TI:03: Guidance Software - A Tech-nological Solution for Implementinga Cost-Effective, Defensible EvidencePreservation & Collection Plan Speaker: Victor Limongelli

The explosion of information technology over the pasttwo decades has vastly increased the volume of informa-tion created and stored by the typical company. Recentcourt decisions, as well as many local rules, emphasizethat counsel must understand how their client's informa-tion is stored and how it can be retrieved. This sessionwill address how to use currently available technology toaddress the problems posed by electronic data.Automating the search for information allows the sophis-ticated litigant to identify and preserve potentially rele-vant computers/data based on key search criteria (forexample, key words, date/time, file types, etc.). Usingtechnology to preserve potentially relevant information mayallow document destruction systems to then continue tooperate, thus minimizing the impact on company opera-tions. In addition, automating the search for informationcan minimize the impact of employee noncompliancewith the litigation hold. As Judge Schiendlin has noted inZubulake, “(if it is not feasible to speak with every keyplayer) counsel must be more creative. It may be possibleto run a system-wide keyword search; counsel could thenpreserve a copy of each ‘hit.’ Although this sounds burden-some, it need not be.” Finally, by conducting the searchfor potentially relevant information on the client's computernetwork, the volume of data loaded into a documentreview and production platform can be vastly reduced, thereby minimizing the cost of electronic discovery.
