TERMS AND CONDITIONS FOR THE AWARD OF CONTRACT FOR TENDER FOR

PURCHASE OF WHITE COLOUR BRAND NEW TOYOTA INNOVA CRYSTA 2016

DIESEL TOP MODEL 7 SEATER VEHICLE

2. INSTRUCTIONS FOR TENDERING

1. Name of Work :

TENDER FOR PURCHASE OF WHITE COLOUR BRAND NEW TOYOTA

INNOVA CRYSTA 2016 DIESEL TOP MODEL 7 SEATER VEHICLE.

2. Tender Cost : Cost of tender is Rs. 5000/- (Five thousand only) (non

refundable).

3. Earnest Money Deposit (EMD) : The Tenderers submitted in response of

Tender shall be accompanied by a Interest free bid security Rs.40,000/- (Rs.

forty thousand only) in the from of a demand draft from a

Nationalised/Scheduled Bank in India drawn in favour of “Atal Indore City

Transport Services Ltd”. And payable at Indore and shall be encashable at any

branch of the bank at Indore. Tenders received without EMD will not be

entertained/considered.

4. Forfeiture of EMD : The tenderer will not be allowed to withdraw the tender

after the same is received in the AICTSL. In case the tenderer withdraws from

the process the EMD deposited by him will be forfeited.

5. Refund of EMD : EMD will be refunded to the unsuccessful tenderer within

thirty days from the date of issue of work order to the successful tenderer. No

interest shall be payable on EMD.

6. Performance Guarantee : The Earnest Money Deposit of successful bidder

shall be retained as interest free performance guarantee during one (1) year.

This will be treated as performance guarantee.

7. Taxes: “Taxes and Duties means all taxes (including road, tax, property taxes)

duties, fees etc. payable under the applicable laws in connection with the

services/project. For removal of doubts, it is hereby clarify that for the purpose

of this clause “all dues regarding taxes” includes all taxes levied or to be levied

by the Central Government, State Government, Local bodies any other

Government agency or private individuals and such taxes will be payable by the

agency/bidder except service tax. The list given in the clause is an illustrative list

and not the exhaustive list which also includes vat tax works contracts tax etc.

8. The bid document shall not be opened if no earnest money deposit and tender

cost in time of submission.

3. TENDER PROCESS

1. TECHNICAL BID WITH BID SECURITY :

Eligibility Criteria - Technical Stage :

A bidder shall be required to fulfill the following eligibility criteria :

1. Latest income tax clearance certificate and PAN is also required to be submitted

by the operator.

2. Earnest Money Deposit (EMD).

3. Bidder shall be submitted authorize dealer certificate.

2. SEALING AND MARKING OF BIDS :

Envelope (A) :

in a separate envelope duly marked as EMD

(b) The original of the Technical Bid.

(c) Original RFP document/MoM/any other correspondence, certificates and

samples duly signed by authorized signatory

(d) A bidder shall be required to fulfill all eligibility criteria document.

(a) The original of the Financial Bids shall be sealed separately.

(b) Both the envelopes viz. ‘A’ and ‘B’ along with the original bid documents

issued by AICTSL along with updated addendums/amendments thereto, duly

signed by the Bidder through its authorized signatory on all pages shall then be

sealed in one outer envelope.

i. The inner and outer envelopes shall be addressed to The Managing Director Atal

Indore City Transport Services Limited Indore, and marked as below:

“TENDER FOR PURCHASE OF WHITE COLOUR BRAND NEW TOYOTA INNOVA

CRYSTA 2016 TOP DIESEL TOP MODEL 7 SEATER VEHICLE”

ii. The outer as well as inner envelopes shall indicate the name and address of the

Bidder to enable the Bid to be returned unopened in case it is received late.

iii. If the outer envelope is not sealed and marked as above, AICTSL will assume

no responsibility for the misplacement or premature opening of the Bid.

5. GENERAL CONDITIONS OF CONTRACT

1. Participating in the tender bidder should be the main or branch office in the city

of Indore.

2. The vehicle should be in very good condition with clean interior. In case

condition of the vehicles is not found satisfactory, they shall be returned for

immediate replacement.

3. The Chief Executive Officer, Atal Indore City Transport Services Limited,

Indore reserves the right to accept or reject any or all Tenders without assigning

any reasons there for. Any attempt of negotiation on the part of bidder to

influence by any means will render the tender liable for exclusion from

consideration.

4. The bidder should quote the rates both in figures and words without cuttings and

over writing and the rate should be inclusive of all taxes. No fluctuation in the

rates is permitted during the currency of the tender.

5. In case of supply order for the material the date of delivery should be strictly

adhered to otherwise the supply order is liable to be cancelled.

6. The payments will be made according to requirement after receiving of the

vehicle in good condition.

7. The acceptance of the tender will be decided by the Chief Executive Officer,

AICTSL who does not bind himself to accept to lowest quotation and reserves

the right to himself to reject or partially accept any or all the quotations received

without assigning any reason.

8. The disputes, if any, arising out of this contract will be subject to the

jurisdictions of the courts in Indore, Madhya Pradesh only.

9. In case of dispute of any kind, the decision of AICTSL shall be final and

binding.

10. Submission of Tenders :- The wax sealed tender superscripted as ‘‘TENDER

FOR PURCHASE OF WHITE COLOUR BRAND NEW TOYOTA INNOVA

CRYSTA 2016 TOP DIESEL TOP MODEL 7 SEATER VEHICLE’’ should be

addressed to Managing Director, Atal Indore City Transport Services Limited,

Please note that the envelope cover which is not wax sealed will not be

considered even if they fulfil all the other terms and conditions.

11. The last date of receipt of technical bid and earnest money is 17.11.2016 at 1500

hrs. and the bid will be opened on same day at 1600 hrs. in the presence of the

bidder or their representatives as may wish to be present.

12. The tenders of only those firms who satisfy all the requirements/conditions

stipulated in this document will be considered. Rates with any cutting or

overwriting in the figures will not be considered.

13. The competent authority reserves the right to reject any tender at any time

without assigning any reason whatsoever.

14. No advance payment will be made by the AICTSL.
