of 161. Eligibility Criteria for bidding

The eligibility criteria for qualifying to participate in TENDER shall be as below: -

1. The company or its partner or person should have an experience of installation or maintenance of minimum 50 BB connections.

2. The person/ Partner/Company/person should own a office at any place at Bhopal. 3. Vendor having experience of providing / maintaining LAN / WAN consisting of

Network elements including minimum 50 No. of PCs.4. The person/ Partner/Company should at least four supporting staff and help desk

support office at any place at Bhopal. (should provide a self certified by Company/partner/person)

2. Terms and Conditions for bidding i. Conditional TENDER will not be accepted.ii. MPWLC is empowered to reject any TENDER without assigning any reason.

iii. If the last day for submission of TENDER or the day of opening of TENDER is declared as holiday, the date will be shifted to the next working day.

iv. Validity of approved rates will be two years from the date of agreement.v. During the entire process if it is observed that the downloaded document is not

exactly as per the original document and/or it is tampered / changed / altered / modified in any way, the TENDER will be rejected.

vi. Tender Should be sent only by Speed Post/Registered Post or submitted directly at MPWLC, Bhopal (Head Office Bhopal) before due date of submission.

3. INSTRUCTIONS FOR BIDDER'S

i. Note down all-important dates mentioned in Tender documents.ii. Fill up the form neatly, Avoid over writing.

iii. All necessary documents being enclosed with Tender should be duly attested (self)iv. Check all points. Verify the documents attached.v. All pages of TENDER including check list must be signed with seal by authorized

signatory/person. vi. Put TENDER along with documents (self attested) in envelop. Mark envelop at top left

side “TENDER for Broadband Provisioning at MPWLC, HO Bhopal Bhopal”vii. Put price bid in a separate envelop and E.M. in separate envelop with technical bid

viii. Seal the envelop with tape or WAX properly from all sides. Envelopes, not properly sealed, will be rejected.

CONTRACT CONDITIONS / Clause of Agreement

1. DEFINITIONS

i. “MPWLC” means the M.D. MP Warehousing Corporationii. “The Bidder” means the individual or firm/Agency/SBO/Company/Maintenance Agency

partner that participates in the tender and submits its bid.for --------------------providing Services under contract

2. Submission of Tender a. The 1 st sealed envelope (E.M. + Technical Bid)

a. Eligibility documents included checklist.b. The issued original bid document signed on each page by the authorized signatory

of the bidder including Annexures duly filled. c. Details of the services proposed like technical specification of broadband as

desired in the scope of work.d. Details of the help desk support and maintenance and installation.e. Experience Certificate of similar kind of works done. f. PAN CARD (Photo copy)

b. The 2nd sealed envelopeDuly marked as “Price Bid”, should contain “Bid Form and Price Schedule”, provided in Annexure duly filled and signed by the authorized signatory/person of the bidder. Price bid will be opened only for those who qualify the eligibility criteria in Technical bid.

3. BID PRICES

a. The bidder shall give the total composite price. The offer shall be firm in Indian Rupees ( ). No Foreign exchange will be made available.

b. I.T. and C.T. etc shall be deducted from the bill by MPWLC as per rules. c. S.D.shall be deducted from each bill @ 5% which will be refunded after

maintenance period.d. The price quoted by the bidder shall remain fixed during the entire period of

contract and shall not be subject to variation on any account. e. A bid submitted with an adjustable basic price quotation will be treated as non –

responsive and rejected.f. Any extension after the specified period would be based on mutually agreed

terms and conditions.

SCOPE OF THE WORK AND CONTRACT

1. Scope and condition of the Work

a. The bidder shall provide 10 Mbps broadband Connectivity for the period of two years for H.O. MPWLC , Bhopal

b. The bidder shall perform the installation and configuration of the network related equipment required for the broadband connectivity. (the related basic infrastructure like civil, space, power, etc. would be provided by MPWLC)

c. The bidder would provide static IP for the configuration shall be provided by the bidder.d. Provision of DVR port and configuration.e. Architect the LAN connectivity at the MPWLC office (single location multiple clients), local

LAN wires and components would be provided by MPWLC).f. VPN configuration at MPWLC, Bhopal.g. Router configuration as desired and agreed with MPWLC.h. Website filter configurations as desired at MPWLC.i. Help desk (telephonic) support on all the departments at all the time.j. Reported issues should be rectified within (12 working hours.), assume 8 hour working a

day. For example if an issue is reported at 11 AM, it should be rectified by 3:00 PM next day.

k. If the issue is not rectified within 12 working hour the penalty would be imposed as mentioned in the contract.

l. At least two support or helpdesk numbers (of two separate support persons/locations) should be provided to MPWLC.

m. The firm/partner/company would provide an online portal /website to report the issue online.

n. Issue resolution life cycle should be maintained by the bidder.

5. NON PARTICIPATION OF NEAR RELATIVES OF MPWLC EMPLOYEES IN THE TENDER

The Bidder should give a certificate that none of his/her near relative is working (either directly recruited or on deputation in MPWLC (units) where he is going to apply for the tender. In case of proprietorship firm, certificate will be given by the proprietor. The near relatives for this purpose are defined as:The one is related to the other in the manner as father, mother, son(s) &Son’s wife (daughter in law), Daughter(s) and daughter’s and daughter’s Husband (son in law), brother(s) and brother’s wife, sister(s) and sister’s Husband (brother in law).

6. OPENING & OVERALL EVALUATION OF BIDS 6.1 The bids will be opened in the presence of bidders or their authorized

representatives who chose to attend, on schedule due date and time. The bidders’ representatives, who are present, shall sign in an attendance register. The bidders shall submit authority letter to this effect before they are allowed to participate in bid opening (Format given in Annexure).

6.2 Venue of Bid opening shall be HO, MPWLC, Office complex block A Gautam Nagar Bhopal.

6.3 One representative of any bidder shall be authorized and permitted to attend the bid opening.

6.4 Bids those are complied to the basic eligibility criteria would be considered for the next evaluation.

6.5 The technically Eligible bids/company representative would be asked to present and discuss-

6.5.1 Provided solution and their capabilities/ experience in the past.6.5.2 Support and maintenance provisions, help desk support staff and maintenance

persons availability.6.5.3 How to maintain the Service levels at the desired levels.6.5.4. How the solution and the capabilities are made available, high scalable and

secured.6.5.5 Best configuration parameters in relevance to MPWLC6.5.6 A technical score would be allotted for the capabilities. (on a mark of 100)6.6 The eligible company/person/partners those scores above 80 in the this phase

would be considered as responsive and shall asked to come for price bid opening.6.7 The L1 would be considered based on Quality & Cost Based Selection (QCBS)

method as 70% cost (as price bid) and 30% quality (score of the presentation and discussion) capabilities.

6.8 On the day of bid opening and the price bids of the “eligible bidders (whose bids are substantially responsive) only” shall be opened afterwards under intimation to the eligible bidders.

6.9 MPWLC shall evaluate the Eligibility Bids to determine whether they are complete and whether the documents have been properly signed and whether the bids are generally in order.

6.10 Prior to the detailed evaluation pursuant to clause, MPWLC will determine the substantial responsiveness of each bid to the Bid Document. For purposes of these clauses, a substantially responsive bid is one which conforms to all the terms and conditions of the Bid Documents without material deviations.


of 167.8. The MPWLC is free to award the contract to any of the bidders it find suitable for

their requirement without assigning any reason whatsoever and without thereby incurring any liability to the affected bidder or bidders on the grounds of MPWLC’s action.

9. In case of single bid MPWLC is free to award the contract to the bidder orre-tender or cancel the bid.

10. MPWLC’s RIGHT TO ACCEPT ANY BID AND TO REJECT ANY OR ALL BIDS

The MPWLC reserves the right to accept or reject any bid, and to annul the bidding process and reject all bids, at any time prior to award of contract without assigning any reason whatsoever and without thereby incurring any liability to the affected bidder or bidders on the grounds of MPWLC’s action.

11. ANNULMENT OF AWARD

MPWLC reserves the right to disqualify the contractor for a suitable period who habitually failed to complete the awarded work in time.

12. CONTRACT AND TERMINATIONValidity of the approved rates under the contract shall be up to two years from the date of agreement and can be extended for another period in multiple year/s on the mutually agreed terms and conditions at the discretion of MPWLC and subject to satisfactory performance of the contractor. However, MPWLC reserves the right to terminate the contract after giving a notice of one month in advance without assigning any reason.

13. Penalty Clause:

Penalty will be imposed for non-attendance of Broadband faults within stipulated time provided that, the problem does not pertain to MPWLC or Network etc.

The details of penalty for urban area is given as below:13.10 Bidder should rectify the faults within on and half working day (i.e 12 working

hours). The penalty for next day shall be Rs 50/- & thereafter it would be Rs 100/- per day.

13.20 Penalty has to be deposited though cheque (as directed by the department then) 13.30 The bidder shall arrange to install and commission modem/splitter/software and

other associated provisioning related work to new broadband connection (on existing/new line).

13.40 The Overall services should not be <90% uptime (on monthly basis). 14. PAYMENT TERMS14.10 Based on one year contract as mentioned in the price bid, MPWLC would provide

monthly payment on the bills produced by the bidder. 14.20 In case at any point if MPWLC finds that services are not satisfactory, MPWLC

may cancel the order with one months notice.


of 1614.30 The bidder shall be fully responsible for the employment or payment of wages to

its employees.15. Duration of Agreement This agreement shall be valid for a period of Two year from the date of signing. 16. Extension of Agreement

MPWLC may extend, if deemed expedient, the period of agreement for a defined period/ years, suo moto or in mutual agreement with the bidder on mutually agreed technical and commercial terms. The decision of MPWLC shall be final in this regard.

17. Modifications in the Terms and Conditions of Agreement

The contract shall be governed by the terms & conditions of this document.

18. Termination of agreement

MPWLC reserves the right to suspend the operation of this agreement, at any time, due to change in its own license conditions or upon directions from the competent government authorities. In such a situation, MPWLC shall not be responsible for any damage or loss caused or arisen out of aforesaid action. MPWLC could terminate the services in case of non-satisfactory services and support by the bidder. In case of termination due to non-satisfactory services or support (with the supported documents), MPWLC would give one month notice and the bidder has to return the remaining support payment within one month.

19. Force- Majeure

If at any time, during the continuance of this agreement, the performance in whole or in part, by either party, of any obligation under this is prevented or delayed, by reason of war, or hostility, acts of the public enemy, civic commotion, sabotage, Act of State or direction from Statutory Authority, explosion, epidemic, quarantine restriction, strikes and lockouts (as are not limited to the establishments and facilities of the Maintenance Agency), fire, floods, natural calamities or any act of God (hereinafter referred to as event), provided notice of happenings of any such event is given by the affected party to the other, within 21 Calendar days from the date of occurrence thereof, neither party shall, by reason of such event, be entitled to terminate the agreement, nor shall either party have any such claims for damages against the other, in respect of such non-performance or delay in performance. Provided Service under the agreement shall be resumed as soon as practicable, after such event comes to an end or ceases to exist. The decision of MPWLC as to whether the service may be so resumed (and the time frame within which the service may be resumed) or not, shall be final and conclusive. However, the Force-majeure events noted above will not in any way cause extension in the period of the agreement.

20. JURISDICTIONFor the settlement of any disputes arising out of this tender/ contract, first MPWLC and the bidder would try to resolve/negotiate with mutual consensus

and agreement, in case it is not happens, then it can be put in the courts at Bhopal / Jabalpur jurisdiction only.

21. Confidentiality of informationThe bidder Maintenance Agency shall take necessary steps to ensure that the Maintenance Agency himself / herself and any person(s) acting on its behalf observe confidentiality of customer information.

22. Security Deposit:-The security deposit deducted @ 5% from each bill shall be refunded after completion of 2 years maintenance period is over without interest to bidder. The E.M. deposited by bidder shall be adjusted in S.D. through running bills.
