IV. Chair's Report - Lucia Tam

Lucia Tam requested that all attendees write their email addresses legibly on the attendance sheet or provide their business cards, so that they can be notified of future TBAC events.

Requested that Metro legal department respond to her inquiries regarding the Brown Act. Metro gave the following responses:

Posting for TBAC general meetings must be made 72 hours in advance in a place accessible to the public. Posting on the internet is not considered adequate. If a committee meeting is planned in which three or more Board Members will be present, the meeting shall be posted in the same manner as a general meeting. If the meeting is called by Metro and not by TBAC, it may still be subject to posting requirements. This includes meetings between the Board and Director Katz. During any such meeting discussion and public comment can be limited to one or two minutes as a means of maintaining order. Minutes shall be taken at such meetings and posted.

Certification: Ms. Tam also inquired on behalf of SBE firms regarding speed of certification. Tashai Smith responded that Metro has a policy of expediting certification for fmns that are bidding on current projects. If firms request expedited certification in writing, and identify on their application what project they are pursuing, Metro will try to certify within 30 days. However, the process will be delayed if the application is incomplete. In 2010 Metro completed 58 expedited certifications; in January 2011 they completed nine. Ms. Smith commented that Metro's staff is stretched to process applications, and in order to meet anticipated demand for expedited certifications, Metro may bring in outside assistance. Ms. Smith invited anyone with questions regarding their application to contact Metro Certification Officer Shirley Wong at 213-922-5419 ([email protected]).

Ms. Tam announced that Elias Cortez had tendered his resignation as TBAC Treasurer and entertained a motion to accept Mr. Cortez's resignation.

Ms. Tam invited inquiries from anyone interested in the position of TBAC Treasurer. The position can be filled by appointment.

V. TBAC Speaker (introduction by Carlos Morgner)

Gordon Head, Hatch Mott MacDonald: Report on Crenshaw/LAX Transit Corridor project. The Crenshaw Corridor is an 8.5 mile, $1.5 billion LRT extension which will interconnect the Green Line and Expo Line. The line includes six planned and two optional stations, including

aerial, at-grade and underground stations. Regarding schedule, Parsons Brinckerhoff is currently completing Environmental Documents and the HMM team is proceeding with Preliminary Engineering. Record of Decision is expected around September 2011. Design-build solicitation can be expected as early as January 2012, however it has not yet been determined whether the project will be released as a single or as multiple contracts. Activation and startup is projected for 2017. Total DBE participation on the HMM team is currently 25.5%. Mr. Head can be contacted at 310-954-1829 or via email [email protected]. VI. Committee Report: 30/10 Subcommittee, - Larissa Ordaz

Ms. Ordaz stated that she will be distributing the structure, goals and format of the committee to interested parties.

VU. METRO Contracting Opportunities - Tashai Smith

Presented contract look-aheads and current solicitations. Drew attention to Contract Look-Ahead Item 2, the Contract Information Management System, which is an ITS contract with a 20% SBE goal. Also highlighted the Environmental Waste-Handling Construction Services solicitation, which has a 40% DALP goal.

VID. Committee reports:

Legislative Affairs - Ali Altaha

Disparity Study: Mr. Altaha asked if the Committee could be given the raw data that BBC used to reach their conclusions. Tashai Smith asked if Mr. Altaha could be more specific in his request. Mr. Altaha said he would discuss with Ms. Smith after the meeting.

PLA's: Mr. Altaha stated that PLA's have an adverse effect on small businesses and called for exclusion for SBE and DBE companies.

Brown Act: Mr. Altaha requested guidance from Metro regarding application of the Brown Act, however Lucia Tam stated that this was discussed earlier in the meeting and offered to review it with Mr. Altaha after the meeting.

405 Freeway Widening Project: Mr. Altaha stated that he has received complaints from members of his organization regarding the practice by firms associated with the 405 Freeway widening project of hiring key personnel employed by SBE companies instead of contracting with the SBE's themselves. Ken Wong stated in response that he has discussed the matter with K.N. Murthy of Metro, who is investigating the matter. Mr. Altaha urged quick action.

Commodities - Ezekiel Patten Mr. Patten is continuing to work on the P-Card issue with Bruce Feerer, Prompt Pay, and changes in Metro purchasing policies.

Construction Management RFP's are being prepared for 710 Center and Northern Section projects. Bench RFP's have also been issued for hydraulic studies and QA for the 710 work. In addition, there are several upcoming highway studies planned for the South Bay and Caltrans CM Assistance contracts for the San Fernando Valley. Soundwall work is delayed until April.

Construction - Ken Wong Met with K.N. Mmthy on Monday 2/28 to discuss upcoming projects. IFB for Division 13 Bus Maintenance Facility expected late March, will be followed by DesignlBuild solicitation for Patsouras Plaza and connection to the El Monte busway. Discussed Metro's plans for newly­acquired Union Station: Catellus will continue to operate the station for a year while Metro evaluates its needs and vision for the facility, including additions associated with High-Speed Rail. Some design and/or planning solicitations for the facility can be expected in 2012. Discussed TBAC concern over allegations that the Prime Contractor on the 1-405 widening project has hired key staff members from several SBE fmns rather than contracting with the SBE's. Mr. Murthy has contacted the contractor in question and is expecting a response.

American Indian Chamber of Commerce (bylaws, questionnaire, name of alternate) BBA and Comto (additional alternates) WCOE (bylaws, minutes, questionnaire)

The Filipino-American Society of Architects and Engineers has completed its membership application, which is now being reviewed by Metro.

Bylaws - Lucia Tam Ken and Lucia will be reviewing policies and bylaws in the near future.

SBU Training for Shared Responsibility Program - Tashai Smith gave a report on progress made in training SBU Leaders and Project Managers in the implementation of the Program.

Metro to report on SBEIDBE hiring practices of Primes: Michelle Caldwell recommended that in lieu of a report from Metro, it would be more effective for TBAC to invite more Primes to present their outreach/diversity programs before the whole Council.

Action Items report printed is not the one submitted by TBAC. Linda Wright will look into the matter.

IX. New Business

Michelle Caldwell encouraged members to visit the MT A website for March Board items, which will include increased SBEIDBE goals and SBE program revisions. Also DEOD will request funding from the Metro Board to outsource SBEIDBE Certifications in light of the increased demand.

x. Public Comments

Jackie Nutting stated that Metro has not responded to ABC's request for MetroffBAC documents related to ABC's application for membership in TBAC and has turned the matter over to legal counsel. Linda Wright replied that a document package has been prepared by DEOD and is currently being reviewed by the Metro legal department.

Lucia Tam announced that the Exposition Light Rail Board will be meeting at 2:30 pm on March 18 to approve its Project Labor Agreement, and encouraged all interested parties to attend.

CACP will hold its general meeting on March 17 at Mission 261, on the subject of Small Business Certification.

Robert Guzman announced that the Caltrans SBC will be meeting on March 17-18 at District 7 Headquarters in Los Angeles, and that SHPE will be hosting Congresswoman Judy Chu at a lunch meeting on March 18 at La Costa restaurant in Montebello.

Scope

The program consists of the work necessary to identify all potential cross connection structures on the Ireated-water distribution system, perform preliminary design for each of the structures and propose relocation/modification configurations to prevent potential cross connection, make CEQA determination, select at-risk structures, prepare final design docwnents for the at-risk structures, and complete construction as required by the regulations of the State of California Department of Public Health. There is one project now open under this appropriation. It involves fmal design, permit acquisition services, and modification/relocation of302 at-risk air-vacuwn relief valves from subsurface manholes/vaults to above ground locations.

Purpose

To eliminate potential cross connection and prevent possible contamination of the drinking water supplies along distribution system.

Accomplishments Through FY 2007/08

Identified 1440 structures with potential cross connection, completed preliminary design and CEQA determination, and selected 302 at-risk structures for final design. Completed modification of 160 highest priority sites. Advertised bid packages nos. 1,2, & 3 covering 74 structures. The first three construction package was awarded in November 2006. Design drawings for remaining packages are scheduled for completion by June 2008.

Objectives For FY 2008/09

Complete relocation/modification of 74 structures from subsurface manholes/vaults to above ground locations. Advertise bid packages nos. 4, 5, & 6 covering 86 structures. Request Board authorization and funding to award three construction contracts. Begin relocation/modification of 86 structures.

In September 1990, the Board approved Appropriation No. 15171 to finance projects included in this program. Completed relocation/modification of221 structures from subsurface manholes/vaults to above ground locations. Completed design drawings for remaining packages 9, 11, and 12 in December 2010. Advertised and awarded bid packages Nos. 9, 11, and 12 covering the remaining 79 structures.

Complete relocation/modification of79 structures from subsurface manholes/vaults to above ground locations, packages 9, 11, and 12. This completes the program.
