption;

“General Principles of Food H

ygiene” means the R

ecomm

endedInternational C

ode of Practice General Principles of Food H

ygiene inthe C

odex Alim

entarius; and

“HA

CC

P” means the H

azard Analysis C

ritical Control Point system

as provided for under the Codex A

limentarius w

hich identifies,evaluates and controls hazards w

hich are significant for food safety.

A holder of a licence to export fish for com

mercial purposes shall-

(a)com

plete the Marine Products Export Log sheet, in Form

2 ofSchedule 3, for every day of export of m

arine product forcom

mercial purposes, including-

(i)Licence holder’s nam

e;

(ii)D

ate of export;

(iii)D

estination;

(iv)Scientific or com

mon nam

e of each species to export;

(v)N

umber of fish by species;

(vi)Total w

eight by species; and

(b)subm

it all completed M

arine Products Log sheets to the Secretaryin their original and unaltered form

no later than 24 hours afterthe com

pletion of the day to which the log sheet relates.

12.Fees for export of m

arine products

All fees for exporting M

arine Products Export shall be charged when the

Ministry receives stam

ped packing list from C

ustoms.

13.A

pplication to export aquarium fish

(1)A

n application for a licence to export aquarium fish shall be-

(a)m

ade in Form 9 of Schedule 1; and

(b)accom

panied by the fee specified in Schedule 2.

n application to renew a licence to export aquarium

fish shall be-

(a)m

ade in Form 10 of Schedule 1; and

(b)accom

panied by the fee specified in Schedule 2.

3.Seafood safety standards

The licence holder shall ensure, for the purposes of processing and export,com

pliance with the food safety standards provisions of the Public H

ealthA

ct and any other law in the K

ingdom.

4.Fish processing establishm

ent certificate

(1)A

n application to register a fish processing establishment shall be-

(a)m

ade in Form 1 of Schedule 1; and

(b)accom

panied by the fee specified in Schedule 2.

(2)A

certificate of registration for a fish processing establishment shall

be issued-

(a)in Form

2 of Schedule 1; and

(b)upon paym

ent of the fee specified in Schedule 2.

5.A

pplication for a fish processing establishment licence

(1)A

n application for a licence to operate a fish processing establishment

shall be -

(a)m

ade in Form 3 of Schedule 1; and

(b)accom

panied by the fee specified in Schedule 2.

(2)A

n application to renew a fish processing establishm

ent licence shall be-

(a)m

ade in Form 4 of Schedule 1; and

(b)accom

panied by the fee specified in Schedule 2.

(3)A

licence to operate a fish processing establishment shall be issued-

(a)in Form

5 of Schedule 1; and

(b)upon paym

ent of the fee specified in Schedule 2.

(4)The holder of fish processing establishm

ent licence shall ensure thatall em

ployees operating under this licence are sufficiently trained inprocessing and the handling of fish and fish product to enhance thequality.

(5)The holder of a fish processing establishm

ent licence shall -

(a)com

plete the Fish Processing Log sheet in Form 1 of Schedule 3;

(b)subm

it all completed Fish Processing Log sheets to the M

inistryin their original and unaltered form

, weekly after the com

pletionof the w

eek to which the log sheet relates; and

(c)ensure that the fish processed at such establishm

ent shall notexceed the total quotas allow

ed to that establishment, including

those relating to species and quantity.

6.D

efinition of fish

In this Part, “fish” means any fish processed for the purposes of export.

7.A

pplication for a licence to export fish

An application for a licence to export fish shall be-

(a)m

ade in Form 6 of Schedule 1; and

(b)accom

panied by the fee specified in Schedule 2.

8.R

enewal of licence to export fish

An application to renew

a licence to export fish shall be-

(a)m

ade in Form 7 of Schedule 1; and

(b)accom

panied by the fee specified in Schedule 2.

9.L

icence to export fish

(1)A

licence to export fish shall be-

(a)issued in Form

8 of Schedule 1;

(b)issued upon paym

ent of the fee specified in Schedule 2, and

(c)valid for a period of 12 m

onths from the date of issue, unless

sooner cancelled or suspended.

(2)A

licence to export fish for comm

ercial purposes shall be accompanied

by a valid licence to operate a fish processing establishment.

10.L

icence conditions

(1)A

licence to export fish for comm

ercial purposes shall be subject tothe follow

ing conditions in addition to any other conditions requiredunder the A

ct –

(a)the objectives of the relevant m

anagement and developm

ent plan;

(b)fish products are processed in a licensed fish processingestablishm

ent pursuant to an effective HA

CC

P system;

(c)the H

AC

CP Plan w

as prepared and is monitored by a person w

horeceived training in the application of H

AC

CP Principles or by a

seafood safety inspector;

(d)the exporter dem

onstrating that they can consistently meet the

appropriate standards regarding microbial and natural toxin

contamination,

chemical

contamination

and physical

contamination;

(e)every consignm

ent of fish to be exported shall be accompanied

by a health certificate which has been prescribed by the Secretary.

14.L

icence to export aquarium fish

A licence to export aquarium

fish shall be-

(a)issued in Form

11 of Schedule 1;

(b)issued upon paym

ent of the fee specified in Schedule 2; and

(c)valid for a period of 12 m

onths from the date of issue, unless

sooner cancelled or suspended.

15.L

icence conditions

A licence to export aquarium

fish shall be subject to the following conditions

in addition to any other conditions required under the Act –

(a)the objectives of the relevant m

anagement and developm

ent plan;

(b)aquarium

fish are processed in a licensed fish processingestablishm

ent;

(c)safe and sanitary packaging for transportation; and

(d)accom

panied by a health certificate which has been approved by

the Secretary.

16.Trained em

ployees

A holder of a licence to export aquarium

fish shall ensure that all employees

operating under that licence are sufficiently trained in and operate usingbest practice for handling and packing to m

inimize m

ortalities duringtransportation.

17.A

quarium fish export L

og sheet

A holder of a licence to export aquarium

fish shall -

(a)com

plete the Aquarium

Export L

og sheet, in Form 3 of

Schedule 3, for every day of export of aquarium fish, including-

(i)Licence holder’s nam

e;

(ii)D

ate of export;

(iv)Scientific or com

mon nam

e of each species being exported;

(v)N

umber of specim

ens of each species being exported;

(v)FO

B value by species; and

(b) submit all com

pleted Aquarium

Log sheets to the Secretary intheir original and unaltered form

no later than 24 hours after thecom

pletion of the day to which the log sheet relates.

18.Fees for export of A

quarium fish

All fees for exporting aquarium

fish shall be charged when the packing list

has been stamped w

ith the Custom

s official stamp.

19.Inspector

spaper widely circulated in the K

ingdom, as

(2)The duties of an inspector shall include but is not lim

ited to thefollow

ing, to –

(a)develop a H

AC

CP Plan w

here necessary;

(b)reassess and m

odify the HA

CC

P Plan, at a minim

um once a year

and when corrective action plans are em

ployed;

(c)carry out regular m

onitoring of the fish processor’s HA

CC

Psystem

;

(d)carry out regular health checks through sam

pling, organolepticchecks, parasite checks, chem

ical checks, microbiological analysis

and contaminants analysis;

(e)ensure com

pliance with the seafood safety standards set dow

n bythe Secretary.

(f)ensure com

pliance with the standards of im

porting countries;

(g)draw

up a list of the licensed fish processing establishments;

(h)confiscate fish found to be unsafe for consum

ption;

(i)suspend or revoke a fish export licence, w

here necessary, if thereis uncertainty as to the safety of the fish product for consum

ption;

(j)provide assurance that particular fish and fish products have beenproduced or processed in accordance w

ith an effective HA

CC

PPlan and the food safety standards provided under the law

s ofTonga; and

(k)conduct necessary inspections of the processor’s prem

ises andoperations in accordance w

ith the requirements of these

regulations.

20.Inform

ation to be true, complete and correct

(1)A

ny information required to be recorded, notified, com

municated or

reported pursuant to any requirement of these R

egulations shall betrue, com

plete and correct.

(2)A

ny change in circumstances w

hich has the effect of rendering anysuch inform

ation false, incomplete or m

isleading shall be notifiedim

mediately to the appropriate person, authority or body.

21.M

inister may raise a resource rent on fish processing and export

(1)The M

inister may, by N

otice published in a newspaper w

idelycirculated in the K

ingdom, raise a resource rent as he deem

s necessaryon any fish processed or exported by any person or establishm

ent thathas been licensed to process or export any fish.

(2)Funds raised from

the resource rent shall be made available to the

Ministry for the purposes of com

pliance, monitoring and research.
