On 11 /11 /08 at approximately 2106 hours, I, Officer Lee 1. Hakes along with Officer Thomas Wahl ofthe Chippewa Falls Police Department responded to 620 W. Willow St. in the city of Chippewa Falls for a9-1-1 call. Dispatch advised the male caller stated he was being "choked" and then disconnected.

Upon our arrival when knocking on the door a male subject came to the door and opened the door ..asked if we could come in and the male subject stated we could, The male subject who opened the door was- .known to me as Thomas F. Erbs, MJW ;DOB : 10 /01 /89. I asked Erbs ifhe had called 9-1-1 and he stated hcdid. Erbs then pointed to his neck and stated his mother had choked him. I looked at Erbs' neck with myflashlight and his entire neck was red. I did not observe any other injuries to Erbs and I was unsure ifhis neckwas red from being grabbed or from being agitated. Also present was Erbs' stepfather Dale R. Berg, M1W,DOB: 01113/60.

I asked Erbs where his mother was and Erbs stated she was upstairs. Erbs stated he would go and gether. A short time later a female who was verbally identified as M a r y E. Berg, FIW, DOB: 04/01 /56, camedownstairs. I asked Mary what had happened. Mary stated she and Thomas were in the basement of theresidence and they started to argue over rent Thomas owed for the last two months. I asked Mary if it hadgotten physical and she stated it did not. I also asked Dale Berg ifhe had seen anything and he stated he wasupstairs and could only hear the argument.

I asked Thomas to tell me his side of the story. Thomas stated he and his mother had gotten into anargument and at some point his mother "choked" and "slapped me." Thomas stated this was abuse and hewanted to press charges. I advised Thomas there was not enough evidence to arrest anyone at this point.Thomas stated he no longer wanted to talk to me and was going to leave for the night. Thomas called hisfather and got a ride from the residence.

I returned to the Police Department and listened to the 9-1-1 call from Erbs. At the start of the call youcould hear a male and female's voice. The female believed to be Mary Berg stated "Don't you ever spit on meagain." You then could hear Thomas Erbs saying something about being choked. Based on the lack of. e~ It/NYReporting Officer Date
