Judiciary in turmoilIt is a development that is both momentous andunfortunate. The press conference held by foursenior judges of the Supreme Court has exposedan unprecedented level of dissension in the topechelons of the judiciary. It is regrettable thatthe banner of revolt has been raised in such apublic way against the Chief Justice of India,Dipak Misra. Regardless of who is right in thecurrent dispute over the administrativefunctioning of the CJI, the reverberations ofwhat took place on Friday will not easily subsideand will be felt for a long time to come. Therewas ample evidence over the last few monthsthat the highest court was in a state of ferment;the question is whether it could have beenhandled internally rather than be dragged intothe open like this. Although Justices J.Chelameswar, Ranjan Gogoi, Madan B. Lokurand Kurian Joseph — the seniormost judgesafter the CJI — did not reveal too many details,it is clear that their grievances are rooted intheir perception that Justice Misra is misusinghis administrative powers to assign cases“selectively”, disregarding conventions onallocation of judicial work. They have added forgood measure that cases with far-reachingconsequences for the nation and the institutionare being assigned to junior judges and Benches“of their preferences”, a suggestion that is beingread by some as an ominous reference to anunknown external hand. It ought to beunderscored here that the Chief Justice isindeed the master of the roster; even the fourjudges concede that this is a well-settled law,one that is reflected in a Constitution Benchjudgment in 1998. While accepting the rule thatthe Chief Justice alone can decide thecomposition of Benches and allot judicial work,they allege that Justice Misra is departing so farfrom set conventions that it would have“unpleasant and undesirable consequences”,ultimately casting a doubt on the integrity of theinstitution itself. Logically, this is an internalmatter of the judiciary, one that is best settledthrough deliberations in a full court meeting ofall the Supreme Court judges themselves.

The letter written by the four judges to the ChiefJustice, which became available to the media,

and the manner in which the press conferenceplayed out, suggest that the grievances go muchdeeper than what was written or said. The germthat led to the outbreak of the current conflictcould be the controversial Prasad EducationTrust case, in which the petitioners alleged thatsome individuals were plotting to influence theSupreme Court. In an unusual order, a DivisionBench headed by Justice Chelameswar wentahead to delineate the composition of the Benchto hear the case, in which charges of judicialcorruption were made, coupled with hints thatthere would be a conflict of interest if JusticeMisra were to hear it. Eventually, a five-judgeBench headed by Justice Misra overturned theorder and asserted that the CJI was indeed themaster of the roster and that he alone couldassign cases and decide on the composition ofbenches. While there is no questioning who hasthe power to determine the roster, what the fourjudges are essentially questioning is how thispower has been exercised. Judicial work isprimarily allocated based on a roster, andindividual cases are allotted to Benches basedon the category under which they fall. Once theroster is fixed, the CJI should ordinarily see thatit is duly followed. Exceptions must be rare, andthat too only for compelling reasons. While it isnot clear in how many cases such exceptionswere made, the four judges seem to have had anissue over the petition that sought an inquiryinto the death of special CBI judge B.H. Loya in2014 being posted before a particular Bench.The deceased judge was hearing theSohrabuddin ‘fake encounter’ case, inwhich BJP president Amit Shah was an accusedbut later discharged. Given the politicalsensitivity of the matter, the concern expressedover this case is something that must besquarely addressed in a way that dispels anymisgivings.

As for the government of the day, it must staysteadfastly away from the internal conflict in thejudiciary — something that it has professed itwill do. Rather than be inexplicably silent, itmust disclose its position on the Memorandumof Procedure for judicial appointments andcommunicate this clearly to the SupremeCourt. One of the specific issues raised in theletter written by the four judges relates to this

issue. They have suggested that since the Centrehad not responded to the MoP, effectively it wasdeemed to have been accepted. Given this, theyhave questioned why a two-member Bench hadreopened the issue when the matter was alreadydecided by a Constitution Bench.

Rather than brush away the concerns of thefour judges, the Chief Justice must convene ameeting of the full court and give them a patientand careful hearing. Disapproval of the form oftheir protest must not cloud the substance oftheir grievances. That four senior SupremeCourt judges could have been pushed to takesuch a drastic and unprecedented step suggeststhat the differences were allowed to fester anddivisions allowed to run deep. Also, that theybelieved, rightly or otherwise, that their optionsof settling their differences internally wereexhausted. It is best that there is no more airingof differences in public and that this incident isregarded by posterity as an aberration ratherthan a precedent. About a year ago, the nationwas discomfited that the executive and thejudiciary were publicly, and often very strongly,disagreeing over judicial appointments. Aninternal rift in the judiciary is far more serious.It poses the risk of diminishing the image of thejudiciary and the esteem it enjoys in society.This institution has illumined national life formore than six decades, but a dark shadowhangs over it now. It is a moment for collectiveintrospection.
