Legal guidance for the set-up of global multi-modal communications and collaborations solutions

Multinational enterprise customers are starting to adopt new technologies to provide their increasingly mobile workforce communication and collaboration capabilities that allows them to perform their work at any place using multi-modal communications (Instant Messaging, Presence, Voice, Video, Desktop Sharing, Conferencing…).

For enterprise customers that have already invested in the Microsoft product portfolio, the implementation of Microsoft’s Universal Communications platform based on Microsoft Lync/ Skype for Business is a natural fit.

Given the fact that Microsoft’s Lync/Skype for Business platform is architected as a data center based solution, the setup of a single globally unique real-time multi-modal communications and collaborations solution becomes possible. For the first time, enterprises can implement and operate a homogeneous system solution that will be used at any given site of the enterprise for all communication modalities including telephony.

In particular the setup of such a global multi-modal communications and collaborations solution in a legally compliant fashion on a per country basis will challenge the enterprise to find solutions to address the following questions:

Silvia C. Bauer was born in 1968. After vocational training as Business

Administration Manager, she spent three years at Hoechst AG in

Frankfurt as a Country Consultant. In addition to working, she studied

Economic Sciences at the University of Applied Sciences in Mainz. She

received her degree in law at the University of Frankfurt. She joined

Luther (or its respective predecessor) in 2000.

Focus of advice

Silvia C. Bauer specializes in assistance pertaining to data privacy. She

conducts data privacy audits and advises companies in the organization

of their data protection. She also provides as-sistance in evaluating

the reliability of planned data processing, the introduction of whistle-

blowing hotlines, the creation of contracts for processing customer data

and leaflets on data protection and data privacy policies. Silvia C. Bauer

is Data Security Officer at Luther and is a guest lecturer at numerous

events related to data protection and IT law.

Dr. Detlef Mäder was born in 1969. He studied law in Freiburg from 1989

to 1994 and completed his first bar examination in 1994. He worked

as a research assistant at the Max Planck Institute in Foreign and

International Criminal Law in Freiburg and at the University of Cologne

from 1994 to 1996. During this time, he completed his dissertation and

has been awarded with a doctor’s degree (Dr. jur). from the University

of Freiburg in 1996. He was admitted to the bar in 1998 and has been a

member of Luther and its predecessor law firms since 1996 and directs

the Cologne office.

Focus of advice

Dr. Detlef Mäder specializes in competition and trademark law as well

as in the other related areas of intellectual property rights (i.e. design

rights, rights against product piracy) and telecommunications law.

Dr Detlef Mäder has comprehensive litigation experience throughout

Germany in patent, trademark, unfair competition and copyright

disputes. Dr Detlef Mäder also advises his clients on contractual

Jens Bernhard was born in 1977. He studied law in Frankfurt from 2000

to 2005. At the beginning of 2006 he started his legal clerkship at the

Regional Court of Frankfurt with stations at the chamber for IP law as

well as a large international law firm in the IT/IP department. He was

admitted to the bar in 2008 and joined Luther the same year.

Simone Bach was born in 1986. She studied law at the University of

Trier (Germany) from 2005 to 2010. At the same time, she also carried

out a foreign language training course in Anglo-American law. After

completing these studies, she went on to obtain an LL.M. in London

(England). During her legal training she worked for a large commercial

law firm in the IP litigation de-partment in Hamburg (Germany) and

Los Angeles (USA) and at the same time also worked as a tutor for the

University of Hamburg. Simone Bach has worked for Luther since 2014.
