Flagler Drive, Suite 310E West Palm Beach, Florida 33401 NEIGHBORHOOD COVENANTS FOR CATALINA ON THE GREEN VILLAGE THIS DECLARATION is made this day of , 19 , by K. HOVNANIAN AT WINSTON TRAILS, INC., a Florida corporation, which de- clares hereby that "The Properties" described in Article II of this Declaration are and shall be held, transferred, sold, conveyed and occupied subject to the covenants, restrictions, easements, charges and liens hereinafter set forth. ARTICLE I DEFINITIONS The following words when used in this Declaration (unless the context shall prohibit) shall have the following meanings: (a) "Association" shall mean and refer to CATALINA ON THE GREEN VILLAGE HOMEOWNERS ASSOCIATION, INC., a Florida corporation not for profit, being a "Neighborhood Association" under the Foundation Covenants (as hereinafter defined). (b) "Common Areas" shall mean and refer to the pro- perty legally described in Exhibit "A" attached hereto and made a part hereof, plus all property designated as Common Areas in any future recorded supplemental declaration; toge- ther with the landscaping and any improvements thereon, in- cluding, without limitation, all structures, gatehouses and appurtenant equipment, recreational facilities, open space, walkways, sprinkler systems and street lights, if any, but excluding any public utility installations thereon and any other property of Developer not intended to be made Common Areas; provided, however, that certain portions of the Properties (including, without limitation, applicable private roads) shall not be deemed Common Areas to the extent such portions are operated by the Foundation. (c) "Declarant" shall mean and refer to the party holding the status of such under the Foundation Covenants, as defined below. (d) "Developer" shall mean and refer to K. HOVNANIAN AT WINSTON TRAILS, INC., a Florida corporation, its successors and such of its assigns as to which the rights of Developer hereunder are specifically assigned. Developer may assign all or a portion of its rights hereunder, or all or a portion of such rights in connection with appropriate portions of The Properties. In the event of such a partial assignment, the assignee shall not be deemed the Developer, but may exercise such rights of Developer specifically assigned to it. Any such assignment may be made on a non-exclusive basis. (e) "Foundation" shall mean and refer to Winston Trails Foundation, Inc., a Florida corporation not for profit, having responsibility for certain community-wide aspects of W\«lU»M.\24>;i.lV»/17/93

THIS DECLARATION is made this day of , 19 , by K.HOVNANIAN AT WINSTON TRAILS, INC., a Florida corporation, which de-clares hereby that "The Properties" described in Article II of thisDeclaration are and shall be held, transferred, sold, conveyed andoccupied subject to the covenants, restrictions, easements, chargesand liens hereinafter set forth.

ARTICLE I

DEFINITIONS

The following words when used in this Declaration (unless thecontext shall prohibit) shall have the following meanings:

(a) "Association" shall mean and refer to CATALINA ONTHE GREEN VILLAGE HOMEOWNERS ASSOCIATION, INC., a Floridacorporation not for profit, being a "Neighborhood Association"under the Foundation Covenants (as hereinafter defined).

(b) "Common Areas" shall mean and refer to the pro-perty legally described in Exhibit "A" attached hereto andmade a part hereof, plus all property designated as CommonAreas in any future recorded supplemental declaration; toge-ther with the landscaping and any improvements thereon, in-cluding, without limitation, all structures, gatehouses andappurtenant equipment, recreational facilities, open space,walkways, sprinkler systems and street lights, if any, butexcluding any public utility installations thereon and anyother property of Developer not intended to be made CommonAreas; provided, however, that certain portions of theProperties (including, without limitation, applicable privateroads) shall not be deemed Common Areas to the extent suchportions are operated by the Foundation.

(c) "Declarant" shall mean and refer to the partyholding the status of such under the Foundation Covenants, asdefined below.

(d) "Developer" shall mean and refer to K. HOVNANIANAT WINSTON TRAILS, INC., a Florida corporation, its successorsand such of its assigns as to which the rights of Developerhereunder are specifically assigned. Developer may assign allor a portion of its rights hereunder, or all or a portion ofsuch rights in connection with appropriate portions of TheProperties. In the event of such a partial assignment, theassignee shall not be deemed the Developer, but may exercisesuch rights of Developer specifically assigned to it. Anysuch assignment may be made on a non-exclusive basis.

(e) "Foundation" shall mean and refer to WinstonTrails Foundation, Inc., a Florida corporation not for profit,having responsibility for certain community-wide aspects of
