To be promoted to Senior Executive, you must have a minimum of 10 personalcustomers and a minimum total of 50 customers in your group.

As a Senior Executive, your group CVC increases from a maximum of 0.6% to amaximum of 0.7% on all your group customers.

Network or Multi-Level-Marketing - what is it?

This independent report was producedby The Trading Standards Department,Nottinghamshire County Council, TrentBridge House Fox Road, West BridgfordNottingham, NG2 6BJ

Often the subject of enquiries and com-plaintsby members of the public to trading standardsdepartments, Multi-Level Marketing (MLM) hasfor too long been shrouded in mystery andmisunderstanding. In this article I attempt to giveyou the facts about this successful, legal andincreasingly popular method of doing business,for your interest and for the benefit of personsseeking advice from our service.

What is it?Also known as Network Marketing, MLM is arapidly expanding method of selling goods andservices which is now firmly established in mostcountries of the free world. It is big business,probably offering the opportunity for wealth tomore people than any other form of business.Worldwide sales through MLM are over£7,000,000 annually. 20% of the 500,000plus millionaires in the USA made their fortunein the last ten years through MLM, and theconcept is being taught at Harvard BusinessSchool in the USA. The basic principle of MLMwhich makes it different to conventionalbusinesses is that, instead of a manufacturerconstructing a large administrative and salesorganisation comprised of employees, selfemployed distributors are encouraged to build asales organisation of persons like themselves bytheir own efforts. Financial rewards are paidbased upon total sales of all distributors withinthe organisation developed by any particulardistributor. In such a way distributors are paidin proportion to their efforts in selling andsponsoring others (recruiting).

The types of goods and services availablethrough MLM cover virtually every area ofconsumer spending: household necessities;slimming products; perfumes; cosmetics; books;food; property development; fitness equipment;financial services etc.

The attractions of MLM include: 1) theavailability of a very high income from part-timework; 2) the lack of any significant financial orother risks; 3) for the companies; a highlymotivated sales force. Stockholding isunnecessary and products are obtained inresponse to retail orders.

We are not talking about “get-rich-quick”schemes here, although exceptional people maybe able to do so. The vast amount of companyprofits which would normally be spent onemployees, marketing and advertising inconventional businesses, are available instead topass on to distributors in commission andbonuses. The high income’s possible are due to“residual” income, i.e. income based uponprevious efforts. Insurance agents, writers, actorsmusicians earn residual income, provided thepolicies continue, the books & records still selland so on. So in MLM, as long as the productssell regularly and your organisation grows, thenyour residual income increases due to your past

efforts in sponsoring. “Linear” income, i.e. amonth's work, is always limited to certain levels,whereas residual income is in theory unlimited.However, it must be remembered that MLM islike any other business in as much as highrewards are solely the product of hard work.Safeguards are built in to the more reputableschemes to ensure that there are no short cuts tosuccess and that the cornerstone of the businessconsists of retail sales to the public. Someschemes require regular purchases by distributorsfor their own use, thereby increasing thebusiness volume and therefore profit of eachdistributor’s group. The most stable andsuccessful companies’ schemes are firmly basedon repeat purchasing of quality products bysatisfied customers.

Complaints & Enquiries Most justifiable complaints relating to MLM arecaused by the overenthusiastic and occasionallydeceptive activities of distributors who areexcited at the potential of their business.Problems are usually related to: a) exaggeratedclaims about the products, b) misleadinginvitations to meetings where the businessopportunity is to be presented, c) reluctance tohonour money back guarantees given by thecompanies, d) misleading information given atbusiness presentations and e) misleadingadvertising for product sales or recruits.

Invariably, contact with the relevant promotingcompany will result in swift action against theproblem distributor, who would certainly beflouting the company's rules of conduct in mostcases. Of course there is always the possibilitythat the distributor and/or the company havecommitted offences.

Common questions about MLM are: Isn't it pyramid selling? The Oxford EnglishDictionary defines the term as “... a form offinancial trickery...” Although the term is oftenused to describe MLM, it is more appropriate toreserve its use for the highly undesirable andnow illegal schemes which surfaced in the early1970’s where participants were required to paylarge sums to enter schemes and wereencouraged to purchase large consignments ofgoods - the larger the quantity the bigger thediscount - before ensuring that they had thecustomers and the additional participants tosupply them to. Naturally, many people were leftconsiderably out of pocket with vast stocks ofunsold product.

“Won't it saturate?” The Department of Tradeand Industry in an advisory leaflet describeshow, within six months there could be67,000,000 distributors in any one scheme.This is fine in theory, but a dubious statementwhen some facts are considered: a) the largestMLM company in the world has steadily beenexpanding for 30 years and its UK distributorsnumber less than 1 in a 1,000 of the population;b) the UK birth rate is many times higher thanthe rate of increase in numbers of distributors inany major MLM scheme; c) saturation of anyparticular area is unlikely due to the facility ofbeing able to sponsor persons living anywherein the UK (or internationally in some cases)

without undue difficulty and d) it has never yethappened. “Is it better to get in at the start?”Again the DTI says yes but I am not sure that thisis correct. Following on from the argumentsabove, there will always be a certain proportionof the population which want to participate inany particular scheme and because of thedynamics of populations I suggest that it is nomore difficult to find prospective distributors orcustomers at a later stage of a scheme than it isat the start. It is also true that some of the mostsuccessful distributors started their businessesvery recently in terms of the age of thecompanies concerned. It is possible that aprospective distributor may be better off dealingwith an established, stable and financially soundcompany than a brand new one.

Legislation Apart from legislation covering many aspects ofspecific products, Part XI of the Fair Trading Act1973 and regulations thereunder govern certainaspects of the operations of MLM schemes.

Most of the larger companies schemes comewithin the scope of section 118 of the 1973 Actand are therefore obliged to operate within therules set down in the Pyramid Selling SchemesRegulations 1973 and in Section 120 of the Act.These requirements are directed principally toproviding full details of the schemes and therights of participants to any prospectivedistributor and to the avoidance of theundesirable aspects of “pyramid selling”, e.g.payments or rewards based upon matters otherthan completed retail sales.

A review of the current legislation by the DTIhas been proceeding for a number of years. Thismay result, among other matters, in restrictionsupon schemes where sales to distributors aregiven more prominence than sales to the public.

Finally, what advice can be given to aprospective distributor who wants to knowwhether to join an MLM scheme? I suggest thefollowing:

Look at some of the numerous other MLMcompanies besides the one that you are arebeing asked to join. Compare the quality, rangeand price of the products and the differentmarketing plans of each company. Then askyourself these questions: (1) Would you buy the products yourself? The power of duplication

One of the best illustrations to show how ourbusiness works is the “Penny a Day” chart.Actually, almost everything that’s worthwhile takestime, so this chart is certainly not limited to ourbusiness.

If you will take a minute to study the chart, somevery interesting things become apparent. Let ustake a look. The presumption is that we're goingto double a penny every day for thirty days.

If you accept the penny as your sole source ofincome, you might be a little nervous as youapproach the middle of the month. Day fifteenrewards you with only £163.84p. This is literallywhen most Networkers start looking around forgreener pastures.

But look what happens the next day. Day sixteenbrings you as much as the first fifteen combined!

Also, another point for the network dropout, whonow moves on to start this whole process overagain in a new programme, is to relate this 30day table to your first year in network marketing.Applying the proof on our chart, their first sixmonths may only bring in £327 but the secondsix months would be worth £10,000,000!!

The problem with most Networkers isthat they actually quit before pay-day!

Suppose your first commission cheque innetworking was only 1p..., how long would youstick it out? Well, keeping our penny chart inmind, imagine if your first cheque was just £10,how long would you stick it out?

I'll save you the trouble of doing the maths. Bydoubling your first £10, your sixth cheque wouldbe £320. You may be thinking, “Big Deal!” butthis is proven to be a benchmark that eliminatesdropouts!! Also, by giving up now, you wouldmiss out on your twelfth cheque for £20,480,bringing your first year's total to £40,950.

So I'll ask you again, what if your first chequewas £10? How long would you stick it out?

When a struggling Networker whines, “I put in allof this effort and all I made was a lousy £25, it isobvious that a) they probably don't have a systemand b) they don't understand the most basicconcept of network marketing THECOMPOUNDING OF NUMBERS.
