GENERAL TERMS & CONDITIONS OF THE TENDER AND CONTRACT(Note: This is to be signed and enclosed with Part -I of the tender while submitting the pre qualification Bid)1 Quotations must be enclosed in a properly sealed envelope ( Part- I ( technical/ pre-

qualifications bid including the general terms & conditions ) & Part- II ( Price bid) areto be sealed in separate envelopes & kept in one envelope ) according to the directionsgiven in the tender notice/Tender form.

2. The rate/unit must not under any circumstances be altered and the rates must be enteredin words as well as in figures. The rates in figures will be final.

3. Tenders should be given by those firm's/dealers who are either registered /approveddealers for these materials or by those who are dealing actually in the job for whichtender is being given.

4. The approved supplier shall be deemed to have carefully examined the conditions,specifications, size, make and drawings etc. of the goods to be supplied. If he shall haveany doubt as to the meaning of any portion of these conditions or of the specifications,drawings etc. he shall before signing the contract refer to the managing Director and getthe clarifications.

5. The contractor shall not assign or sub-let his contract or any substantial part there- of toany other any agency.

6. (a) The Managing Director or his nominee shall have all reasonable time accessto the tenderer premises, and shall have the power at all reasonable time to inspect andexamine the materials and workmanship of the goods.(b)The tenderer shall, invariably, furnish complete address of the premises of his office,godown and workshop where inspection can be made together with full name & addressof the person who is to be contacted for the purpose. In case of those dealers who havenewly entered into business ; letter of introduction from their Bankers will be necessary.

7. In case the goods are not of the approved quality, make or size used for the job aresupplied ,the same will be rejected on supplier cost .The rejected articles must beremoved by the tenderer from the site within a week of the information of the rejection.

8. The tenderer shall be responsible for the proper packing so as to avoid any damage in thenormal condition for the transport by sea,rail,road or air.And delivery of the material ingood condition to the consignee at destination.The supplier, if he so desires,may insurethe valuable goods at his cost against loss by theft,destruction,riots or damage byfire,flood,under exposure to weathers or other tenderers.

(9) No objection or alterations should be made in the tender. No overwriting shouldbe done.

(10) The tenderer should sign the tender form at each page at the end in token of theacceptance of all the terms and conditions of the tender and agreement.

(11) All rates quoted must be F.O.R.JAIPUR DAIRY PLANT,JAIPUR and shouldinclude all taxes and duties.In case of local supplier also, no cartage will be paidby the Milk Union.

(12) Tender form must be accompanied by an earnest money of RS….………(RS inwords…………………….……..) without which tender will not be consideredThe amount should be deposited either in cash or by bank draft in favor ofManaging Director,Jaipur Zila Dugdh Utpadak Sahakari Sangh Ltd.This earnestmoney will be refunded to the unsuccessful tenderer within three months of thefinal acceptance of the tender.

(13) The security will be refunded if otherwise found to be qualifying for refund, within30 days of final settlement of Bill/Payment. No interest will be paid by the JaipurDairy on such security amount. It will, however, be refunded on the expiry ofguaranty /warranty period, where there is a condition of guaranty /warranty.

(14) Remittance charge on movement made to the firm will be born by theContractors.

( 15) If the approved suppliers fails either to work as per the prescribed specificationsor to complete the job within specified period, the Managing Director shall be atliberty to supply/get work done either through retender or otherwise. TheManaging Director may give seven days notice in writing to the approvedsupplier to make good the loss due to his failure, neglect or contravention andshould the contractor fail to comply with the notice within seven days of the dateof service there-of in such cases. If the Managing Director deems fit, it shall belawful for him to retain the balance due to contractor or to apply the amount ofearnest money, deposited by the supplier, to make good the losses sustained orexcess cost incurred by the Dairy in arranging the supplies or completing the jobthrough any other agency. Penal action, for the fault in quality / Deliveryschedule, may also be taken as deemed fit, by the Managing Director.

(16) Direct or indirect canvassing on the part of tenderer or their representative willdisqualify their tenders.

(17) The J.Z.D.U.S.S. Ltd., Jaipur reserves the right to accept any tender notnecessarily the lowest tender and reject any tender without assigning any reasonthere of. Order can be placed for the whole or part of the job to the tenderer at theabsolute discretion of the Dairy plant.

(18) Payment shall be made with in one month from the date of receipt of material,with bill in satisfactory condition at Jaipur Dairy Plant.

(19) All legal proceedings, if necessary arises, to be instituted by any of the parties,dairy plant or Supplier shall have Jaipur jurisdiction.

(20) The material is to be supplied immediately (within 15 days) after receipt ofPurchase Order. In case the supplier fails to deliver the material in time, thesecurity deposit will be forfeited and the tender will be terminated.

(21) All risks / insurance for the safety of our machines , tools ,tackles , labor etc.should be covered by the contractor only . For any loss / damages of ourequipment the contractor shall be solely responsible .

(22) No Railway receipt will be accepted and material will not be received by V.P.P.

(23) J.Z.D.U.S.S.LTD., has the right to split the tender between one/more parties. Alsothe Right to accept or reject any tender in part or full rest with Managing Director,J.Z.D.U.S.S. LTD. JAIPUR.

In case of first purchase order to a newly approved party or

when the design is changed the time will be calculated from the date of

approval of design and art work.

MATERIAL AND MANUFACTURE: - For table butter CFC

The corrugated boxes shall be manufactured in the shape of cubical / rectangular parallelepiped.The blanks shall be properly creased for slotted so that after assembly no holes shall be left at thecorners. The flaps on the boxes shall be capable of being folded at an angle4 of 180 degreealong the line of creasing without fracture of board of facing.TECHNICAL:

1. Lap Joints: The manufacturers joint shall be made by a lap. The width of lap shall notbe less than 30 mm. The joints shall be stapled with 12 staples with six double. TheStaples shall be centrally located along with the lap and may be either straight or at theangle of 45 degree. The staple shall be placed in such a way that they do not fall morethan 50 mm. apart from each other in each row and first and last not farther than 25 mm.from beginning and ended joint respectively. The staples shall be made of mild steel,galvanised24 BGX 13 mm. crown *13 mm. width and shall be of good quality.

2. Flutes: The type of flutes shall be narrow (B) with a height of minimum 2.1 mm.and Maximum 2.9 mm. The number of flutes per 30 cm shall be minimum 52maximum 56.

3 Adhesive: Adhesive used should be starch based on dextrin capable of firmlyadhering the various plies together. Silicates or highly alkaline adhesive will not beused. The adhesive used shall be adequately resistant to moisture and all climateconditions in the country. The minimum quantity of glue shall be 20 gms. On dry wt.basis.

4. Tolerance Limits: a tolerance of ± 2 mm in case of dimension and ± 7% in case ofGrammage of paper is permissible.

5. Bursting Strength: When tested in accordance with standard ISI method ( IS:1060/Part/-I/1966) the average bursting strength of 5 ply 150 GSM triple wallcorrugated fiber board shall be not less than 12 kg. / cm². The average shall bebased on at least five determinations on each face.

6. Compression Strength: When tested by standard ASIM method but conditioned at atemperature of 27 + 2 ° C and 5 pH, the average compression strength of the 5 plytriple walled fiber box (top to bottom ) shall be not less than 400 kg.

7 Water Absorption: The increase in mass of the board after water absorption testwhen tested in accordance with standard ISI method (ISI 4006-part-I/1985) shall benot more than 155 mm. per square meter.

8. Paper Substance: The top and outer surface shall be water proof. The liners shallbe laminated with bitumen or water resistant glue as barrier material. The rest shallbe 150 GSW virgin Kraft paper.

GENERAL TERMS & CONDITIONS OF THE TENDER AND CONTRACT

(Note: This is to be signed and enclosed with Part -I of the tender while submitting the prequalification Bid)(Quotations must be enclosed in a properly sealed envelope according to the directionsgiven in the tender notice/Tender form)

(1) Bids in two parts are required to be submitted. Bids in two parts will comprise TechnicalBid (Part-I) and Price Bid (Part-II). Part-I and Part-II should be placed in separateenvelops duly sealed. The EMD should be enclosed in the envelope containing TechnicalBid (Part-I).

(2) The rate/unit must not under any circumstances be altered and the rates must be enteredin words as well as in figures. The rates in figures will be final. The rates / unit should bequoted for a contract period of one year from the date of finalization of tender. Thecontract period can be extended for one more year or more if mutually agreed to.

(3) Tenders should be given by those firm's/dealers who are either registered /approveddealers for these materials or by those who are dealing actually in the job for whichtender is being given.

(4)The approved supplier shall be deemed to have carefully examined the conditions,specifications, size, make and drawings etc. of the goods to be supplied. If he shall haveany doubt as to the meaning of any portion of these conditions or of the specifications,drawings etc. he shall before signing the contract refer to the Managing Director and getthe clarifications.

(5) The contractor shall not assign or sub-let his contract or any substantial part there- ofto any other any agency.

(6) (a) The Managing Director or his nominee shall have all reasonable time accessto the tenderer premises, and shall have the power at all reasonable time to inspect andexamine the materials and workmanship of the goods.(b)The tenderer shall, invariably, furnish complete address of the premises of his office,

godown and workshop where inspection can be made together with full name & addressof the person who is to be contacted for the purpose. In case of those dealers who havenewly entered into business ; letter of introduction from their Bankers will be necessary.

(7) In case the goods are not of the approved quality, make or size used for the job aresupplied ,the same will be rejected on supplier cost .The rejected articles must beremoved by the tenderer from the site within a week of the information of the rejection.

(8) The tenderer shall be responsible for the proper packing so as to avoid any damage in thenormal condition for the transport by sea, rail, road or air. And delivery of the material ingood condition to the consignee at destination. The supplier, if he so desires, may insurethe valuable goods at his cost against loss by theft, destruction, riots or damage by fire,flood, under exposure to weathers or other tenderers.


(9) No objection or alterations should be made in the tender. No overwritingshould be done.

(10) The tenderer should sign the tender form at each page at the end in token ofthe acceptance of all the terms and conditions of the tender and agreement.

(11) All rates quoted must be F.O.R.JAIPUR DAIRY PLANT,JAIPUR andshould include all taxes and duties.In case of local supplier also, no cartagewill be paid by the Milk Union. Unloading etc. also will have to be done bythe supplier.

11.1. The rates will be inclusive of Erection / commissioning /InstallationCharges.

11.2 The software /Program if any, of the Unit, will have to be provided bythe supplier free of cost.

Whereas in the case ofsuccessful tenderer it shall become the part of security of five percent (5 %) of thetotal amount of the material to be supplied.

(13) Remittance charge on movement made to the firm will be born by the Contractors.(14) If the approved suppliers fails either to work / supply as per the prescribed

specifications or to complete the job within specified period, the Managing

Director shall be at liberty to supply/get work done either through retender orotherwise. The Managing Director may give seven days notice in writing to theapproved supplier to make good the loss due to his failure, neglect orcontravention and should the contractor fail to comply with the notice withinseven days of the date of service there-of in such cases. If the Managing Directordeems fit, it shall be lawful for him to retain the balance due to contractor or toapply the amount of earnest money/ security money , deposited by the supplier, tomake good the losses sustained or excess cost incurred by the Dairy in arrangingthe supplies or completing the job through any other agency. Penal action, for thefault in quality / Delivery schedule, may also be taken as deemed fit, by theManaging Director.


(16) The J.Z.D.U.S.S. Ltd., Jaipur reserves the right to accept any tender notnecessarily the lowest tender and reject any tender without assigning anyreason there of. Order can be placed for the whole or part of the job to the

tenderer.


(17) 90 % Payment shall be made with in one month from the date of receipt ofmaterial ,with bill, in satisfactory condition at Jaipur Dairy Plant.Balance 10 % will be made after completion of the warranty period of one Year.However , the balance 10 % can also be released , if so desired by the supplier,provided the supplier furnishes a Bank Guarantee from a scheduled orNationalised Bank for the 10 % value valid for a period of 12 calender monthsfrom the date of issue in the prescribed Proforma.


(19) If the goods are not supplied with in the period as specified in the purchaseorder ,then the penalty will be imposed as under :-


(20) The time of completion of all jobs (Supply & Installation) as per schedule P.O.

(21) The equipment must carry a warranty of for a minimum period of one yearfrom the date of supply of the equipment or satisfactory performance of thesupplied equipment according to the specification , rated capacity, etc.


(23) Deductions for ESI/P.F. will be made as per prevailing rules.

(24) No Railway receipt will be accepted and material will not be received by V.P.P.
