PART A - PROPONENT INFORMATION

The proponent is Rushy Holdings Pty Ltd and the land titles on which this proposal is located are in the name of Rushy Holdings Pty Ltd , ( ACN 077 074 652 ) . Rushy Holdings Pty Ltd covers approx. 27900ha in total . Included in that total are Wyambi , East Wyambi , Rock Bank and Miegunyah which together comprise approx. 19000 ha. . PART B - PROJECT DESCRIPTION 1 : DESCRIPTION The proposal is to produce up to 75000m3 p.a. of construction material over a 3 year period to supply the Musselroe Wind Farm Development for roads and hardstand areas . There may also be an opportunity to supply material to other proposed developments in the NE . The material to be extracted is of a coarse sandy nature and is intended as a surfacing material primarily . The site has been used as a source of road and track material since the 1960,s and consequently there are a number of exposed areas on the northern side of the access track . To further develop the site to generate the volumes proposed the intention is to use and expand the areas that are already exposed thereby minimising overall disturbance . It is proposed to extract this material from a low ridge 1.5 km to the southeast of Six Mile Hill . The intended method of extraction is to establish a series of bays of approx. 1.0 ha each sequentially along the ridge in a generally northeast direction. Each bay would be separated by a section of natural ground approx. 20m wide generally at right angles to the access track . On each area between bays the natural vegetation would be retained and bays positioned to save areas of healthier vegetation . The aim of retaining these sections of natural ground is to prevent a large area of sandy ground requiring rehabilitation from accumulating and being subject to winds likely to complicate rehabilitation by abrasion of regrowth plant stems .

The surface will be recontoured and a number of water storage sites will be developed from the planned settling ponds on the SE side and below the proposed bays . It may be desirable to concentrate runoff into a smaller number of ponds , this will depend on site conditions after extraction . Pond areas will be left in a stable condition with potential scouring points rock armoured . The existing access track shown in Diagram 2 will be replaced by a track on the SE side of the exposed area at completion of activities . The intention of placing the new track in the worked area is to minimise overall disturbance . Diagram 2 – General layout of proposed quarry operation working towards NE .

Rehabilitation will take place after completion of extraction from each bay or at the end of the seasonal operations . The bays will be recontoured and previously stockpiled overburden and soil spread over the disturbed area . Previously stockpiled soil and overburden will have been placed on the NW of the works in order to provide some wind protection during operations . During the recontouring operation the gravel faces on the NW side of the bays will be left in a steeper configuration rather than bevelled to a low angle in order to minimise the gravelly slope area requiring revegetation . Where gravel faces are over 5m in height they will be stepped to form two lower faces . Drainage from the bay floors will be directed into settling ponds on the southeastern side of the ridge before being dispersed through culverts under the access track into vegetation . See sketch at Attachment 6 . Each of the 4 bays proposed will be approx. 75m X 150m and as the bays are excavated the access track will be moved to the SE side of the works so that on completion the remaining track will be included in the worked area and on the SE edge . The total disturbed area for the proposal would be < 5ha including access tracks with probably half or less of that total being open during any year . The machinery configuration will vary with the activity being undertaken but typically the excavation and stockpiling stage will be followed by a loading and cartage cycle . Material would be stockpiled in the bay floors . Direct digging and loading may be an option if the excavated material is of consistent size and relatively boulder free . Gravel screening operations may be required if there is an excessive number of oversize rocks in the extracted material . It is expected that moderate quantities of oversize rocks would be sorted during the loading operation . If screening is required it is expected to be for less than 5000m3 of the excavated material . The hours of operation will follow the Quarry Code of Practice acceptable standards and run from 0700 to 1900 on weekdays and 0800 to 1600 on Saturdays . If other arrangements for extended hours of operation are desired then approval will be sought from the Environmental Protection Authority and Dorset Council .

Annual production rates will be at their peak during 2009 and 2010 during the early stages of construction of the Wind Farm and will reduce during the remaining period of the lease . Production rates will depend on construction requirements and will be higher during the drier summer months .

2: THE PROJECT AREA

Mining Lease No. 1867 P/M runs along the existing farm track from the SW . The SW corner of the lease is at AMG E 587900 , N 5477430 . The lease is situated on land title vol 201002 folio 1 which is part of Rushy Holdings Pty Ltd . and managed as part of the Rushy Lagoon property . See attachments 1 and 2 at the end of this report .

The area was initially used for agricultural purposes in the 1850,s but it was not until the 1960,s when the property was purchased by the British Tobacco Company that major clearing and broad scale farming started at which time the property was the largest farm in Tasmania . Diagram 5 - View showing degraded woodland and bracken in the SW corner of the lease . The current access track can be seen in the middle ground .

The site is > 2 Km from the Cape Portland Road and > 2.5 Km from the nearest residence which is the Rushy Lagoon homestead on the eastern side of Cape Portland Road . The topography of the general area is characterised by plains and low rolling slopes and ridges . The low productivity of the sandy / gravely granite derived soils has resulted in less pasture establishment and these lower productivity areas tend to be remnant bushland which is currently grazed by cattle and bears evidence of previous bushfires . The site is surrounded by pasture which broadly follows the more productive soils . The site is described in the Flora and Fauna Report on p8 as " .. covered partly by native bushland , and partly by the pits and mounds left by past

extraction . The native bushland is Black Peppermint coastal woodland ( TASVEG code DAC ) , which is not a threatened community . Although this woodland is degraded and grazed by cattle , there is a threatened plant here . The rare species , Juniper Wattle , is found in the southwest corner of the site ". The quarry is within an area listed on the Tasmanian Geoconservation Database known as the Northeast Tasmania Pleistocene Aeolian System , ID 136 PIP10 . The description of this system is " Part of a Pleistocene desert dune complex , which formerly covered much of Bass Strait . Aeolian sand sheets and longitudinal dunes of the last glacial age constitute the largest desert dune complex in Tasmania . Landforms in marginal areas are likely to include

important evidence of interfingering relationships with other landform process systems ( e,g. fluvial , periglacial ) . The current (1996) status of knowledge of the feature is inadequate for the identification of significant sites and features within the overall complex ." This quarry site is located on a low rounded ridge running from NE to SW . The area is described as type Dgaasg ( Variably porphyritic coarse - to very coarse – grained biotite – garnet – minor muscovite granite ) on the Musselroe 1:25k sheet No. 5847 produced by MRT . These deposits are Devonian and part of the Eddystone Batholith . This site has a shallow organic layer underlain by deep sandy and quartz gravel uncemented A2 layers . The organic layer appears to be thin and sandy in texture and limited to a few cm in depth . Diagram 8 – Deep sandy and quartz gravel A2 layer visible in cut .

Phytophthora cinnamomi The proposed operation being located in the NE lowland is at risk of infection by Phytophthora cinnamomi . Susceptible and resistant species are tabulated in Forest Practices Authority Flora Technical Note No. 8 which will be a reference document for management of this site . Soils and overburden stripped at this site will be separately stockpiled and the quarry floor will be constructed to drain freely to the southeast .The objective being to maintain the floor and stockpiles as dry and free draining as possible . Stockpiles will not be formed on the lower side of the quarry and will be formed in steep sided rows . Ponding in the quarry floor will be avoided by attention to drainage during wet periods . These measures are part of the operational conditions of Mining Lease 1879 P/M . Plant and machinery will be treated in accordance with Tasmanian Washdown Guidelines for Weed and Disease Control – April 2004 . This will be a Management Commitment at item " D " . Plant and machinery must comply before entering Rushy Lagoon property .

Trucks arriving at the quarry from other areas must be confirmed as washed down outside this property according to the guidelines and the procedure must be repeated before re-entering the site if trucks leave this cartage operation for other quarry destinations during the operation . A person delegated by Rushy Holdings Pty Ltd will be responsible for confirming hygiene procedures . There will be no washdown facility at Rushy Lagoon for trucks entering the site . In addition Flora Technical Note No 8 produced by the Forest Practices Authority will be used a guide to recognising field symptoms of Phytophthora root rot . Weed control during operations and rehabilitation will follow the processes outlined in the Quarry Code of Practice 1999 . Because the intention is to return this site to native vegetation regular monitoring for weed emergence will be required , particularly after individual bays have been rehabilitated . If there is weed emergence during the operation either manual weeding or spraying should be applied . Regular site monitoring l will be required to ensure weed removal and prevention of a weed seed bank developing on site .

PART C - POTENTIAL ENVIRONMENTAL EFFECTS 1 : FLORA AND FAUNA A Flora and Fauna Survey was conducted by consultant botanists Ms Anna Povey and Ms Helen Morgan of Bushways Environmental Services - Tasmania on the 17 September 2008 and that report accompanies this document. This site is referred to as "site 2 " and " Bullock Paddock 2 " in the Flora and Fauna Survey . This site is partly remnant bushland with a central access track and previous workings that have exposed a number of areas . The Bushways report found that the remnant bushland on this site , Black Peppermint coastal woodland , is not a threatened vegetation community and that there was no significant habitat for threatened fauna. This site is outside the range of the Giant Freshwater Crayfish (Astacopsis gouldi ) , the range limit is the Ringarooma River and its tributaries Which is located to the west of this area . Drainage from this area enters the Little Musselroe River system. Previously recorded species and those with an estimated range within 5 Km of the site that were considered are listed on page 12 of the Flora and Fauna Survey together with their TSPA 1995 and EPBC 1999 status . Specific comments in relation to each species are included in the table which is reproduced on the page 16 of this document . Comments for this site in relation to the spotted – tailed quoll in the Flora and Fauna Survey concluded that it " Could den and forage in bushland of Bullock Pdk 2 , but unlikely to den within site 2 as disturbed and few logs etc. No scats found ".

It was also indicated that , " There may be impacts at site 2 , which has bushland and rare plants " . Refer to p3 " Summary " of the Flora and Fauna Report . There were a number of plant species observed at this site and these are listed at appendix 2 of the Flora and Fauna Survey . A specific search for threatened flora previously recorded in the area did not result in any of those plants being found . The threatened species are listed in Appendix 3 of the Flora and Fauna Survey . The rare flora species , Juniper Wattle ( Acacia ulicfolia ) was located in the general SW area of the lease . To protect these plants recommendation 6.1 , page 14 of the Flora and Fauna Survey will be implemented . That is , to fence the area containing the Juniper Wattle and prevent operations or machinery from entering that area . It is proposed to indicate the exclusion area by marking it with high visibility bunting on steel droppers . Contractors entering the worksite will be advised that the fence indicates a machinery exclusion area . At least one of the Juniper Wattle plants has grown in part of the previously worked area , the plant is marked by pink tape in the foreground below . The Juniper wattle plants occur to the north of the access track so the edge of the exclusion area will be partly delineated by the northern side of the access track . 2 : RIVERS , CREEKS , WETLANDS AND ESTUARIES The nearest drainage line is approx. 80 m to the north of the lease and it runs generally westerly towards the Little Musselroe River . Drainage from the quarry area will be directed into settling ponds to the SE of the works area before being dispersed into the surrounding vegetation and pasture . Outlets should be monitored in order to prevent soil scouring from developing and a rock apron below the outlet will assist in dissipating higher flows during wet periods . The quarry operation will require monitoring of run off water quality to ensure that the measures in place are operating efficiently and are maintained in effective condition . Maintenance to settling ponds will involve regular removal of accumulated silt and monitoring of the structure . MRT Record 2003/01 indicates that groundwater prospectivity in this type of rock is considered to be low to moderate as is vulnerability to pollution . There are no bores listed in this area , the nearest is bore 16017 located approx. 2.5 Km SW of the site at cape Portland Road and on different geology . The measures described at Item 10 , DANGEROUS GOODS AND CHEMICALS, concerning fuel storage and handling are intended to prevent groundwater contamination from fuel spills . 3 : SIGNIFICANT AREAS AND LAND FEATURES The area is characterized by plains and low rolling topography with Six Mile Hill approx. 1.5 Km to the NW being the dominant local feature . Drainage lines head generally westward on either side of the low ridge where the lease is located . The weathered granite derived soils are of lower productivity than the marine sediment derived soils to the west and this is reflected in land use with remnant bushland dominating the former and pasture on the marine derived soils .

4 : AIR EMISSIONS Stockpiles will be located in the quarry floor and direct digging and loading may be an option . If trucks leaving the loading area produce an excessive amount of dust on the access track before reaching the Cape Portland Road a water cart should be used . The water cart should also be used if excessive amounts of dust are carried onto Cape Portland Road . Water for dust suppression will be sourced from farm dams on Rushy Lagoon . Initially the dam located approx. 250m to the northeast of the site will be used as a water source , see Diagram 3 page 6 . The source will vary with requirements for stock and the need for strategic supplies for fire suppression . Dust emissions will vary with the type of activity and ground moisture as well as wind strength , the prevailing winds from the NW will generally blow dust away from Cape Portland Road . Where the highly used sections of the quarry floor generate excessive dust watering may be needed . 5 : LIQUID EFFLUENT No liquid effluents other than stormwater .

6 : SOLID WASTE Minimal solid wastes will be generated , possibly grease cartridges and rags and these will be stored in drums prior to removal to an authorized disposal site at the end of each operational cycle or monthly and general rubbish such as plastic and metal will be separately stored and regularly removed to an authorized collection depot or transfer station . 7 : NOISE EMISSIONS Noise from the proposed operation will be generated by general machinery operation involved in removing topsoil and overburden as well as the loading and cartage operations . There are no close residents . The nearest houses are near the Rushy Lagoon homestead > 2.5 Km SW from the operation . The hours of operation will follow the Quarry Code of Practice acceptable standards and run from 0700 to 1900 on weekdays and 0800 to 1600 on Saturdays . If other arrangements for extended hours of operation are desired then approval will be sought from the Environmental Protection Authority and Dorset Council .

8 : TRANSPORT IMPACTS The shortest route to the Wind Farm Project is via Cape Portland Road which will be the main cartage route for all materials and machinery . If 20m3 truck and trailer combinations are used for cartage then the annual production volume of 75k m3 represents 3750 loads . As the construction period would be of the order of 26 weeks p.a. this is equivalent to 144 loads per week or 24 loads per day over a 6 day week with the same number of return trips. This gives a total of 48 20m3 capacity truck movements per day to and from the quarry . Inevitably there will be ebbs and flows in the construction process due to weather , vehicle access and site conditions so these traffic movements would be expected to vary from these averages . Cartage from this quarry is one of a number of traffic sources for the Musselroe Wind Farm project . There will be a considerable volume of traffic generated in moving the components for +/- 70 turbines to the site and movement of personnel and ancillary equipment . It will be necessary for the various parties to agree on a co-ordinated Traffic Management plan to facilitate safe and efficient cartage of these various products and personnel as well as integration with other road users along Cape Portland Road towards the wind farm site . A Traffic Study has been carried out by Mr Terry Eaton on behalf of Rushy Holdings P/L . There will need to be intersection improvements where the access track meets Cape Portland Road and this will be constructed to Dorset Council specifications and comply with safe intersection sight distance requirements . Discussions have been held between Council and Rushy Holdings Pty Ltd regarding additional requirements on Cape Portland Road and the Traffic Study will form part of the Planning Application to Dorset Council .. 9 : OTHER OFF-SITE IMPACTS There are no expected off-site impacts because of the distance to other properties and residences . 10 : DANGEROUS GOODS AND CHEMICALS Generally only daily quantities of fuel will be stored for on site plant , this is unlikely to exceed 200 litres per vehicle mounted fuel tank unit . An area will be set up in the quarry floor where vehicles carrying fuel tanks will be parked , this area will be located away from the lower edge of any current workings and consist of a depression that would localise any inadvertent spill . Trailer mounted fuel tanks will be located in bunded depressions located such that any inadvertent spill will not enter any waterway . All tanks and machinery will be maintained to minimise the likelihood of fuel leaks or spills . The general

principles and approach to fuel management will follow section F of the Forest Practices Code 2000 and p 94 of the Code is shown at Attachment 5 . A spill kit for each trailer mounted fuel tank unit will be located on site . When on site plant is serviced in the quarry floor oils will be collected in containers such that spill risk is minimised and grease will be contained in a box on service vehicles , typically of EL-3 lithium base . Should any spill occur clean up procedures will be applied at the earliest opportunity and if there is any leakage into a watercourse the contractor will report the incident to DPIWE as soon as practicable . Any oily wastes such as cartridges , filters or rags will be stored separately from general rubbish and removed regularly to a collection depot suitable for receiving such wastes . All contractors will be made aware of the requirements of items 6 and 9 of Part D of this report prior to commencing work at the site and these requirements will not alter or negate any of the requirements of the Forest Practices Plan ( Quarry ) applicable to this site .

11 : CONTAMINATION There are no indications of previous contaminations .

12 : CULTURAL HERITAGE

A detailed Aboriginal Archaeological ( Heritage ) Survey has been conducted over the proposed operational area by Mr Vernon Graham , Senior Aboriginal Heritage Officer of Palawa Heritage Services P/L and he has advised that no Aboriginal Heritage material was observed at the site . His report accompanies this document and included in his recommendations is the advice that " Before any action is taken upon these recommendations , clarification of the suitability of any and all recommendations should be sought from the office of Aboriginal Heritage Tasmania ." In summary no Aboriginal Heritage material was observed in the subject area however it was indicated that there was a possibility of objects or materials being present in subsoils . Because of the possibility of Aboriginal Archaeology ( Heritage ) values being present in subsoils care should be taken when stripping to monitor stripped material for any shells or shell fragments , human remains and rock fragments . The rock fragments would generally be different to the in-situ weathered granite and may be chert , cherty hornfels , quartz or quartzite . Any findings to be treated in accordance with Mr Grahams report recommendations and the requirements of the Aboriginal Relics Act 1975 .

13 ; SITES OF HIGH PUBLIC INTEREST

There is seasonal use of Cape Portland Road by tourist traffic travelling to coastal areas which is the dominant site of public interest and this light traffic will have to be incorporated into the overall Traffic Management Plan. It is likely that interest in the Wind Farm project itself will be sufficient to generate a significant volume of light traffic during and for a period after construction . 14 . REHABILITATION

The conditions of the mining lease require progressive rehabilitation of the site and a bond is lodged with MRT to guarantee rehabilitation . The rehabilitation objective is to return the worked areas of the lease to native vegetation by re-spreading overburden and topsoil and ensuring successful regrowth . Settling ponds may be used as future water storage once the silt collection function has been superseded by native vegetation re-growth . Each bay will be rehabilitated within 12 months , either on completion of work on that bay or no later than the end of that years seasonal operations on the lease . The option of rehabilitation time is to allow optimal timing for revegetation . Generally the earthworks aspect of rehabilitation is carried out in drier conditions and seeding and fertilizer application as close as possible to wetter conditions . Timing of rehabilitation will be guided by the measures suggested at point 7.7 p. 28 of the Quarry Code of Practice . There are currently some small areas of stockpiled gravel , this material will be pushed to the top ( NW ) side of the bays for subsequent use during rehabilitation . Stockpiled soils and overburden will not be placed on the retained 20m sections of natural ground but will be placed on the NW side of the works area . Soils on this type of geology can be very thin and difficult to discern from the A2 layer so stripped " soil " should run to a nominal depth of +/- 200mm to ensure inclusion of available seeds . Topsoil stockpiles should be generally less than 1m high to reduce scouring and not be compacted by machinery . Handling and movement of topsoil should be minimised . The orientation of the extraction bays with a batter face on the NW side is intended to assist with wind reduction across the bay floors in order to reduce stress on plants during the rehabilitation phase . Each bay would be rehabilitated on completion of works or at the end of seasonal operations . On-site topsoil containing local seed will be respread to facilitate the return of the site to natural vegetation . Revegetation will be assisted by following the procedures detailed in section E of the Forest Practices Plan ( Quarry ) covering clearing on this site . They may include seeding the rehabilitated areas with a mixture including E.viminalis , shrub and other tree species if natural regrowth fails or is inadequate . Seed is to preferably originate from Seed Zone 7 . Seed

is available from the Forestry Tasmania Seed Centre , 15960 Midlands Hwy., Perth . A suitable seed mix for this site would be available from the Seed Centre . In order to minimise sediment leaving the quarry bays runoff will be directed into settling ponds before being dispersed into vegetation on the southeastern side of the ridge . The outlets are to be rock armoured and because of the gravelly nature of the soil an apron of rock is to be constructed below the outlet to prevent soil scouring . The site will be monitored for weed emergence during the rehabilitation process and any weed treatment will follow guidelines and prescriptions contained in the DPIW - Weeds , Pests and Diseases information site . Any metal or other material relating to the quarry operation will be removed prior to final rehabilitation works .

PART D - MANAGEMENT COMMITMENTS

The management commitments generated by this EER are :-

1. During the course of operations and periodic rehabilitation works the recommendations detailed in the Aboriginal Archaeological ( Heritage ) Survey will be complied with , in particular the requirement to contact the Aboriginal Heritage Officer / Consultant who will liase with Aboriginal Heritage Tasmania if artefacts or relics of the type described in the recommendations are located . If items relating to European heritage are located the property manager should be consulted regarding the items and future works .

2. The area where the Juniper Wattle plants have been marked will be

delineated with a high visibility bunting line on steel posts and machinery will be excluded from that area and contractors will be advised of the exclusion .

3. Residents living in the vicinity of the Rushy Lagoon homestead will be

advised of the nature of operations and working hours prior to commencement .

4. Operations will comply with the Quarry Code of Practice 1999 . 5. Site drainage will be directed into settling ponds . 6. Solid wastes will be removed to an approved disposal site.

7. There will be regular communication with the Dorset Council concerning operations and overall progress of development .

8. Site rehabilitation and operation will be in accordance with the provisions

of Mining Lease 1867 P/M. 9. Plant will be maintained so that the risk of leaks is minimised .

10 .Co-operation with other transport groups to generate and implement an effective traffic management plan .

11. Plant and machinery will be treated in accordance with the Tasmanian a. Washdown Guidelines for Weed and Disease Control – April 2004

and b. a delegate of Rushy Holdings Pty Ltd will confirm compliance .

PART E - PUBLIC CONSULTATION

There has been consultation with the Dorset Council regarding the use of Cape Portland Road and a number of recommendations have been discussed to date including the construction of a series of passing bays on Cape Portland Road . There have been discussions with Hydro Tasmania from the earliest stages of the project and regular meetings continue . Hydro Tasmania have given permission to use data contained in the Musselroe Wind Farm reports in the compilation of this report and that permission is appreciated . PART F - FIRE PLAN The intention of Rushy Holdings Pty Ltd is to prevent any fire from spreading from the quarry into the adjacent native vegetation and to have an immediate action suppression plan in place . In order to achieve these objectives the following procedures will be observed . Tasmania Fire Service fire permit conditions will be complied with . Each item of plant operating in the quarry will have a dry powder extinguisher of at least 1.5 kg capacity . There will be a knapsack pump of at least 9 litres capacity or one charged air-water extinguisher on site during operations . During high fire danger periods a 200 litre drum of water will be maintained on site .
