Commercial solarenergy production systems shall be al-lowed with special permit approval in theIndustrial C (IC) Zoning Use District.

    108-209 Use regulations.Commercial Solar Energy Production

    System shall be permitted as a permitteduse or as allowed with special permit ap-proval as provided in section 108-208. Inaddition to the requirements set forth inthis Chapter, all such permitted and spe-cial permit uses shall be subject to thefollowing criteria and subject to site planapproval by the Planning Board:

    (a) The commercial solar energy sys-

    tem shall be on a parcel of not lessthanfive (5) acres.

    (b) All ground-mounted panels shallnot exceed the height of eight (8) feet.

    (c) All mechanical equipment ofcommercial solar energy system, includ-ing any structure for batteries or stor-age cells, are completely enclosed by aminimum eight (8) foot high fence witha self-locking gate.

    (d) Notwithstanding any requirementin Sections 108-49, 108-136, 108-275 and108-279 of this Chapter, the total surfacearea of all ground-mounted and free-standing solar collectors,including solarphotovoltaic cells, panels, and arrays,shall not exceed 80% of the total parcelarea.

    (e) The installation of a vegetatedperimeter buffer to provide year roundscreening of the system from adjacentproperties.

    (f) All solar energy production sys-tems are designed and located in orderto prevent reflective glare toward anyhabitable buildings as well as streets andrights-of-way.

    (g) All on-site utility and transmissionlines are, to the extent feasible, placed

    underground.(h)The installation of a clearly visiblewarning sign concerning voltage must beplaced at the base of all pad-mountedtransformers and substations.

    (i) The system is designed and situ-ated to be compatible with the existin-guses on adjacent and nearby properties.

    (j) In approving a special exception,the Planning Board may waive ormodifyany of the above criteria if it finds thatthere is no detriment to public health,safety and welfare.

    (k) Any special permit approval grant-ed under this article shall have a term oftwenty years, commencing from the grantof the special permit, which may be ex-tended for additional five-year termsupon application to the Town Board.

    (1) Decommissioning/Removal:(i)Any commercial solar energy pro-

    duction system that is notoperated fora continuous period of 24 months shallbe deemedabandoned. At that time, the

    owner of the commercial solar energyproduction system or the owner of theproperty where the commercial solarenergy production system is locatedshall remove all components thereofwithin 90 days of such deemed abandon-ment or will be in violation of this sec-tion. In the case of a commercial solarenergy production system on preexist-ing structures, this provision shall applyto the commercial solar energy produc-tion system only. If the commercial so-lar energy production system is not re-moved within said 90 days, the BuildingInspectors may give the owner noticethat unless the removal is accomplishedwithin 30 days, the Town will causethe removal at the owners expense.All costs and expenses incurred by theTown in connection with any proceed-ing or any work done for the removal ofa commercial solar energy productionsystem shall be assessed against the landon which such commercial solar en-

    ergy production system is located, anda statement of such expenses shall bepresented to the owner of the property,or if the owner cannot be ascertained

    or located, then such statement shallbe posted in a conspicuous place on thepremises. Such assessment shall be andconstitute a lien upon such land. If theowner of the system and the owner ofthe property upon which the system islocated shall fail to pay such expenseswithin 10 days after the statement is pre-sented or posted, a legal action may bebrought to collect such assessment or toforeclose such lien. As an alternative tothe maintenance of any such action, theBuilding Inspector may file a certificateof the actual expenses incurred as afore-saidtogether with a statement identi-fying the property in connection withwhich the expenses were incurred andthe owner of the system and the ownerof the property upon which the systemis located, with the Assessors, who shall,in the preparation of the next assess-ment roll, assess such amount upon suchproperty. Such amount shall be includedin the levy against such property, shallconstitute a lien and shall be collected

    and enforced in the same manner, by thesame proceedings, at the same time andunder the same penalties as are provid-ed by law for the collection and enforce-ment of real property taxes in the Townof Riverhead.

    (ii) This section is enacted pursuant toSection 10 of the Municipal Home RuleLaw to promote the public health, safetyand general welfare of Town citizensthrough removal provisions to ensure theproper decommissioning of commercialsolar energy production systems withinthe entire Town. The removal reductionprovision of this chapter shall supersedeany inconsistent portions of the TownLaw Section 64(5-3) and govern the sub-ject of removal of commercial solar en-ergy production systems in this chapter.

    108-210 Decommissioning Plan, Feeschedule for commercial solar energysite plan applications.

    A. All applications for a commercialsolar energy system shall be accompa-

    nied by a Decommissioning Plan to beimplemented upon abandonment and/orin conjunction with removal of the com-mercial solar energy system. Before be-ginning any decommissioning activities,the applicant must submit a performancebond in a form and amount satisfactoryto the Town Attorney, which shall bebased upon an estimate approved by theTowns Consulting Engineer or TownEngineer, assuring the availability of ad-equate funds to restore the site to a use-ful, non-hazardous condition in accor-dance with the Decommissioning Plan.Prior to removal of commercial solar en-ergy system, a permit for removal activi-ties shall be obtained from the buildingdepartment. The Decommissioning Planshall include the following provisions:

    (1) Restoration of the surface gradeand soil after removal of abovegroundstructures and equipment.

    (2) Restoration of soil areas with na-tive seed mixes, and/or plant species suit-

    able to the area, which shall not includeany invasive species.

    (3) Retention of access roads, fences,gates or buildings or buffer plantings, as

    required at the discretion of the Town.(4) Restoration of the site for agri-

    cultural crops or forest resource land, asapplicable.

    (5) The disposal of all solid and haz-ardous waste shall be in accordance withall local, state, and federal waste disposalregulations.

    (6) An applicant of a commercial so-lar energy system comprising more thanten (10) acres shall provide a form ofsurety, either through escrow account,bond or otherwise, to cover the cost ofremoval in the event the Town mustremove the installation and remediatethe landscape, in the amount and formdeemed to be reasonable by the Town-

    ship Engineer. Such surety will not be re-quired for Municipal or State owned fa-cilities. The applicant of the facility shallsubmit a fully inclusive estimate of thecost associated with removal, preparedby a Professional Engineer.

    B. Notwithstanding Article XXVIof this Chapter, the fee for new siteplan applications for commercialsolar energy production systems shallbe a flat fee of $3,000.00 and the fee foran amendment to a site plan applicationfor commercial solar energy productionsystems shall be $2,000.00.

    SEVERABILITYIf any clause, sentence, paragraph,

    section, or part of this Local Law shallbe adjudged by any court of competentjurisdiction to be invalid, the judgmentshall not affect the validity of this law asa whole or any part thereof other thanthe part so decided to be unconstitution-al or invalid.

    EFFECTIVE DATE

    This Local Law shall take effect im-mediately upon filing with the Secretaryof State as provided by law.Dated: September 16, 2014
