TERMS AND CONDITIONS ACCEPTED BY USE OF AIM FACILITIES

Users of the AIM Facility equipment must comply with the Swansea University Research Ethics and Governance May 2017

AIM facilities were established and are supported in part by grant income and in part by the College of Engineering. The open access offered to the facilities should thus be formally acknowledged in all publications, grants and applications, for example using the following text:

"We would like to acknowledge the assistance provided by Swansea University College of Engineering AIM Facility, which was funded in part by the EPSRC (EP/M028267/1), the European Regional Development Fund through the Welsh Government (80708) and the Ser Solar project via Welsh Government."

Publications arising from AIM generated data presented in a thesis are subject to the standard expectation of UK/Worldwide practices of acknowledgements or authorship as per the research ethics and governance pdf referenced above.

When data is included in higher degree theses, full acknowledgement is required in the thesis, and it would assist if AIM is notified when the thesis has been submitted for examination and the degree conferred.

2. Terms for analysis services

In return for AIM agreeing to analyse the sample,

1. the requester ensures that the Sample(s) will be safe for analysis by AIM and further agrees to (i) supply the Sample(s) suitably packaged and clearly labelled with the name and address of the Requester; (ii) fully detailing on the Request Form any health and safety issues that relate to the Sample(s) and (iii) any relevant COSHH/MSDS documentation.

2. the requester recognizes that AIM shall use reasonable endeavours to meet any dates specified in the Equipment Request Form, and bookings that are made on the systems. But given the nature of sensitive and highly specialized equipment any such dates have to be seen as provisional and estimates only. Date and time cannot be held as a guarantee in the completion of the analysis.

The requester is advised to check the AIM scanning work schedule before booking travel and accommodation. 3. the requester recognises AIM accepts no liability or responsibility for any damages, losses, theft or accidents that the requester

may incur to the Sample(s) or otherwise in relation to the scanning of the Sample(s) and related supply of the Data other than to the extent that such liability cannot, as a matter of law, be excluded or limited.

4. the requester is expected to hold the legal right to request the work being commissioned and hereby indemnifies AIM in respect of any claims, damages, costs or expenses AIM may incur (including loss of profits) arising from scanning the sample(s) and/or any reproduction of the Data.

5. the requester recognises any failure by AIM to exercise or enforce any of its rights will not be deemed to be a waiver of such rights nor bar their exercise or enforcement in future.

6. the requester recognises these ‘Terms and Conditions’ shall be governed by the laws of England and Wales and the parties agree to submit the jurisdiction of the English and Welsh courts.

7. the requester recognises these Terms and Conditions apply to the analysis services to the exclusion of any other terms. No variation of these terms or conditions shall be effective unless agreed in writing by both parties.
